ALBERTA ENERGY REGULATOR (AER) PHASE 3 IMPLEMENTATION – INDUSTRY

INFORMATION SESSIONS The Government of Alberta and the Alberta Energy Regulator (AER) have developed and passed legislation, regulations, and rules that outline the AER’s legal framework. As the regulator implements the final sections of the Responsible Energy Development Act (REDA), the AER will be hosting stakeholder information sessions. Content will focus on industry requirements, but all stakeholders are welcome to attend.

The sessions will highlight changes that will occur upon proclamation of REDA on March 29, 2014. A question and answer period will follow.

PROPOSED DESIGNATED MATERIALS RECYCLING REGULATION

AER RELEASES INVESTIGATION REPORT ON PIPELINE INCIDENT NEAR SUNDRE

The Alberta Energy Regulator (AER) has released its investigation report that details Plains Midstream Canada’s (Plains) Rangeland pipeline failure that occurred on June 7, 2012, near Sundre, Alberta.

The pipeline incident resulted in approximately 462 m3 of crude oil being released into the Red Deer River, and nearby residents were impacted.

The AER investigation concludes that the pipeline failure was caused by deficiencies in the company’s management of the pipeline and preincident administration procedures. The AER investigation describes the company’s failure to

• inspect the Rangeland pipeline annually, • complete inspections on the pipeline at the required frequency according to its own pipeline integrity

management program, • apply appropriate mitigation measures according to its own assessment of scour (erosion of river bed

under pipe), • apply appropriate mitigation measures according to its own hazard assessment, and • to respond to the Government of Alberta’s high stream flow advisories that were issued on (June 5th and

6th, 2012) and which would have mitigated the volume of crude oil released.

On July 4, 2013, the AER issued an order under section 22 of the Oil and Gas Conservation Act against Plains; the order includes a full regulatory audit of the company’s Alberta pipeline operations. The audit stems from the company’s failure to follow Alberta regulatory requirements over a prolonged period of time.

The AER has also issued four high risk enforcement actions against the company for its role in the Rangeland pipeline failure. The AER enforcement action directs the company to update its emergency response plan and to conduct a resident awareness program within the emergency planning zone of the Rangeland pipeline. Further, Plains is required to develop, implement, and electronically submit an action plan to the AER detailing what the company will do to prevent future regulatory noncompliance.

Should the company fail to complete any of the required actions, the AER will issue additional high risk enforcement actions and escalate existing enforcement consequences.

The AER provides regulatory oversight for more than 421 000 kilometres of pipeline within Alberta's borders. If the AER identifies a pipeline operation that is, or is at risk of, causing unacceptable impacts, the regulator will pursue all available remedies to ensure that public safety is protected and environmental stewardship is upheld.

In 2013, the AER conducted nearly 1400 pipeline inspections and investigations. As a result, 217 high risk noncompliances were recorded, and 37 pipelines were suspended.

The Alberta Energy Regulator ensures the safe, efficient, orderly, and environmentally responsible development of hydrocarbon resources over their entire life cycle. This includes allocating and conserving water resources, managing public lands, and protecting the environment while providing economic benefits for all Albertans.

BAYTEX SPILL DID NOT AFFECT WILDLIFE OR WATERWAYS, REGULATOR SAYS

(Source: Edmonton Journal) EDMONTON - About 88 barrels of crude oil and water spilled March 2 on a Baytex well site near Peace River after severely cold weather caused a pipe to freeze.

None of the oil and “produced water” — brackish water which comes up the well — flowed off the lease site, company spokesman Andrew Loosley said Wednesday.

The leak, made public this week by Alberta Energy Regulator, occurred as the oilsand mix was pumped from a well head into a storage tank, where the mixture is heated to separate the oil and sand and melt the resulting bitumen for transportation.

The area was cleaned up and waste taken to a landfill site for disposal. The “relatively small” spill occurred in the Three Creeks area north of Peace River, Loosley said.

On its website, the Alberta Energy Regulator said there was no impact on wildlife or any water body.

Baytex’s production method sees thick bitumen and sand is augered out of the ground and pumped up into large surface storage tanks, a process called CHOPS or cold heavy oil production with sand.

The oil mixed with sand comes out of the ground at about 20 C, and is heated up to 80 C d to melt the bitumen.

Baytex operations in the nearby Reno oilfield were central in a public hearing in January into health effects of emissions from bitumen storage tanks.

Loosley said the company sent letters to area residents this week seeking their approval to install the pollution control equipment they say will reduce air pollution from the bitumen storage tanks the nearby Reno field.

Seven families have left the area, concerned about ill health they suspect was caused the bitumen fumes.

The company also signed an agreement this week to send excess natural gas from its area wells to GenaltaPower, enough gas to generate power for 1,400 homes, said Loosley.

PROVINCE NEVER INSPECTED BERM THAT BURST AT OBED MINE TAILINGS POND

(Source: Edmonton Journal) EDMONTON - The berm around the Obed mine coal tailings pond that failed last fall had not been inspected by the province because it was not classified as a dam, a public forum at the University of Alberta was told Thursday.

The berm broke Oct. 31, 2013, sending a wall of water, mud and fine coal particles out of the tailings pond in the largest coal slurry spill in Canada. The spill over ran the banks of two small creeks and left a layer of muddy, contaminated sediment in the creeks and along the banks for five kilometres and ran into the Athabasca River.

At the public forum, U of A water scientists presented the results of their review of mine owner Sherritt’s cleanup plans — a review requested by Alberta Environment in an effort to get and independent review and “the best science” to guide the cleanup.

In response to a question about inspection reports on the berm around the tailings pond, Alberta Environment said no such reports exist as the structure was not classified as a dam and therefore “not subject to regular testing. “

That raised a red flag for some at the forum. Peter Fortuna of Fort McMurray asked if there was a list identifying which structures are considered dams “so we can know in our community” what is being inspected.

Sherritt’s John Schadan, vice-president of operations, said later that the company inspected the berm regularly and found no warning signs. It is too early to say how or why the berm burst — that is still under investigation, he added.

Alberta Environment later said to be classified as a dam, the structure must be 2.5 metres high and have the capacity to store 30,000 cubic metres of water, and they require licence. The height of the Sherritt berm was not available.

Alberta Environment and Sherritt are looking at how to contain the contaminated slurry that is frozen under ice and snow, stopping the flow into the Athabasca River but with the spring melt approaching.

Cleanup crews will go in with shovels to try to dig out as much as possible of the sediment on the riverbed and banks of the two creeks, he said.

In places where the coal tailings mixed into mud on the riverbed, there can be a buildup of heavy metals such as mercury and arsenic, he added.

Sherritt has spent tens of millions of dollars on the cleanup, Schadan said. Sherritt sold the mine to Colorado-based coal giant Westmoreland Coal Company which will take over at the end of March, though Sherritt will remain involved in the cleanup, Schadan said.

COAL FIRM TO PAY RECORD PENALTY AND SPEND MILLIONS ON WATER CLEANUP IN 5 STATES

(Source: NY Times) One of the nation’s biggest coal companies will pay a record civil penalty and will spend tens of millions of dollars to clean up water flowing from mines in five states, the Environmental Protection Agency and the Justice Department announced on Wednesday.

The company, Alpha Natural Resources, and 66 of its subsidiaries including the former Massey Energy, will spend $200 million under a consent decree to reduce pollution from coal mines in Kentucky, Pennsylvania, Tennessee, Virginia and West Virginia. The company will also pay $27.5 million, the largest civil penalty ever for permit violations under the Clean Water Act, in connection with more than 6,000 such violations from 2006 to 2013.

Under the agreement, which involved both state and federal agencies, Alpha’s new equipment should prevent the discharge of about 36 million pounds of dissolved solids each year, including about nine million pounds of metals and other pollutants.

The agreement is the fifth in recent years between the agencies and coal companies, following deals with Massey in 2008, Patriot Coal in 2009, and Arch Coal and Consol Energy in 2011.

Because of such agreements, “we have a very significant share of the coal mining companies in Appalachia under consent decrees to clean up their discharges,” said Robert G. Dreher, the acting assistant attorney general for the Environment and Natural Resources Division of the Justice Department.

In a statement, Alpha noted that water safety in industrial operations had been at the forefront of public attention in recent months with a chemical spill in West Virginia and a coal ash spill in North Carolina.

“The public expects that regulators ensure that water quality is protected and that companies comply with their permits,” said Gene Kitts, Alpha’s senior vice president for environmental affairs. “That’s the way it should be. We respect and support that, and understand the concerns that these events have raised, yet there are distinct differences between those events and what we’re talking about here.”

The company’s rate of compliance with water quality permits in 2013 was 99.8 percent, Mr. Kitts said, “but our goal is to do even better.”

Joe Lovett, the executive director of Appalachian Mountain Advocates in West Virginia, expressed little enthusiasm for the agreement, saying such deals do not get to the fundamental problem of heavy pollution from mining techniques like mountaintop removal. “What E.P.A. should do is stop issuing permits that it knows coal companies can’t comply with,” he said.

Introduction to In Situ Bioremediation of Groundwater (EPA 542-R-13-018). In situ bioremediation (ISB) of groundwater involves the encouragement of indigenous bacterial populations to metabolize target contaminants through the addition of various amendments (biostimulation) to the subsurface environment. In addition to amendments, select strains of bacteria may be added to the subsurface to help treat some sites (bioaugmentation). Bacteria perform coupled oxidation/reduction (redox) reactions to live, and bioremediation exploits these reactions to remove contaminants from contaminated media (soil, air, or groundwater). Bacteria can use different electron acceptors (oxidized compounds) and donors (reduced compounds) in the three major oxidation pathways aerobic respiration, anaerobic respiration, and fermentation. ISB can use all of these pathways, and contaminant degradation may occur through direct metabolism, cometabolism, or abiotic transformations that may result from biological activities. Reference Report on the management of contaminated sites in Europe (2014). The JRC has published a Reference Report led by the IES, which presents the current state of knowledge on the management of contaminated sites in Europe. The report outlines findings such as the following: " There are an estimated 2.5 million potentially contaminated sites in Europe, where soil contamination is suspected and detailed investigations are needed. " Of the circa 115 000 contaminated sites that have already been identified in Europe, nearly half of them (46%) have already been remediated. " Contaminated sites are mainly managed using traditional techniques such as excavation and off-site disposal, which together account for about one third of management practices. " Mining activities, metal industries and gasoline stations are the most frequently reported sources of soil and groundwater contamination. However, the range of polluting activities varies considerably from country to country. " The most frequently occurring contaminants are mineral oils and heavy metals. " Annual national expenditure for the management of contaminated sites is on average about ?10 per capita. Oak Environmental is pleased to bring The Nielsen Environmental Field School to Calgary, AB to teach their 5-day Complete Ground-Water Monitoring Field Course focusing on Ground-Water monitoring and sampling. The course instructors, David and Gillian Nielsen, will conduct classroom and field training from June 16th to June 20th, 2014.

This course comprehensively covers environmental drilling and monitoring well placement, design, construction and development as well as up-to-date procedures for ground-water sampling. The course features two half-day field sessions in which students’ hands-on participation is encouraged. In the first field session, students will learn how to collect and use ground-water samples and other information to characterize a site, install small diameter wells using a direct-push rig and either an auger or sonic drilling rig; as well as learn about multilevel monitoring and sampling systems. The second field session focuses on field practices and procedures used to effectively implement a ground-water sampling event for traditional sampling, low-flow purging and sampling, and no-purge sampling programs.
