COMPLAINT AFFIDAVIT
I, MANUEL P. MEJORADA, Filipino, of legal age, married, and a
resident of No. 2 Kasoy St.,Block 11, Villa San Lorenzo
Subdivision,Lapaz,5000 Iloilo City, after having been duly sworrin
accordance with law, do hereby depose and state:
1. This affidavit is executed to establish the grounds for an
ADMINISTRATM complaintagainst EDILBERTO TAYAO, Regional Director,
Department of Public Works andHighways (DPWH), Region VI, with
mailing address at Fort San Pedro, 5000 Iloilo Cityfor violation of
the Anti-Red Tape Act, or Republic Act No. 9485, in the performance
ofhis official duties.The offenses were committed when respondent
TAYAO deliberately refused to fumishand provide me with certified
copies of official documents in the procurement of threecontracts
for the implementation of infrastructure projects in Iloilo City
which weredirectly undertaken by the DPWH Regional Office which he
heads.On January 28,2014,I wrote addressed respondent TAYAO in
separate letters requestingfor these documents for the following
projects:
a. The Iloilo Bridge widening project;b. The Iloilo City
Convention Center;c. Road widening of the Benigno Aquino Jr. Avenue
(or known as the "Diversion
Road").Copies of these letters, which were dispatched by
Registered Mail, are appended asAnnexes "A" for the Iloilo Bridge
project, "B" for the Iloilo City Convention Centerproject and'oC"
for the road widening of the Benigno Aquino Jr. Ave.The registry
receipts issued by the Philippine Postal Office are also appended
as Annexes"D","r" and o'F" for the above-enumerated projects in the
same order.After a lapse of time, and not having received a reply
from respondent TAYAO, Idispatched another letter dated February
19,2014 reminding him about my request (copyof the letter appended
as Annex "G"d

Such failure of respondent TAYAO is deliberate as he apparently
shuns any attempt todig into the transactions of the DPWH Regional
Office No. 6 in the procurement andimplementation of various
infrastructure projects which reek of comrption.This refusal to act
on these THREE (3) legitimate requests from the public is a
violationof Republic Act No. 9485, Section 11, paragraph (a),
subparagraph (2), which states"Failure to act on an application
andlor request or failure to refer back to the client arequest
which cannot be acted upon due to lack of requirement/s within the
prescribedperiod."
10. Such actions constitute THREE (3) counts of violations of
the afore-cited provision ofRepublic Act No. 9485.
11. I am executing this affidavit to attest to the truthfirlness
of the foregoing statements toestablish the grounds for THREE (3)
counts of violation of Section 11, paragraph (a),subparagraph (2)
of Republic ActNo. 9485 against respondent EDILBERTO TAYAO.
