What is the Legal Status of CBD?
In the US, the legal status of CBD is clear – CBD is Legal in all 50 states under the “Industrial Hemp Farming Act of 2015’’
This is a very common question due to the misinformation surrounding CBD’s chemical properties that closely resemble THC’s properties.
H.R. 525 - Industrial Farming Act of 2015 defines Industrial Hemp as ““the 15 plant Cannabis Sativa L and any part of such plant, whether growing or not, with a delta-9 Tetrahydrocannabinol (THC) concentration of not more than 0.3 percent (0.3% or less THC) on a dry weight basis.”

Where Does CBD Oil Come From? CBD oil is extracted from the Industrial Hemp plants grown specially
to contain high concentrations of Cannabidiol (CBD). Industrial Hemp belongs to the plant species named ‘cannabis’.
There are many varieties and several categories of Cannabis plants. The two most popular categories are the Non-Psychoactive plant (Industrial Hemp) and the Psychoactive plant (Cannabis or Marijuana). Industrial hemp is considered unsuitable for recreational use as it will not produce the euphoria or “high” feeling when consumed.
What Is Cannabidiol (CBD)? This is a frequently asked question. Cannabidiol (CBD) is a natural
substance that has emerged into the spotlight for several reasons. CBD is one of over 500 compounds, and among a class of at least 113 molecules called Cannabinoids found within Cannabis Plant (Marijuana and Industrial Hemp).
The definition of “Cannabinoids” has evolved over time. Cannabinoids were originally defined as compounds produced only by plants, now termed “Phyto-Cannabinoids”. The definition has been expanded upon the discovery of our body’s own natural production of Cannabinoids “Endocannabinoids” and the production of artificially manufactured Cannabinoids “Synthetic Cannabinoids.”
Of these compounds, CBD and THC are usually present in the highest concentrations, and are therefore the most recognized and studied.
CBD is natural & safe to consume, as well as legal in all 50 states and 40 countries. The FDA classifies CBD as a food product. Currently the most popular known forms are sublingual (under the tongue) or oral edibles, yet topical products continue to grow in popularity. Cannabidiol, so we wanted to take the time to explain. Below are some of the most important Cannabidiol related terms to understand.• Cannabis – A type of tall flowering plant that includes three distinct
variations: Cannabis Ruderalis, Cannabis Indica, and Cannabis Sativa. Cannabis has a wide range of industrial and medical applications and has been used since ancient times for its sturdy fiber, oils, and medicinal purposes. The different plant variations containing high THC concentrations, being cultivated & utilized as a recreational drug, remain strictly regulated.
• Industrial Hemp – Industrial Hemp refers to the increasing varieties of Cannabis that are grown specifically to be utilized for seeds, oils and fibers. Industrial Hemp is also grown, processed & refined into numerous products including wax, resin, cloth, pulp, paper, rope, fuel, and hemp oil.
• Cannabinoids – A very diverse chemical family including plant, animal & artificially derived compounds. Different Cannabinoids possess widely varied effects, with some Cannabinoids proven to possess soothing & relaxing properties, while others are classified as illegal drugs.
• CBD – Cannabidiol (CBD) is a naturally occurring Cannabinoid, and the second most abundant constituent of the Cannabis plant. CBD is safe to consume and is legal in all 50 states and 40 countries.
• THC – Tetrahydrocannabinol (THC) is the most abundant constituent of the Cannabis plant and a strongly Psychoactive Cannabinoid. THC is responsible for the “high” obtained from smoking Marijuana, thus its production and usage is strictly regulated.
• Psychoactive – Any chemical substance entering the brain and directly affecting the Central Nervous System is considered Psychoactive. Many Psychoactive substances have medical applications (i.e., Anesthetics, Psychiatric drugs, etc.), yet some of these substances are used solely for recreation, resulting in dangerous side effects and addiction.
• Intoxicating – Any substance causing one to alter their behavior, or causing one to lose control of one’s faculties. Almost all illegal drugs have Intoxicating properties, although worldwide most Intoxication cases are attributed to alcohol. Intoxication can be caused by substances that directly affect the brain (i.e., Psychoactive) or by indirectly causing damage to your organs (i.e., through Toxicity, hence the term).
What Is the Endocannabinoid System (ECS)? The ECS is perhaps our body’s most important Physiologic system
involved in a variety of processes including Appetite, Immune System functions, Inflammation, Memory, Mood, Nausea, Pain Management & Sleep. The ECS exists in all humans and many animals, and is active from before birth until the end of life.
The ECS consists of a series of internal Endocannabinoids and Cannabinoid Receptors throughout the body; within the Brain, Organs, Connective Tissues, Glands, and immune Cells. In each area, the ECS performs different tasks, however the goal is always the same, Homeostasis (the ability of the body to maintain stability needed to function properly), which aids in overall health and wellbeing. Our bodies constantly produce Endocannabinoids to keep our body in Homeostasis, but for many reasons the ECS can fail due to many reasons such as lifestyle, pollution, disease, and or any other factors.
Researchers have discovered two main Endocannabinoid Receptors, Cannabinoid 1 (CB1) and Cannabinoid 2 (CB2), both receptive to Endocannabinoids (naturally produced within our bodies) and Phyto-Cannabinoids (plant-based). CB1 Receptors are primarily found in the Central Nervous System – mostly affecting the brain and CB2 Receptors are primarily found within the Immune, Gastrointestinal (GI) and Peripheral Nervous Systems.
The most notably studied Cannabinoids are Phyto-Cannabinoids, Tetrahydrocannabinol (THC) & Cannabidiol (CBD), and how they interact with the ECS. Research confirms CB1 Receptors are keyed to THC and responsible for the feeling of intoxication. From a therapeutic standpoint, THC’s most important effect is to modulate and moderate the perception of pain.
The intensity of pain is reduced when THC is present in the CB1 Receptor sites. For this reason, THC medications are so prized by people with intense pain issues. Additionally, CB1 Receptors are not present in the part of the brain that regulates heart rate & respiration, so unlike narcotics, there is no lethal dose threshold for THC, allowing one to consume as much as needed for its palliative effects.
CB2 Receptors are keyed to CBD and influences many of our body’s systems. In the immune System CBD acts as an Anti-Inflammatory agent to boost the Immune System’s functions. In the GI system, CBD has Anti-Spasmodic properties and in the Peripheral Nervous System, CBD is noted for its calming & relaxation effects.
According to the National Institutes of Health, manipulating the ECS by introducing external Cannabinoids like CBD, could be useful in
treating a variety of medical ailments.Armed with the known impact of how CBD interacts with the ECS, as well
