B. Siegel Middle School

Principal Kim Stoecker has requested permission to build a 12’x 20’ metal storage building with a concrete slab. This structure will be located inside the practice field fence, in the South West corner. The structure will be similar to one already erected and on site. Siegel will be responsible for applying for all permits and funding provided by

the Siegel Middle Football account. Funds to be available before construction starts. Estimated cost for project is approximately $3,000.00. The concrete slab has been donated. Engineering and Construction has reviewed this project and recommends approval.

Recommend Approval -- motion to approve Siegel Middle School Football 12’x 20’ storage building.

C. Siegel Middle School

Principal Kim Stoecker has requested permission to build a 20’x 66’ addition to the existing baseball building. The building addition will match all existing structures. Appropriate permits will be applied for and funding will be provided by the Siegel Middle School Boosters. All funding to be available prior to starting construction. Estimated budget for this project is $19,000.00. Engineering and Construction has reviewed this project and recommends approval.

Recommend Approval --- motion to approve Siegel Middle School Baseballs 20’x 66’ addition as presented.

D. Blackman Middle School

Engineering and Construction would like to proceed with demolition of the wrestling building that burned. Bids have been solicited for three contractors. Two of those being no bids. Engineering would like to award the demolition to DEMO PLUS for $18,900.00.

Recommend Approval --- motion to approve and award demolition of the Blackman Middle wrestling building to DEMO PLUS for $18,900.00

E. Rocky Fork Elementary

RG Anderson contacted Engineering and Construction to notify us that Waller Masonry, has withdrawn their bid. They have requested to move to the next bidder, RG Masonry. This is an increase in cost of $400,000.00. This increase is within our budget and RG Anderson will still be low bidder. Engineering and Construction has discussed this matter with RG Anderson and recommends adding $200,000.00 to the contract through change order now and the other $200,000.00 be provided through any savings from the project at the end of construction. Should there be no savings, no additional funds will be added.

Recommended Approval --- motion to approve adding $200,000.00 through change order and the balance be funded from project savings, if available. This funding is due to Wallen Masonry withdrawing their bid.

F. Lease from City of Eagleville for Practice Field

The Board of Education had previously leased an area owned by Craig Sewell for a practice field for Eagleville High School under a no rent lease. The City of Eagleville now owns the parcel and is willing to lease it to the Board of Education at no rent. The lease can be terminated by either party upon giving the other 30 days advance written notice. A copy of the proposed lease is attached.

Recommended Approval --- motion to approve the Board of Education to enter into a lease with the City of Eagleville for the practice field in a form approved by the Board attorney Jeff Reed.

5. VISITORS

Senator Bill Ketron presented a RESOLUTION to Mr. Gary Clardy, Assistant Superintendent, who will be retiring from the system on June 30, 2018.

6. JOB DESCRIPTIONS

Motion made by Mr. Hodge, seconded by Mr. Young, to approve new positions for Athletic Trainer Coordinator and a Certified Athletic Trainer.

Vote: All Yes

8. FACILITIES

A. Blackman High School Baseball Restroom/Laundry and Concession Stand

Dr. Leisa Justus, Principal of Blackman High School has submitted a request to add restrooms and a laundry room to the existing baseball building. The addition will be approximately 12’8” by 28”. She has also requested permission to rearrange the seating at the baseball field and add a small 10’8” by 10’8” concession stand. The project will be fully funded by gifts and funds raised by the parents and team.

Dr. Justus submitted the appropriate paper work. Everything appears to be in order and Engineering has checked the site and there are no conflicts. Blackman High will purchase the appropriate permits and meet all state and local codes at no cost to the Board. The estimated total cost is $29,850.00.

Motion made by Mr. Estes, second by Mr. Blair, to approve construction of a baseball building addition and a concession stand as presented at no cost to the Board.

B. Automated Control Systems for Fifteen Schools

Energy Efficiency Schools Initiative has approved a loan in the amount of $1,282,842.00 to install automated energy management systems in the balance of Rutherford County Schools for maximizing energy

efficiency. These buildings include Rockvale Elementary School, Central Magnet School, Siegel High School, Holloway High School, Christiana Elementary School, Christiana Middle School, Central Office Building, Maintenance/Adult Ed Building, Cedar Grove Elementary School, Smyrna Elementary School, Roy Waldron School, Oakland High School, Riverdale High School, Smyrna High School and LaVergne High School.

The loan has a 1% interest rate and a term of 3 years. The simple average payback from savings is 3.33 years which means that we will be putting money back into the budget in 3.33 years. The application, approval and contract is attached under a tab for Board review. This application must be approved and forwarded to the County Commission for approval.

Motion made by Mr. Holladay, seconded by Mr. Young, to approve a loan in the amount of $1,282,842.00 at 1% interest and a term of 3 years from Energy Efficiency Schools Initiative for automated energy management systems. The work will commence once the agreement has made it through the full County Commission and signed by the County Mayor.

C. Right-Of-Way and Easement and Electric Meter Agreement for Atmos Energy Corporation

Mr. Ronnie Sutton of Atmos Energy Corporation forwarded two agreements for Rutherford County School property at Walter Hill. One is a 30’ diameter Right-Of-Way Easement Agreement for the length of ten years at the intersection of Highway 231 and Jefferson Pike where we currently have a pole light and flashing school sign. Atmos wants to install an antenna at the top of a new pole at the same location for their digital metering, etc. They want to replace the pole, reinstall a new parking light and put the flashing school light back up on that pole and change the meter over to their name and pay the electric bill for the parking light, the flashing school light and the antenna for the length of the terms of the agreement. The Electric Meter Agreement gives them permission to put the current service under their name and will repair and maintain the pole and antenna.

Engineering has reviewed the site and location and finds no conflicts or issues with the agreements. Mr. Reed, School Board Attorney, has reviewed the agreements.

Motion made by Mr. Blair, seconded by Mrs. Moore, to approve the Right-Of-Way Easement Agreement and The Electric Meter Agreement for Atomos Energy Corporation as presented.

Vote: All Yes

9. TRANSPORTATION Pursuant to Policy 3.405 Bus Contract award procedures, the potential contractor list for the 2018-2019 school year are presented. These two lists (first priority list is regular bus drivers; second priority list is those contractors who currently own one or more contracts) are for approval to facilitate the awarding of new bus contracts on a timely basis for the beginning of the new school year and thereafter as contracts are turned into the transportation department throughout the year. Motion made by Mr. Holladay, seconded by Mr. Estes, to approve the potential first and second priority lists for the 2018-2019 school year as presented. Vote: All Yes

10. ZONE EXEMPTION APPEAL

Staff Attorney swore in all participants involved in the Zone Exemption Appeal #256. The mother requested that her child be allowed to attend Eagleville School. Motion made by Mr. Blair, seconded by Mr. Hodge, that the request be denied, but the student will remain eligible for a zone exemption if space becomes available. Vote: All Yes

11. PROPOSED SITE ACQUISITION FOR THREE SEPARATE SCHOOL COMPLEXES

Matthew’s Property This property consists of up to 94 acres at $42,500 for a total of $4,000,000. It is located on the eastside just past Jefferson Pike on Highway 231. Soil testing, environmental, wastewater treatment compatibility, and appraisal, etc. will be performed before the Board’s final approval. Mr. Jeff Reed,

Board Attorney will draw up the contract and handle the closing. The Board has toured this property and engineering has done an initial inspection and believes this is a suitable site with proper access to Hwy 231 for a middle and high school.

Proposed Property for South Murfreesboro/Christiana Area

The Board toured two pieces of property in this area at a special called Board Meeting on Saturday, June 16 for a three-school complex. The first piece consisted of 120 acres priced at $18,000 for a total of $2,160,000 and is located with Miller Road to the west and Christiana Hoover Gap Road to the south. The second piece consisted of 120 acres priced at $19,000 for a total of $2,280,000 was bordered by Christiana Road on the southwest and Woodfin Road on the northeast. Both pieces have a few positive and negative characteristics. Mr. Lee is prepared to discuss both properties. Soil testing, environmental, wastewater treatment compatibility, and appraisal, etc. will be performed before the Board’s final approval at a cost of $120,000 for either piece. Mr. Jeff Reed, Board Attorney will draw up the contract and handle the closing.

Hwy 96/Almaville Road/I840 Property

This property consists of up to approximately 113 acres at $32,500 for a total of $3,672,500. It is located with Shores Road to the North, Almaville Road to the west and Hwy 96 to the south. Soil testing, environmental, wastewater treatment compatibility, and appraisal, etc. will be performed before the Board’s final approval. Mr. Jeff Reed, Board Attorney will draw up the contract and handle the closing. The Board has toured this property and engineering has done an initial inspection and believes this is a suitable site with proper school. There was a lengthy discussion and no motion was made on the above suggested properties. However, the following motion was made.

Motion made by Mr. Blair, seconded by Mr. Hodge, to request the county commission to appropriate $10.3 million dollars for the purchase of multiple school sites which would be available to the Board subject to the Board obtaining acceptable prices, terms, and inspection reports.

14. DIRECTOR’S UPDATE

As it was his final School Board meeting as Director of Schools, Mr. Odom took the opportunity to address Board members and thanked them for their various contributions to the school district and for supporting him during his time as Director. He also thanked Board Secretary Joyce Michaels for her vast knowledge and dedication to serving the School Board and the Director.

Mr. Odom also encouraged the Board to remember the following;

- Keep the best interests of students in mind when making a decision.

- Listen to your Director and his recommendations

- The district’s most important asset is its people.

- Mr. Odom referenced Micah 6.8 as his guiding principle and recited it to Board Members.

14. TENNESSEE LEGISLATIVE NETWORK (TLN) UPDATE

Board member Lisa Moore gave a report on the TNReady testing platform. The Tennessee Commissioner of Education has released findings that confirms the testing platform issues were not caused by a cyber attach but rather was the fault of the testing vendor. Specifically, the issue with a text-to-speech option within the testing platform caused the stability issues.

15. FEDERAL RELATIONS NETWORK (FRN) UPDATE

Board member Aaron Holladay reported the Department of Education is pursuing an initiative to reduce the size of the department. In addition, there have been communications from the National School Boards Association to keep everyone informed about proposed reforms for immigrants and how it will affect students from immigrant families within our schools. Lastly, Mr. Holladay gave a report about a new recommendation from the White House to reorganize and combine the U.S. Department of Education and the U.S. Department of Labor.

Transportation 

 

Pursuant to Section 16.1 of the Rutherford County Board of Education Bus Contract, the transportation 

dept. has received a letter dated 6/27/18 from Christopher O’Connell, contractor of bus #187, 

requesting voluntary termination of his contract with the Board. The transportation dept. is prepared to 

award this contract to the next potential contractor on the appropriate contractor list. 

Recommend Approval – motion to approve voluntary termination of the Bus Contract from Christopher 

O’Connell, bus #187, effective as soon as possible.

termination of his contract with the Board. The transportation dept. is prepared to award this contract 

to the next potential contractor on the appropriate contractor list. 

Recommend Approval – motion to approve voluntary termination of the Bus Contract from Roy Gossett, 

bus #74, effective as soon as possible. 

Lease Agreement This agreement is entered on the ____ day of _____________, 2018, between the City of Eagleville (hereinafter “City” or “Lessor”) and the Rutherford County Board of Education (hereinafter “Lessee”). The purpose of the agreement is to lease the property described as the corner of Old Hwy 99 and New Hwy 99, Map 144 Parcel 06002 (hereinafter “Premises”) and as further illustrated on Exhibit A attached hereto. WHEREAS the City has voted and desires to lease the Premises, described above, to Lessee for the period of one (1) year without payment of any rental amount. Lessee for and in consideration of the use shall keep the Premises neatly mowed or bushhogged, clear of brush and/or other obstructions and maintained in a clean, neat and orderly fashion. Any repairs and maintenance of the property connected to Lessee’s use shall be at the sole expense of Lessee. The term of the lease shall automatically renew for an additional one (1) year term unless the parties agree to alter the agreement in writing and signed by both. Lessee shall not make any material alterations to the Premises without the consent of the City. Upon termination of this lease, for any reason, Lessee shall remove any improvements and items it has installed at Lessee’s own expense, unless further agreed to in writing by the Parties. The City shall have the right to enter the leased Premises, with reasonable notice to the Lessee of no less than twelve (12) hours. Lessee shall not sublet or assign the premises in any form, regardless of the City’s consent thereto. Either party shall have the right to terminate the lease described herein, with or without cause, after providing thirty (30) days’ notice to the other, as provided herein. If Lessee fails to maintain the premises, the City shall retain the right to terminate the agreement, if after providing notice of the deficiency, the deficiency is not remedied within ten (10) days. All notices shall be provided to the parties via certified mail, return receipt requested at the following locations:

the Premises. Lessee hereby waives all claims against the City for damages to improvements that are now on or hereafter placed or built on the Premises and to the property of the City. Lessee shall upon termination of the lease promptly return possession of the premises to the City and peaceably surrender the Premises. This lease represents the entirety of the agreement between the parties.
