Tender for running “Kitchen, Catering and Hospitality Services” for AICTE Guest

House & Canteen of AICTE at its Headquarters, Nelson Mandela Marg, Vasant Kunj, New

Delhi.

1. Introduction:

All India Council For Technical Education having its Headquarters at Nelson Mandela Marg,

New Delhi having area of 5 Acres of land with provision of Canteen for nearly 300 Officials,

Guests/experts of AICTE. Apart from this, AICTE is also having a Guest house in its office

premises consisting of 16 rooms and 4 suites. AICTE is looking for an experienced Agency to

provide “Kitchen, Catering & Hospitality Services” for its Guest House & Canteen situated

at its Headquarters New Delhi. The jobs include supply of tea, coffee, lunch and snacks etc.

to AICTE employees, experts and visitors including Kitchen, Catering & Hospitality Services

(Breakfast, Lunch & Dinner) etc. to its Guests staying in the Guest House. The Agency

should be capable to handle the events/workshop catering programme (Breakfast, Buffet

Lunch & Dinner) of 400 approx. participants.

2. Definition

In this Contract, the following terms shall be interpreted as indicated below:

2.1 “Service Provider” shall mean the successful bidder to whom the contract has been

awarded and with whom the Tendering Authority signs the contract for rendering of goods

and services.

2.2 “Contract” means the agreement entered into between the Tendering Authority and the

Service Provider, as recorded in the document signed by the parties, including all the

attachments and appendices thereto, and all documents incorporated by reference

therein;

2.3 "Bidder” means any firm taking the full responsibility of managing the contract as

required in the tender. The word “Bidder” when used in the pre award period shall be

synonymous with “Service Provider” which shall be used after award of the contract.

2.4 “Contract Price” means the price payable/receivable to / by the Successful Bidder under

the Contract for the full and proper performance of its contractual obligations;

2.5 “Goods” means all the material/ services, which the Service Provider is required to

supply/provide to the Tendering Authority under the Contract;

2.6 “Services” means services ancillary in the Operation & Maintenance Services to Canteen

and Guest House at Nelson Mandela Marg, Vasant Kunj, New Delhi.

2.7 “AICTE” or “Council” means “All India Council for Technical Education”

2.8 “Bank Guarantee” means the guarantee to be provided by the Bidders as given in the

tender document of the specified amount.

4. Eligibility Criteria for Technical Bid.

a. The Bidder should have last 3 years’ experience in the field of Kitchen, Catering & Hospitality services to the Government Department/Banks, Institutions & other organizations having minimum capacity of 400 staffs.

b. The Bidder should have valid GST certificate (along-with VAT/D-VAT & service tax registration for old years) from concerned Government Authority.

c. The Bidder should have valid FSSAI License

d. The Bidder has to submit the copy of return filed of VAT/D-VAT/GST/Service Tax for

the last One year (four quarters).

e. The Bidder should have audited Balance Sheet for the last three financial years, 2014-15, 2015-16, 2016-17

f. The Bidder should have PAN No., GST No., EPF Reg.No., ESI Reg.No., FSSAI

certificate and should submit legible attested copies of these documents with Technical Bid.

g. The Annual Turnover of the Kitchen/Catering Agencies must be minimum

Rs. One Crore per year during last three financial years. Copies of work orders to be attached.

Role of AICTE in Canteen & Guest House.

i. The vendor has to maintain the quality of the food items as per prescribed standards of FSSAI and other Govt. agencies working in the filled of Foods / Hospitality i.e. ITDC and IRCTC, failing which the Tender will be terminated without any notice with immediate effect.

ii. AICTE will charge for Electricity Bill from the Vendor at canteen and the guest

house on basis of sub meter installed in the premises for the purpose, however

water will be provided free of cost.

iii. In case of any kind of damage to the building / equipment / furniture etc. , the

charges will be recovered from the Vendor as per the estimate decided by C.A.

iv. AICTE will not charges on Account of Rent/License fees/Maintenance charges for

the space provided to the vendor for the running of Kitchen at AICTE HQ.

v. The financial bid will contain the provision of all the type of food items required for day to day functioning, events, National programme, International programme & Special menu etc. (05 Nos. Financial/Price bid)

vi. The Vendor will make the Hospitality arrangement for the events to be organized

by AICTE or any other Govt. body in the AICTE premises. The rate will be charged

by the Vendor as fixed by AICTE on the basis of approved rates in awarded letter.

The menu will be selected/decided and finalized by the organizer / concerned

bureau of the event.

vii. The pre bid meeting will be called by AICTE on 16th July 2018 at 14.30 hours at

AICTE – HQ, New Delhi.

viii. Technical bid will be opened on 25th July 2018 at 15.30 hours.

ix. No payment will be made by AICTE for the manpower deployed by vendor for hospitality arrangement required in the regular functioning/during events. All the cost of Manpower will be borne by Vendor.

x. AICTE will not bear any cost for the of manpower/staff deployment by the Vendor.

The vendor will be responsible to provide satisfactory services as per requirement

of AICTE by providing sufficient manpower/staff and their cost will be borne by

the Vendor only.

xi. AICTE will provide the Housekeeping Service only in the Dining Area.

xii. The Kitchen / Cooking area and store area shall be maintained in neat and clean

by the Vendor at own level. The vendor has to maintain hygienic condition in the

Kitchen Area by taking all the precautions.

xiii. The store room, kitchen & other storage area where raw material is to be store by

the Vendor in the whole premises of the Canteen and Guest House shall be liable

for surprise inspection by Authorized Officer(s) of AICTE to check the quality of the

raw material and food items used and provided by Vendor. The contractor shall

have to abide by the instructions issued by the Authorize Officer of AICTE from

time to time. (according to rules and norms of AICTE and Govt. of India)

xiv. The AICTE will provide the Kitchen equipment’s presently available at both the

location i.e. AICTE HQ & Guest House. Besides above no other equipment will be

provided. The vendor will arrange rest of the equipment at their own level if

required by vendor. The Vendor will hand over the equipment’s in working

conditions at the time of closure of contract before releasing Performance

Guarantee (P.G. money).

4. Preparation and Submission of Tender:

(i) Tender shall be submitted in standard tender form only which is provided by AICTE;

failing which same shall be summarily rejected.

(ii) The tender should be submitted in two parts viz. Technical Bid and Financial Bid

in the prescribed proforma of AICTE in the two separate envelopes.

Each cover must contain the address of the Bidder, and should be superscripted

with the statement “Technical Bid for running Kitchen, Catering & Hospitality

Services at All India Council for Technical Education (AICTE), HQ & Guest

House, New Delhi and “Financial Bid for running Kitchen, Catering &

Hospitality Services at All India Council for Technical Education (AICTE), HQ

& Guest House, New Delhi as the case may be. These two covers should then be

kept in another sealed cover addressed to: Advisor (Admin) All India Council for

Technical Education (AICTE), HQ Nelson Mandela Marg, Vasant Kunj New

Delhi.

(iii) The pre bid meeting will be held on 16th July-2018 at 14.30 Hours at AICTE

HQ. The interested firm can participate in the above meeting as per schedule and

venue given above.

(iv) The Technical & Financial bid will be submitted/uploaded on or before 24th July 2018 at 15.00 Hours The Technical bid will be opened 25.06.2018 at 15.30 Hours in the presence of Bidders present at that time, if any. The Financial bid will be opened after evaluation of the technical bids and only such Bidders, whose bids qualify in technical evaluation, shall be called for opening of

their Financial Bids. (v) Tender document with any correction, using white fluid amendments, overwriting

etc. shall be considered invalid and shall be rejected, except if duly initialed with seal of the Bidder.

(vi) The tender is liable to be ignored if complete information is not given therein, or if the particulars and data (if any) asked for in the schedule to the tender are not filled in.

5. Earnest Money Deposit (EMD):

Earnest Money Deposit (EMD) of Rs 2.50 lakhs and Rs. 1500/- toward Tender Cost along with the tenders shall be paid by Demand Draft in favor of Member Secretary, AICTE, New Delhi payable at New Delhi. EMD will not carry any interest. The validity of EMD shall be 180 days from date of opening of Tender.

(i) The EMD paid by the bidder will be forfeited if:

The bidder withdraws his tender before processing of the same.

The bidder withdraws his tender after processing but before acceptance of “Letter of Intent” issued by Council.

The selected bidder withdraws his tender before furnishing an unconditional and irrevocable Performance Bank Guarantee.

The bidder violates any of the provisions of the terms and conditions of this tender specification.

(ii) The EMD will be refunded to the successful bidder within three months after the award of contract subject to furnishing of an unconditional and irrevocable. The successful tender has to deposit Performance Guarantee in the form of Bank Guarantee / through pay order of 10% value of the contract value i.e. Rs. 5 lakhs in favour of Member Secretary, AICTE payable at New Delhi.

(iii) The EMD will be returned to the unsuccessful bidders after receiving the Bank Guarantee from the selected bidder.

6. Technical Bid :

(i) The Technical bid, having details of the Contractor along with the EMD, Tender Cost

etc. should be submitted in the prescribed form (Page Nos.-17-18)

(ii) Copies of the following certificates will be enclosed with the Technical bid, otherwise the tender would be summarily rejected:

(a) Registration Certificate (In case of a Registered Firm)

(b) Copy of trade license issued by concerned local Food and Health/concerned department

(c) Copy of license certificate issued by FSSAI

(d) Copy of GST Registration Certificate;

(e) Copy of PAN Card;

(f) Copy of PF and ESI registration certificates;

(g) Copies of Income Tax Return filed for the last three financial years/ copies of accounts statement issued by CA mentioning details of turnover;

(h) Proof of running a cafeteria / canteen (Copies of at least one work order received from Govt. depts. / PSUs/ Universities/Institute’s during each of the last three years should be enclosed).

(iii) The Contractor should also submit an undertaking as given in Annexure-I with the Technical bid.

7. Financial Bid:

(i) The Financial Bid should be submitted in the prescribed format given at

Page Nos. 19 to 23.

(ii) The consolidated price quoted shall be firm & final and inclusive of all taxes, duties, GST etc. as applicable. No extra amount shall be payable on this account.

(iii) The rates will be valid for a period of one year, computed from the date of award of contract.

(iv) Rates should be written in figure and words clearly for each item.

8. Validity:

The bids shall be valid for a period of 4 (four) months from the date of opening of the tender. AICTE may request for further extension for another period of 60 days, without any modifications and without giving any reasons thereof.

9. Criterion for Evaluation of Tenders:

(i) The evaluation of the tenders will be made first on the basis of technical information furnished in the prescribed forms, which is an eliminatory round, and then on the basis of commercial information furnished in the prescribed forms. Any inferences drawn by the Bidders or their representatives during the opening of the technical bid will be their own view and AICTE will not be responsible/required to abide by the same.

(ii) It shall be noted that required documents submitted along with the technical bid

will be perused/examined and in case of any deficiency, the bid will be rejected.

(iii) The initial criteria prescribed above, in respect of years of operation in the business, experience of similar class of work completed and financial turnover will first be scrutinized and the applicant’s eligibility for the work will be determined.

(iv) AICTE shall obtain feedback from the previous/present clients of the Bidder and also depute its evaluation committee to inspect the site(s) at present contract(s) for on-the-spot firsthand information regarding the quality of food and services provided by the Bidder, which will form the basis for evaluation of technical bids, other than requirements listed in the point no.06 above. The decision of the AICTE in this regard will be final and binding on all Bidders.

(v) As a part of the process to evaluate the technical bids, AICTE may invite the bidders

to make a presentation before Tender Evaluation Committee.

(vi) At the time of opening of financial bids, the price of each bidder shall be read out on the spot. However, it shall be clearly stated that the final financial bid prices would be arrived at after detailed scrutiny/correction of arithmetical errors in the financial bid, if any.

(vii) The bidder is required to quote prices for all the items listed in financial bid

proforma. The sum total of rates shall be considered to ascertain L1 Bidder.

(viii) Merely becoming the lowest bidder, prior to financial bid scrutiny will not give any right to the lowest bidder to claim that he is successful in the bidding process. The successful bidder (L-1) shall be decided only after following due procedure by the Tender Evaluation Committee.

10. Right of Acceptance and Other Provisions:

(i) The acceptance of the tender rests with AICTE. The Council is not bound to accept the lowest tender bid and reserves the right to accept or reject any or all the bids without assigning any reasons thereof.

(ii) AICTE reserves the right to change any condition of the tender before opening of the

Technical Bids. AICTE also reserves the right to relax any terms & conditions of this tender document to safeguard its interest.

(iii) The incomplete and conditional tenders will be rejected. Quoting unrealistic rates

will be treated as disqualification.

(iv) The Competent Authority reserves the right to award any or part or full contract to any successful Contractor(s) at its discretion and this will be binding on the bidders.

(v) The Bidders will be bound by the details furnished by him/ her to the AICTE, while

submitting the tender or at subsequent stage. In case, any of such documents furnished by the Bidder is found to be fictitious at any stage, it would be deemed to be a breach of terms of contract making him/ her liable for legal action besides termination of contract.

(vi) AICTE reserves the right to black list a defaulting Contractor. (vii) Any inquiry after submission of the tender will not be entertained.

(viii) Any failure on the part of the Bidder to observe the prescribed procedure and any

attempt to canvas for the purchase order will prejudice the Firm’s quotation.

(ix) AICTE reserves the right to cancel the tender process without assigning any reason whatsoever, at any stage.

(x) The tender document is valid for a period of six months from the date of issue. If

Work order is not issued within this period, the process will have to start afresh.

(xi) In case of failure to comply with the provisions of the terms and conditions

mentioned in the tender, by the Contractor that has been awarded the contract, the Competent Authority reserves the right to award the contract to the next higher bidder or any other outside agency and the difference of price shall be recovered from the defaulting Contractor, which has been awarded the initial contract and this will be binding on the bidders.

(xii) AICTE may terminate the contract if it is found that the Contractor is blacklisted on

previous occasions by any of the Government Departments/ Institutions/ Local Bodies/ Municipalities/ Public Sector Undertakings and other organization etc. whose experience has been attached.

(xiii) The performance of the Guest House and Office Canteen will be reviewed jointly by a

Committee constituted by AICTE for the purpose periodically or by any other official authorized by AICTE. The Contractor will address the general complaints received from the Committee members, staff and Guests of AICTE regarding the operation of the Canteen/Hospitality services at AICTE HQ & Guest House.

11. Description of work

(i) The Contractor shall be responsible for engaging adequate number of trained/ semi-trained manpower required for providing good catering services in AICTE Guest House and Office Canteen at its AICTE HQ, New Delhi.

(ii) The Contractor will be required to provide services in the AICTE Office Canteen premises and also in various rooms of the Guest House.

(iii) The employees of the Contractor should possess good health and be free from any diseases, especially contagious and frequently recurring diseases. They will have to undergo medical checkup periodically as per requirement of AICTE.

(iv) The Contractor will, prior to the commencement of the operation of contract, make available to AICTE the particulars of all the employees who will be deployed at the AICTE premises for running the Cafeteria. Such particulars, inter alia, should include age/ date of birth, permanent address, police verification report and profile of the health status of the employees.

(v) The Bidder is advised to visit and examine the site of works and its surroundings and obtain for himself all information that may be necessary for preparing the bid and entering into contract for execution of the works. The cost of visiting the site shall be Bidder's own.

(vi) The Contractor shall have to operate Guest House and Office Canteen at AICTE, HQ, Nelson Mandela Marg, Vasant Kunj, New Delhi – 70

(vii) The contractor shall provide sufficient sets of Uniforms, Head Gear and Gloves for food handlers and pair of shoes to his employees and shall ensure that they wear them all times and maintain them properly.

(viii) The Contractor shall be personally responsible for conduct and behavior of his/ her staff and any loss or damage to AICTE’s moveable or immoveable property due to the conduct of the staff shall be made good by the Contractor. If it is found that the conduct or efficiency of any person employed by him/her is unsatisfactory, the Contractor shall have to remove the concerned person and

engage a new person within 48 hours of intimation by AICTE. The decision of the AICTE’s designated officer in this regard shall be final and binding on the Contractor.

(ix) The Contractor shall keep the Canteen and Guest House Kitchen Area, Dining Area and its surrounding areas clean and adhere to good sanitation standards every day after the services are over. The cleaning includes cleaning of utensils, kitchen, dining hall/ area, floor, counter, benches, tables, chairs, etc. AICTE officials will have 24-hour access to inspect the Guest House and Office Canteen premises at any time for ensuring the cleanliness and hygienic conditions of the kitchen and dining hall premises.

(x) AICTE reserves the right to appoint officers/ officials to inspect the quality of raw material, food and other items prepared and sold/served in the guest House and Office Canteen. Any defect(s) pointed out by such officers/ officials during their visits shall be properly attended to by the Contractor.

(xi) The Contractor shall sell all items at the rates mentioned in the financial bid and no changes, what-so-ever shall be made without prior written approval of the AICTE. Packaged food items/ beverages shall not be sold at rates more than the MRP. The rate list will be displayed at appropriate places in the Guest House and Office Canteen for the customers to see.

(xii) If the Contractor fails to carry out the work as per the terms and conditions agreed upon, he/she is liable for forfeiture of EMD/ Security Deposit in addition to penalty.

(xiii) The workers employed by the Contractor shall wear uniform and name badge, which is provided by the Contractor, and he/she, shall be responsible for the discipline of his/ her workers. The workers are not employees of the AICTE and shall not have any claim whatsoever on the AICTE and shall not Act detrimental to the interest of the Council. The workers shall have to follow the security regulations as directed by Administration Bureau of the AICTE. Workers shall not form union or carry out trade union activities in the AICTE.

(xiv) The AICTE shall provide chairs and tables for the dining hall of the Guest and Office Canteen. Other furniture and equipment’s (only available with AICTE), if any, required for satisfactory performance of the contract will be provided by the Council. The maintenance (excluding repairs, etc. due to normal wear and tear) and upkeep of the above equipment’s, installations, shall be responsibility of the Contractor.

(xv) The Contractor shall arrange to bring own kitchen equipment, cutlery, crockery, utensils, burners, stoves, mixer, grinder, cutter, deep freezer, refrigerator, microwave ovens, food warmers, tea kettles, hot plates, display counter, cash/ billing machine, fly trappers, cleaning material and tools, raw material storage units/ cupboards, table linen and any other item/ equipment that they may deem necessary for proper and efficient functioning of the Cafeteria, in addition to what is provided for by AICTE. Kitchen equipment as on date available will be provided to the vendor on returnable basis.

(xvi) It will be the responsibility of the Contractor to store the stock of materials purchased by him/her in a neat, tidy and hygienic manner. The Contractor hereby agrees and undertakes not to use the articles purchased for any purpose

other than to meet the requirements of the AICTE and/or its employees and Guest. AICTE will not be responsible for any loss or damage done or caused to the Contractor's stock, materials, etc., while they are stored within the AICTE premises.

(xvii) The Contractor should have sufficient equipment & crockery and other items normally required to cater at least 400 persons at a time. He should have sufficient utensils, crockery and other infrastructure to provide the service and also for Buffet Lunch/ High Tea, as and when required. The Contractor will provide good quality table cloth/table linen and flower in case of Sit Down Lunch/ Dinner at his own cost. The Contractor shall replace table cloth/ table linen/ flower every day.

(xviii) The Contractor shall not make or cook any meal(s) in the premises of the AICTE for supply to any person(s) outside the AICTE.

(xix) The Contractor shall not make any alterations or additions to the accommodation provided in the Council for cooking and catering purposes. The Contractor shall not occupy any other area for any purpose, which has not been allotted by the Council.

(xx) The food has to be prepared in clean, hygienic and safe conditions as per the menu.

(xxi) The Contractor will ensure that all vegetables, fruits, spices and other ingredients used to prepare food are of standard quality. All items of food, raw materials for food purchased will have to confirm to the standards, prescribed under the prevention of Food Adulteration Act, FSSAI Act and/or any other Act applicable and as far as possible shall have the standards/ branded bearing the mark ‘FSAAI, Agmark, ISI whichever applicable.

(xxii) The kitchen, dining-hall, hand wash area, dish wash area, etc. will be washed with water and Soap solution and mopped after every meal (breakfast, lunch and dinner) and will be disinfected once in a week or as and when required. Tables will be cleaned after a customer has finished his/ her food.

(xxiii) The Contractor shall arrange for disposal of the garbage collected from the kitchen, dining halls, dish wash area etc. every morning in closed bins by separation of bio-degradable waste from non-biodegradable waste. The surroundings shall be kept clean and hygienic.

(xxiv) High quality of hygiene, sanitation and safety will be maintained at kitchen and dining halls. All the surrounding area of the mess premises should be cleaned and washed daily.

(xxv) After every meal all the plates, cups, ketosis, water glass, spoons, forks, knives etc., are to be cleaned in soap solution and water and dried. All the vessels used for cooking also should be washed in soap solution and hot water before these are made available for use for cooking the next meal. The cleaning material supplied should be of approved quality.

(xxvi) The Guest House shall remain open from 07:30 a.m. to 09:30 p.m. on all days and the Office Canteen shall remain open from 08.30 to 6.00 PM from Monday to Saturday. However, skeleton services will be provided beyond office hours up to 08:30 P.M. as per requirement of AICTE during Approval Process/ exigency of services.

(xxvii) Depending on the exigencies, the Contractor may be required to keep the Guest House and Office Canteen open or closed as per requirements of AICTE.

(xxviii) Complaint/Suggestion books shall be kept in the Guest House and Office Canteen for recording any complaint or suggestions from any user of the Council i.e. its Employee, Officers, Visitors and Guests. The Canteen Manager will be the custodian of the above book. The page no. will be allotted / marked on each page and will be authenticated by AO (Admin-III) and same will be produced to the AO (Admin-III) will be produced for inspection on weekly basis. Decision taken by the Competent Authority of AICTE for disposal of all these complaints/ suggestions shall be final and binding on the contractor.

(xxix) Care must be taken to ensure that, while carrying out the work, no fittings, fixtures, furnishings, equipment’s provided by the AICTE are damaged. Any damages done to the same or any other property will have to be repaired / replaced by the Contractor, failing which the same will be got done by AICTE at the contractor’s risk and cost. In this regard, the decision of the designated officer of AICTE shall be final and binding on the Contractor.

(xxx) All work shall be carried out with due regard to the convenience of AICTE. The orders of the concerned authority shall be strictly observed.

(xxxi) Whenever required, the Contractor will deploy adequate manpower for work during late hours and on Saturdays/ Sundays, including other holidays, according to the requirement of AICTE.

(xxxii) Storing/supply/ sale and consumption of drugs, alcoholic drinks, cigarettes or any other items of intoxication are strictly prohibited in the AICTE campus. Any breach of such restrictions by the Contractor or his/ her staff will attract deterrent action against the Contractor as per statutory norms.

(xxxiii) The Contractor shall ensure that either he/ she himself/ herself or his/ her representative is available for proper administration and supervision of Canteen/Kitchen Area to the entire satisfaction of the AICTE.

(xxxiv) The Contractor shall not use the Canteen premises for any other activity except for the purpose for which it has been provided for.

(xxxv) The contractor will have to make arrangements for preparing and serving lunch/ dinner to officers and official guest of AICTE whenever the AICTE arranges the official lunches, dinners. Generally, three categories i.e. regular/VIP/VVIP of lunch and dinner would be provided at guest house depending upon the occasions vise Board Meeting, VIP visits etc. The indicative menus to be followed for these three categories of lunch/dinner are indicated in Annexure-I and the Contractor shall be paid as per the AICTE rates indicated against the menus.

12. Period of Contract

(i) The contract for Kitchen Canteen/Hospitality services shall initially be awarded for a period of one year which is extendable further on existing terms & conditions as desired by AICTE subject to satisfactory performance of the Contractor. However, in order to evaluate the performance and services of the Contractor, the contract will have probationary period of three months. The contract for the remaining 9 months will be confirmed only if the services and quality of items served by the Contractor are found satisfactory during the probationary period.

(ii) In case the performance and services of the Contractor are not found satisfactory during the probationary period of three months, AICTE reserves the right to cancel the contract and award the work to the L2 Bidder or to invite fresh bid.

13. OTHER CONDITIONS:-

1. The Contractor shall employ adequate number of qualified and experienced persons as per requirement like Supervisors, Cooks, Masalachi, Waiters etc. to ensure provision of efficient and high standards of services envisaged in the scope of work.

2. The Contractor shall be wholly responsible for the payment of salaries/wages, provident fund, ESI benefits etc. as per labour act and all other legal Liabilities and statutory requirements under the various acts in force from time to time during the contract period.

3. The Contractor will have to make his own arrangements for accommodation for their staff. Moreover, no personnel of contractor will be allowed to stay in the guesthouse/ AICTE HQ, New Delhi after duty hours except the staff on duty.

4. These workers shall be the employees of the Contractor for all the purposes and AICTE will have no responsibility or liability on this account. The Contractor shall fully indemnify AICTE in the event of any claims made by his employees, AICTE in the responsible for death, disablement, injury, accident to contractor’s employees which may arise out of and in the course of their duties with the Contractor. In such case AICTE Shall not be liable to pay any damages or compensation to the contractor’s employees.

5. The contractor shall have to provide cooking gas at his own cost at all times.

6. The contractor will be solely responsible for shortages & damages DUE TO NEGLIGENCE OF THE CONTRACTOR OR HIS EMPLOYEES to the AICTE property and the items provided at the Guest House by AICTE and will be required to compensate for avoidable damages or loss or such items issued during the period of the contract. None of the items belonging to the AICTE will be taken out by the Contractor at any time without proper authorization.

7. The Bureau in-charge/AICTE Committee shall certify the quality of lunch/dinner served by the contractor. In case of default of the contactor in quantity & quality, AICTE will have the right to effect recovery from the Bidder. In addition, for unsatisfactory performance the AICTE will have the right to recover liquidated damages from the monthly bills of the contractor @ 0.5% of the contract value per day & maximum 5% of the contract value.

8. AICTE may terminate the contract at any time after giving one months’ notice in case of:-

i) Fraud committed by the contractor.

ii) Serious default of the contract committed by the contractor.

iii) Sub-contracting without authorization from AICTE;

iv) If services are found not satisfactory.

9. Any act on the part of the contractor or his employees which will be prejudiced to the reputation of the AICTE shall be considered as grave breach of the condition of the contract and shall render the contract liable for immediate termination.

10. This award of work to the contractor is a mere license to enter the premises and does not confirm any tenancy right or ownership. The entire and exclusive possession of the premises will remain and shall at any time be deemed to have remained always with the AICTE.

11. During the tenures of the contract the contractor shall strictly comply with all the Central, State and Municipal Laws & Rules and shall be solely responsible for the implementation of the provision of the various Labour Laws and rules there under and other statutory regulations, rules that are in force and such of the labour enactments that may be made applicable to him. Contractor shall be required to maintain and produce records under various laws for the inspection and perusal of the representatives of the management/ statutory authorities at any time. Any obligations financial or otherwise, imposed under any statutory enactment rules and regulations there under shall be sole responsibility of the contractors.

12. All staff employed by the contractor shall be the contractor’s employee for all intents and purposes.

13. The contractor shall cover his employees under the Employee Provident Fund Act under his own Code No. and shall deposit their E.P.F. contribution with the provident Fund Commissioner every calendar month if applicable as per Govt. Norms. The contractor should give the complete list of employees and the details of recovery of E.P.F. from their wages and also the equivalent employee’s contribution.

14. The contractor shall cover his employees under the E.S.I. Act under his own under Code No. and shall deposit their E.S.I. contributions regularly every month.

15. The contractor will have to pay wages as per the provisions of the Minimum Wages, act 1948 as announced by the Government from time to time.

16. The contractor will have to pay 6 monthly contributions of their employees to the Welfare Commissioner and compliance with provisions of the labor Welfare Act, if any, applicable in Delhi.

17. Engagement of Child labor/adolescent is prohibited and any one violation this clause will be black listed a whenever there are violations of the provisions, the AICTE will resort to legal action as deemed fit.

18. The monthly bills submitted by the contractor will be paid only after the contractor produces the documents of monthly payments register of E.P.F. and ESIC contributions of workers duly certified receipted by the EPF/ESIC authority, if applicable.

19. The tenderer shall include all taxes duties, levies and other costs towards maintenance, housekeeping, catering services, uniforms etc. taking into consideration of all the aspects which the contractor considers have bearing on this contract while quoting for the tender.

20. The tenderer shall quote lump sum monthly rate taking into account the facilities and other free services provided by the AICTE and also the rates provided by AICTE towards the various categories of Lunch/Dinner and other food items as per Annexure-I. The rates quoted shall remain firm and fixed for the entire contract period. In addition, tenderer may also independently indicate the rates for additional snack dishes which he wishes to provide to guests.

21. The tenderer shall submit their tender in a sealed cover in the preform shown in Annexure-II is a price bid & Earnest Money Deposit in the form of demand draft in

favor of AICTE Payable at Delhi in separate envelope as mentioned at mode of application Tenders received without EMD will not be considered.

22. Income Tax will be deducted at source from the bills of the vendor as applicable from time to time.

23. The contractor shall execute an agreement as per AICTE standard format on a Rs.100/- non judicial Stamp Paper. This contract will be governed by Indian Laws.

24. AICTE shall have right to accept or reject any or all tender without assigning any reason thereof. AICTE does not bind itself to award the tender to the lowest tender.

25. In the event of any difference and disputes arising out of or in connection with or relating to this contract all such differences and disputes shall be referred to the sole arbitration of the arbitrator appointed by the Member Secretary, AICTE, New Delhi and the decision of the arbitrator shall be final and binding on the parties hereto. The provisions of the arbitration & conciliation Act 1996 shall apply to such arbitration along with statutory modification or enactment thereof. The venue of arbitration shall be at New Delhi only.

26. “Arbitration: All disputes relating to this agreement or claims arising out of or relating to this agreement or breach, termination or the invalidity thereof or on any issue whether arising during the progress of the services or after the completion or abandonment thereof or any matter directly or indirectly connected with this agreement shall be referred to Arbitrator appointed by AICTE on receipt of such request form either party. Matters to be arbitrated upon shall be referred to a sole arbitrator. The arbitrator shall be appointed within a period of thirty days from date of receipt of written notice/demand of appointment of arbitrator from either party.

27. The appointment of sole arbitrator by AICTE, It is stated that Arbiration and Concilation Act, 1996 does not permit one party to appoint a sole Arbitrator unilaterally. To solve this issue in accordance with the provisions, of the Act, AICTE and Vendor (both parties) can appoint one Arbitrator with mutual consent. If both parties fail to appoint one Arbitrator with mutual consent, then Arbitrators can be appointed i.e. one Arbitrator by Each party and the third Arbitrator by the Two Arbitrators. Kindly take necessary action accordingly.

28. The decision of sole arbitrator shall be binding on all the parties. The cost of arbitration shall be borne by respective parties equally. The venue of such arbitration shall be Delhi/ New Delhi. The parties agree to comply with the awards resulting from arbitration and wave their rights to any form of appeal in so far as such waiver can validly be made.

29. Rules governing arbitration proceedings: The arbitration proceedings shall be governed by Indian Arbitration and Conciliation Act 1996, as amended from time to time including provisions in force at the time the references made.”

30. The Contractor is, therefore, advised to ensure that all the necessary documents are properly furnished in time whenever revision is requested for.
