The Uptown Plan, approved in 2002, is an amendment to the City's 1996 Comprehensive Plan. The Uptown Plan provides recommendations for the area known as the Uptown Core, where the property is located. In summary, the recommendations for this area indicate that retail, restaurant and entertainment uses should be located on the ground floors of buildings. Pedestrian-oriented commercial, service and office uses should also be permitted on the ground floors. The proposed hair salon would be considered a pedestrian-oriented commercial use, as it would include moderate customer traffic. ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARK RIDGE GRANTING A SPECIAL USE FOR

124 South Prospect A venue

WHEREAS, the Planning and Zoning Commission of the City of Park Ridge has received an application for a special use, Zoning Case Number SU-13-02, on property hereinafter described; and

WHEREAS, the Planning and Zoning Commission, in accordance with the Zoning Ordinance of the City of Park Ridge has held a public hearing on May 14, 2013 to consider the application for a special use; and

WHEREAS, the Planning and Zoning Commission has made findings of fact in support of granting the special use and has recommended to the City Council of the City of Park Ridge that the special use be granted.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Park Ridge as follows:

SECTION 1 ; The Mayor and the City Council approve and adopt the findings and recommendation of the Planning and Zoning Commission and incorporate such findings and recommendation herein by reference as ifthey were fully set forth herein.

SECTION 2; A special use permit is hereby granted to allow a ground floor personal service use, hair salon, in the B-4, Uptown Core District, for the following described property:

Introduction Niko Zafiriadis, applicant, requests a special use to allow a personal service establishment on the ground floor of the B-4 Uptown Business District -Uptown Core Subdistrict at 124 South Prospect Avenue, in accordance with the special use provisions in Section 4.6 of the Zoning Ordinance.

Notification requirements for this application have been satisfied. A legal notice for the public hearing was published in the Park Ridge Herald-Advocate. A sign was posted on the property. Neighboring properties were notified by mail.

Information Submitted by the Applicant The applicant requests a special use to allow a personal services establishment on the ground floor of a property located in the B-4 Uptown Business District - Uptown Core Subdistrict. The applicant plans to locate a salon within the multiple tenant building at 124 South Prospect Avenue. The entire property is 7,000 square feet and contains a one-story building at approximately 3,750 square feet. The existing tenant space is approximately 1,250 square feet. The applicant plans to remodel the tenant space within the building for a salon use. The salon would be separated into five workstation areas, and would include restroom facilities. The specific space is currently vacant and was most recently occupied by a bakery. A dental office is located adjacent to the space in the other tenant space of the building. There are currently

eight parking spaces on the property located behind the building. Street parking adjacent to the front of the building is also available. Ingress and egress to the parking areas is off the alley along the northwest side of the building. The existing refuse storage area would remain behind the building off the alley.

An analysis of utilities, stormwater drainage plans, traffic circulation and traffic generation, and parking was not submitted with the application. The intensity of this personal services use would be similar to the previous use and is not expected to increase the impact on utilities or stormwater. Traffic circulation and generation would be similar to the previous use. There would be a moderate amount of pedestrian traffic in and out of the building.

Staff Analysis Staff reviewed the proposal in accordance with the Uptown Plan and the Zoning Ordinance.

Uptown Plan The Uptown Plan, approved in 2002, is an amendment to the City's 1996 Comprehensive Plan. In summary, the recommendations for this area indicate that retail, restaurant and entertainment uses should be located on the ground floors of buildings. The proposed hair salon would be considered a pedestrian-oriented commercial use, as it would include moderate customer traffic. B-4 Uptown Business District, Uptown Core Subdistrict The proposed special use would satisfy all the requirements of the B-4 District - Uptown Core Subdistrict. The salon is considered a personal services establishment, which requires a special use if located on the ground floor. No work is planned on the exterior of the structure.

Site Design No changes are planned to the exterior of the building, site or parking area. The impact from the proposed personal service use is expected to be equal to the previous use in the same unit. The building exterior and interior are currently designed for commercial uses on the ground floor. The front fayade of the building along Prospect A venue has large windows typical of a retail storefront. The other current tenant has similar Prospect A venue window frontage. The applicant plans to remodel only the interior of the tenant space for the proposed use.

Signs The applicant is not requesting exterior signs for the proposed use at this time. Any wall signs would be required to be reviewed and approved by the Appearance Commission.

Landscaping and Screening No landscaping or screening (Section 13) is required for the property. The applicant does not plan on making changes to the exterior of the building or to the parking areas.

Traffic Circulation Traffic is expected to be minimal at the site and no more than the previous use. The use would generate a mix of pedestrian and vehicular traffic.

Off-Street Parking Off-street parking required for a personal services use is two spaces per 1,000 square feet. By contrast, off-street parking required for a retail use is three spaces per 1,000 square feet, and off-street parking

required for a professional office use is four spaces per 1,000 square feet (Section 12.13, Table 9). The property contains eight overall spaces located at the rear of the property behind the building. One space is reserved for handicapped use.

The tenant space for the salon is approximately 1,250 square feet. Section 12.13.B. states for those businesses of 1 ,000 square feet or more which are located in the B-4 District, only the area above the first 1,000 square feet shall be used to calculate the required off-street parking. Therefore, one parking space would be required for the proposed use. The dental office is required to have three spaces, so the parking area behind the building would be sufficient for both uses. Section 12.13.C. of the Zoning Ordinance further states that parking spaces located in front of the building in the B-4 District may be counted towards overall parking counts. There is one parking space located on the street that is in front of the building that could be counted as an additional space.

Other Department Reviews The City Engineer expects no increased impact on utilities, stormwater, traffic or parking from this use, as it is similar to the previous use that was at the site. Further review will be required as part of the building permit process.

Commission Review and Action The Commission should review the standards for special uses and determine if the proposed use satisfies the findings of fact for special uses (Section 4.6.E.l).

The Commission may decide to recommend approval, approval with conditions, or recommend denial to the City Council to allow a special use for a personal services establishment on the ground floor of the B-4 Uptown Business District - Uptown Core Subdistrict at 124 South Prospect Avenue, Zoning Case Number SU-13-02.

This location is 1 ,250 sq. ft and will be divided into five studios. Four studios will be providing hair services and one will be providing esthetic services.

Three of the hair studios will be approx. 12ft by 1Oft. One hair studio will be approx. 12ft by 12ft, and the esthetics room will be approx. 12ft by 11ft.

It was moved by Commissioner Bennett, and seconded by Commissioner Kocisko, that the minutes of the meetings held on March 26, 2013, April 16, 2013, and April 23, 2013, be approved as submitted. The Commissioners, by voice vote, approved the minutes.

Commissioners Abella-Austriaco and Argionis arrived after the minutes were approved.

Planning and Zoning Commission Minutes May 14,2013

1. Case Number SU-13-02: Special Use for Ground floor Personal Service Use (Hair Salon) in the B-4 - Uptown Core District at 124 South Prospect Avenue

Jon Branham summarized the staff report dated May 14, 2013. He stated that the Niko Zafiriadis, applicant, requests a special use to allow a personal service establishment on the ground floor of the B-4 Uptown Business District- Uptown Core Subdistrict at 124 South Prospect Avenue. He highlighted the fact that the proposal is in accordance with the Uptown Plan and that there was sufficient parking for the salon.

Commissioner Zamaites questioned the applicant on the design of the "studios" mentioned in the report.

Mr. Zafiriadis, 327 Cherry Court, Glenview, IL stated that the salon would include 5 small rooms or "studios", four for hair salons and one for skin care. He noted that the rooms would be enclosed. There would be no reception area or receptionist and the rooms would be "rented" to other hair care professionals. The first station, which Mr. Zafiriadis would use has a window that would make that studio visible to the street. The doors would be controlled by a buzzer to let the customers in.

Commissioner Bennett questioned whether the studios would be enclosed and Mr. Zafiriadis responded yes, each studio would have a locking door. Commissioner Bennett questioned if this could be considered subdividing the space and if any fire codes would be violated.

Jon Branham noted that the plans would have to be approved by the Fire Department, but that the design would not effect zoning or parking requirements.

Dr. Ross Rubino,_ owner of the property, stated that he had owned the building for 16 years and that it had been used by a financial advisor who also used the rooms for separate meeting rooms. He voiced his support of the proposal.

No other residents testified in this matter.

On a motion by Commissioner Bennett, seconded by Commissioner Kocisko, the Commission voted unanimously to close the public hearing.

The Commissioners discussed the proposal and agreed that this was a good use for the space.

On a motion by Commissioner Abella-Austriaco, seconded by Commissioner Bennett;

The Commission AGREED to recommend City Council Approval to allow a special use for a personal services establishment on the ground floor of the B-4 Uptown Business District - Uptown Core Subdistrict at 124 South Prospect Avenue, Zoning Case Number SU-13-02, as submitted. The applicant shall be required to satisfy all requirements for landscaping and screening in Section 13 of the Zoning Ordinance.

The Commission AGREED to continue Case Number TA-13-02: Text Amendments to Section 14 (Signs), Section 16: (Definitions) and Section 4 (Applications and Approval Process) to the June 11, 2013 meeting of the Planning and Zoning Commission.

Vote on the motion was as follows:

The Commission having held a public hearing on May 14, 2013, as required by law, and having heard evidence on the matter, based on the evidence presented, as reflected in the minutes of these proceedings, and for the reasons indicated in the minutes of this Commission in this case.

The Planning and Zoning Commission finds that the following facts have been established:

1. The proposed Special Use will accommodate a business that would occupy a vacant property in the Uptown area. It will generate foot traffic and provide a service to the residents of Park Ridge.

Therefore, the establishment, maintenance, and operation of the special use in the location proposed will not endanger the health, safety, morals or general welfare of the city.

2. The proposed business will also contain a retail component and would be in accordance with the Uptown Plan, which recommends pedestrian-oriented commercial, service, retail, restaurant and entertainment uses.

Therefore, the special use will be compatible with adjacent and nearby properties.

3. The proposed business would be consistent with the spirit and intent of the Zoning Ordinance and not impact the traffic or parking at this location.

Therefore, the special use is expected to be consistent with the spirit and intent of the Zoning Ordinance.

Therefore, the Commission recommends that the City Council approve the special use ordinance, as requested, Zoning Case Number SU-13-02, on the terms and conditions set forth in the meeting minutes of May 14, 2013.
