On May 18, 2018, La Coordinacion Social y Politica Marcha Patriotica, La Cumbre Agraria,

Campesina, Etnica y Popular (The Agrarian, Peasant Ethnic and Popular Summit) - CACEP and

Instituto de Estudios sobre Paz y Desarrollo (Institute of Studies on Peace and Development) -

INDEPAZ present the Special Joint Report on Human Rights. All of the names, all of the faces,

on the status of social leaders, human rights defenders, ex combatants of FARC-EP and their

relatives in the affected territories of Colombia.

The main factor of threat and insecurity continues to be the existence and operation of

organized crime units who perpetually launch assaults on defenders, social leaders, political

activists, communities FARC members and their relatives. They commit massacres, homicides,

threats, forced disappearances, physical attacks and extortion, as well as committing various

other criminal activity. Among these organized crime groups, special reference is made of the

organizations that are the named successors of paramilitary and their support networks1. This is

then followed by the stigmatization and use of military force against social protests and the

resurgence of extrajudicial executions and “false positives” committed by agents of the State.

The Colombian government is currently developing implementation of new laws and regulations

to address the violence and have agreed to a series of measures within the framework of

systematic violence for the exercise of political opposition and the work of the Human Rights

defenders. However, today we repeat that to date they have not implemented any effective

regulation, nor at the very least, effective regulation in practice. There is evident concern

generated by the issuance of regulations that show a material setback for the guarantee of

rights for Colombian men and women.

In the midst of this reality and the considerations of these contrasts of the past few years, civil

society organizations including Consultoría para Desplazamiento Forzado (Consultory of Forced

Displacement) - CODHES2, el Centro de Investigación y Educación Popular (Center of

Research and Popular Education) - CINEP, la Comisión Colombiana de Juristas (Colombian

Commission of Jurists) - CCJ, Somos Defensores (We Are Defenders), el Instituto de Estudios

Políticos de la Universidad Nacional (The Institute for Political Studies at the National

University) - IEPRI, el Observatorio de Restitución y Regulación de Derechos de Propiedad

Agraria (Observatory of Restitution and Regulation of Rights of Agrarian Property), el Colectivo

de Abogados José Alvear Restrepo3 (Law Firm of José Alvear Restrepo), La Cumbre Agraria,

demand action.

We have continued producing reports that record cases of homicides and contribute in the

analysis of the causes of violence against social leaders, human rights defenders and members

of the FARC and their families.

Adding to the trend presented two years ago relating to the diversity of reports, analysis and

observation on the violence against social leaders, advocates of human rights, their

organizations, their communities and ex-combatants of FARC - EP in the reintegration process;

this is a positive addition because, the more information there is and the more analysis is

carried out in advocacy spaces, communication media and social networks, the more attention

and sensitivity of society is achieved and greater pressure can be exercised towards the State.

We emphasize that the reports indicate a correlation between the reasons for the violence,

areas of affectation, the growth of the aggression, the incapacity of the State and government to

stop it and the serious affectation to the peace context. The difference is in terms of figures,

which we agree with what was indicated in other reports that have their origin in several

reasons: a. Many figures stop only in the field of murders, but do not contextualize a broader or

detailed analysis of violence. b. Time periods and references from different contexts are taken.

c. Some are based on secondary sources and do not have verification mechanisms in the field.

d. There is no criterion unit in the definition of who is a human rights defender and e. different

methodologies for the survey, systematization, characterization, analysis and data exposure.

Acknowledging the existence of sub-registries, we have unfortunately recorded that during the

months of May to November of 2018, the security situation of leaders and social leaders, of

defenders of Human Rights has worsened, so we must update the information to present day.

1. Systematic violence against social leaders and human rights defenders and ex-

combatants of the FARC-EP in the reintegration process and their families

1.1. The current scenario regarding homicides

- Between January 1 and November 17 2018, 226 human rights leaders and/or advocates

have been murdered in Colombia.

-181 of the homicide cases were victims part of peasant, JAC and / or rural ethnic organizations.

Conflicts over land, territory and natural resources account for 80.08% of homicides in 2018.

-To consider the type or motive for conflict, it has been confirmed that those related to coca

crops (substitution pacts or forced eradication) have resulted in 40 cases of homicide (17.69%

of the total).

-30.97% of homicides (70) were committed against members of the national organizations that

make up the Agrarian, Peasant, Ethnic and Popular Summit (Social Coordination and Political

Patriotic March 32, National Indigenous Organization of Colombia - ONIC 26 , Process of Black

Communities - Afro - Colombian National Authority PCN - ANAFRO 5, Congress of Peoples 4,

Ríos Vivos 2 and Movement for the Popular Constituent 1, COMOSOC 1.

-38.93% of the homicides (88) were committed against members of the Colombian Communal

Confederation.

-12.38% of homicides were carried out against women.

Since the presidential election on June 17, 2018, 120 leaders and human rights defenders have

been murdered. 43 between the election and the inauguration of the President and 77 during

the mandate of Iván Duque.

During the period from January 1 to November 17, 2016, 97 leaders and / or human rights

defenders were assassinated. In the same period of 2017, they murdered 159 leaders and / or

human rights defenders. In the same period of 2018, they have murdered 226 leaders and / or

human rights defenders.

It should be noted that in 2018, the departments where the most homicides occurred were

Cauca (48), Antioquia (33), Valle del Cauca (19), Norte de Santander (18), Putumayo (18)

Nariño (13), Córdoba (11), Meta (11) and Caquetá (11). Continuing the 2016 and 2017 trend of

the departments most affected by this type of violence.

-The homicides occurred in 112 municipalities located in 27 departments of the country. 80.53%

of homicides are concentrated in 9 Departments.

-In 2018, the leading amount of homicides were ex-combatants of the FARC - EP in process of

reintegration, 52 homicides were registered, also 9 relatives of ex-combatants were killed.

1.2. Threats

During the analysis period, individual or collective threats, direct and indirect, were presented

through pamphlets, calls, text messages to cell phones, messages on Facebook and WhatsApp

social networks and e - mails. In the case of threatening pamphlets, there are basically two

factors of analysis:

a) Territorial factor: Some were distributed in rural and urban areas of municipalities and others

at the regional level.

b) Material factor: There are two types of threats:

● Targeted human rights defenders and / or organizations that support the processes of

peace, defending their territory from multinationals and illegal mining and actively

participating in the claim of rights through political, legal action and social mobilization

and denouncing corruption. Like ex-combatants of FARC-EP in reintegration process

and relatives; In which in addition to the signaling, and threats of death express

economic rewards are offered for attempt against the lives of people.

● Targeted "thieves", "rapists", "gossipers", "homeless", "drug dealers", "sex workers",

"prostitutes", "motorcycle or car drivers", "husbands who regularly beat their wives ", And

other negative categorizations of "Social Intolerance"5.

Most of the threats were received through pamphlets, in other cases the victims were directly

approached, received phone calls, received text messages, messages through instant

messaging applications, received emails or received messages through third parties.

1.3. Stigmatization and repression of social protest

Although the State participated in the conclusion of the "protocol for the coordination of actions

and guarantees to peaceful protest", which was made into law through Resolution 1190 of

August 3, 2018, since President Iván Duque took office, the expressions of protest in the

exercise of the rights of assembly and public demonstration have been constantly stigmatized

by high officials of the National government, in particular by the Minister of Defense.

Likewise, combined forces of the National Police, the Anti-Disturbance Mobile Squadron -

ESMAD and the Special Operations Group - GOES of the National Army, have reacted to the

days of peaceful protest through infiltration and sabotage and subsequent military repression

against peasants, indigenous people, afro descendants, trade unionists and students.

These war actions have left hundreds of Colombians injured and/or incarcerated.

To date, the relative content, "Protocol for the coordination of actions and guarantees to

peaceful protest" is not being implemented, and particularly in regard to the following points: a.

Role of the public force; b. Coordination instances; c. Verified missions; d. approaches and

principles.

1.4. Forced displacement

Between January and June 2018, the Ombudsman's Office reported that "17,825 people (5,262

families) have been displaced in 55 massive forced displacement events, which occurred due to

causes associated with the internal armed conflict in the country. This represents a significant

increase in trends of forced displacement and the effects on the population, taking into account

that in 2017, 12,841 people were displaced in 51 events registered by the Ombudsman's Office.

Regarding confinement, The Ombudsman's Office has registered approximately 11,214

confined persons on this same date, affecting 66 communities in 6 departments of the country,

due to causes associated with the armed conflict such as restrictions on free movement,

antipersonnel mines, combats and confrontation"6.

According to CODHES figures, 126 massive and multiple forced displacement events occurred

in the first 8 months of the year. In total, 38,490 people have been affected by the

displacements. Of these, 8,376 are Afro-descendant and 7,808 indigenous.

The main causes of displacement have been armed confrontation (43 percent), threats in

intimidation (25 percent) and the presence of armed groups (13 percent). On the alleged

perpetrators of the displacement, CODHES found that they are, in their order: ELN and EPL,

Heirs of Paramilitarism Groups (GHP) and unidentified armed groups.

there have also been reported attacks on the national and regional level, as well as forced

displacements and forced disappearances against ex-combatants of FARC - EP in the

reintegration process.

In the year 2018, False positives were formally acknowledged by the state. Between the months

of January - April, 34 people have been linked to judicial proceedings for rebellion, of which only

6 have been prosecuted.

We want to highlight new mass arrests against leaders who turned themselves in as well as

alerts about alleged arrest warrants against territorial leaders and leaders. Between April 20-23,

2018, 30 people were arrested in 5 different departments, among which were recognized

territorial leaders, who were charged with the crimes of Rebellion, conspiracy to commit a crime,

drug trafficking etc, which implicated membership of the ELN. Like other judicial assembly

processes, the charges were weak and inconsistent in supporting evidence, including

demobilized statements and information from the military forces, which were relevant at the time

of the judge's decision for the arrest warrant.

2. Demands

We insist that the ongoing obstacles of the peace process require new responses to the

aggressions that have been perpetuated against the leaders, human rights defenders and

communities in the priority territories of the peace agreement implementation. The increase of

homicides and aggressions has been denounced by national and international institutions,

social organizations and human rights platforms who are demanding measures of prevention

and territorial/collective protections, such as the following:

a) Consolidate the States integral and effective presence in rural areas, especially the areas

most affected by the armed conflict to strengthen the recognition and support of the legitimacy

of the work by the Community Action Boards, the Afro Colombian community councils and the

indigenous authorities7.

b) Strengthening of self-protection units such as the indigenous and conifer guards of the Cauca

Pacific, plus the recognition and strengthening of the Peasant and Women's Guards.

c) Promote and adopt the draft "declaration on the rights of peasants and other people working

in rural areas" delivered on September 28, 2018, by the UN Human Rights Council.

d) Adopt and incorporate into the Colombian legal system the regional agreement of ESCAZU,

on access to information, participation and access to justice in environmental matters in Latin

America and the Caribbean.

e) Regional pacts of nonviolence and anti-stigmatization, promoted by territorial peace councils

and other institutional mechanisms of the participation system

f) Compliance with peace agreements and participatory implementation of development plans

with a territorial approach and substitution agreements

g) Carry out a process of dissemination, pedagogy and operation coordinated with the

guarantees processes such as the decree Decree Law 895 of 20178, Decree No. 2124 of

December 18, 20179, Decree No. 2252 of December 29 of 201710 and Decree 660 of April 17,

201811, Resolution 1190 of 201812, Directive No. 002 of 2017 of the Attorney General's Office

and Directive 002 of 2017 of the Office of the Attorney General of the Nation, among others.

h) Incorporation of the agreements of substitution of illicit crops of all the families that have

expressed their willingness to participate and therefore the suspension of forced eradication in

those territories

i) End the repeated stigmatization and criminalization of social protest and social leaders,

human rights defenders and organizations by state officials and servants, which increases the

risk of attacks.

j) Overhaul the Damascus military doctrine and the role of the public force and refine it by

prioritizing the territories where there are higher rates of human rights violations and where

there is paramilitary involvement.

k) Issue, in a massive and constant manner, State declarations and public actions of

recognition, respect and support for the work of defending human rights, highlighting the

importance of these in society.

l) Respond and advance effectively to investigations and prosecutions for crimes perpetrated

against social leaders, human rights defenders, ex-combatants of FARC-EP and their family

members committed to peace; mainly around those who finance and promote these groups;

likewise, pursue the investigations of the crimes committed in the development of the armed

conflict as part of the guarantees of non-repetition, establishing material and intellectual leaders

who remain in impunity, as well as extrajudicial executions, including those of which are being

investigated senior military commanders.

m) Centralize cases of human rights violations committed against social leaders and human

rights defenders by paramilitary groups, GAO, paramilitary successor groups, criminal groups or

criminal allies of the above mentioned and put under special investigation. This includes those

that are not within the jurisdiction of the Special Directorate of Human Rights Research, to

ensure special treatment in investigations, by qualified professionals.

n) Urgent execution of the investments defined in regional plans and plan contracts in the

municipalities most affected by violence

o) Urgent social investment plan for youth and women with massive participation in educational

programs and productive and cultural projects

p) Strict compliance of the commitments with the many ex-combatants in the Location Zones

q) Political and social commitments by full implementation of the agreements with the

communities in the territories (Buenaventura, Chocó, Tumaco, Cauca, Bajo Cauca, MIA,

Agrarian Summit, Indigenous Minga)

r) Anti-corruption plan that commits all State agents, companies and civil society organizations

to avoid any complicity, collaboration or involvement with illicit economies and violent dynamics

by the appropriation of public resources and income via legal or illegal means

s) Safeguard and implement precautionary measures in defense of the territories as a whole for

indigenous, peasant, Afro, and urban communities, guaranteeing a dignified life.

t) Fully comply with the law of victims 1448 and the decrees law and non-ethnic processes.

Extend the duration of the victims' law and guarantee budget. That guarantees the process of

design, adjustment, implementation and monitoring of this policy, a broad and effective

participation of the victims in the processes of truth, justice and integral reparation and a

guarantee of non repetition of the heinous crimes.

u) Establish a route of compliance with the pacts and the Interlocution Tables and Agreements

signed by the government with the communities in the southwest territories.

v) Reactivate and strengthen inter-institutional and social spaces and processes of Guarantees

(National and Territorial Guarantees Tables, Protection Sub-Committees and Territorial Tables)

and comply with the agreements agreed with the Sub-Committee on Guarantees and Human

Rights of the National Single Committee and the National Board of Guarantees for Human

Rights Defenders.

w) Specifically to Judges and justice operators: refrain from participating in any form of undue

criminalization of human rights defenders, demanding due evidence to process the proceedings,

reviewing the credibility of the testimonies presented as evidence, etc. Likewise, Facilitate the

procedures for the freedom of the leaders arbitrarily detained and those who have been

subjected to long and inconclusive proceedings against them.

x) Bilaterally resume the dialogues with the National Liberation Army, seeking to address the

agreed agenda and urgently sign a definitive agreement that leads to the ceasefire of hostilities

and effective measures that will de-escalate the conflict with guarantees to the civil population

and the participation of society in the construction of peace.
