BOARD OF PROFESSIONAL ENGINEERS AND PROFESSIONAL LAND SURVEYORS Minutes of Meeting The Board of Professional Engineers and Professional Land Surveyors held a regular meeting on September 13 & 14, 2018 at the Division of Building Safety, 1090 E. Watertower St., Ste. 150, Meridian, ID 83642 to conduct Board business. The meeting convened at 8:00 a.m. on Thursday, September 13, 2018 with the following Board members present: John Elle, Glenn Bennett, Raymond Watkins, Dusty Obermayer, and George Murgel. George Wagner joined by telephone. Also present was Keith Simila, Executive Director, Jim Szatkowski, Deputy Director, Tom Judge, Deputy Director and Jennifer Rowe, Administrative Assistant. Minutes of Meeting

The Board of Professional Engineers and Professional Land Surveyors held a regular meeting on September 13 & 14, 2018 at the Division of Building Safety, 1090 E. Watertower St., Ste. 150, Meridian, ID 83642 to conduct Board business. The meeting convened at 8:00 a.m. on Thursday, September 13, 2018 with the following Board members present: John Elle, Glenn Bennett, Raymond Watkins, Dusty Obermayer, and George Murgel. George Wagner joined by telephone. Also present was Keith Simila, Executive Director, Jim Szatkowski, Deputy Director, Tom Judge, Deputy Director and Jennifer Rowe, Administrative Assistant.

David Cotton, PE, PEng. joined the meeting as a representative of the UK Engineering CounciL Dave Clark, PEng of the UK Engineering Council joined the meeting via Skype.

i. AGENDA REVIEW - Are there any new agenda items? A new complaint was filed against a PLS.

Moved by Mr. Elle, seconded by Dr. Murgel to declare an emergency and add this item as New Business #17 as well as authorize a preliminary investigation. Motion passed unanimous! y.

V. CONSIDERATION OF APPLICATIONS

Moved by Mr. Bennett, seconded by Mr. Elle to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Roll call vote results; Mr. Bennett, yes; Mr. Watkins, yes, Mr. Elle, yes; Mr. Wagner, yes; Dr. Murgel, yes, and Mr. Obermayer, yes. After meeting in executive session, the Chairman directed the Board to return to regular session.

Non-Standard - Comity

Moved by Dr. Murgel, seconded by Mr. Elle to approve the following applications for comity licensure:

• Stephen Freiburger for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his licensure in Colorado.

• Thomas Anthony Moore for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his licensure in Kentucky.

The motion passed with Mr. Wagner abstained.

Non-Standard - Faculty

Moved by Dr. Murgel, seconded by Mr. Bennett to approve the application of Daniel Cordon for licensure as a faculty restricted professional engineer. Motion passed with Mr. Wagner abstained.

Non-Standard - Comity

Moved by Mr. Bennett, seconded by Dr. Murgel to approve the application of David Chu for licensure as a professional engineer especially qualified in civil and structural engineering on the basis of comity with his license in the United Kingdom. Motion passed with Mr. Wagner voting against the motion.

Move by Mr. Elle, seconded by Mr. Bennett to continue the application of Andres Heladio Estrada for licensure as a professional land surveyor on the basis of comity with his license in Nevada pending additional documentation. Motion passed with Mr. Wagner abstained.

Moved by Dr. Murgel, seconded by Mr. Bennett to continue the application of Alfred David Sanchez, III for licensure as a professional engineer especially qualified in civil engineering on the basis of passage of the PE exam in Utah pending additional documentation. Motion passed with Mr. Wagner abstained.

Mr. Cotton left the meeting.

III. UNFINISHED BUSINESS

1. Review the Strategic Plan Objectives. A draft of the FY2020 Strategic Plan was provided for review. The Board noted the information and made no changes to the current Strategic Plan.

2. Subcommittee Updates

a. Surveying FAQ (Frequently Asked Questions) Page Subcommittee (Mr. Obermayer, Mr. Bennett and Mr. Elle): The subcommittee reviews changes to the surveying laws and assists staff with updating the Surveying FAQ web page. Mr. Bennett and Mr. Elle are working with Mr. Szatkowski to keep the FAQ current. The Chairman directed the dissolution of the subcommittee.

b. Surveyor Apprenticeship Subcommittee: (Mr. Bennett, Mr. Elle and Mr. Obermayer) Subcommittee to work with the Department of Labor on survey education and apprenticeship program. Mr. Obermayer updated the Board on ISU' s upcoming enrollment.

3. Mr. Szatkowski provided an update to the Board on the 2019 NCEES Western Zone meeting planning. The Board noted the information.

4. Mr. Bennett and Mr. Elle provided an update on ISU & Survey Education. The Board noted the information.

Moved by Mr. Obermayer, seconded by Mr. Bennett to direct the Chairman to send a letter in support of the surveying certificate program. Motion passed unanimously.

5. Comments and adoption of proposed laws/rules.

Moved by Dr. Murgel, seconded by Mr. Elle to adopt the pending rules as presented. Motion passed unanimously.

IV. NEW BUSINESS

16. Safe Harbor rates (Joel Grounds, P.E.) Mr. Grounds joined the meeting and made a presentation to the Board. Mr. Grounds left the meeting. The Board noted the information.

III. UNFINISHED BUSINESS

7. Gratuities FAQ, news bulletin article. The Board noted that the article will be published in the next news bulletin and added to the FAQ.

11. The UK Engineering Council sent a representative to the meeting to evaluate our licensure process. The Board noted this and will wait for documentation from the Council.

12. Mr. Szatkowski provided an update on the complaint against a Lewiston surveyor for unlicensed practice. This matter has been referred to the Attorney General's office. The Board noted that there is no new information in this matter.

IV. NEWBUSINESS

1. Reports by Board Members and Staff of activities since the June meeting.

Mr. Watkins attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; attended a PNWER Summit; participated in an ABET accreditation call with BYU-Idaho; attended an ISPE chapter meeting and responded to emails from licensees. Mr. Elle attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; continued to work on negotiations for disciplinary cases; responded to questions from surveyors and attended a few ISPLS chapter meetings. Mr. Bennett attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; attended the ISPLS Board of Governors and Chapter meetings; continued teaching surveying to students in Idaho City and responded to surveyor questions. Mr. Szatkowski attended the Board Retreat in

Dr. Murgel attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; participated in a conference call relating to a NCEES exam breach; attended a NCEES cut score meeting and a NCEES FE environmental exam meeting. Mr. Wagner attended the Board Retreat in Riggins, ID. Mr. Simila attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; conducted an investigation on avalanche engineering and attended several ACEC-Idaho meetings. Mr. Judge attended the Board Retreat in Riggins, ID; attended the NCEES Annual Meeting; attended the ISPLS Board of Governors meeting and worked on several investigations.

III. UNFINISHED BUSINESS

Attorney Mike Kane joined the meeting.

6. Avalanche engineering update

Moved by Mr. Wagner, seconded by Mr. Bennett to issue an opinion that licensees practice within their area of expertise and that avalanche runout zone determination can be the practice of both engineering and land surveying. The impact pressure determination is practice of engineering. An opinion will be developed and brought back to the board for review at a future meeting. Motion passed unanimously.

8. Unlicensed practice questions. The Board noted the information.

9. Riverbank repair- practice of professional engineering

Moved by Dr. Murgel, seconded by Mr. Elle to send a letter from the Chair indicating that river hydraulic engineering is the practice of engineering. Motion passed unanimously.

10. Right-of-Entry Q&A. The Board noted the information and it will be published on the surveyor FAQ.

IV. NEW BUSINESS

4. Authoritative surveying Q & A. The Board noted the information.

6. Prosecution of non-responsive CPD inquiries - refuse to renew or admin suspension.

Moved by Dr. Murgel, seconded by Mr. Elle to approve rule change as presented. Motion passed unanimously.

IV. NEW BUSINESS

17. Surveyor in Shoshone County request for inquiry.

Moved by Mr. Elle, seconded by Mr. Bennett to authorize a preliminary investigation into this matter. Motion passed unanimously.

2. Staff provided an update on the Board's financial status as of August 31, 2018. The Board noted the information.

3. Staff prepared an Expense Reimbursement Summary for the Executive Director for June 1, 2018 through August 31, 2018 for the Board's review.

Moved by Mr. Obermayer, seconded by Dr. Murgel to approve the expense summary as presented. Motion passed unanimously.

5. Discontinued COA (policy on eligibility) & discontinue retired fee

Moved by Mr. Bennett, seconded by Dr. Murgel to approve the policy as presented. Motion passed unanimously.

7. Easements questions. The Board noted the information and Mr. Judge will write a Q&A for the news bulletin on easements to be reviewed at the November meeting. In addition, Mr. Judge will work to clarify the meaning of professional land boundary survey and bring back at a future board meeting proposed law changes to

Moved by Mr. Obermayer, seconded by Mr. Bennett to send the Executive Director to the APEGBC meeting. Motion passed unanimously.

10. ACEC-Idaho Annual Conference Invitation

Moved by Mr. Bennett, seconded by Mr. Obermayer to send Mr. Watkins and Mr. Simila to the ACEC-Idaho Annual Conference. Motion passed unanimously.

11. The Board meeting scheduled for February 7-8, 2019 conflicts with the NCEES Board Presidents Assembly meeting.

Moved by Mr. Obermayer to move the board meeting to February 19-20, 2019 in Pocatello to coincide with the ISPLS conference and Board of Governors meeting. Motion passed unanimously.

IV. NEW BUSINESS

14. The Executive Director of the Washington Board would like to have the Washington and Idaho Boards meet jointly to consider cross-border issues and matters of mutual concern. He requests that the Idaho Board consider the possibility of a meeting in the Spokane/PostFalls/CdA area and to begin the dialogue necessary to make it happen in the next year or so. He'd really like this conversation to include Oregon but doesn't know if that can happen. The Board

Move by Mr. Obermayer, seconded by Mr. Bennett to approve the application of Gerry Hammond for licensure as a professional land surveyor on the basis of comity with his license in California. Motion passed with Mr. Wagner abstained.

Move by Mr. Obermayer, seconded by Mr. Bennett to continue the application of Joshua Elson for licensure as a professional land surveyor on the basis of comity with his license in California pending additional documentation. Motion passed with Mr. Wagner abstained.

Move by Mr. Bennett, seconded by Mr. Elle to approve the application of Michael Robert Merritt for licensure as a professional land surveyor on the basis of comity with his license in Nevada. Motion passed with Mr. Wagner abstained.
