Approval For discussion Feedback requested For your information Staff Contact: Shawn Hamilton, Acting City Manager Phone Number: 847/318-5206 Email Address: [email protected] Background: On August 16, 2010, Steven Taber of Taber Law Group of Irvine, California, presented to the City Council his memorandum of options for Park Ridge related to noise and air quality issues created by the expansion of O’Hare International Airport. On March 7, 2011, the City Council approved an amount not to exceed $2,400 for Mr. Taber to send a request to the Federal Aviation Administration (FAA) for a supplemental Environmental Impact Study (SEIS) on behalf of Park Ridge. On May 25, 2011, the City received notification of Taber Law Group’s withdrawal from representation of the City of Park Ridge in relation to any matter concerning the O’Hare Modernization Program. There was no charge for services or advice already rendered. The City then contracted with Hinshaw & Culbertson LLP in Rockford, Illinois, who agreed to send a request to the FAA on behalf of Park Ridge for an SEIS, and accept the payment already approved by the City Council. This request was sent to the FAA on October 25, 2011. On February 23, 2012, the FAA responded with a 10-page letter stating that, “the FAA has not been provided sufficient information to warrant the preparation of a supplement to the O’Hare Modernization Final Environmental Impact Statement (FEIS).” On March 20, 2012, Hinshaw & Culbertson LLP provided to the O’Hare Airport Commission an outline of the “FAA’s omissions to air quality impacts” and recommended drafting a response to the FAA’s February 23, 2012 letter in order to address the issues that the FAA failed to address in its letter (a copy of Hinshaw & Culbertson LLP’s March 20, 2012 letter is attached). The FAA also ignored Park Ridge’s request for a meeting with the FAA to discuss the environmental issues relating to Park Ridge. Additionally, contrary to what was shown in the EIS, there will now be a 65-acre site on the northeast side of the airport (the old military installation), which will hold five cargo buildings of varying sizes, mostly in the hundreds of thousands of square feet per building. This development may also support a request for an SEIS as the size of the facility and proximity to Park Ridge may produce significant noise and emissions impacts. Hinshaw & Culbertson LLP has agreed to draft a response to the February 23, 2012 FAA letter on behalf of the City to address the issues ignored by the FAA and, where possible, to include the cargo facility plans to protest the denial for an SEIS to the Director of the FAA. Such a response letter on behalf of the City is directed at receiving a substantive and complete response to the environmental impact issues set forth in the City’s October 25, 2011 letter to the FAA in hopes of obtaining an SEIS to assess the current environmental impact on air quality over Park Ridge given the changed circumstances that have occurred since the outdated 2005 EIS. At a minimum, the response should assist in obtaining a formal meeting

with the FAA (as was requested in the City’s October 25, 2011 letter but ignored in the FAA’s February 23, 2012 response) to address Park Ridge’s concerns and to open a dialogue with the FAA to address those concerns going forward. The Committee of the Whole approved this request at its July 9, 2012 meeting with the caveat it not exceed $2,100. The City Council approved the request on July 16, 2012. The law firm of Hinshaw & Culbertson LLP has completed the draft response. The O’Hare Airport Commission reviewed this at its September 19, 2012 meeting and is in favor of its being sent to the FAA. Recommendation: Approve the response letter to FAA’s February 23, 2012 letter relating to Park Ridge’s October 25, 2011 request for a supplemental Environmental Impact Study. Budget Implications:

Mr. Porter's environmental practice includes experience with CERCLA, NEPA, RCRA, Clean Air Act, Clean Water Acts, Phase I and II reports, TACO program, Brownfields programs, NPDES permitting, environmental impact studies, Superfund litigation, underground storage tanks, toxic tort actions, indoor air quality, asbestos abatement and solid waste management. Mr. Porter has represented businesses, municipal entities and individuals in personal and enforcement actions, and responds to and defends against violation notices from the EPA, the IEPA, and the Office of State Fire Marshall. He counsels business entities of all sizes on environmental regulation, helping them audit their compliance, and consulting with them on environmental policy in their ongoing operations.

He also represents business clients in contested environmental matters, defending their interests in government compliance and enforcement actions, helping them secure necessary permits and approvals, and handling private contractual disputes over such issues as environmental indemnity/hold harmless clauses.

Mr. Helsten has appeared on behalf of clients before numerous federal, state and local regulatory agencies, tribunals and courts. He has also served as Defendant’s Group liaison counsel and as Steering Committee Chairman at various Superfund sites.

Representative Cases Mr. Helsten holds several important environmental regulatory positions in Illinois local and state government. He serves as Special States Attorney for Environmental Compliance and Enforcement Matters for numerous counties in Illinois. In addition, Mr. Helsten is also Special Counsel to many municipalities in Illinois on environmental matters.

He is a former Special Assistant Attorney General on Environmental Matters with the Illinois Department of Transportation and the Illinois State Toll Highway Authority.

Professional Background Mr. Helsten joined Hinshaw & Culbertson LLP in January 1985. He is the Leader of the firm’s Environmental Practice Group, and was a member of the firm’s Executive Committee from 2006 to 2009.
