A CONTRACT FOR THE SUPPLY AND DELIVERY OF VARIOUSOFFICE SUPPLIES

KNOW ALL MEN BY THESE PRESENTS:

This contract, made and executed this 17th Day of March, 2016 at Palompon, Leyte,Philippines, by and between Palompon Institute of Technology, duly represented in this act byDR. NORBERTO C. OLAVIDES, President, hereinafter referred to as the Client;

and

Uni-Real Trading Corporation, a school/office supplier with office address at Real St.,Ormoc City, duly represented in this act by MS. JOSEFINA C. PARING, hereinafter referredto as the Supplier;

WITNESSETH THAT:

Whereas, the Client desires to purchase various office supplies for the PalomponInstitute of Technology;

Whereas, the Supplier is a SEC registered business firm engaged in the supply anddelivery of various office supplies;

Whereas, the Supplier is willing and capable of supplying various office supplies,described under Paragraph 1, Section 1 hereof;

NOW, THEREFORE, for and in consideration of the foregoing premises and of themutual covenants and provisions hereinafter set forth, the parties hereto agree and do herebymutually agree as follows:

2. Warranty of the following:

2.1. The delivery period shall be thirty to forty five days or earlier after the issuanceof the Notice to Proceed.

2.2. A staff, who shall serve as a contact person whenever problem/s may arise, shallbe provided.

2.3. Each piece of material shall have a warranty period of three months

SECTION 2CLIENT RESPONSIBILITIES

1. Provide a safe room / storage facilities for all school/office supplies

SECTION 3FINANCIAL TERMS

1. The contract price for all various office supplies shall be one million three hundredninety three thousand three hundred three pesos only (Php 1, 393,303.00).

2. The method and conditions of payment to be made to the supplier through theGovernment's current disbursement procedure within sixty (60) days of thesubmission of documents under the contract shall be as follows :

2.1. On delivery: eighty percent (80%) of the contract price shall be paid to thesupplier within sixty (60) days after the date of receipt of the goods at the projectsite and upon submission of the documents.

2.2. On acceptance: the remaining twenty percent (20%) of the contract priceshall be paid to the supplier within (60) days after the date of submission of theacceptance and inspection certificate for the respective delivery issued by theProcuring Entity has authorized representative. In the event that no inspection oracceptance certificate is issued by the Procuring Entity's authorizedrepresentative within forty five (45) days of the date shown on the deliveryreceipt, the supplier shall have the right to claim payment of the remaining twentypercent (20%) subject to the Procuring Entity's own verification of the reason (s)for the failure to issue documents as indicated in GCC Clause 4 of Section -5 ofthe bidding document (General Conditions of the Contract)

2.3. Ten percent (10%) of the amount of each payment shall be withheld by theProcuring Entity to cover the Supplier's warranty obligations under the contractas described in GCC CLAUSE 29.3.

2.4. The currency to be used in the payment shall be the Philippine Peso.

SECTION 4WARRANTY, MAINTENANCE, AND SUPPORT

1. Warranty. The Supplier shall provide a warranty period of three (3) months to alloffice supplies delivered reckoned from the date of acceptance.
