AN ACT RECTIFYING TH E PERIO D TO C O N STITU TE THE SEARCH COMMITTEE FOR THE PRESIDENCY OF THE PALOMPON INSTITUTE OF TECHNOLOGY AN D E X T E N D IN G T H E D E A D L IN E FO R IT S CO M PLIA N C E W ITH T H E R E Q U IR E M E N T S OF THE COM M ISSION ON H IG H ER EDUCATION FOR C O N V E R S IO N IN T O A S T A T E U N IV E R S IT Y , TH EREBY AM ENDING SE C T IO N S 9 AND 25 OF REPUBLIC ACT NO. 10599

Be it enacted by the Senate and House o f Representatives o f the Philippines in Congress assembled:

S ection 1. Section 9 of Republic Act No. 10599, en titled “An Act C onverting the Palom pon In s ti tu te of Technology in the M unicipality of Palom pon, P rovince of Leyte In to a S ta te U n iv ersity to be Known as the Palom pon Polytechnic S ta te U niversity , In teg ra tin g T herew ith the M arcelino R. Veloso

N ational Polytechnic College in the M unicipality of Tabango, Province of Leyte and A ppropriating Funds Therefor”, shall be am ended to read as follows:

“S e c . 9. The U niversity P residen t. - The U n iversity sh a ll be headed by a P resid en t, who sh a ll re n d e r fu ll-tim e service and who sh a ll be appointed by the Board, subject to the guidelines, qualifica tions and s ta n d a rd s se t by the Board, upon recommendation of a duly constituted search com m ittee. The U niversity P resid en t shall have a term of four (4) years and sh a ll be elig ib le for reappo in tm ent for ano ther term : Provided, T hat in o rder to effect a sm ooth tra n s itio n to a s ta te u n iv e rs ity , th e in cu m b en t P re s id e n t of th e Palom pon In s ti tu te of Technology, if qualified,

' sh a ll se rv e as th e in te r im P re s id e n t of th e U niversity . However, w ith in th ree (3) m onths from the effectivity of th is Act, a new P res id en t shall be appoin ted by the Board.

“W ithin two (2) months before the expiration of the term of office of the in terim P residen t of the University, the Board shall constitute the Search Committee for the Presidency (SCP).

XXX.

S e c . 2. Section 25 of R epublic Act No. 10599 sh a ll be am ended to read as follows:

“Sec. 25. Compliance With CHEDRequirements.- The provisions of th is Act n o tw ithstand ing , the conversion of the in s titu tio n in to a s ta te u n iv ers ity sh a ll become effective only upon the d e te rm in a tio n and d ec la ra tio n by th e CHED, based on the recommendation of a panel of experts, t h a t th e in s t i tu t io n h a s com plied w ith th e re q u ire m e n ts for u n iv e rs ity s ta tu s based on CHED M em orandum O rder No. 46, series of 2012.The CHED, through its regional office, shall regularly provide technical assistance to the in stitu tio n and m onitor compliance w ith the requirem ents of the Commission.

“T he CHED sh a ll d e s ig n a te a p an e l of ex p e rts who shall p rep are a recom m endation to th e C hairperson of the CHED, on w h e th e r the in s titu tio n has su b s tan tia lly com plied w ith the req u irem en ts for the g ran t of u n iversity s ta tu s .

“The following operational requirem ents for a un iversity , as es tab lish ed by the CHED, sh a ll be complied with:

“(a) Faculty members who possess relevant degrees in their areas of speciahzation, as required by the CHED, and shall have p a rtic ip a te d in re sea rch and developm ent a c tiv itie s in th e ir respective disciplines, as evidenced by refereed publications and o ther scholarly ou tputs;

“(b) A co m p re h en s iv e ra n g e of d eg ree program s in all levels, from basic post-secondary to doctoral program s;

“(c) V iable re search p rogram s in specific (d isc ip lin a l an d m u ltid is c ip lin a ry ) a re a s of study th a t produce new knowledge, as evidenced by refereed publications, citations, inventions, and p a ten ts , am ong others;

“(d) Comprehensive learning resources and support structures, to include hbraries, practicum laboratories, re levan t educational resources, and l in k a g e s w ith th e re le v a n t d is c ip l in a l an d professional sectors, to allow s tu d en ts to explore basic, advance, and even cu tting edge knowledge in a wide range of discip lines or professions;

“(e) A c tiv e a n d o n g o in g l in k a g e s a n d a f f i lia tio n w ith o th e r re s e a rc h in s t i tu t io n s in v a r io u s p a r t s o f th e w o rld t h a t w o u ld e n s u re t h a t th e re s e a rc h a c t iv i t ie s o f th e U n iv e rs ity a re fu n c tio n in g a t c u r re n t global s tan d a rd s ; and

“(f) O u tre ach a c tiv it ie s th a t allow th e studen ts , faculty, and research s ta ff to apply the new knowledge they generate to address specific social developm ent problems.

“The in stitu tion shall re ta in its s ta tu s prior to the effectivity of th is Act, u n til i t is able to comply w ith the requ irem ents provided herein .”

Se c . 3. T his Act shall take effect fifteen (15) days a fte r its pub lication in th e Official Gazette or in a new spaper of general circulation.
