Item 2: Section 00700, Paragraph 4.07 I, in Volume I of the Contract Documents shall read as follows:

4.07 Concerning Subcontractors, Suppliers and Others

I. The CONTRACTOR shall submit the Subcontractor Disclosure Form found in Volume II, Appendix I with each monthly and final pay application. This form shows the list of payments to be made to NON-SDBE subcontractors on this project for the applicable time period.

Item 3: Section 001000, Paragraph 2.06 B, in Volume I of the Contract Documents shall read as follows: 2.06 PAYMENTS AND FINAL COMPLETION

B. PAY ESTIMATES/PAY APPLICATIONS

All pay estimates will be generated by the Owner. The Contractor and the Project Coordinator will review quantities and mutually agree on the monthly quantities for payment. The monthly progress status report shall be signed by the Contractor and the Project Coordinator. Payment shall be based on those quantities installed and accepted as of the last Friday of the month. The Project Engineer will generate the pay application based on the quantities submitted and forward electronically the pay application to the Contractor to be returned with original signatures. The Contractor shall return two (2) signed pay applications with sales tax certifications (by Part) and invoices, stored material documentation (by Part), certified payrolls for the period, the Subcontractor Disclosure Form, and Affidavit E. Pay requests will not be processed if any of the required documents have not been submitted.

Item 4: Add the attached Erosion and Sediment Control Plan Approval to Volume II, Appendix C. Item 5: Add the attached Easement Special Requirements to Volume II, Appendix D. Item 6: Add the attached approved Sewer Permit to Volume II, Appendix E. Item 7: Add the attached Subcontractor Disclosure Form to Volume II, Appendix I. Item 8: Below are comments received from NCDEQ regarding their review of the erosion control

plans. Revisions were made, and plans were resubmitted for approval by NC DEQ. These have been included in this Addendum 1 to provide all prospective Bidders knowledge of additional requirements for erosion and sedimentation control.

1. As pertains to the Drawings Sheet ECP-11 and Sheet ECP-2:

Add note on each sheet that reads as follows: “Linear Projects-Limit construction to that length which can be stabilized at the end of the work day.”

2. As pertains to the Drawings Sheet ECP-3:

Revise General Notes Sediment Pollution Control Act Note 1, Minimum monitoring and Reporting Requirements as follows:

All sedimentation and erosion control of facilities shall be inspected and documented by the Contractor at least once every seven calendar days and within 24 hours after any storm event of greater than 1.0 inches of rain per 24-hour period. The Contractor shall install and maintain a rain gauge on the site and a record of the rainfall amounts and dates.

3. As pertains to the Drawings Sheet D-1:

Add the following notes to the detail titled – Inlet Protection for Storm Drainage Under Construction:

1. Inspect hardware cloth & stone at least once a week, and after each rainfall. Make repairs immediately.

2. Replace any damaged hardware cloth with new hardware cloth. 3. Remove sediment from stone filter and replace stone filter as necessary.

Item 9: As of the date of issuance of this Addendum, PWC has not received approval from the US

Army Corps of Engineers for the required wetlands permit. Approval of the permit is anticipated prior to the Notice to Proceed. The only area of the project requiring this permit is on Sheet PP-20, where the connection is made to the existing outfall at the end of Silverstone Court. The delineated wetland boundary is shown on Sheet PP-20. Although official approval has not been received, it is anticipated that the sanitary sewer main at this location will be required to be constructed in accordance with the requirements of the Nationwide Permit 12, issued by the US Department of Army Corps of Engineers, and the Water Quality General Certification No. 4133, issued by the NC DEQ Division of Water Resources. The general requirements for these permits can be found at the following web links:

and approved revision will be provided to the successful bidder. This proposed revision adjusts the horizontal alignment only, and therefore will not cause an increase or decrease in the proposed depth of the sanitary sewer main at this location. There are no anticipated changes to the line items in the bid proposal as a result of this shift to the alignment of Profile B.

Question 1: Will there be a pay item for the abandonment of the wells? What about access to these properties and the restoration due to construction activities? Answer: Item C-3 “Abandon Exist. Private Well in Accordance with NCDEH requirements and Sod” will be used to pay for this work. PWC right-of-way agents are

currently working to acquire Temporary Construction Easements and/or Rights of Entry where necessary, to access the wells to be abandoned. The area disturbed is to be restored with sod. If driveways are damaged during the process, they are to be restored with like materials in accordance with the requirements of the Contract Documents. Question 2: There are a couple of locations where the sewer to the house is noted to be reverse to the street. Is this something the Contractor is responsible for? Will there be a separate pay item for this work? Answer: The Contractor will not be required to turn the plumbing underneath the residence. This note is for design purposes and for future use by PWC when requests for connection are made by the property owners. Question 3: Can PWC please provide the locations that must be hydrostatically tested? Answer: On Sheet PP-20, the section of sanitary sewer from Sta. 0+00 to Sta. 0+40 on Silverstone Court shall be hydrostatically tested. Question 4: At address 7211 Manassas – Can PWC change the location of this service to miss the existing 4’ brick wall? This will keep the lateral from having to go under the wall. Answer: The wall runs the length of the property. The lateral cannot be shifted and shall be installed at the location shown on the plans. Question 5: Since PWC has removed the 1” overlay; is it PWC’s intention to increase the general contractor’s mandatory participation to 65% of the Contract Value? Answer: In accordance with Section 0700, Paragraph 4.07H, in Volume I of the Contract Documents, “The Contractor shall not subcontract more than 49% of the value of this Contract.” Therefore, the Contractor’s mandatory participation on this project is 51% of the Contract value. Question 6: General note #19 refers the Contractor to pay all cost necessary to support the utility and make any repairs and associated costs if damaged. Where and how many locations are anticipated requiring support? Answer: Locations where utilities are to be supported are not indicated on the plans. Contractor should visit the site to determine if existing utility poles will require support during construction based upon the Contractor’s means and methods. Contractor is also responsible for supporting existing underground utilities as necessary when crossing them during construction. Question 7: Note on PP-6 – Place temp pipe/drainage under inlet protection at catch basin or headwall. Please elaborate. Will this undermine the erosion protections? Answer: Based upon typical construction practices, this protection is to be placed at the entrance to driveway pipes, street culverts and/or headwalls to prevent sediment from entering the pipe or culvert. This should supplement the erosion protection measures, not undermine their integrity. These protective measures are to be properly installed and maintained.

Question 8: Several boring locations will require the bore pit soil to be hauled out during the bore and hauled back in upon completion of the bore and pipeline. Can PWC add a line item for this additional work? Answer: A line item for the excavation, removal, and hauling of material for the bore pit will not be added. In accordance with the Contract, this work, if necessary is incidental to the installation of the bore and jack. Any costs associated should be included in the unit price for the associated bore and jack line items in the Contract Bid Proposal. Question 9: There is a tail piece that is shown for the laterals. Will this tail piece be required as it extends beyond the ROW? Will PWC pay for restoration of this area beyond the ROW where the tail piece is installed? Answer: The Contractor is expected to install the sanitary sewer lateral and cleanout as shown on PWC Standard Detail S-10. The Contractor will be paid for restoration of the lateral trench in accordance with the Contract Specifications, which includes the area outside of the ROW for the installation of the tail piece. Question 10: Is AQUA or PWC aware of any of the existing water main being AC pipe or is it all PVC? Answer: Based upon information received from AQUA, and available SUE data, it appears that all existing water main in this area is PVC.

In accordance with your application, the Public Works Commission of the City of Fayetteville, onbehalf of the State of NC Environmental Management Commission, has assigned Permit# PWC2019-S022, effective May 23, 2019 to the addressee for the construction, operation and maintenance of thesubject wastewater collection system extension as described in the application for Phase V AnnexationArea 23 Section I Wells Place

This permit shall be effective for 24 months from the date of issuance, or until revoked and shallbe subject to the conditions and limitations as specified below:

I. The enclosed Authorization to Construct shall be posted at the primary entrance of the job sitethroughout construction.

2. The project shall be constructed in accordance with the approved application, engineering plans, andthe Public Works Commission standards, specifications, Local Pennitting Ordinance on behalf of theState of NC Environmental Management Commission and other applicable Laws, Rules, andRegulations. Permission is hereby granted to Fayetteville Public Works Commission for theconstruction of 15,581' of 8" Gravity Main and 777' of 12" Gravity Main to discharge 73,440GPD of collected domestic wastewater into the City of Fayetteville existing sewer system, pursuant tothe application received and in conformity with 15A NCAC 2H .0200, PWC's Design Manualminimum design criteria as applicable, and any other supporting data subsequently filed and approvedby the Public Works Commission.

3. The sewage and wastewater collected by this system shall be treated in the City of Fayetteville PublicWorks Commission Rockfish Waste Water Treatment Facility (Permit No. NC0050105), prior tobeing discharged into the receiving stream.

4. This permit shall become voidable unless the wastewater collection facilities are constructed inaccordance with the conditions of this permit, PWC's Design Manual, applicable State rules andregulations, and other supporting material, unless specifically mentioned herein. This permit is nottransferable.

5. This permit shall be effective only with respect to the nature and volume of wastes described in theapplication and other supporting data.

If any parts, requirements or limitations contained in this permit are unacceptable, you have 30days following receipt of this permit to request an adjudicatory hearing. This request must be in the formof a written petition, conforming to the Public Works Commission Ordinance and filed with the PublicWorks Commission, Water Resources Engineering Department, at 955 Old Wilmington Road, FayettevilleNC 2830 I. This permit shall be final and binding, unless such petition has been filed.

We are enclosing one (I) set of approved plans for construction. The project must comply with allpermit requirements as contained herein, all requirements found in the Public Works Commission DesignManual and all regulations related to the Environmental Management Commission.

ii. No additional time for weather delays has been included in the Contract Time Calculation. In accordance with the Contract Documents, the Contractor will be required to submit a request for time due to weather delays within 30 days of the occurrence.

f. Liquidated damages will be assessed at $1,000.00 per calendar day beyond the Contract final completion date.

g. A Bid Bond is required for this project and must be submitted with all bids. h. All prospective bidders should thoroughly review the Bid Evaluation information

listed in Volume I of the Contract Documents. If any information is omitted, the submitted bid may be considered incomplete. Incomplete bid packages may be rejected. A Bid Evaluation Checklist has been provided, but may not be all inclusive.

4. Lexi Hasapis, PWC Procurement Analyst, gave an overview of the SDBE

requirements. a. This project has an opportunity based goal of 10%. Contractors are required to

give SDBE Contractors the opportunity to quote the work. b. The SDBE contractors must be certified through the NC Office of Historically

Underutilized Business, or certified by NCDOT as an SDBE. A link to the NCDOT online directory can be found on the PWC website (www.faypwc.com).

c. All SDBE documents required to be submitted with the bid are marked as such. Good faith opportunity efforts shall be documented. If the goal is not met, Contractor will be required to show that good faith efforts were made.

d. PWC promotes utilizing local businesses for services and supplies. There is not a contract goal for local use. However, it is requested that you solicit local businesses, if possible. ‘Local’ is defined as having a home office in Cumberland or Hoke Counties.

e. By submitting a bid, the Bidder agrees to comply with the E-Verify and Iran Divestment Acts.

Encroachments, permits, soil report, easement special conditions and other items pertaining to this Contract are found in the Appendices.

6. Construction Issues

a. Encroachments i. There are NCDOT encroachments for each of the bore and jack crossings

of Graham Road. These have been submitted to NCDOT, but PWC has not received approval prior to this meeting. Contractor should anticipate

standard NCDOT requirements for work within the NCDOT right of way, to include time restrictions of 9:00am-4:00pm for lane closures and interruption of traffic.

b. Easements i. Easement acquisition is underway at this time. 15 of the 32 easements

have been acquired as of this meeting. It is anticipated that all easements will be acquired prior to the NTP. A list of outstanding easements will be included in the Addendum.

ii. The Contractor is expected to adhere to the easement special conditions listed in Volume II of the Contract Documents. The easement special conditions are also noted on the plans. Any additional special conditions will be provided by Addendum.

c. Customer Service – It is expected that the Contractor recognize they are working in a subdivision. All personnel are to be respectful and courteous. The Contractor shall follow the Contract requirements for dealing with complaints that may arise during construction. Special attention was called to the working hours provided within the Contract Documents. The working hours will be enforced. There will be no work on weekends and PWC recognized holidays.

d. Testing and Acceptance i. Compaction testing will be conducted in accordance with the Contract

Documents. 1. Compaction testing will be coordinated by the PWC Project

Coordinator. 2. PWC will contract directly with the materials testing firm, and pay

for all initial compaction testing. However, the Contractor will be charged for all retests and bracket testing for failed compaction testing.

ii. Testing of the sewer mains, manholes, and laterals shall be conducted in accordance with the Contract Documents. 1. Contractor shall coordinate with the PWC Project Coordinator two

(2) business days prior to schedule testing. e. Traffic Control – Traffic Control shall be in accordance with the most recent

edition of the MUTCD, NCDOT Standards, and the Approved Traffic Control Plan. The Contractor is required to submit traffic control plans for approval to the Project Engineer for work in both NCDOT and City of Fayetteville roadways. These plans shall be approved prior to work beginning in any roadway. In accordance with the Contract Documents, the Contractor shall notify the City of Fayetteville and PWC by close of business the Wednesday of the previous business week, indicating which roadways will be affected by the work for the upcoming week. This notification shall include a brief sketch. The Contractor shall abide by all NCDOT and City of Fayetteville requirements when working within their respective rights of way.

f. Erosion Control – The Contractor will be required to abide by the approved erosion control plan and permit daily. The Contractor is also required to submit a supplemental erosion plan for their staging area to NCDEQ for approval. Upon completion of the project, the staging area shall be seeded and ground cover established, in accordance with the requirements of the erosion control permit.

g. Water Services i. The water on this project and within the subdivision is owned and

maintained by AQUA America North Carolina. If an AQUA water

service is damaged during construction, the Contractor is expected to replace the water service from main to meter with poly pipe. If any damage to facilities occurs, the PWC Project Coordinator and the AQUA representative shall be notified.

1. AQUA’s field representative during construction is Scott McMasters. He can be reached at (910) 728-1043.

ii. PWC has a 12-inch water main running along the east side of Graham Road near the intersection with Carloway Drive. Any interruption of this water main is to be coordinated with the PWC Project Coordinator.

h. Restoration shall be in accordance with the Contract Documents. All lateral trenches shall be seeded. Sod shall be utilized for all easement areas. Areas outside the project limits that are damaged shall be considered collateral damage areas and shall be restored with sod at no cost to PWC.

i. This project includes Permanent Pavement Patch, which consists of 8-inches of ABC stone base and 2-inches of surface course. The Contractor will be required to place and compact 10-inches of ABC Stone in the trenches prior to removing the upper 2-inches for paving. Contractor should review Section 0125A, Measurement and Payment Item A-1, in Volume I of the Contract Documents. There will not be an overlay or an alternate bid for temporary patching on this Contract. A line item has been included in the bid form for permanent pavement patch in failed areas outside the trench limits, as previously identified by the City of Fayetteville. These areas will be painted by the City of Fayetteville Inspector prior to patching.

j. There are approximately 10 private wells to be abandoned on this project. PWC will be in communication with the property owners to inform them of this issue. Temporary construction easements and rights of entry will be obtained where necessary to access the wells. At least one (1) property will require a connection to AQUA’s water system.

k. Staging Area requirements can be found in Volume I, Section 01000. The Contractor is required to submit a plan to PWC, as indicated in the Contract Documents. Any Temporary Use and Truck Route Permit fees shall be the Contractor’s responsibility. An approved supplemental erosion control plan is also the Contractor’s responsibility.

l. Requirements for the Truck Route Bond have been included in Volume I, Section 01000. The Contractor will be required to bond those City streets outside the project limits that will be utilized for construction activities. A bond amount of $25,000 is anticipated.

7. Design Engineer Comments

8. City of Fayetteville Comments None.

9. Questions 1. Who owns the water in this area?

AQUA North Carolina owns the water system within this project area.

However, PWC does have a 12-inch water main on Graham Road near the

intersection with Carloway Drive.

2. Who will be providing construction staking on this project?

Moorman, Kizer, & Reitzel will be providing the construction staking for this

project. The Contractor will coordinate staking needs directly with MK&R.

3. Will the Contractor be required to place 10-inches of stone in the trench?

Yes, the requirement for permanent pavement patching profile requires 8-

inches of ABC stone and 2-inches of surface course. Therefore, 10-inches

will need to be placed initially and the upper 2-inches removed just prior to

placing the asphalt. Please reference Section 0125A, Measurement and

Payment Item A-1, in Volume I of the Contract Documents.
