Bidders should have a CIDB contractor grading designation of 7EP or higher. No Alternative Class of work; as referred to in Clause 25(3) (a) (i) of the CIDB Regulations, as amended, as anticipated for this project

A compulsory site inspection shall be held on 14 March 2018 and prospective bidders are to meet the Engineers and the Client’s Representatives at East London Airport at 10:00. Bid documents can be obtained at no charge by download from Treasury Departments Central Supplier Database www.etenders.gov.za The bid documents will be available from 09h00 06 March 2018. BIDDERS SHALL TAKE NOTE OF THE FOLLOWING BID CONDITIONS: The Airports Company South Africa Supply Chain Management Policy and all other

regulations of Supply Chain Management will apply; The Airports Company South Africa does not bind itself to accept the lowest bid or any other

bid and reserves the right to accept the whole or part of the bid; Bids which are late, incomplete, unsigned or submitted by facsimile or electronically, will not

be accepted; Bids’ validity period will be taken as 84 days. All contractors including sub-contractors must be registered with the Construction Industry

Development Board (CIDB) and certificates should also be attached. Valid original tax clearance attached. All tenders will be evaluated based on Functionality, Price and BBBEE. Please note: Evaluation consists of two (2) phases, namely, Phase One – Functionality and

Phase Two – Price & BBBEE. Before commencement of evaluation, all bidders should have the mandatory administrative items (stated below), otherwise they will automatically be disqualified and therefore not be evaluated.

F.2.1 The Tender shall have a contractor grading designation equal to or higher than a contractor

grading designation determined in accordance with the sum tendered, or a value determined

in accordance with Regulation 25 (1B) or 25(7A) of the Construction Industry Development

Regulations, for a 7EP class of construction work, are eligible to have their tenders evaluated.

Joint ventures are eligible to submit tenders provided that:

1. every member of the joint venture is registered with the CIDB;

2. the lead partner has a contractor grading designation in the 7EP class of construction

work; and

3. the combined contractor grading designation calculated in accordance with the

Construction Industry Development Regulations is equal to or higher than a contractor

grading designation determined in accordance with the sum tendered for a EP class of

construction work or a value determined in accordance with Regulation 25 (1B) or 25(7A)

of the Construction Industry Development Regulations.

F.2.18 The tenderer shall, when requested by the Employer to do so, submit the names of all

management and supervisory staff that will be employed to supervise the Labour Intensive

portion of the works together with satisfactory evidence that such staff members satisfy the

eligibility requirements.

F.2.19 Access shall be provided for the following inspections, tests and analysis:

1. Network and equipment verification and inspection.

F.2.20 The tenderer is required to submit the following certificates with his tender:

1) A copy of a valid Tax Clearance Certificate issued by the South African Revenue

Services including Tax clearance pin.

2) All required documents list as Returnable Documents

3) CIDB Registration Certificate

4) BBBEE certificate for a bidding single entity or JV’s joint certificate(certified copy or

The procedure for the evaluation of responsive tenders is Method 2. Financial offer scoring In terms of the PPPFA and its regulations only a maximum of 20 points may be awarded for preference. The preferential point systems are as follows: a) 80/20 preference point system for acquisition of goods or services for Rand value equal to or above R30 000 and up to R50 million. b) The 90/10 system for requirements with a Rand value above R50 million (all applicable taxes included). The value of this bid is estimated to not exceed R50 million (all applicable taxes included) and therefore the 80/20 system shall be applicable. Preference points for this bid shall be awarded for: Points Price 80 B-BBEE Status Level of Contribution 20 Total Points for Price and B-BBEE must not Exceed 100 Preferences scoring The Minister of Finance promulgated the Regulations to amend the PPPFA Regulations which control how the 10 or 20 points for preference are allocated in the 90/10 and 80/20 tender scoring system for Public Enterprises. 10 or 20 points are scored only by reference to the organisations BEE rating certificate, issued by an accredited Verification Agency or by a registered auditor approved by the Independent Regulatory Board for Auditors. The new Regulations also make it clear that functionality must be scored first, where this is used as a criterion in an objective fashion, and if the minimum qualifying score for functionality is not achieved, the tender is not considered on price and preference points. Up to 100 minus W1 tender evaluation points will be awarded to tenderers who complete the preference schedule and who are found to be eligible for the preferences claimed. Preference points will be allocated as follows: Failure on the part of a bidder to fill in and/or to sign this form and submit a B-BBEE Verification Certificate from a Verification Agency accredited by the South African Accreditation System (SANAS) or a Registered Auditor approved by the Independent Regulatory Board of Auditors (IRBA), an affidavit in the case of Qualifying Small Enterprises and an Emerging Micro Enterprises or an Auditor/Accounting Officer as contemplated in the Close Corporation Act (CCA) together with the bid, will be interpreted to mean that preference points for B-BBEE status level of contribution are not claimed. ACSA reserves the right to require of a bidder, either before a bid is adjudicated or at any time subsequently, to substantiate any claim in regard to preferences, in any manner required by ACSA.

4.3 Definitions 4.3.1 “All Applicable Taxes” includes value-added tax, pay as you earn, income tax,

unemployment insurance fund contributions and skills development levies; 4.3.2 “B-BBEE” means broad-based black economic empowerment as defined in section

1 of the Broad -Based Black Economic Empowerment Act; 4.3.3 “B-BBEE status level of contributor” means the B-BBEE status received by a

measured entity based on its overall performance using the relevant scorecard contained in the Codes of Good Practice on Black Economic Empowerment, issued in terms of section 9(1) of the Broad-Based Black Economic Empowerment Act;

4.3.4 “Broad-Based Black Economic Empowerment Act” means the Broad-Based Black Economic Empowerment Act, 2003 (Act No. 53 of 2003);

4.3.5 “Comparative Price” means the price after the factors of a non-firm price and all unconditional discounts that can be utilized have been taken into consideration;

4.3.6 “Consortium or Joint Venture” means an association of persons for the purpose of combining their expertise, property, capital, efforts, skill and knowledge in an activity for the execution of a contract;

4.3.7 “EME” means any enterprise with an annual total revenue of R5 million or less in terms of the B-BBEE Codes of Good Practice of 2007 and an entity with a turnover of less than R 10 million in terms of the amended B-BBEE Codes;

4.3.8 “Firm Price” means the price that is only subject to adjustments in accordance with the actual increase or decrease resulting from the change, imposition, or abolition of customs or excise duty and any other duty, levy or tax, which, in terms of the law or regulation, is binding on the contractor and demonstrably has an influence on the price of any supplies, or the rendering costs of any service, for the execution of the contract;

4.3.9 “Functionality” means the measurement according to predetermined norms, as set out in the bid documents, of a service or commodity that is designed to be practical and useful, working or operating, taking into account, among other factors, the quality, reliability, viability and durability of a service and the technical capacity and ability of a bidder;

4.3.10 “Non-Firm Prices” means all prices other than “firm” prices; 4.3.11 “Person” includes a juristic person; 4.3.12 “Rand Value” means the total estimated value of a contract in South African currency,

calculated at the time of bid invitations, and includes all applicable taxes and excise duties;

4.3.13 “Total Revenue” bears the same meaning assigned to this expression in the Codes of Good Practice on Black Economic Empowerment, issued in terms of section 9(1) of the Broad-Based Black Economic Empowerment Act and promulgated in the Government Gazette on 9 February 2007;

4.3.14 “Trust” means the arrangement through which the property of one person is made over or bequeathed to a trustee to administer such property for the benefit of another person; and

4.3.15 “Trustee” means any person, including the founder of a trust, to whom property is bequeathed in order for such property to be administered for the benefit of another person.

4.4 Adjudication Using A Point System 4.4.1 The bidder obtaining the highest number of total points will be awarded the contract,

unless objective criteria exist justifying an award to another bidder or ACSA exercises one or more of its disclaimers.

4.4.2 Preference points will be calculated after prices have been brought to a comparative basis taking into account all factors of non-firm prices and all unconditional discounts

4.5.1 In the event that two or more bids have scored equal total points, the successful bid

will be the one scoring the highest number of preference points for B-BBEE. 4.5.2 However, when functionality is part of the evaluation process and two or more bids

have scored equal points including equal preference points for B-BBEE, the successful bid will be the one scoring the highest score for functionality.

4.5.3 Should two or more bids be equal in all respects, the award will be decided by the drawing of lots.

i. The tenderer will be marked out of a total of 100 points. ii. Only tenderers scoring 70 points (and more) out of 100 points for functionality

evaluation will be considered for further evaluation (as stipulated in F3.11.3). iii. Bidders must meet the minimum requirement per each item line of the functional

SCHEDULE 11: HEALTH AND SAFETY PLAN Tenderers are to note the requirements of the Occupational Health and Safety Act No. 85 of 1993 and the Construction Regulations 2014 issued in terms of Section 43 of the Act. The tenderer shall be deemed to have read and fully understood the requirements of the above Act and Regulations and to have allowed for all costs in compliance therewith. 1.5. The purchaser reserves the right to require of a bidder, either before a bid is adjudicated or at

any time subsequently, to substantiate any claim in regard to preferences, in any manner required by the purchaser.

2. DEFINITIONS 2.1 “all applicable taxes” includes value-added tax, pay as you earn, income tax, unemployment

insurance fund contributions and skills development levies;

1. This ACSA Bidding Document (MBD) must form part of all bids1 invited.

2. Section 4 (1)(b)(iii) of the Competition Act No. 89 of 1998, as amended, prohibits an

agreement between, or concerned practice by, firms, or a decision by an association

of firms, if it is between parties in a horizontal relationship and if it involves collusive

bidding (or bid rigging).2 Collusive bidding is a pe se prohibition meaning that it cannot

be justified under any grounds.

3. ACSA Supply Regulation 38 (1) prescribes that a supply chain management pol icy
