The Maryland Department of the Environ-ment (MDE) has instituted a new citizen com-plaint number for reporting of environmentalemergencies and complaints. Citizens can nowcall 1-866-MDE-GOTO (1-866-633-4686). Thisnumber will provide citizens a single number tocall 24 hours a day to report chemical and oilspills or report emergencies or unusual eventswhich have the potential to present threats topublic health or the environment.

In the past, MDE has used several different

The general daytime information numberfor MDE will remain 1-800-633-6101, as will thecurrent Water Management Administration’sdaytime numbers for reporting of water pollu-tion concerns (410-537-3510) and drinking wa-ter concerns (410-537-3702).

Preserving and protecting our en-vironment remains a top priority, and Iam confident Richard will be an out-standing secretary as we work to buildon the environmental accomplish-ments that have made Maryland a na-tional leader.”

Prior to his appointment, Pecoraserved as the deputy secretary at theMaryland Department of General Ser-vices. Pecora, who is no stranger toMDE, acted as the assistant secre-tary for operations at the agency from1987 to 1991.

As secretary of MDE, Pecora di-rects all aspects of pollution preven-tion, environmental regulation and en-vironmental enforcement in Maryland.Programs under MDE include air qual-ity control of stationary and mobilesources, management of hazardousand solid waste, oil control, regula-tion of wastewater discharges andpublic drinking water, wetlands protec-tion, environmental risk assessmentand financial assistance for environ-mental restoration. Secretary Pecoraadministers a combined operating andcapital budget of approximately $250million and manages a diverse staff ofscientists, engineers, lawyers andother professionals.

“I’ve been involved in the envi-ronmental, along with the civil rightsmovement, since the sixties,” the Bal-timore native said. “I wasn’t 50 in thesixties. Preservation of our strengths— our environment and our racial di-versity — both have the same under-pinnings intellectually and both are theright thing to do.”

While at the University of BaltimoreSchool of Law in the late ‘60s, Pecorawas among a group that fought plansto build a road through Gwynns Fallsand Leakin Parks on Baltimore’swest side, which would have hadmajor impact on many neighbor-hoods and the Gwynns Falls. Thatmovement led to the founding ofVolunteers Opposed to the LeakinPark Expressway (VOLPE) wherehe assumed the role of president.VOLPE, the Sierra Club and the

then Legal Defense Fund filed a fed-eral lawsuit that led to the demiseof the roadway, but resulted in masstransit railways being constructedfrom the Mondawmin section of thecity west to Reisterstown. Pecorais still active in VOLPE that contin-ues to own 13 acres of inner citywoodlands. He is also active in wa-ter quality improvements as a mem-ber of Manasota 88, an organizationworking to encourage environmen-tal change in the watersheds ofTampa and Sarasota bays in Florida,where he owns a seasonal home.

“I’d like the stakeholder groups toknow I’ve done this before, ” Pecorasaid citing his enforcement activi-ties associated with the Fager’s Is-land project while working as theDistrict Trial Counsel and DeputyDistrict Counsel at the U.S. ArmyCorps of Engineers, Baltimore Dis-trict, from 1982 to 1987. The wet-lands and bridge at that popularOcean City destination were theresolution to what could have beena marina and a hotel, the secretarysaid.

“So I’d like the community to know,I come here prepared,” the 1967 Uni-versity of Maryland graduate said.

“This administration and depart-ment have set a high water mark interms of environmental protection.This has been a good departmentlong before that. I hit the ground run-ning. I’m ready and willing to do what

my role calls for me to do. But Iwould ask that you not look for radi-cal change in this department un-der my tutelage. I am hands on. Youwill feel me, but the leadership wehave here is good leadership and I’mcommitted to helping them do theirjob without making some crazychanges after much success.

“I want the environmental commu-nity, the business community andthe citizenry in general to be awarethat they will get a fair hearing infront of me,” he added. “I’m amenableto input. I do practice an open doorpolicy and that includes personnel.”

When asked about the future ofenv i ronmenta l i ssues and thepublic’s support of them, Pecoraresponded, “It does look like thepublic is becoming a little morelaissez-faire compared to whengroups like the Chesapeake BayFoundation blossomed. I don’t thinkpeople have lost their desire. I justthink they have become a little com-placent.

“In tough economic circumstance,which we seem to be in right now,sometimes the first thing to go arethe good socio-economic policies infavor of the bread basket issues,”he explained. “But we can’t forgetthat the breadbasket is dependenton a good environment. It’s our jobto do what’s right regardless of anyperceived public slipping [on theenvironment] and at the same timewe have an education responsibil-ity. That’s why so many of us hereat the department have roles thatare a merge of technical and con-scious raising. People want to dothe right thing. They just need to bereminded what it is.”

Among other duties, SecretaryPecora serves on the Governor’sCabinet and is a member of theGovernor’s Chesapeake Bay andSmart Growth Sub-Cabinets. Healso serves on the Ozone TransportCommission, the Appalachian LowLevel Radioactive Waste Commis-sion and is a member of the Envi-ronmental Council of States andCouncil of State Government.

Q. How can my business conserve water?A. Many businesses are more concerned

about saving water because of the drought andthe mandatory restrictions on certain activities.However it is important for businesses to con-serve water all of the time. Water conservationefforts can save businesses money over thelong term.

There are some simple steps that can be takenby almost any type of business to reduce wateruse. The first step is to make sure all employeesare aware both of the need to conserve waterand the desire for them to do so. A contest canbe held for employees to come up with conser-vation ideas or slogans and posting signs re-minding them to conserve.

Business owners and managers shouldevaluate how the company uses water so thebest ways to conserve can be determined —which means taking water meter readings on aregular basis. Depending on how much waterthe business uses, use of monthly records maybe possible or breaking usage down in to weeklyor even daily records may be necessary.

Make sure there are no leaks in the existingwater system. Repairing a leaking faucet or pipewill save water and money without requiring achange in operations. Of course there is muchmore to a water conservation plan than check-ing for leaks.

Start by looking at the parts of the operationthat use the most water because that is whereyou may be able to find the biggest savings.One suggestion to conserve is to find ways toreuse water that is currently going down thedrain. An electroplating operation, for example,may be able to reuse the final rinse water in theinitial rinse tank or a cafeteria may be able to usethe water from steam tables to wipe downcounter tops. Another way to conserve is touse water only when necessary. Use brooms topick up solids instead of washing them downthe drain or reduce the frequency of vehiclewashing.

The changes youmake now will save money while helping toreduce environmental impacts by reducing wa-ter withdrawals and discharges.

Gov. Parris N. Glendening and environ-mental officials signed a partnership agree-ment Sept. 25 with representatives of theDepartment of Defense and federal installa-tions in Maryland to promote pollution pre-vention measures at federal facilities. Theprincipal goal of the partnership is to protectthe environmental resources in Maryland byusing pollution prevention techniques andby pooling resources to identify and imple-ment solutions to environmental problems.

“Preventing pollution before it starts is byfar a much better strategy for environmentalprotection and resource conservation thanthe traditional methods of treating dis-charges,” Glendening said. “This partner-ship will jointly strengthen the abilities ofeach individual partner facility to take posi-tive steps that can improve the quality ofMaryland’s environment and preserve ourprecious natural resources.”

“Department of Defense installations al-ways have been, and always will be, integralparts of the communities that surroundthem,” said Rear Admiral David Architzel,Commander, Navy Region Mid-Atlantic andDepartment of Defense Regional Environ-mental Coordinator for EPA Region 3. “Wetake pride in our relationships with local com-munities and view this partnership as a fur-ther indication of our commitment to the citi-zens and environment of Maryland.”

The basic approach of pollution preven-tion environmental management strategiesis to identify opportunities where the amountof pollutants entering the environment canbe reduced or eliminated entirely. The use ofnon-harmful materials and environmentallysensitive work practices are emphasized.

larly to provide a forum to share ideas anddiscuss regulatory and technological devel-opments in the area of pollution prevention,which is known as P2. Participating in theexchange will be environmental managersfrom defense installations, and state and fed-eral regulators who are committed to achiev-ing measurable environmental improvementsby improving communications betweenthemselves, providing training and educa-tional opportunities and undertaking inno-vative and cooperative P2 projects.

Representatives from 20 federal facilities inMaryland signed the partnership charter alongwith the U.S. Environmental Protection Agencyand the Maryland Department of the Environ-ment (MDE).

“EPA is glad to partner in preventing pol-lution prevention at military bases in Mary-land. In Benjamin Franklin’s words — anounce of prevention is worth a pound ofcure,” said Donald S. Welsh, EPA Mid-At-lantic regional administrator.

“We anticipate seeing significantly mea-surable and sustainable environmental im-provements,” said MDE Secretary RichardF. Pecora. “No one agency or facility canwork on its own and expect to achieve wide-spread results. It is only through partner-ships like this one, where everyone is work-ing together toward the same environmentalgoal — sharing resources and knowledgewith each other — that we can hope toachieve these improvements.”

ing its seventh month of drier than normalconditions with forecasts predicting nor-mal to below normal precipitation throughthe winter. Central and eastern portions ofthe state remain in a drought emergencywith various mandatory water use restric-tions in effect, while Southern Marylandis in warning phase.

Groundwater continues to set record lowlevels in the central region. The recentabove normal rainfall has had little effecton ground water levels. All four wells theMaryland Department of the Environmentevaluates were at record low levels for thistime of year. Three of the four wells set alltime record lows. On the Eastern Shore,ground water levels showed some benefitfrom the recent rainfall with one well withinthe range of normal and another two wellsin the watch range. However the SomersetCounty monitoring well is at an all timerecord low.

Reservoir storage has declined in theBaltimore City, Cumberland, Washington

Suburban Sanitary Commission (WSSC)and Potomac reservoir systems. Reservoirsin the western region have over 300 daysof storage remaining. Storage in the LochRaven/Prettyboy system has declined to49 percent of available storage and is esti-mated to be sufficient for about 105 days,not considering the continued use of theSusquehanna pipeline. Storage in WSSC’sPatuxent reservoirs has declined to 44 per-cent or about enough for 100 days of opera-tion.

To remind Marylanders of the serious needto conserve water, the Maryland Departmentof the Environment has sponsored a seriesof drought messages during Metro Networksnews and traffic reports heard on major radiostations throughout the Baltimore region.

Marina pledges to keep cleanInner Harbor Marina in Baltimore re-

cently vowed to take measures to protectMaryland’s waterways. By signing theClean Marina Pledge, owner Kenneth Wil-son and manager Stephen McBride havecommitted to do their part to keepMaryland’s waterways free of harmfulchemicals, excess nutrients and debris. ment (MDE) is committed to providing qual-ity service to the MDE’s regulated commu-nity to more effectively achieve Maryland’spublic health and environmental protectiongoals while fostering economic development.

The department has implemented a num-ber of regulatory reforms and permit stream-lining activities such as: Standardizing andreducing permit turnaround times, implement-ing and expanding “One-Stop” services inthe Environmental Permits Service Center,providing compli-ance assistance toMaryland’s smallbusiness commu-nity, standardizingand reducing thenumber of forms,developing newgeneral permits,posting the Busi-ness Guide to Envi-ronmental Permitsand Approvals onthe Internet, and posting permit applicationforms and instructions on the Internet. Thedepartment is continually seeking opportu-nities to implement additional innovativepermit streamlining and regulatory reforminitiatives.

The department is also committed to anopen dialogue with all Maryland citizens,local governments, business and environ-mental communities to develop effective so-lutions to Maryland’s environmental andbusiness challenges. The agency believesthat we must build partnerships and workcooperatively to protect the environment,foster sustainable economic growth and im-prove the quality of life for all Marylanders.

As part of the effort to improve servicesto permitting customers in December 1996,MDE established and published standardpermit review times for all MDE permits, li-censes and certifications. Every year MDErevisits the permit turnaround standards inconsultation with businesses and other in-terested parties. MDE’s expected reviewtimes are published annually in compliancewith §1-607 of the Environment Article. Aspart of this iterative process, public commentis being solicited again this year and the stan-dards may again be revised for calendar year2003.

The adjoining table illustrates thedepartment’s success at meeting its standardpermit application review times from Jan. 1 toDec. 31, 2001. In most permitting programs,each application has unique characteristicsthat influence its processing time. For eachprogram, the standard represents the time inwhich 90 percent of applications can be pro-cessed. MDE met this goal, issuing 91 per-cent of its permits within the applicable stan-dard times. Many applications will requireless time; a few will require more time due tounusual circumstances.

It is interesting to note that many of MDE’s

permits are issued in less than 30 days. In2001, the department issued more than 79percent of its permits in 30 days or less.

The department is committed to providingsuperior customer assistance to our permit-ting customers and offers the following fivetypes of assistance to applicants for everytype of permit, license, and certification.

1) Pre-application meetings with pro-spective applicants to address technical is-sues;

2) Written receipts documenting ap-plication submission;

3) Information on application status;4) Written lists of common applica-

tion questions and mistakes; and5) Written lists of information and

materials required with applications.

MDE also publishes and distributes aBusiness Guide to Environmental Permitsand Approvals (Permit Guide). The permitguide provides detailed information abouteach of MDE’s permits, such as the purposeof the permit, the permit requirements, thepermit application process, the standard turn-around time, the term of certification, the per-mit fee and the contact for further informa-tion and assistance if needed. The permitguide is also available on MDE’s website at:www.mde.state.md.us/permit.

In addition, MDE has developed generalpermits to enable businesses to acquire en-vironmentally sound permits more quickly.General permits streamline the environmen-tal permitting process by eliminating the needfor individual permits that require morelengthy review procedures.

General permits are developed, with inputfrom interested stakeholders, for types ofbusinesses whose activities pose a relativelylow level of risk to the environment, whoseactivities are similar across the group andproduce similar types of pollutant discharges.General permits provide a way for MDE todeliver superior customer service to busi-nesses while ensuring that the environmentand public health of Maryland are fully pro-tected.

Once the general permit is issued, eligiblefacilities obtain coverage under the permitusually in less than 30 days. MDE addedtwo new general permits in the last year bring-ing the current total to 18 and will continueto evaluate additional opportunities tostreamline in this area.

As mentioned above, MDE’s standard

permit application turnaround times are up-dated annually in consultation with busi-nesses, environmental advocates and otherinterested stakeholders. Following on Page5 are the proposed calendar year 2003 stan-dard permit application turnaround times.

MDE is implementing an EPA-approvedplan that will result in issuance of water dis-charge permits grouped by geographical ar-eas (watersheds). A permit with less thanhalf of the effective period remaining whenits watershed is being permitted may be pro-cessed early for re-issuance with all of the

permits in the watershed.Other permits may be allowed to expire

and then be administratively extended (forno more than 2.5 years) to get on cycle withthe other permits in the watershed group.For these permits, the standard times listedin the attached table do not apply unlessenvironmental concerns or business operat-ing plans require re-issuance of the permit inadvance of the watershed permit schedule.MDE also removed the turnaround times forsurface discharge renewals from the turn-around time list in 2001.

MDE’s Wetlands and Waterways Programis revising its permit turnaround times to re-flect staffing levels and the increased com-plexity of permit applications.

For nontidal wetlands and waterways ap-plications, the turnaround time for minorprojects will increase from three months tofour months. The turnaround time for majorprojects willl increase from six months toeight months. For tidal wetlands licensesand permits, the turnaround time for minorprojects will increase from 30 days to 45 days.

The turnaround time for major tidal projectswill increase from 6 months to 8 months. It ishoped that these adjustments will assist ap-plicants in estimating the time needed to ob-tain these approvals.

Due to limited staff resources and the in-creasing complexity of water appropriationand use permit applications, the Water Sup-ply Program has decided to extend the an-ticipated turnaround time on these permitapplications.For minor permit applications,the turnaround time will increase from 60 to90 days and for majors the turnaround time

will increase from 12 to18 months.

The permit turn-around time stan-dards refer to the timebetween MDE’s re-ceipt of a completepermit application andMDE’s issuance ordenial of the permit,excluding delayscaused by factors be-yond MDE’s control.

Many applications are incomplete when theyfirst arrive at MDE.

The Environmental Permits Service Cen-ter or the appropriate MDE permit writer canprovide tips on how to ensure that an appli-cation is complete when submitted.

Unfortunately, there are factors beyondMDE’s control that can delay the process-ing of permit applications. Examples includedelays in receiving information needed fromthe applicant and delays in obtaining neces-sary approvals from local or federal govern-ment agencies. MDE’s permitting personnelcan provide advice about avoiding such de-lays.

bedroom communities to major tributariesthat lead flow to the majestic ChesapeakeBay, Maryland’s work to achieve federalClean Water Act goals can be seen.

“All across the state, the work of MDEstaff in conjunction with other dedicatedenvironmental professionals in the publicand private sectors has created marked im-provement in making sure waterways arefishable and swimmable,” said MarylandDepartment of the Environment (MDE) Sec-retary Richard F. Pecora.

One major accomplishment of the 1972Clean Water Act that has had extensiveramifications in all waters of the state hasbeen the reduction of pollutants comingfrom point sources, like manufacturing fa-cilities and sewage treatment plants.

For example, discharge loadings to theBaltimore harbor from major point sourceshave been reduced by over 90 percent sincethe passage of the Clean Water Act (Seethe 1996 Baltimore Harbor Regional ActionPlan for further details), with significantadditional reductions being implementedas the result of current permit requirements.

Major sewage discharge reductions haveoccurred below the District of Columbia linetoo. A significant source in Georgetown(Georgetown Gap) was repaired in the early1970s rendering major benefit to thePotomac River’s water quality. The federalconstruction grants program funneledmoney to upgrade sewage plants in thewatershed and a major largemouth bassfishery exists as a result of that effort.

Although sewage influx remains a prob-lem in certain portions of the state, in theBaltimore harbor watershed there havebeen dramatic improvements since the pre-Clean Water Act days. The Gwynns Falls,Jones Falls and Patapsco River belowEllicott City no longer have sustained dis-charges due to major improvements in sew-age infrastructure. The water continues toimprove as heavy industry is replaced byrecreational/residential uses.

Maryland has also put considerable ef-fort into improving the North Branch of thePotomac River with focus on surface coalmine reclamation, acid mine drainage treat-ment, fish stocking and eliminating the toxicdischarges of area industry. When the En-vironmental Protection Agency EPA iden-tified dioxin as a significant health risk inpaper mill effluent, Maryland implementedone of the first permits in the country toeliminate dioxin as a concern. Recent stud-ies have noted increased bio-diversity andexpanded natural propagation of trout inWestern Maryland as a result of those ac-tions.

states and local governments to meet thesenew water quality mandates.

“Maryland, as one of the first states tobe delegated authority from the federalgovernment for these new and expandedprograms, became a national leader formany of the broad initiatives for water qual-ity permitting, enforcement and providingcapital funding for municipal sewage treat-ment plants,” said MDE Secretary RichardF. Pecora. “The Clean Water Act also pro-vided the basis for Maryland’s regulationsto protect sensitive wetlands, estuarine andcoastal waters. The Clean Water Act alsomakes federal funding and participation ofthe U.S. Environmental Protection Agency(EPA) in the Chesapeake Bay Program, aswell as the National Estuaries Program thatsupports efforts in Maryland’s AtlanticCoastal Bays Program, possible.”

The framework for the issuance of per-mits under the Clean Water Act was theNational Pollutant Discharge EliminationSystem (NPDES), which established efflu-ent limitations for point source dischargesfor the waters of the United States and dis-charges of wastewater are only allowedunder a discharge permit issued by EPA ora state, such as Maryland, with authoritydelegated to it by EPA.

The NPDES program was initially pre-scribed for nationwide standards, imple-mented by discharge permits, for the levelof treatment and water pollution controltechnology that must be provided by in-dustry (Best Available Technology) andmunicipal sewage treatment plants (Sec-ondary Treatment).

“In many instances, most notably in thecase of the Chesapeake Bay, initial waterpollution control efforts proved to be in-sufficient and discharge permits werestrengthened to contain effluent limitationsrequiring more advanced treatment thanthe nationally prescribed technology,” saidJeff Rein, deputy program administrator forMDE’s Wastewater Permits Program.

For example, phosphorus controls on thelarger municipal facilities discharging to theupper Chesapeake Bay have been includedin Maryland discharge permits since thelate 1970s. In the late 1980s, implementa-tion of Maryland’s Tributary Strategies forNutrient Control, motivated by the Chesa-peake Bay Agreement, have resulted inpermit provisions dealing with phospho-rus and nitrogen for all sewage treatmentplants discharging to the Bay with flowsover 500,000 gallons per day.

Subsequently, the NPDES permittingprogram was expanded to cover major mu-nicipal separate storm sewer systems (MS-4 permits) that convey polluted stormwaterinto the nation’s waters from state citiesand towns.

“Maryland has also been a leader in thedevelopment of stormwater pollution con-trols,” Rein added. “Since the early 1980s,Maryland’s stormwater programs haveserved as a national model for stormwaterNPDES permits and with publication of

Maryland’s new Stormwater DesignManual, adopted into state regulations inOctober of 2000, our state has continuedto set the bar high for other states to matchin their efforts to control stormwater pollu-tion.”

Enforcement of the federal CWA, whichcreated an obligation for each permittedfacility to monitor and self-report data thatcharacterizes the quality of their discharges,is also a substantial obligation of states.Compliance with each facility’s permit re-quirements is addressed in the CWAthrough a determination of whether theseverity or pattern of effluent violationsmeets the description for significant non-compliance.

Although any permit violation may besubject to an enforcement action under theAct (and penalties of up to $27,500 a dayunder the current language), there was aclear focus on facilities that experiencedlarge, unauthorized discharges of pollut-ants or chronic excursions. Most of thesefacilities were upgraded or replaced withtreatment plants that ensure that permit limi-tations are consistently met.

The act established a process wherebystates could enter delegation agreementswith EPA in which the states agree to bethe first line of response to water pollutionand enforce state laws or regulations thatmeet or exceed the federal requirements.Maryland has consistently acted to fulfillits obligations as a delegated NPDES state,according to Rein.

In the early years of the Clean Water Act,the main enforcement focus was on majorpoint source dischargers — large indus-trial facilities or municipal wastewater treat-ment plants that process 1 million gallons aday or more.

Over time, the focus of the Clean WaterAct has expanded to include the extensiveuniverse of minor point sources (all indus-

trial dischargers and municipal sewagetreatment plants).

In the 1990s EPA launched an initiativeto address wet weather pollution issuesunder the Clean Water Act. These includedpermitting programs for combined seweroverflows (CSOs), sanitary sewer over-flows (SSOs), urban storm water and con-centrated animal feeding operations(CAFOs). The framework of the Clean Wa-ter Act continues to provide a solid basisfor efforts to protect the waters of theUnited States from pollution.

One of the most successful programscreated by the CWA was the federal Con-struction Grants Program (CGP), estab-lished to provide federal grants to localgovernment to meet enforceable require-ments of the CWA, namely the construc-tion of wastewater collection, conveyanceand treatment/disposal systems.

“Soon after enactment of the CWA,Maryland received partial delegation ofauthority from the federal government toadminister the CGP, and in 1979, Marylandbecame one of the first states in the nationto become fully delegated,” said DaveLyons, division chief of MDE’s Water Man-agement Administration Compliance Pro-gram. “During its tenure from 1972 to 1989,the CGP funded some $2 billion in waste-water treatment projects in Maryland.”

Over its life the program was inventedand reinvented numerous times to dealwith changing priorities and national bud-get realities. Annual federal allocationsranged from a high of about $280 million inthe early years to a low of about $15 mil-lion near the end of the program. In 1989,despite its unheralded success and popu-larity, and after years of slowly reducingfederal contributions that had to be pickedup by the state, the CGP ceased and wassucceeded by the creation of a federal StateRevolving Loan Program (SRF) to provide

low interest rate loans.The SRF Program, administered by

MDE, provides a source of below-marketrate loans to local government and eligibleprivate entities for both point and non-point source water pollution controlprojects. For the SRF, MDE receives anannual federal allocation of about $32 mil-lion and routinely finances some $80-120million of loans each year.

With the loss of federal grants throughthe CGP and the start-up of the SRF, Mary-land had responded by expanding the useof the SRF to create new eligible projectcategories. Maryland is also increasing thevariety of state grant programs (about $15-20 million in state funds annually) to pro-vide supplemental grants to help local gov-ernment maintain affordable user costswhen undertaking water pollution controlprojects.

“Maryland’s regulatory and capital fund-ing programs have been the most success-ful in the Chesapeake Bay watershed andthe nation in reducing nitrogen and phos-phorus loading from point sources, but thishas not been enough to achieve our waterquality goals for Maryland’s waters,”Lyons added. “Today, major initiatives areunderway in Maryland to implement state-of-the-art treatment technologies and fur-ther reduce the nitrogen and phosphorusload on the Chesapeake Bay.”

Many facilities are already significantlyreducing the nutrient load in their effluent,but even lower levels will have to beachieved under new water quality stan-dards being prepared by the ChesapeakeBay Program.

Despite the successes of the past, Mary-land will be continue to be challenged onthe 30th anniversary of the CWA to meetenforceable requirements, fulfill the increas-ing mandates of the Chesapeake Bay Pro-gram, provide adequate infrastructure forgrowth and avoid placing an unrealisticfinancial burden on local government.

A recent completed report by theGovernor’s Task Force on Upgrading Sew-erage Systems (2001) identified the total20-year wastewater needs in Maryland at$4.3 billion.

This report identified comprehensiveneeds for upgrading all sewerage systemsin Maryland and included elimination ofcombined and sanitary sewer overflows,additional nutrient removal projects to pro-tect the Bay, adequate infrastructure to ac-commodate Smart Growth and otherneeded projects as documented by localgovernment.

“Maryland will be up to these challengesand is implementing the recommendationsof the task force, one of which is the needfor additional federal funding support,”Pecora said. “With the reauthorization ofthe CWA pending, Maryland’s congres-sional delegation is hard at work in theseregards and MDE is in the forefront of na-tional and regional efforts to continue toprotect and restore water quality.”

Under the terms of the settle-

ment agreement, Passyn has agreed to pay apenalty of $30,000 to the Maryland SedimentFund in resolution of Administrative Complaint,Order and Penalty No.MDE-WMA-001-200200001 filed against Passyn on Sept. 11. Sta-tus: Case closed. (Reference #SA-03-0022).

Mayor and Town Council of Westernport –Allegany County – The Circuit Court ofAllegany County entered a civil Consent De-cree and Judgment between MDE and West-ern port on Sept. 6 regarding improvements toeliminate and control combined sewer overflows(CSOs) from the town’s combined sewer sys-tem to George’s Creek and to the North BranchPotomac River. Under the terms of the ConsentDecree, Westernport has agreed to completeimplementation of an MDE approved long-termcontrol plan to eliminate and/or control CSOs in

accordance with the Environmental ProtectionAgency (EPA) CSO Control Policy by July 31,2022. Westernport has also agreed to pay a civilpenalty of $6,500 to the Maryland Clean WaterFund or expend $6,500 to complete a supple-mental environmental project to resolve allegeddry unauthorized discharges. Status: Caseclosed. (Reference # Case No. 01-C-00-018487-L).

Water and Sediment Pollution Penalties –Statewide – During the period Aug.15 to Sept.15,MDE collected an additional $9,025 to the CleanWater Fund in settlement of alleged water pol-lution violations from 10 establishments. MDEalso collected an additional $27,790 in adminis-trative penalties to the Sediment Fund in settle-ment of alleged sediment and erosion controlviolations from 11 facilities.

There have been major improvements tothe Chesapeake Bay’s water quality sincethe bay program began in 1984. Nitrogenand phosphorous loads to the bay havebeen dramatically reduced. The 1985 lawbanning phosphorous in laundry detergenthad an immediate effect. Bay grasses arebeginning to rebound and Maryland’sfamed striped bass population has in-creased to healthy levels. In recent years,there has been an evolutionary shift inmanagement focus from the bay itself to itsrelated watersheds, called the tributary

strategy. By controlling pollution up-stream—in the streams and rivers that feedthe Chesapeake Bay—Maryland’s 10 tribu-tary teams are working to make a differencein our neighborhoods, our cities and towns,and the entire Chesapeake Bay watershed.A major focus of their efforts is controllingnutrient pollution from farm fields and horsepastures, construction and road buildingactivities, and hundreds of thousands ofsuburban properties.

Other successes directly attributed to theact include the re-opening of many shell-fish areas closed because of high bacterialdensities. Improvement in water quality ledto the re-openings after identification andsubsequent correction of septic tank, sew-age violations and sewage treatment plantupgrades.

Although Maryland’s compliance rate forpermittees has consistently remained in themid to upper 90 percent range for both ma-jor and minor industrial/municipal discharg-ers to the Chesapeake Bay and its tributar-

ies, significant enforcement actions havebeen issued against corporate violators andMaryland municipalities to compel compli-ance with state and federally delegatedwater pollution control laws and to ensure

protection of public health and the envi-ronment. Over the past five fiscal years,MDE’s Water Management Administrationhas taken hundreds of enforcement actionsand collected penalties totaling more than$5 million for violations of state water pol-lution control laws.

Enforcement actions include both admin-istrative and civil court actions to addressdischarge permit violations, unlawful pollut-ant discharges, sediment pollution, sanitarysewer overflows, combined sewer overflows,unpermitted concentrated animal feedingoperations and pre-treatment violations.

“In the last 30 years the Clean Water Acthas provided us a critical tool in helping en-sure that an essential part of our world willbe in good enough shape to pass on to fu-ture generations,” Secretary Pecora added.“MDE remains fully committed to taking thenecessary steps that will continueMaryland’s progressive stance in environ-mental policy, preservation, education andrestoration.”
