1. WHO CAN APPLY TO THE IRU ACADEMY ADR PROGRAMME? The ADR Programme is open to any organisation with qualified ADR instructors that wants to offer internationally recognised, high-quality ADR training. The organisations that can apply under the ADR Programme include (this list is not exhaustive):

1) Road Transport Associations; 2) Vocational Training Schools; 3) Training Institutes; 4) Universities; 5) Road Transport Operators.

2. HOW TO APPLY TO BECOME PART OF THE INTERNATIONAL

NETWORK OF IRU ACADEMY ADR ACCREDITED TRAINING INSTITUTES (ADR ATIs)?

To become a Member of the International Network of IRU Academy ADR Accredited Training Institutes (ADR ATIs) you must submit an application. There are four ADR Programmes for which your Training Institute can apply:

1) ADR Programme for Drivers transporting ADR in Packagings and Bulk, excluding Classes 1 and 7 (*)

2) ADR Programme for Drivers transporting ADR in Tanks, excluding Classes 1 and 7

3) ADR Loading and Unloading Specialist 4) ADR Dangerous Goods Safety Advisor

The following pages list the elements which must be included in your application. All information must be submitted in English only! The IRU Academy will only process applications which are duly completed.

(*) You can only get accreditation for the ADR Programme for Drivers

transporting ADR in Tanks, excluding Classes 1 and 7 if you have accredited for the ADR Programme for Drivers transporting ADR in Packagings and Bulk, excluding Classes 1 and 7.

3. TWO SIMPLE APPLICATION STEPS To apply to become an IRU Academy ADR Accredited Training Institute (ADR ATI) and to apply for courses within the IRU Academy ADR Programme, you must:

STEP 1) Transfer the Application Fee STEP 2) Submit your Institute’s duly completed Application

TRANSFER THE APPLICATION FEE Application Fee Your Institute must transfer the applicable Application Fee as per the information provided in Table 1 of this booklet (see Section 6 & Appendix 5). The IRU Academy will not process Applications for which the Application Fee has not been received. SUBMIT YOUR INSTITUTE’S DULY COMPLETED APPLICATION The documents needed to make your application duly complete are: ADR ATI Letter of Intent and Copy of Bank Transfer A Letter of Intent (See Appendix 4), showing your interest to join the ADR Programme, with a Copy of the Application Fee Bank Transfer enclosed, must be sent to the IRU Academy. ADR ATI Application Check List Your Institute must tick the appropriate boxes on the ADR ATI Application Check List (See Appendix 3). ADR ATI Application Form Your Institute must duly complete and return the “ADR ATI Application Form” (See Appendix 5). The information provided will appear on the IRU Academy Web Site through the “IRU Academy Online”.

Please do NOT submit an individual form for each branch! ADR ATI Branches Listing Form Your Institute’s ADR ATI branches will benefit from your accreditation, including the use of “IRU Academy Online”. The only requirement is for your Institute to list each of those branches using the enclosed “ADR ATI Branches Listing Form” (See Appendix 6), which must be duly completed, if applicable, and submitted with your Institute's application. ADR ATI Questions on Quality Processes Your Institute must submit the duly completed answers to the Quality Control Questions for your Institute (See Appendix 7). ADR Instructors Data & Questions Your Institute must list all Instructors that will conduct IRU Academy ADR Accredited Classes, including those of your branches, using the “ADR Instructors Data & Questions” Form (See Appendix 8). Only those ADR Instructors listed will be permitted to teach the ADR Classes for which your Institute is accredited! ATI Agreement Your Institute must submit the duly completed and signed “IRU Academy ATI Agreement” and its Annex A (See Appendix 9). Important! In case of doubt, contact the IRU Academy at [email protected] to complete Annex A of the “IRU Academy ATI Agreement”. National Certificate of Approval as an ADR Institute

Upon signing the IRU Academy ATI Agreement, your Institute certifies to be in possession of a national (regional) ADR training institute approval document.

Documentation per ADR Instructor

Upon signing the IRU Academy ATI Agreement, your Institute certifies that its ADR Instructors, including those of your branches, meet the strict IRU Academy quality criteria and is able, upon request, to provide for each instructor at least one of the documents listed under each of the 3 bullets printed below:

(1) Proof of Subject Knowledge: A proof of academic background, A valid ADR certificate for the course(s) he/she would

like to teach or, A valid certificate of approval to instruct ADR courses

issued by the competent national (Regional) Official Authority or,

A valid Dangerous Goods Safety Advisor (DGSA) certificate issued by the competent national (Regional) Official Authority.

(2) Proof of Working Experience:

At least one letter by an employer (former or current) stating that he/she has working experience in dealing with Dangerous Goods, preferably ADR, indicating for how long he/she performed this task.

(3) Proof of Teaching Experience: A proof of academic background, A letter from a training provider for which he/she works or

worked, stating that he/she has at least 12 months teaching experience or,

A letter from the training provider stating that he/she is guided by another ADR Instructor who is coaching your ‘new’ Instructor until he/she reaches a satisfactory level of 12 months teaching experience or,

An official license (degree) as a teacher, instructor or professor.

Your Institute’s ADR Lesson Plan Your Institute must submit its ADR Lesson Plan in English. Your Institute shall provide additional information to the IRU Academy with its application and it may be submitted in your national language. Examples are:

ADR Course Books; ADR Work Books, with Model Answers; ADR Practise Tests, with Model Answers and Marking

Scheme; ADR Teaching Aids; ADR Promotional Materials, e.g. ads, brochures,

pamphlets, newsletters, etc.

4. IRU ACADEMY ADR TRAIN-THE-TRAINER As soon as possible following Accreditation, your Institute must have at least the Principal ADR Instructor trained by the IRU Academy, who will then train all other ADR Instructors. This training will cover the following objectives:

Full coverage of the IRU Academy ADR Lesson Plan and ADR Recap Exercise;

Best Teaching Methods for ADR; An insight in the latest developments in ADR legislation; An overview of the IRU and IRU Academy (for new ATIs).

Participation is free of charge for one ATI Principal ADR Instructor from your Institute. Additional ADR Instructors (named ATI Additional ADR Instructors) wishing to participate in this ADR Train-the-Trainer will pay a Registration Fee (See Section 6, Table 2). This ADR Train-the-Trainer event will be held at a location decided by the IRU Academy and most appropriate based on demand. For more information, visit: www.iru.org/academy. 5. WHAT WILL YOU RECEIVE ALONG WITH YOUR ACCREDITATION? Once accredited, your Institute and its Branches, if any, will be permitted to operate and promote themselves as IRU Academy ADR Accredited Training Institute (ADR ATI). Your Institute will receive:

An original signed copy of the IRU Academy ATI Agreement;

An official IRU Academy ADR ATI Accreditation Certificate;

Access Codes to your ADR ATI’s private web site and IRU Academy Interactive Training Programme; An access to the Academy Content Management (ACM) to consult and download the IRU Academy ADR Programme and the IRU Academy ADR Instructor Guide;

An over-the-phone training in the use of the “IRU Academy Online”;

Regular updates on latest changes in the field of ADR;

Access to the IRU Academy events;

IRU Academy Promotional Materials;

and more. 6. WHAT IS THE COST TO BECOME AN ATI ACCREDITED IN THE IRU ACADEMY ADR PROGRAMME? All fees indicated are in Swiss Francs (CHF). APPLICATION FEE The following application fees concern the two first accreditations only. For the third and subsequent accreditations, accreditation fees are reduced by 50%. The Application Fee is non-refundable. ANNUAL FEE The Annual Fee is a flat rate of CHF 190, irrespective of which IRU Academy ADR programme the ATI holds accreditation(s) for. For the third and subsequent accreditations, the annual fee is reduced by 50%.

PER STUDENT FEE Your Institute and its branches, if any, commit to register its students in the “IRU Academy Online” (AOL) to maintain its accreditation. For each Certificate issued to a student registered in AOL, an “IRU Academy Certificate Fee Per Student” will be settled on a yearly basis and must be paid within 30 days of the invoice date. The “IRU Academy Certificate Fee Per Student” is calculated as 2% of your Institute’s “Full Training Fee Charged to Students by ATI” that must be indicated in Appendix 9 (pages 10-14 – Annex A to the ATI ADR Agreement). The “IRU Academy Certificate Fee Per Student” is due for all students who have graduated from the ADR programme and is based on the calculation indicated in your Institute’s completed form “Annex B” as given in Appendix 9 (pages 15-16 – Annex B to the ATI ADR Agreement). At the end of the calendar year, there may be a need to reconcile any fee discrepancy due to difference in the number of students who have obtained a Certificate, any changes in the “Full Training Fee Charged to Students by ATI” made by your Institute in the course of the previous calendar year and the average annual exchange rate applicable for the conversion of the “IRU Academy Certificate Fee Per Student” in Swiss Francs. Your Institute must submit to the IRU Academy Secretariat a completed form “Annex B” as given in Appendix 9 (pages 15-16 – Annex B to the ATI ADR Agreement) for the purpose of reconciling any discrepancy with the IRU Academy calculations. 7. HOW TO UPDATE ACCREDITATION INFORMATION? The accreditation will remain valid until cancellation or termination of the IRU Academy ATI Agreement. Any update of information related to the training programme(s) delivered by the ATI under IRU Academy accreditation or by the IRU Academy will require renewal of Annex A that will need to complete, sign and return it to the IRU Academy secretariat. All Instructors from your ATI, including those of your branches, who deliver the IRU Academy ADR Programme shall undertake the IRU Academy ADR Instructor Tests and obtain a pass rate of minimum 80% to ensure high standards of training delivery of this programme. 8. 1. PREAMBLE

Through this agreement, the ATI confirms that it has fulfilled all the requirements of the application procedure for IRU Academy Accreditation and hereby agrees to undertake the following:

2. GENERAL

2.1. To take responsibility for its activities and those of its Branch Offices as well as for full compliance with the terms of this IRU Academy ATI Agreement and any applicable laws.

2.2. To observe, support, promote and implement IRU Academy training programmes and to refrain from taking positions or communication, public or private, by the ATI or by its management, in contradiction with the policy of the IRU or the IRU Academy.

3. ATI ACCREDITATION RIGHTS

3.1. The ATI is accredited by the IRU Academy as an IRU Academy Accredited Training Institute to conduct itself and through its Branch Offices the Programmes for which it is accredited in Annex A, which forms an integral part of this IRU Academy ATI Agreement. This Annex should be duly completed by the ATI and returned signed to the IRU Academy together with the signed IRU Academy ATI Agreement.

3.2. All new ATI accreditation, for another IRU Academy programme, will require the fulfilment of the same accreditation procedure and renewal of Annex A of this IRU Academy ATI Agreement.

3.3. The ATI will receive, upon Accreditation and full payment of the corresponding fee to the IRU Academy, for every IRU Academy Programme for which it receives IRU Academy accreditation, an official IRU Academy Accreditation Certificate / Attestation.

3.4. The ATI undertakes:

3.4.1. To register all of its IRU Academy Accredited Classes, Students, their respective grades in percentage (%) and Graduates’ Diplomas / Certificates in the IRU Academy AOL Internet Application.

3.4.2. To use the “IRU Academy Content Management” System (ACM) to access updated programme material, as required.

3.4.3. To use the “IRU Academy Accredited Training Institute (ATI)” logo and name as well as other supporting materials to promote the IRU Academy Programmes for which it is accredited.

3.4.4. To systematically print IRU Academy Diplomas / Certificates for each student having graduated from a training programme and publish these Diplomas / Certificates on the IRU Academy AOL Internet Application.

3.4.5. To enable graduates from IRU Academy training programmes to publish their Diplomas / Certificates, together with their personal profile, on the IRU Academy AOL Internet Application, with a view to opening access for potential business partners / employers.

3.5. The ATI is promoted on the IRU Academy web site and presentations as an IRU Academy Accredited Training Institute (ATI).

4. ATI ACCREDITATION OBLIGATIONS

4.1. The ATI cannot bind the IRU Academy in any manner whatsoever as a result of its accreditation by the IRU Academy.

4.2. The ATI agrees to become accredited for each training programme it is delivering for which an IRU Academy equivalent programme already exists as soon as possible, but not later than within one calendar year of the signature of this IRU Academy ATI Agreement.

4.3. The ATI commits to systematically issue IRU Academy Diplomas and/or Certificates to each student who successfully graduates from any IRU Academy accredited programme.

4.4. The ATI has the responsibility to promote the IRU Academy’s principles of high quality training standards, international recognition and excellence in professional road transport training towards its national authorities, students and other national stakeholders.

4.5. The ATI agrees to establish links with the National Competent Authorities in order to have the IRU Academy Diplomas / Certificates countersigned by a high level official of the National Competent Authority.

4.6. The ATI will maintain its premise(s) and classroom facility(ies) to the highest quality standards.

4.7. The ATI and its Instructors commit to maintain the highest quality training for all of its IRU Academy Accredited Programmes and to deliver these training programmes in strict conformity with the related programme plans.

4.8. To ensure high standards of training delivery, all ATI Instructors, including the Additional Instructors and those engaged in the ATI branches, who deliver IRU Academy programmes shall undertake appropriate training for each accredited programme and succeed in the relevant IRU Academy Instructor Test(s) available on the IRU Academy Content Management system (ACM).

4.9. The ATI commits to make available to the IRU Academy a copy of its training programme(s) and their related materials in electronic format in its native language, together with an English translation of the table of content.

4.10. The ATI confirms that it is duly registered and holds all applicable licenses and documents as required by the laws of its respective country.

4.11. The ATI commits to implement any modification required by:

- a change in the National Legislation

- the National Competent Authorities

- the IRU Academy

and inform the IRU Academy in writing without delay.

4.12. The ATI commits to have at least one “ATI Principal AOL Administrator” trained in the use of the “IRU Academy Online”.

4.13. The ATI commits to register and manage its classes by using the IRU Academy AOL Internet Application.

4.14. The ATI accepts to inform its IRU Academy training graduates about the availability of the IRU Academy AOL Internet Application, provide access details to their personal pages and train them in the use of AOL.

5. COMMUNICATION

5.1. The ATI will assign at least one (1) ATI Liaison Person, fluent in English, who will ensure, to the IRU Academy’s full satisfaction, proper and timely communication.

5.2. The ATI will, without delay, advise the IRU Academy of any changes to the information submitted within the Accreditation Process, including the names and qualifications of its Instructors.

5.3. The ATI accepts to have at least one Principal Instructor trained per IRU Academy Programme (with the exception for the CPC Manager and CPC Driver Programmes that require preparation of at least two Principal Instructors), as required in Annex A, at a location decided by the IRU Academy.

5.4. The ATI reserves the right to provide training to any additional instructor(s) itself or may have them trained by the IRU Academy in accordance with the terms mentioned in Annex A to this ATI Agreement. All IRU Academy training of Additional Instructors is at the cost of the ATI, but is not mandatory for IRU Academy accreditation.

6. FEES TO BE PAID TO THE IRU ACADEMY

6.1. All fees per IRU Academy Accredited Programme are defined in Annex A and are non-refundable.

6.2. The fee to be paid to the IRU Academy for each Diploma / Certificate distributed to a graduate and for any accredited programme will be invoiced by the IRU Academy once a year. The amount to be charged per programme will represent 2% of the full training fees charged to the graduates by the ATI for the respective programme as mentioned in Annex A.

6.3. The IRU Academy is entitled to modify any applicable fees. However, to avoid any retroactive charge on students due to these adjustments, such changes can only be undertaken at the end of the calendar year.

6.4. The ATI shall inform without any delay the IRU Academy Secretariat of any changes to the full training fees charged to students by itself.

6.5. Any modification of the fees as per paragraphs 6.3 and 6.4 above would require the renewal of Annex A to this ATI Agreement.

6.6. In order to ensure that data registered in the IRU Academy AOL Internet Application truly reflects the number of graduates who successfully passed the exams, and to allow the IRU Academy to properly inform the IRU Academy Advisory Committee (ADC) on the training activities undertaken by the ATI, every year, latest by 15th January, the ATI shall return to the IRU Academy Secretariat one duly completed and signed copy of Annex B for all programmes for which it holds IRU Academy accreditation.

6.7. Taking into consideration information available in the IRU Academy AOL Internet Application and information provided by the ATI in Annex B, the IRU Academy will establish an invoice with the total number of ATI graduates from IRU Academy accredited programmes.

6.8. The ATI shall settle all IRU Academy fees within 30 calendar days of the IRU Academy invoice date.

7. QUALITY CONTROL AND AUDIT

7.1. The IRU Academy must be immediately informed about any modification in the ATI accreditation data.

7.2. In case of any doubt in the ATI’s fulfilment of the IRU Academy accreditation requirements, the IRU Academy may require the ATI to undertake a reaccreditation process and / or to be audited.

7.3. The ATI agrees to authorise the IRU Academy or its representative to inspect, at its discretion and without prior notice, the ATI premises, classroom facilities, official registration or any other related documents, and to audit instructors, classes and teaching methods as deemed necessary.

7.4. The IRU Academy is entitled to conduct independent auditing on the full training costs charged to students by the ATI.

8. USE OF IRU ACADEMY LOGOS AND NAMES

8.1. The IRU Academy logos and names can only be used by the ATI and its branches throughout the period during which the training centre is accredited.

8.2. The IRU Academy Accredited Training Institute logo may be used in promotional materials directly linked to the accredited programme(s).

The logo may also be used on the ATI’s:

- website - letterhead paper - business card - brochures

Any other use of the IRU Academy logos and corporate identity should be agreed with and approved by the IRU Academy.

In order to guarantee the trade mark and the quality of reproduction of the IRU Academy and IRU Academy Accredited Training Institute logos, it is essential that only the logos provided by the IRU Academy via the Academy Content Management system (ACM) are used in any publication.

8.3. In no circumstances may IRU Academy or IRU Academy Accredited Training Institute logos appear on non-IRU Academy Diplomas / Certificates issued by the ATI or its branches. It is also forbidden to use the IRU and IRU Academy names and logos after termination of the ATI’s accreditation.

The institutes are advised against using photocopies of the logo for documents distributed outside of their administrative framework.

8.4. The IRU Academy Graduate logo was created to give the possibility to directly associate a Graduate’s name with the values which the IRU Academy training programme stands for: international recognition and quality of training. This logo can only be used by students who have graduated from an IRU Academy Accredited Training Institute and have successfully completed an IRU Academy programme.

The logo may only be used on the following documents:

- Graduate’s business card - Graduate’s CV - Graduate’s personal web page - The web page of the company, in direct connection with Graduate’s name.

9. COPYRIGHTS

9.1. All contents of the IRU Academy training material made available to the ATI through accreditation is protected worldwide by copyright and other intellectual property rights. The use of this material is strictly limited to the ATI for programme delivery in the strict framework of its accreditation. All IRU and IRU Academy copyrights and intellectual property rights survive the termination of the ATI Accreditation.

9.2. Any translation, representation, copy, reproduction, dissemination or use of all or part of the material, in any form by any means, for activities that are outside the scope of the ATI agreement is illegal.

9.3. For use of IRU Academy material outside the framework of IRU Academy programmes, the ATI must ask for a written permission of the International Road Transport Union – Head of the IRU Academy. In cases of non respect of these provisions, offenders make themselves liable to legal proceedings and sanctions.

10. DISCLAIMERS

The user hereby is aware and agrees that neither the IRU Academy, nor any other party or anyone cooperating with the IRU Academy on a voluntary or paid basis, shall be liable for the contents of the IRU Academy programmes and their use and shall not in any way be liable for any loss or damage whatsoever, including the inappropriate, improper or fraudulent use of IRU Academy programmes.

No user should act on the basis of programmes without referring to the relevant international and national regulations in force.

The designation of countries, territories, cities and the presentation of related material in the IRU Academy programmes shall not be considered as implying any standpoint whatsoever on the part of the IRU Academy concerning the political or legal status of any country, territory or city, or of its authorities, or concerning the delimitation of its frontiers or boundaries.

11. FAILURE TO RESPECT THE IRU ACADEMY ATI AGREEMENT AND TERMINATION OF THE ATI ACCREDITATION

11.1. The IRU Academy or the ATI may cancel the IRU Academy ATI Agreement at any time, without any financial compensation or indemnity, subject to prior notice of at least 1 month sent by registered letter with acknowledgement of receipt addressed to the other party. The cancellation of the IRU Academy ATI Agreement automatically terminates the ATI Accreditation for all IRU Academy programmes.

11.2. If the ATI fails to respect the obligations entered into by it by virtue of this IRU Academy ATI Agreement, the Head of the IRU Academy shall:

- issue a warning to the ATI, by registered letter with acknowledgement of receipt addressed to the ATI, detailing the observed irregularities and requiring it to rebut or redress the alleged situation to the satisfaction of the IRU Academy within a given time limit,

- cancel this IRU Academy ATI Agreement, without any financial compensation or indemnity, with immediate effect or after a given time limit, in cases where the ATI does not remedy the situation to the satisfaction of the IRU Academy.

11.3. Cancellation of the IRU Academy ATI Agreement may also result from but is not limited to:

any action which may compromise the IRU, IRU Academy or its ATIs international credibility, image and reputation;

misuse of the IRU Academy logos or name; unauthorised issuance or reproduction of IRU Academy Diplomas and / or

Certificates;

Unsystematic issuance of IRU Academy Diplomas and / or Certificates as per the provisions of paragraphs 4.3 and 11.4;

unpaid fees; bankruptcy or similar proceedings against the ATI; mutual agreement.

11.4. This IRU Academy ATI Agreement will immediately become null and void in the case of non-respect by the Accredited ATI of its obligation to systematically issue IRU Academy Diplomas / Certificates (to each graduate per each IRU Academy accredited programme) as per the current agreement.

11.5. In case of cancellation of the IRU Academy ATI Agreement, the ATI has the obligation to:

remove from all of its electronic, video or paper support the names and the logos of the IRU, of the IRU Academy and the IRU Academy Accredited Training Institute;

hand over to the IRU Academy Secretariat all non issued Diplomas / Certificates still in its possession;

hand over to the IRU Academy Secretariat all IRU Accreditation Certificates.

11.6. As per the date of termination of the ATI Accreditation, the IRU Academy will publicly display and inform its stakeholders about the termination of the ATI Accreditation status.

12. APPLICABILITY AND COMPETENCE

12.1. This IRU Academy ATI Agreement, its form, validity and the resulting obligations shall be subject to Swiss law, and only the version in English, signed by the ATI, shall be applicable in its relations with the IRU Academy.

12.2. The provisions of this IRU Academy ATI Agreement shall be governed with respect to and in accordance with the laws of Switzerland. Any dispute arising out of, or in connection with, or in the implementation of this IRU Academy ATI Agreement, shall be, whenever possible, settled amicably. Any dispute, which cannot be settled amicably, shall be settled before the Courts of the Canton of Geneva. An appeal to the Swiss Federal Court is admitted.

13. ENTRY INTO FORCE AND VALIDITY OF THE IRU ACADEMY ATI AGREEMENT

13.1. This IRU Academy ATI Agreement shall enter into force on the date of its signature by the Secretary General of the IRU.

13.2. This IRU Academy ATI Agreement annuls and replaces all precedent Agreements separately signed between the IRU Academy and the ATI. It applies exclusively to all IRU Academy programmes for which the ATI is accredited.

13.3. Annexes A and B form an integral part of this IRU Academy ATI Agreement.
