    Subject: Engagement of 112 workers of various categories of Group “C” & “D” for CMC office-regarding.

    The Medical Officer of Health has awarded contract for the engagement

    of 96 workers of various categories of Group “C” and “D” to M/s Malwa Engineering

    Works due to lowest Administrative Charges i.e. 0.99% for the period of 1 year

    extendable upto 3 years. The said contract period of 1 year has expired on

    15.04.2016. Now the MOH office has get the contract extended from the General

    House in its 228th

    meeting held on 29.2.2016 (Annexure-1) for the extension of

    contract with the same agency on the same terms and conditions and Administrative

    charge for further period of 1 year i.e. upto 15.4.2017.

    As per above said contract, the office of the Commissioner, MCC had

    also engaged 112 workers (i.e. 55 helpers for Enforcement wing, 23 helpers for the

    work in the office of Commissioner, MCC 18 Data Entry Operators and 16 Drivers) for

    the period of 1 year (i.e. 16.4.2015 to 15.4.2016) from M/s Malwa Engineering Works,

    Chandigarh on the same terms and conditions and Administrative Charges. These

    workers were paid salary on D.C. rates from the Contingency head of CMC office on

    the same terms and conditions and Administrative Charges as settled with the MOH

    vide agreement dated 30.4.2015.

    The detail of total expenditure involved to hire these workers is as under:-

  • Now the said period of engagement of workers of 1 year has expired on

    15.4.2016. The Joint CMC-I has pointed out that the contract for engagement of 112

    additional workers on the same Administrative Charges is not reasonable. Hence, to

    hire these 112 workers a new e-tender is required to be floated which will require a

    time of 3 months for finalization. Meanwhile 3 months extension is required to be

    given to the present agency i.e M/s Malwa Engineering works Pvt. Ltd. i.e. from

    16.4.2016 to 15.7.2016.

    The matter is placed before the General House for consideration and its

    recommendation to float afresh e-tender for the engagement of above said 112

    workers of various categories of Group “C” and “D” and grant of extension of 3

    months to M/s Malwa Engineering works Pvt. Ltd. for the supply of 112 workers (i.e.

    from 16.4.2016 to 15.7.2016) on the same terms and conditions and Administrative

    Charges.

    “The House considered & resolved that disposal off 40 booths under New Over Bridge, Sector-17, Chandigarh, be leased out

    for 99 years through open auction for general trades as per

    rates mentioned in Annexure „A‟ which may be taken as reserve price rounded to next higher thousand and on amended terms &

    conditions (copy enclosed).

    Contract for the supply of 96 workers of various categories of Group C & D.

    The Secretary placed agenda item No.7 for consideration.

    The Joint Commissioner-I apprised the House that the work for the supply of 96

    workers of various categories of Group C&D was allotted to M/s Malwa Engineering Works on e-

    tendering @ Rs. 0.99 % administrative charges for one year extendable upto three years. He

    further said that the term of the contract is going to expire on 15.4.2016. he further said that the

    agenda had been brought in the House either the extension should be granted for another one

    year or fresh tender be floated through e-tendering process.

    “The House considered & extended contract for one year i.e. upto 15.4.2017 to M/s Malwa Engineering Works, for the supply of 96 workers of various categories of Group C & D.”

    Hiring of 20 No. of Tractor-trolleys.

    The Secretary placed agenda item No.8 for consideration.

    Sh. Satish Kainth said that when Sanitation Committee was constituted

    under the Chairmanship of Sh. Darshan Garg consisting of Sh. M.P. Kohli, Satish Kainth

    & others. The Committee found that the tarpaulin had not been laid on the tractor

  • trolleys having garbage. He further said that the committee decided to visit Delhi

    Subject: Hiring of 20 No. of Tractor Trolleys.

    An Agenda was placed before the General House in its 228th meeting

    held on 29.2.2016 for floating e-tender for hiring of 20 No. of tractor trolleys and

    extension of the previous contract for one month i.e. upto 30.4.2016 or till the

    tender is finalized whichever is earlier.

    The House considered and approved as under:

    “The House considered and unanimously approved extension for

    hiring of 20 No. of Tractor Trolleys already deployed for lifting of solid

    waste in the Municipal area of Chandigarh till 30.4.2016 or finalization

    of the tender, whichever is earlier.”

    Keeping in view the decision of General House, tender was floated

    through e-tendering process for hiring of 20 No. of Tractor Trolleys on 22.3.2016.

    In response to the tender, 06 bids were received on e-tender website. These bids

    were technically evaluated by the „Technical Evaluation Committee‟. During the

    evaluation, the Technical Committee found that the Condition No. 4 of the DNIT

    relates to the civil/electrical works only which is as under:

  • The firm/bidder should have successfully executed the similar nature

    of work for the last 07 years as per detail given below:

    a) Three similar nature of works of 40% of the required work for one

    year.

    Or

    b) Two similar nature of works of 50% of the requirement work for one

    year.

    or

    c) one similar nature of work of 80% of the requirement work for one

    year.

    Whereas the said tender relates to store/purchase contracts and the

    following criteria is applicable:

    “Prequalifcation/post qualification shall be based entirely upon the

    capability and resources of prospective bidders to perform the particulars

    contract satisifactorily, taking into account their (i) experience and past

    performance on similar contracts for last 2 years (ii) capabilities with

    respect to personnel, equipment and manufacturing facilities (iii) financial

    standing through latest I.T.C.C. Annual Report (Balance sheet and Profit

    and Loss Account) of last 3 years. The quantity, delivery and value

    requirement shall be kept in view, while fixing the PQ criteria, no bidder

  • should be denied prequalification/post qualification for reasons unrelated

    to its capability and resources for successfully perform the contract.”

    The Technical Committee recommended that present tender may be

    scrapped and fresh tender may be floated with the amended DNIT containing the

    above criteria in place of Condition No.4

    Agenda is placed before the General House of Municipal Corporation,

    Chandigarh to allow to float fresh tender with amended condition in the DNIT and

    meantime extension for 3 months of the existing contract i.e. upto 1.5.2016 to

    31.7.2016 on the same terms and conditions.

    Subject: Sanitation contract for outsourcing of areas – regarding.

    An agenda was placed before 227th meeting of Gen. House of the Corporation

    held on 29.01.2016 for approval to float new tenders of outsourced areas for a total 1132 nos.

    of Safaikaramcharis in three groups i.e. Group A, B & C consisting of Villages/Colonies/Sectors

    located in the jurisdiction of Municipal Corporation, Chandigarh and to extend the existing

    contract for a period of three months i.e. 01.02.2016 to 30.04.2016 or till the finalization of new

    tender whichever is earlier.

    And the General House of Municipal Corporation considered and resolved as

    under;

    “General House considered and resolved that the present contract for outsourced

    areas be extended for another three months i.e. from 01.02.2016 to 30.04.2016 on

    existing terms and conditions.

    It was further resolved that before floating the new tender, the requirement of

    manpower be re-assessed and agenda regarding new tender be brought in House

    meeting.”

    Keeping in view the decision of General House, the manpower in the outsourced

    areas has been re-assessed. The re-assessment of the manpower in the whole of the city

  • Chandigarh is also required. The re-assessment of manpower of the whole of the city

    Chandigarh will require more time.

    Keeping in view of above, an agenda is placed before the General House of the

    Corporation to extend existing contracts of outsourced areas on same terms & conditions for

    further three months i.e. w.e.f. 01.05.2016 to 31.07.2016, so that re-assessment of whole of the

    city Chandigarh be done in order to know the exact requirement of Safaikaramcharis in the city

    Chandigarh.

    Subject: Amendment in Service Regulation of Sub Divisional Engineer (Horticulture)

    The Municipal Corporation, Chandigarh notified its own Service Regulation of

    Engineering Wing on 17.8.2012.

    The following are the notified Service Regulations for filling up the post of Sub

    Divisional Engineer (Hort.) by promotion.

    By Promotion(50%)

    Sectional Officer (Hort.)/Horticulture Inspector with 12 years regular service in the grade (including service any, rendered in the grade of Sectional officer (Hort) (Selection Grade and possessing B.Sc. (Agriculture)/B.Sc. (Botany)/B.Sc. (Hort.) of a recognized university or equivalent.

    Or

    Sectional officer (Horticulture) with 10 years regular service in the grade including regular service, if any, as Horticulture Supervisor and possessing Certificate in Garden Training course in Horticulture or Agriculture from a recognized university, Institute or equivalent, provided atleast 8 years regular service should be Sectional Officer (Hort.)

    In the above Service Regulation, the minimum regular service required for the

    degree holder for promotion to the post of SDE(Hort.) is given 12 years & 10 years for non

    degree holders whereas the qualification of degree holders Junior Engineer(Hort.) for promotion

    to the post of SDE(Hort.) should not be more than non degree holders. Therefore, the Service

    Regulation of SDE (Hort.) are required to be amended (Annexure-I).

    The matter is placed before the General House to reconsider the Service

    Regulation for the post of Sub Divisional Engineer (Horticulture). After that the same will be sent

    to Chandigarh Administration for amendment.

    Subject: Special Sanitation Campaign under Swachha Bharat Mission - regarding.

    An agenda regarding engagement of 60 nos. of Safaikaramcharis, 06 nos. of

    Tractor Trolleys and Sanitation material amounting to Rs. 25.25 lacs for special Sanitation

    Campaign under Swachha Bharat Mission was approved for two months by the Gen. House in

    its 227th meeting held on 29.01.2016. Accordingly, the said campaign has been carried out

    w.e.f. 09.03.2016 and is going to expire on 08.05.2016.

    Whereas, there is still requirement to carry out special sanitation campaign under

    Swachha Bharat Mission and 60 nos. of Safaikaramcharis and 06 nos. of Tractor Trolleys are

    further required.

    In view of above, an agenda is placed before the Gen. House of the Corporation

    for granting extension for further two months to the following for special sanitation campaign

    under Swachha Bharat Mission:-

    Subject: Hiring of one inspector and 14 nos. security guards from PESCO for security purpose of MC, Sector-17, Chandigarh Building.

    The office has awarded contract for providing services of 1 Inspector and 14

    Security Guards through PESCO to the MCC w.e.f. 01.08.2013, which is extendable upto three

    years on the same terms and conditions as settled by the MOH on DC rates (revised by the DC

    from time to time) and allied charges with the approval of the F & CC for security of MCC

    Building. The present contract for Security is upto 31.07.2016. The services of Security

    Guards alongwith Inspector are required for the security of MCC Building and its assets round

    the clock. The per man per month cost is Rs. 19408/- for Security Guard and Rs.32,376/- for

    Inspector as per D.C rates revised from time to time (as per Annexure „A‟). The rates are for 08

    hours duty per individual. The tentative expenditure for the same would be approximately Rs.33

    lacs for the financial year 2016-17 and the provision for expenditure has already been made in

    the budget for the financial year 2016-17.

    The matter is placed before the General House of Corporation for awarding the

    contract to PESCO for providing the services of One Inspector and 14 Security Guards for the

    Security of New Deluxe Building, MC, Sector-17, Chandigarh initially for a period of one year

    from 01.08.2016 to 31.07.2017 on DC rates as revised from time to time and allied charges (as

    per Annexure „A‟).

    Subject: Amendment required in the Policy/ guidelines approved for the management

    of Community Centres/ Janj Ghar by the General House in its 189th meeting

    held on 30.01.2013 for smooth functioning.

    The following points/amendments are required to be considered and decided by

    the General House of MC Chandigarh:

    a) During the gap period between the expiration of tenure of Executive Committee and re-

    constitution of Executive Committee of the respective Community Centres, the

    Commissioner, MCC may authorise to any officer/official of the MCC to exercise the power

    of the Executive Committee.

    b) The day to day expenditure for maintaining the Community Centre like purchasing of broom,

    phenol, repair/change of water tap / bulb/ tube light etc. upto maximum of Rs. 5,000/- per

    month may be done by the Executive Committee from the joint account by following the

    GFR.

    c) All the expenditure made from the joint account of the respective Community Centres shall

    be placed before the Executive Committee every quarter.

    d) Election for the executive Committee in the villages /rehabilitation colonies under the jurisdiction of MC, Chandigarh:-The election to the post of President, Vice President, Secretary, 3 members of Executive

    Committee shall be conducted by the MCC on the recommendation received from

    Chairperson and official Executive members. There shall be minimum 25 member of the

    Community Centres are required for conducting the elections of Executive Committee of

    respective Community Centre.

    e) Proposal for constitution of executive committee for all other community centres where there is no executive committee.

    The above said Executive Committee will remain in existence till an Executive committee is

    formed as per the guide lines approved by the General House of Municipal Corporation

    Financial power:-

    The area Executive Engineer of Road Wing may authorise to any officer/official of the MCC to

    exercise the power of the Executive Committee.

    NOTE:

    This executive committee will work as per the approved guide lines of the General house.

    f) Functioning of Gym in Community centres:-

    i) Maintenance and operation of gym is a technical issue with health concern. Initiative should

    be taken to get gym installed, operated and maintained by private parties on the commercial

    basis. The Commissioner, Municipal Corporation, Chandigarh may be authorised to explore

    such opportunities and take appropriate action.

    ii) In Community centres where gym is maintained and operated by private parties, the members

    of the Community Centre should be allowed to use the gym at concession rates.

    The above points/amendments are placed before the General House for its consideration

    and approval.

    Subject: P/L 40mm thick bituminous concrete on V-5 road in Sector 33 A, B, C & D,

    Chandigarh.

    (Amount: Rs. 84.47 Lac)

    On the request of area councillor the V-5 road in Sector 33 A, B, C & D inspected by the undersigned alongwith Sub Divisional Engineer, Roads Sub Division No.1, M.C. Chandigarh and it was observed that lot of cracks & pot holes have developed on the road surface. These roads were last carpeted in the year 11.7.2011.

    Accordingly, the rough cost estimate amounting to Rs.84.47 lac has been framed by including the following scope of work.

    1. Dismantling of existing kerbs/channels. 2. P/A tack coat 3 kg/10 sqm. 3. P/L 40mm thick bituminous concrete. 4. Fixing of old PCC kerbs/channels. 5. P/F PCC kerbs of size 2`-0” x 9” having 4” thickness. 6. P/F PCC channels of size 2`-0” x 1` having 3” thickness.

    The scope of work taken in the estimate has not been included in any other already approved estimate, amount of already approved estimates and expenditure under this Head for Roads Division No.1 is as under:-

    I. Budget Allocation : Rs. 1600.00 lac. II. Total amount of spillover works 31.03.2015 : Rs. 2602.04 lac.

    III. Total amount of estimate sanctioned after 1.4.2015 : Rs. 653.52 lac. IV. Total of Sr. No. II & III : Rs. 3255.56 lac. V. Expenditure incurred during current financial year : Rs. 1094.28 lac.

    The matter is placed before the General House of the Municipal Corporation,

    Chandigarh for consideration and approval please.
