This warranty will not apply if:

The product has not been installed and operated according to Agriplas' specifications and installationinstructions. The warranty does not extend to products that are misused, tampered, altered, neglectedand incorrectly maintained. Products operated out of specifications and if the irrigation water used has not been filtered to the correct specifications the warranty will not apply. If the product fails due todamage by insects, rodents or any other animals. Where damage due to fire, lightning, freezing, powerfailure, power surges, flooding, water damage or mechanical damage is present. Agriplas will identify the product and problem during the warranty period before any warranty can be issued.Agriplas will repair or replace, at its sole option the product or the defective part. Proof of purchase or manufacture date is not presented.

AGREEMENT OF SALE

1. Customer Services

If you do not understand these terms or if you are not satisfied with the quality of the product purchased from Agriplas please contact us via our website (www.agriplas.co.za) or on

2. Payment terms

2.1 All purchases are on a cash basis unless you have concluded a written credit agreement with us.

2.2 If you purchased any product on credit, the product will remain our property until you have made payment in full.

2.3 The price of the product does not include transport unless you have made another arrangement with us.

3. Delivery

3.1 We will arrange for the delivery of the product at your request. The cost of delivery is the responsibility of the Purchaser.

3.2 We will not accept liability for damages to, or loss of the product while it is being transported, regardless of whether we are delivering the product or whether we have

arranged for a third party to do so.

4. Warranty of Quality and exclusion of liability

4.1 In terms of the Consumer Protection Act 68 of 2008 (“the CPA”) we are obliged to distinguish between buyers who are consumers entitled to rely on the provisions of the

CPA and those who are not. If you are an individual or if you represent a legal entity with an annual turnover or gross asset value of less than R2 million you are considered

a consumer.

4.2 If you are a consumer you are entitled to receive products which are of a good quality, are usable and durable for a reasonable period of time, and are fit for the purpose for

which those products are normally intended and are safe and free of any defects. If you feel that you have not received products which conform to this standard, you should

contact us.

4.3 This warranty is in addition to any other express warranty which you might be given in respect of a particular product.

4.4 Unfortunately Agriplas cannot accept any liability for claims which fall outside of the CPA or any express warranty.

5. Hazardous Goods

5.1 Some of our products are hazardous by their very nature.

5.2 You must take care to use and store the product according to the manufacturer’s specifications and instructions for use.

5.3 You should obtain expert advice if you do not understand the manufacturer’s specifications or instructions for use or if you intend to use the product for a purpose for which

it is not ordinarily used.

5.4 Agriplas will not be held liable for any damage or loss which you may suffer as a result of the improper use of any product.

6. Returns

Purchasers will not be entitled to return any goods purchased from Agriplas for any reason whatsoever except to the extent allowed in the Agriplas returns policy. A copy of this policy

is available at all Agriplas branches.

RETURNS POLICY

3. Consumer Protection Act

3.1.3 Unfortunately we cannot accept any liability for claims which fall outside of the CPA or any express warranty.

3.2 Returns

Consumers entitled to rely on the CPA who bought a product as a result of “direct marketing” are entitled to cancel this transaction within 5 days of the purchase or

delivery. If you elect to do so the requirements of the CPA regarding the return of the product and the refunding of the purchase price will apply. Please contact us for

more information. Also note that proof of purchase is required.

3.3 Warranty on repaired goods

Consumers entitled to rely on the CPA should note that all repairs are warranted for a period of 3 months after installation except for ordinary wear and tear or for

damage caused by the misuse of the repaired product.

3.4 Special order goods

We will not accept returns in respect of special order goods, goods which may not be returned for public health and safety reasons or goods which have been physically

altered to the extent contemplated in clause 20 (3)(b) of the CPA.

4. General Right to Return

4.1 We extend a general right to return goods within 10 days of purchase to all consumers if the product is still in its original packaging. We will charge a 5% handling fee

should you exercise this right. Also note that proof of purchase is required.

4.2 Unfortunately we will not accept returns in respect of special order goods, goods which may not be returned for public health and safety reasons or goods which have

been physically altered.
