• 40 CFR 58.10: “The plan shall include a statement of purposes for each monitor and evidence that siting and operation of each monitor meets the requirements of appendices A, C, D, and E of this part, where applicable.”

• FRM/FEM instruments at the following stations: SLAMS, Ncore, STN/CSN, State speciation, SPM, PAMS

• It is more of a documentation tool than a planning tool.

What is an Air Monitoring Annual Network Plan (ANP)?

• ANP reg. clarified in 2006 Monitoring Rule Revision• 2007:

– EPA R9 provided a guidance memo – First plans due July 2007

• 2011: EPA was sued on approval of South Coast AQMD’s ANP –litigants claimed that South Coast AQMD was not meeting a monitoring requirement

• 2012: – EPA R9 provided an updated guidance memo– EPA developed a new ANP review process which includes a

checklist to serve as the “basis for approval”• 2012 and 2013 ANPs reviewed under new process• Comments/litigation for other ANPs on-going

• CARB plus 21 districts that operate air monitors• We get 14 ANPs for CA agencies• Multiple agencies can be involved in one dataset• Requirements are at local, MSA, state, and PQAO

level– Local: siting– MSA: minimum monitoring requirements– State: background and transport sites– PQAO: collocation requirements

Challenges for CA Agencies

inspection/comment period required prior to submittal to EPA – posted by May 31

• Coordination: Areas with multiple agencies operating sites require coordination and synthesis in advance of May 31– local district with CARB sites in its area – all ANP

information for CARB site(s) should be in district plan

– Local district sites included in CARB plan – all ANP information for local district site(s) should be in CARB plan

• Legal challenges– EPA approvals must be defensible and well-documented– Deficiencies in monitoring operations can result in legal

basis to discount data

• Infrastructure SIPs– requires approvable network of monitoring sites

• Attainment/Non-attainment decisions– Data not collected according to Federal regulations can

result in data not being used for regulatory decisions– Lack of approved network plan can prevent a regulatory

action from moving forward
