Per CCP's disclosure, CCP had twoprospective bidders after the opening ofbid proposals. CCP BAC declared SMPrime Holdings, lnc. eligible to proceedwith the public bidding while PhilippineEstate Corp. was disqualified due toincomplete submission of requirements.Considering the peculiar event of havingone bidder, CCP sought opinion from theOffice of the Govemment CorporateCounsel (OGCC) if they can pushthrough with the public bidding. OGCC'sopinion stated that a sole bidder cannotbe considered as responsive andsuccessful based on COA's and DBM'sguidelines. CCP requested forreconsideration, however, OGCCmaintained its position. 7

Presented validating documents showedthat agreements with satellite partnerswere signed in 2015. lt should be noted,however, that the measure pertains tothe number of new satellite partnershipsforged nationwide.

It must be noted that during thenegotiations for the 2016 PerformanceScorecard both parties agreed that themeasure shall pertain lo new satellitepartnerships. This takes into account thefact that the MOUs have a 3-year validity.

CCP, in a letter dated 25 October 2017,maintains that no new satellitepartnership was established owing to theurgent need to re-assess the Kaisa saSining programs of the existing partners.This justification, however, does notqualil, as "substantial change incircumstance that could not have beenforeseen at the time the targets wereagreed upon. Such re-assessment musthave been taken into consideration byCCP during the negotiations. Moreover,it must be noted that the request forreconsideration of target was not evencommunicated to the Commission duringthe Performance Year.

The foregoing considered, the requestfor reconsideration/appeal is denied.
