By Khushboo Panjabi W ith the sudden dis- covery of a third mo- bile belonging to murder victim Esther Anuhya on Friday, the investigations have moved on to a a new track. On Friday, the Government Railway Police (GRP) of Kurla came across the third mobile inside the flat she was staying in at Andheri. Esther's body was discovered on January 16 in the Bhandup creek which comes under the jurisdiction of Kanjurmarg police station. “Interestingly, the usage of this particular mobile by the deceased was not even known to her family mem- bers,” said Shivaji Dhumal, senior inspector of Kurla GRP. This makes the police sus- pect the role of another per- son known to Anuhya, in the case, as the latter must have been keeping her third mo- bile for personal use, added Dhumal. Already, the de- ceased was using one mobile of Samsung which was dis- covered near her body, with dual SIM cards, which means that she was utilising two numbers, said the police. Among these two numbers, one SIM card was of Airtel while another was a BSNL SIM card, said police. The third mobile did not have any SIM card, said the police, adding that the mo- bile will be examined by technical experts and all the incoming, outgoing and missed calls will be verified. This would give the investi- gators any hidden details of Anuhya and the people with whom she was in touch. Hitherto, the police have been questioning the role of taxi or rickshaw drivers, who might have raped and then killed Anuhya, before leaving her body in the creek at Bhandup. The Brihanmumbai MunicipalCorporation (BMC) has pro-posed to set up three energy

plants to process 8,000 metrictonne of garbage generated everyday in the city. However, it it is un-clear what the BMC plans to dowith the power that is generated.Additional municipal commis-

sioner Mohan Adtani said, “Therewill be a qualification tender whichwill be issued in next 15 days andthe processing plants will be set upat existing dumping grounds inDe-onar, Mulund and Kanjurmarg; asample of waste has been sent tothe laboratory named ‘NEERI’ inNagpur in order to know how en-ergy can be generated.”P.S. Aawate, executive engineer,

Solid Waste Management added,“We are re-starting the process ofplants as BMC’s earlier plan to shutdown the Deonar and Mulunddumping grounds is under investi-gation.”As BMC does not hold its own

dumping ground they have de-cided to lease the dumping groundland to the contractor for Re.1 persquare metre per annum.Aawate added, “Earlier in 2009-

10, the project to treat around 6,500 tonne of garbage from thesethree dumping grounds wasstopped, hence we have now de-cided to generate at least 600-800tonne of garbage per day; we alsohave invited opinions from acrossthe globe for the new project. Un-like the previous project, where theoperator was to make the full in-vestment, the BMC will invest 50

per cent.”“With a 50 per cent stake, the

contractor will have to ensure thatthe work is completed in the mini-mum footprint area and the pro-cessing system should be fast,” hesaid.Out of the 6, 500 tonne of

garbage which was to be treated,Deonar had 2, 000 tonne and Kan-jurmarg 1,000 tonne of garbage

which was window composed fortreating the waste, and in Mulund,500 tonne of garbage was biomethanised for treating the wastefrom hotels andmarkets but as theprocess was stopped, now thesame process will start but only600-800 tonne of garbage will betreated.The plants will process the re-

maining 3,000 tonne garbage to be

used as a landfill for the inert ma-terial generated from the plant.Waste management has always

been a serious issuewith theMum-baikars as the city’s dumpinggrounds overflow with amixture ofwaste. Through this treatingprocess it can help cure the prob-lem but the foul odour will remain.

shown himself as having modestlivelihood while filling his nomina-tion papers for the biennial RajyaSabha elections due to be held onFebruary 7. Shiv Sena’s RajkumarDhoot has beenwiser of the lotwhohas shown Rs 1 crore liabilities inthe name of his wife. As against thissecond NCP candidate and notedcriminal lawyer Adv MajeedMemon has shared the liabilities ofRs 1 crore along with his wife in hisaffidavit. But amongst the threewhohave filed their nominationpa-pers yesterday, Pawar has total as-sets worth Rs 32 crores, Memon Rs23 crores and Dhoot Rs 19 crores.Pawar (73 years) has passed his

SSC in 1958, while Memon (68years) is a BA (1969) and Bachelorof Law from Mumbai (1972). Asagainst this Dhoot (58 years) hascleared second year of B Com(1975) fromMarathwadauniversity.Pawar who has shown the total

asset worth as Rs 32.13 crore, hasshown no liabilities in his or hiswifes name. However, as per his

2012-13 I-T returns his incomewasRs 72 lakhs, while his wifes incomeis Rs 89 lakhs and his Hindu Undi-vided Family (HUF) income as Rs14 lakhs. While he has shown hisprofession as agriculturist and hiswife as agriculturalist and busi-nesswoman.According to poll affi-davits of earlier elections with ECfor 2004 and 2009 was shown to beRs 3 crore and Rs 8 crore respec-tively. In 2010 following PM DrManmohan Singh asking all hiscabinet colleagues to disclose theirfinancial assets – Pawars then in-comewas quoted to be Rs 12 crore.On the other hand Memon who

has shown his total asset worth tobe as Rs 23.80 crore has shown hisliabilities worth Rs 1.62 crore to besplit between his wife. As per his ITreturns, Memon’s own income in2012-13 was Rs 3.78 crore and thatof his wife to be Rs 22 lakhs. As perthe affidavit filed byDhoot his totalassets are worth Rs 19 crores, whilethe liabilities shown in his wifesname are valued at Rs 1.65 crore.

Milk prices in Mumbai havebeen hiked by Rs.2 per litre,

as lead suppliers Amul andMother Dairy have passed in-creased cost of procurement oncustomers.While Amul has increased the

price from Friday, Mother Dairywill hike rates from Saturday."We have increased milk price

in Mumbai by Rs 2 per litre fromtoday," Gujarat CooperativeMilkMarketing Federation (GCMMF),which sells milk under the Amulbrand, told PTI.Sodhi said the prices of Amul

gold (full cream milk) has goneup to Rs 46 per litre from Rs 44per litre, while that of AmulTaaza(toned) to Rs 36 per litre from Rs34 per litre.Amul is the largest dairy firm

inMumbaimarket with sale of 11lakh litres per day, while MotherDairy sells nearly 2.5 lakh litre aday.

THE level of hilarity occasioned byShiv Sena leader UddhavThackery’s confusion over whatexactly happens on Republic Day(tomorrow) is both unseemly andironic, given the fact that mostpeople of this country are equally,if not more ignorant in the matter.For those who may have come

in late, Mr Thackeray referred tothe prime minister making his“last speech” from the rampartsof the Red Fort, an occurrencethat takes place only onIndependence Day. Being a leadervery much in the public eye, heshould have known better. The flipside is that a leader is no betterthan his constituents, sopperhaps we should not be toojudgmental of him!Suffice it to say that a quick

scan of students in colleges arebound to throw up the sorry factthat apart from it being a publicholiday, few are aware of what itmeans to be a republic. Or that itis celebrated every year tocommemorate the date andmoment when the Constitution ofIndia came into effect. AlthoughIndia attained independence onAugust 15, 1947,till 1949 it didn’thave a permanent Constitution ofits own and instead werefunctioning under the lawsenacted and implemented by theBritish.

A little over two years after webecame Independent, onNovember 26, 1949, theConstitution was approved andaccepted. We are willing to betthat for all those who associatethe day with the dire events of2008, this little tidbit will come asa surprise. And two months afterthis date, on January 26, 1950,India became a republic.No speeches then, from the

High Court had directed in-vestigating agencies to com-plete their investigationswithin three months. TheACB, EOW and CollectorRaigad had on January 7submitted their final reportsin sealed envelopes to a divi-sion bench of Justice S.J.Vaz-ifdar and Justice G.S. Patel.The agencies were directedto conduct probe after aPublic Interest Litigation(PIL) was filed by BJP leaderKirit Somaiya. He hadsought CBI probe into al-legedmoney laundering andland grabbing by various

companies floated byTatkare and his relatives.While hearing the matter

by a bench headed by Jus-tice S.J. Vajifdar on a PILwhich complained aboutseveral issues, includinglack of infrastructure, fillingup of vacant posts of mem-bers and Presidents of Con-sumer Forum andinsufficient salaries paid tothem.The PIL, filed by Mumbai

Grahak Panchayat, a lead-ing consumer NGO, allegedthat out of the 40 consumerfora in the state, 19 weredysfunctional due to vacantposts of members and pres-idents.The government in-

formed the court today thatthey had already filled up30 posts of president in 40consumer fora all over the

state.However, 10 were still

lying vacant and efforts arebeing made to fill them.The government said 34

posts of members out of thetotal 84 in consumer foraacross the state were lyingvacant and the process ofappointing such memberswas in final stage.In Bandra Consumer

Forum, where space was amajor constraint, 400square feet additionalspace had been provided,the court was told.Another bench hearing

the samematter had earlierpulled up the governmentfor its lackadaisical attituderegarding vacancies in theconsumer redressal foraacross the state.The bench had also sug-

shows a different scenario. In Delhi, the AAPis as popular as ever. It cannot be denied thatthe AAP has huge support in Delhi. All thebelow the belt attacks have not diminishedpeople’s support to AAP. Perhaps, thepopularity of AAP in Delhi has increased.

No control over the policeONE of the 18 promises made by ArvindKejriwal in the party’s elections manifestowas that the Delhi police would be broughtunder the control of the Delhi government.Just now, the Delhi police are not under theDelhi government but are under control ofthe Centre.Arvind Kejriwal must have realised

by now that this would be a tough task.

The Centre will not agree to give up controlover the Delhi police.What sort of government is now inDelhi? It

is nothing but a farce that theDelhi police arenot under the control of the Delhi govern-ment. A Delhi policeman can refuse to takeorders from anyminister in theDelhi govern-ment. It looks like theministers are under thecontrol of the police.The police imposed section 144 in the area

where Arvind Kejriwal was holding thedharna and he defied it.A FIR has been lodged against him for the

‘offence’ he has committed.The police have the last word in anymatter

powers than the government.Without control over the police, the AAP

cannot govern. And what is an amazing real-ity is that aDelhi cop can arrest aminister, filecase against him and send him to jail.This situation is quite hilarious.

demolishedIT has become clear now that Adarsh, thecontroversial building in Colaba, will not be

razed. The building in the military area hascome up on the ground which was reservedfor the widows of Kargil heroes. The govern-ment claims that the land belongs to it. Thereis a dispute about the claim that the groundwas allocated for Kargil widows.Top leaders of the Congress party are in-

volved in the Adarsh scam. It is alleged thatsanctions were obtained from the govern-ment through unfair means. It has been alsoalleged that some bureaucrats and ministersare also involved. It is also alleged that severalbenami transactions have taken place.Adarsh, however, will stand there for ever.

Efforts by activists in this regard have failed.Legal opinion has been sought. The govern-ment has ordered enquiries. And finally areport which was produced has beenrejected. A storm of protest followed. Thematter was discussed in Parliament. AndCongress vice-president Rahul Gandhi ex-pressed the view that the response to reporton Adarsh needs to be reconsidered.It is not known whether any reconsidera-

tion has taken place. Rahul’s view was not anorder. It was a remark which was casuallymade. Aftermaking a vague remark, the Con-gress vice-president, who is in charge of theCongress poll campaign, has chosen to keepmum.There is every indication that Adarsh will

not be demolished. When a top Congressleader like Sushilkumar Shinde is alleged tobe involved, it is certain that the Kargil wid-ows cannot get back the ground on whichAdarsh has been built. And if at all those whobuilt Adarsh fail, it is better it is not demol-ished. It should be given away to Kargilwidows.

Time to pack upAPPARENTLY, it’s time for our Cen-tral HomeMinister to pack up now.He is fit only for a verbal diarrhoea.If he is not in a position tomake thenon-working corrupt police forcework, what good is the Home Min-ister doing then? Why, and underwhose instructions, is he support-ing the corrupt by giving them pro-tection? That the Delhi ChiefMinister should have to sit for anovernight ‘dharna’ with his partycolleagues for such demandsspeaks volumes for the Home Min-ister’s competence. RIP Nageswara RaoCLOSE on the heels of the passingaway of Suchitra Sen comes the sadnews of the demise of AkkineniNageswra Rao, the doyen of theTel-ugu film industry for some 75 years.He had acted in over 250 films,mostly inTeluguwith some inTamiltoo and received practically all theawards offered, from the Dadasa-heb Phalke Award and Padma Vib-hushan to a number of stateawards. The affable actor with athin, short moustache, had won in-ternational recognition also and ledmany delegations abroad. He wasso popular among the youth in the1950s that some of us, graduate stu-dents of geology on tour, campingat Rayalacheruvu in 1953, used ourweekly-off day to go to the cinema-hall in Cuddapah town where hisfilm ‘Devdas’ was being shown bythe Bombay Mail and a horse-dri-ven cart. And we were treated to anexcellent fare by Nageswara Raoand Savitri in the film for all thetroubles we took. Ironically, though‘Devdas’ was a Bengali classic ofSarat Chandra Chhattopdhyaya, theTelugu film industry was the first tomake a film out of it and Bimal Roymade his Hindi ‘Devdas’ only in1955, spurred by the tremendousresponse from the public to theTel-ugu version.

THE decision of the Reserve Bankof India (RBI) to withdraw fromcirculation all currency notes be-fore 2005 is in right direction andtimely one. These notes will belegal tender till March 31 and canbe exchanged from April 1 fromthe banks for new ones. The ex-change of more than 10 notes ofRs.1,000 and Rs.500 by a personwill need identification proof andresident address but it is notknown if the banks have to notedown details of those exchangednotes and pass them on to the rel-evant authorities to maximise theflush-out of black money. Thosehoarding currency notes before2005 have to get out in open totransect or exchange till March 31.I strongly feel that it will not beeasy to get large volumes of cur-rency into the systemunnoticed ina short period. Even if some of itdoes get exchanged, the RBI willnot mind it as it would haveachieved its objective of gettingsuch money into the legal system.The RBI move will also help elimi-nate counterfeit currency butmakelife difficult for those who havehoarded the currency notes andfund political parties for elections.

If it weren’t for Salman Khan’s stardraw, a film like Jai Ho wouldhave been hooted out of the cine-mas after one show. So it the filmdoes well, it’s all credit to his fanfollowing; the director, SohailKhan, could have handed the reinsto the action director (Ravi Verma)and gone on vacation for all thework he has done. The bits in be-tween the action set pieces arehaphazard and ridiculous, makinga mess of the sweet Hollywooddrama Pay It Forward, which hadinspired Telugu film, Stalin, whichin turn spawned Jai Ho.Salman Khan has built his recent

blockbuster star image on remakesof over the top Southern films,which splurge on extravagant fightscenes and elaborate dance num-bers, but are resolutely old-schoolin every other department.In this film, Jai (Khan) is an army

officer with a past. Not sure whathe does, perhaps runs a garage(because there are scenes of himtinkering with cars), but is always

ready to bash up wrongdoers andhas a strange collection of sunglasses in lurid colours. The film

Until some ago, investing in immovableproperties for NRI’s was quite an uphilltask. In the days of the Foreign ExchangeRegulation Act, the buying or selling ofimmovable property was governed bythe citizenship of a person.At present, the term Non-Resident

Indian means a person residing outsideIndia who is either a citizen of India or isa person of Indian Origin who is nolonger a citizen of India. An Indian citi-zen who stays abroad for the purpose ofemployment, business or to pursue anykind of vocation outside India or undercircumstances indicating an intentionfor an uncertain duration of stay abroadis a non-resident Indian. In addition,non-resident foreign citizens of Indianorigin are treated on par with Indian NRIcitizens for the purpose of many invest-ment related facilities.To avail of a number of facilities in

India such as opening and maintenanceof bank accounts or investment in sharesand securities in India, the term ‘Personof Indian Origin’ means a citizen of anyother country other than Pakistan orBangladesh who,(a) at any time has held an Indian pass-

port;(b) he or either of his parents or any of

his grandparents was a citizen of India byvirtue of the constitution of India or theCitizenship Act, 1955 (57 of 1995);(c) is a spouse of an Indian citizen.For investments in immovable proper-

ty, a Person of Indian Origin covers thesame criteria. But it also debars citizensfrom neighbouring countries such asPakistan, Bangladesh, Afghanistan,Bhutan, Sri Lanka, China, Iran or Nepalto be called a ‘Person of Indian Origin’. Allpersons whether residing in India or out-side India who are citizens of the abovesaid countries require prior permissionof the Reserve Bank of India for acquiringor transferring any immovable propertyin India. A person of Indian origin resid-ing outside India does not require per-mission to acquire any immovable prop-erty in India other than agricultural land,farmhouse or a plantation property byway of gift from a person who is a resi-dent of India or a person who residesoutside India but is a citizen of India orfrom another person who is of Indianorigin but resides outside India. Thesame holds true in the case of inheri-tance too. This means that a person ofIndian origin residing outside India doesnot require permission to acquire anyimmovable property in India throughinheritance from another person resid-ing outside India who had acquired suchproperty in accordance with the provi-sions of the foreign exchange law in forceat the time of acquisition.Non-resident Indians and persons of

Indian origin can also freely rent out

their immovable property in India with-out seeking any permission from theReserve Bank. The rental income being acurrent account transaction is freelyreportable outside India.

tive society and any other multi-State co-operative society, between a multi-Stateco-operative society and liquidator ofanother multi-state co-operative societyor between the liquidator of one multi-State co-operative society and the liq-

uidator of another multi-state co-opera-tive society,Such dispute shall be referred to arbi-

tration.(2) For the purposes of sub-section (1),

the following shall be deemed to be dis-puted touching the constitution, man-agement or business of a multi-State co-operative society, namely: -(a) a claim by the multi-State co-op

society for any debt demand due to itfrom a member or the nominee, heirs orlegal representatives of a deceasedmem-ber, whether such debt or demand beadmitted or not;(b) a claim by a surety against the prin-

cipal debtor where the multi-State co-opsociety has recovered from the surety anyamount in respect of any debt ordemand due to it from the principaldebtor as a result of the default of theprincipal debtor, whether such debt ordemand is admitted or not;(c) any dispute arising in connection

with the election of any officer of amulti-State co-operative society.(3) if any question arises whether a dis-

pute referred to arbitration under thissection is or not a dispute touching theconstitution, management or business ofa multi-State co-op society, the decisionthereon of the arbitrator shall be finaland shall not be called in question in anycourt.(4) Where a dispute has been referred

to arbitration under sub-section (1), thesame shall be settled or decided by thearbitrator to be appointed by the CentralRegistrar.(5) Save as otherwise provided under

this Act, the provisions of the Arbitrationand Conciliation Act, 1996 (26 of 1996)shall apply to all arbitration under thisAct as if the proceedings for arbitrationwere referred for settlement or decisionunder the provisions of the Arbitrationand Conciliation Act, 1996.

After receiving an approval from the appropri-ate authority, the developer either sells or leas-es out plots to co-operative societies subject todeveloping the land in strict accordance withthe terms and conditions laid down by theauthority.Before starting construction, the society pre-

pares its plans of building construction andobtains an approval from the relevant authori-ty. However, the problem arises when the devel-oper does not complete the construction workas assured. Concurrently, in a rush to get theoccupation certificate from the authority, themembers of the society do not verify whetherthe development of the layouts/sub-division isdone as per plan. The developer, on his part,tends to ignore the problems of the membersand dodges their queries.

Often, he is also prepared to forego thedeposit amount paid to the authority as thecost of development lands up being higher thatthe amount deposited. Importantly, with thework remaining incomplete, the title to theproperty cannot be conveyed to the society.
