Authorize and direct the Conununity Development Agency Director, or his designee, to take all actions necessary to implement the contract, including execution of future contract amendments for scope of work that do not increase the contract amount. DISCUSSION/SUMMARY: Alameda County has taken an active role in adopting policies to reduce greenhouse gas (GHG) emissions to protect the environment and protect public health. In July 2007, the Board of Supervisors adopted County Resolution 2007-366, known as the Cool Counties Climate Stabilization Declaration, establishing the County's long-term commitment to reduce GHG emissions to 80 percent below Year 1990 levels by Year 2050. In addition, the County is looking to the target levels set in California Legislation AB 32, the California Warming Solutions Act, to achieve 1990 emissions levels by the Year 2020. At the June 16,2009 Board Planning meeting, the Alameda County Board of Supervisors approved Contract #4079 for the hiring of EDAW, Inc., an ABCOM Company (now AECOM Technical Services, Inc.), to provide consulting and document preparation services for the draft CCAP for the unincorporated area. EDAW, Inc. was merged and absorbed into AECOM, Inc., and the name changed to AECOM Technical Services, Inc. The project has been funded, in part, by a grant from the Bay Area Air Quality Management District (BAAQMD) to the County General Services Agency for $40,000, of which $20,000 has been made available to the Planning Department for CCAP development. At the December} 5, 2009 Board Meeting,

DISCUSSION/SUMMARY:

the Board of Supervisors approved a time extension to this contract for reasons of schedule and adequate timeliness; no additional expense was incUlTed at that time. To date, the consultant has been diligent and timely in its efforts.

The reason for the time extension request and request for additional funding is that staff has received a number of comments from the public that question, and are critical of, many of the basic measures that the draft CCAP has fOWld important to reach the County's goals for greenhouse gas reduction. As a result, staff has received direction to conduct at least one additional workshop, additional public hearings and some additional analysis. This, in tum, would require technical analytical services of the consultant that were originally unforeseen and unfunded. The goal of the additional work would be to provide your Board with the broadest reasonable array of alternatives within the constraints of the CCAP, and a description of their relative effectiveness in reaching the CCAP's goals. Staff anticipates an additional 6 months to complete this expanded process.

SELECTION PROCESS:

The Community Development Agency (CDA) issued a Request for Proposals (RFP) for this project on March 24, 2009. The RFP was sent to 27 firms, ofwhich 24 firms were local and/or Alameda County SLEB finlls, and threefirms from the larger Bay Area. The General Services Agency (GSA) handled the press advertising and County website positing ofthe RFP. GSA also posted the RFP to its own Current Contracting website, and posted the Networking/Bid Meeting all its Calendar ofEvents, and advertised the bid in a total of910cal and ethnic newspapers. Two pre-bid conferences were held, and a total of24 finns attended.

Ten responses were received. An interview panel consisting oftwo Planning Department staff, one staff person from the GSA Sustainability Program, and one staffpersoll from the City ofHayward Planning Department interviewed five firms. EDA W. fnc., an AECOM Company, who has partnered with a certified Alameda County SLEB (Gibson & Associates) for 31 % ofthe total contract amount, was selected as the most qualified team to complete the project.

Although the current amendment proposal does Ilot have an express role for the SLEB participant, and so does not contain a proportional SLEB percentage, the SLEB average ofthe total combined contract remains well above the minimum 20% requirement.

FINANCING:

Although the extension request includes an increase for contract budget, the contract is included in the Conununity Development Agency, Planning Department budget, and in a grant from the BAAQMD. There is no additional Net County cost as a result of this action.

Second Amendment to Standard Agreement

Reference is made to that contract made and entered into on the 30th day of JW1e 2009, by and between the County of Alameda and EDAW, Inc., which was assigned to AECOM Technical Services, rnc., v"lth the consent of the County, on D~ember 15,2009.

Said contract is bereby amended:

The con.tract term sha1l he extended bv six month, from June 30,2010, to December 31, 2010. The contract ru:nount shall increase by $18:4lO".OO from $90,000,00 to $108,410.00. AEeOM Technical Services, Inc. shall continue to provide Professional Services for an Alameda COlUlty Community Climate Action Plan in accordance with the attached May 14, 2010, ABeOM letter proposal and estimated budget which are incorporated herein.

ABeOM Technical Services, Inc, shall continue to be required to subcontract an amount of not less than $27,900.00 .(31% of the original contact arnount) to Sub-contractor Oibson & Associates.

As oftbe current, second amendment and aU future amendments, the SLEB sub-contracting percentage requirement shall be changed from at least 3l% of the original contract amount of$90,OOO.OO to not less than 20% of the revised contract amOlUlt.

As per your email of Wednesday, May 05,20102:48 PM, we are happy to submit the budget below to amend the Alameda County Draft Climate Action Plan as a result of pUblic review and comments. We have tried to keep this budget light, and it has been put together assuming that the process of amending existing measures and identifying new ones will be streamlined. Please nole the number of hours we have allocated, given the uncertainty at the point relating to the process. We will review this with you regularly, in relation to the contlngency amount of $4000 to supplement the budget. This contingency has been Included as a line Item In the budget table overleaf.

The work will consist of:

• Revision of 6-8 existing measures In terms of partlclpatlon rates, performance,.phasing etc. It is assumed that Ule existing GHG quantIfication methodologies will be applicable

• Write up of these altematives (max of 12) In table format alongside the current form of each of those measures to allow easy comparison for decision making bodies. The gap that these leaves relative to the County's GHG reduction target will be clear.

• rden~fication of up to 2 new measures, With assocIated cost and GHG quantification. The budget presumes that we can use exlstlng methodologies for quantifying GHG reductions, and doesn't inclUde the development of any further graphics or maps. Where robust GHG quantification methodologies do not eXist, we will work with the County to comB up with· reasonable assumptions, for example relating to voluntary participation in partiCUlar energy efficiency retrofit schemes.

• Write up of the 2 new measures into the pUblic review draft CAP measure format. • Preparation and attendance at one public hearing. We have not included costs for preparing

a presentation for the hearfng.
