PUBLIC INPUT POLICY

Public Input Policy: “At the beginning of each RGRWPG meeting, the RGRWPG will allow for an open public forum/comment period. This comment period shall not exceed one (1) hour in length, and each speaker will be allowed a maximum of three (3) minutes to speak. All individuals desiring to address the RGRWPG must be signed up to do so, prior to the open comment period. The purpose of this comment period is to provide the public an opportunity to address issues or topics that are under the jurisdiction of the RGRWPG as outlined within final implementation guidelines of Senate Bill 1, 75th Legislative Session (SB-1). For issues or topics which are not otherwise part of the posted agenda for the meeting, RGRWPG members may direct staff to investigate the issue or topic further. No action shall be taken on issues or topics which are not part of the posted agenda for the meeting. Members of the public may be recognized on posted agenda items deemed appropriate by the Chairman as these items are considered, and the same time limitation (3 minutes) applies.”

MEETING OF THE RIO GRANDE REGIONAL WATER PLANNING GROUP (RGRWPG) (REGION “M”)

1. Call to Order and Roll Call Chairman Tomas Rodriguez called the meeting to order at 11:00 a.m. and announced that the meeting had been posted as required by statute, and that a quorum of the voting membership was present. Consider Approval of April 10, 2018 Meeting Minutes Mr. Sonny Hinojosa made a motion to approve the minutes of April 10, 2018 as presented. Mr. Carlos Garza seconded the motion, and upon a vote the motion carried unanimously. 3. Hear Public Comment There were no public comments. 4. Consider Removal of Voting Member in Electric Generating Utilities Category Mr. Carlos Garza made a motion to remove Mr. Robert Pena as a voting member due to excessive absenteeism. Mr. Riazul Mia seconded the motion, and upon a vote the motion

passed with a vote of 5 for and 4 against.15.40 5. Consider Approval to Advertise for Voting Members in County Category and Electric Generating Utilities Category Judge Joe Rathmell made a motion to advertise for one (1) voting member in the County category and one (1) voting member in the Electric Generating Utilities category. The motion was seconded by Mr. Sonny Hinojosa and upon a vote the motion carried unanimously. 17.02 6. Presentation RE: Water Allocations in the Rio Grande Askarali Karimov, Ph.D. was recognized and gave a presentation titled “Water Allocations in the Rio Grande” that covered the extended hydrologic datasets he has developed for the Rio Grande Water Availability Model (WAM) that covers the 1940 – 2016 hydrologic period of analysis which is used by the Group to develop the Regional Water Plan. The presentation also included the Texas Rio Grande Basin, Rio Grande Water Rights, Irrigation Districts, Drought Management, and short and long-term reliability analysis. Dr. Karimov also discussed “The Diversifying Water Portfolio for Agriculture in the Rio Grande Basin”, a four (4) year USDA-NIFA (National Institute of Food and Agriculture) project of which he is a co-principal investigator and Extension Program Leader. 1.13.00 7. Status Reports

A. Status on Current TWDB Contract Activities Ms. Sara Eatman, Black & Veatch, was recognized and informed the Group that she has not received responses from either the City of Penitas or the City of Primera regarding further information on their requests for amendments to the 2016 Regional Water Plan. Chairman Rodriguez recommended ending these Plan amendment opportunities because of lack of notice and response from the requesting entities and stated that he will include an item on the next agenda to take action accordingly.

1.21.00 1. 2021 RWP Development Process

Ms. Eatman reported that the Technical Memorandum is due to TWDB by September 10 and will include Water User Group (WUG) population and demands, Wholesale Water Providers (WWP) relationships, current supplies, designated Major Water Providers (MWP), and source availability. 1.21.00

2. Major Water Providers

Ms. Eatman stated that the Rio Grande Regional Water Planning Group agreed on a threshold for determining if an entity qualifies as a Major Water Provider (MWP) at the last Board Meeting. Any entity that supplies or delivers 3,000 acre feet or more of municipal water delivery in 2020, will be designated a MWP in the 2021 RWP based on current estimates of 2020 municipal supplies. The Major Water Provider designation will not change the role of the entity in the RWP, but TWDB will require a few additional summaries of information about the MWPs in the plan to provide a “snapshot” of the region.

3. “Virtual” Water Market Accounting

Ms. Eatman explained that the RWP rules require the consultants to populate a database in addition to writing the text of the Plan. TWDB’s DB22 database follows every “drop” of water from the source through physical and ownership transfers down to the end user. She emphasized that all supplies must be reliable in a drought year in order to be included in the Plan. One-time water sales have not been included in previous plans, but may represent a significant supply of water for some entities1.23.56

The Group considered the following approach to represent existing supplies from the Water Market in the Planning Data in DB22:

• That entities that have more water supply than demand in the planning data (surplus), can be shown to sell water on the water market.

• Entities that show need can be shown in the plan to purchase water on the water market.

• Transactions will be between individual entities in reality, but will be grouped together in the planning data under a “virtual water market” entity.

• Only municipal water will be considered in the Virtual Water Market planning data.

• The total quantity of water that will be shown as passing through the “virtual Water Market” in the existing supply planning data will be limited to 2% of the municipal water rights, which is considered representative of an average historical year.

• The use of the Virtual Water Market and on-time water transactions in the water planning data will presently be limited to existing supplies, and will be revisited when the Group is considering what water management strategies and projects to recommend in the RWP.

Upon conclusion of discussion Mr. Carlos Garza made a motion to approve the use of a “Virtual” Water Market in the planning data with up to 2% of the municipal water rights. Mr. Frank Schuster seconded the motion, and upon a vote the motion carried unanimously. 1.59.11

B. Financial Report

Ms. Marcie Oviedo, LRGVDC was recognized and report that so far approximately $12,500 has been collected from the recent request for local matching funds. The current budget balance is $14,590.73 and the current available cash is $81,049.02.

C. Status of Joint Groundwater Area Planning in GMA’s 4, 5, 7, 13, & 16

There was no new information to report at this time.

D. Status of No Charge Releases from the San Juan River There was no new information to report on this item.

E. Reports from Other Water Planning Groups

1.26.30 1. Reports from Liaisons with Regions: Region E, Glenn Jarvis; Region J, Chairman

Tomas Rodriguez; Region L, Don McGhee, and Region N, Judge Humberto Gonzalez Mr. Carl Schwing, Liaison from Region J, was recognized and reported that there is not much change from the previous report in June except that the aerial pipeline has been installed and they are making the connections at the present time to the facilities. 2.01.57

F. Report on Water Conservation Plans and Drought Management Plans Filed with Region Chairman Rodriguez noted that McAllen PUB has submitted their current Water Conservation and Drought Contingency Plan.

G. Report on Notices of Applications for Funding and Grants

Current notices have been emailed to the Group.

H. Report on Voting Member Completion of Texas Open Meetings Act Chairman Rodriguez noted there was only one Voting Member who has yet to complete the training and submit the certificate of completion.

8. Reports from Federal and State Agencies 1.35.07

A. TWDB Mr. William Alfaro was recognized and addressed the following items:

2.03.40 1. Presentation RE: Update on Revised 31 Texas Administrative Code (TAC) Rules,

Chapters 355 & 357 Mr. Alfaro provided details on the many revisions recently made to the Texas Administrative Code pertaining to water planning. Upon conclusion of the presentation on the TAC, Mr. Alfaro proceeded with the status of the following: • Rules Revisions

Final rule revisions were adopted March 21, 2018 and became effective on April 11, 2018.

• Population and Water Demand Projections Mr. Alfaro reported that the Board adopted projections on April 16 for the 2021 Regional Water Plans and the 2022 State Water Plan.

• Flood Assessment The goals for the State Flood Assessment include assessing flood risks, estimating flood mitigation costs, and gathering stakeholder input on how flood planning should proceed in the state. The public comments period for this project is open during the summer of 2018 and the final report is due in December 2018.

• Working Schedule and upcoming Deadlines The Technical Memorandum is due on September 10, 2018 and has new notification requirements and new content.

B. IBWC No representative from the IBWC was present and no report was provided; however, Chairman Rodriguez announced that Mr. Jose A. Nuñez had recently been appointed IBWC’s Acting Commissioner.

C. TCEQ Watermaster There were no representatives from the TCEQ Watermaster’s Office; however, the report on reservoir levels was in the meeting packet for review.

D. TPWD There was no new information to report at this time. Judge Joe Rathmell asked for a question of privilege and informed the Group that Zapata County is struggling with low water levels in Falcon Lake. This is causing problems for the citizens of Zapata and affecting fishing tourism which is a main source of income. He has discussed this issue with TCEQ with unsatisfactory results, and asked if the Region M Group could add their support to his request. Chairman Rodriguez agreed to include this topic on the next agenda for discussion and possible action.

9. Discussion and Possible Action RE: Meeting Schedule

It was the consensus of the Group to schedule the next meeting on Wednesday, August 1, 2018 at 10:30 am at the LRGVDC Main Campus in Weslaco.

Attached please find a completed copy of the Rio Grande Regional Water Planning Group (Region M)

Nomination Form. I hereby nominate Hidalgo County Precinct 1 Commissioner David Fuentes because he has

shown tremendous leadership in the areas of water conservation, water reuse, and flood control. As the

responsible person for the Delta Region Watershed Project, Commissioner Fuentes has secured a TCEQ Permit to

beneficially reuse 62,712 acre feet of water per year in Hidalgo County, Willacy County, and Cameron County.

This project will serve as a major economic driver in the coming decades in key areas such as manufacturing,

residential developments, commercial developments, and agriculture.

Having served alongside him in the Hidalgo County Commissioners Court, I can assure you that his

insight to the RGRWPG will be a key asset to developing solutions for our region’s water challenges.

Commissioner Fuentes also serves as a Board Member of Hidalgo County Drainage District No.1 and as

the representative of Hidalgo County in the Lower Rio Grande Valley Development Council. He is therefore well

versed in the challenges we face not only as a county, but also as a region. I speak not only for myself when I state

that Commissioner Fuentes’ vision and leadership will beneficially shape our county for generations to come.

Re: Hydrologic Assumptions for the 2021 Rio Grande Regional Water Plan (Region M)

Mr. Walker,

The Rio Grande Planning Region intends to rely on current Water Availability Model (WAM) Run

3 estimates of Firm Yield and Modeled Available Groundwater to establish availabilities in the

2021 Rio Grande Regional Water Plan. The following assumptions have been approved by the

Rio Grande Regional Water Planning Group at the August 1, 2018 scheduled Board Meeting,

and are submitted here for your review.

Surface Water

1. The most current WAM Run 3 will be used for all Surface Water Rights Modeling for

existing supplies and future WMS;

a. Full exercise of existing surface water rights;

b. Zero effluent discharges unless specifically required by a surface water right

(hydropower, industrial rights, etc.);

c. Best available water rights information as of June, 2018; and

d. In the evaluation of the cumulative effects of water management strategies, the

Rio Grande WAM Run 3 may be used to estimate the impacts of future

urbanization (and the resulting reclassification of water rights) on the firm yield of

the system.

2. Reservoir capacities for Amistad and Falcon will be based on the current estimates for

sedimentation in 2020 and 2070, and a linear interpolation will be used to determine

capacity for the decades between.

a. Existing supplies will be based on the 2020 Firm Yield

b. Projected supplies and WMS will rely on estimated decadal averages of Firm Yield

3. Period of record for simulations:

a. Rio Grande WAM: 1940 – 2000

b. Nueces-Rio Grande WAM: 1948 – 1998

4. The Rio Grande WAM will be run to be consistent with the applicable variances submitted

by Region E and Region F:

a. Irrigation demand patterns above Fort Quitman will be modified so that diversions

only occur March through October, which is consistent with the operations of the

Rio Grande Project.

b. Flows from San Solomon and Griffin Springs have been corrected to enter

diversion points.

c. Water rights for three users in Region E were removed because the right was not

recognized for these claimants in adjudication.

Groundwater

1. Availability for existing and future supplies for the Carrizo-Wilcox, Yegua Jackson, Gulf

Coast, and other minor aquifers will be in accordance with Modeled Available

Groundwater estimates, as calculated by TWDB on or before June 1, 2018. Region M may

pursue reallocation of MAG volumes, and will do so in coordination with TWDB.

2. The non-relevant DFC-compatible aquifer availabilities provided by TWDB (May 16, 2018)

will be included as groundwater available for current and future use.

Reuse/Recycle Water

1. Source water available for a reuse water management strategy will be determined based

on the estimated amount of water returned to a utility’s WWTPs for each decade, less

the amount of reuse water already being utilized as existing supply.

a. The amount of water returned to a utility’s WWTP will be estimated at 50% of the

utility’s projected water demands, adjusted for water conservation and drought

management strategies, unless site-specific information is available

Grande would be limited by this calculation, and the effluent could be

entered as a return flow in the WAM to assess downstream availability.

There are no current or proposed future indirect reuse project in Region

M.

2. Existing and future non-potable reuse supplies will be shown to meet no more than 10%

of municipal demands. Manufacturing and steam-electric use of non-potable water will

be considered on a case-by-case basis.

Source Water Availability Assumptions The following discussion describes the models and assumptions that have been used to estimate

the availability of water from groundwater, surface water, and other sources. Region M has

submitted a Hydrologic Variance (Appendix B: Region M Hydrologic Variance Request) on August 6

2018, which has not yet been approved by the TWDB Executive Administrator.

SURFACE WATER

Region M relies on two hydrologic models for surface water availability: the Rio Grande WAM and

to a much lesser extent, the Nueces-Rio Grande WAM. For regional water planning purposes, the

most current WAM Run 3 is used to estimate existing and future water supplies, with the following

assumptions:

1. Full exercise of existing surface water rights;

2. Zero effluent discharges unless specifically required by a surface water right (hydropower,

industrial rights, etc.);

Modeling versions, assumptions, and results are included here.

Rio Grande WAM

A hydrologic variance has been requested that includes modifications to the Rio Grande WAM

which are expected to be consistent with modifications currently being made by the TCEQ.

The Rio Grande WAM has a period of record of 1940 through 2000.

The 2016 Region M Water Plan relied on a modified Rio Grande WAM which consolidated the water

rights diversions to 14 aggregated demands, 7 diverted from the Middle Rio Grande Basin, and 7

from the Lower Rio Grande Basin (“abbreviated WAM”). These modifications and several other

corrections were made in close coordination with the water modeling staff at TCEQ, and have been

adopted in revisions to the TCEQ’s current Rio Grande WAM.

The TCEQ staff has since performed a detailed review and update to the abbreviated Rio Grande

WAM, which is expected to be complete in July of 2018. This version is the “current” Rio Grande

WAM, which includes revisions based on feedback from Region E, F and M.

The hydrologic variance request submitted by Region E (Appendix C: Region E Hydrologic Variance

Request) on February 22, 2018 describes some of the updates and revisions that were requested to

the modeling assumptions and structure in the upper Rio Grande basin:

1. Irrigation demand patterns above Fort Quitman will be modified so that diversions only

occur March through October, which is consistent with the operations of the Rio Grande

Project;

2. Flows from San Solomon and Griffin Springs have been corrected to enter upstream of

Balmorhea in the Pecos Basin rather than downstream of water right diversion points;

And Region M has worked closely with TECQ to make the following updates:

4. The distribution of municipal, and irrigation Class A and B water rights have been updated

as water rights ownership and classification have changed.

In order to establish decadal firm yield estimates over the planning horizon, the rate of

sedimentation was estimated. Reservoir capacities for Amistad and Falcon will be based on the

current estimates for sedimentation in 2020 and 2070, and a linear interpolation will be used to

determine capacity for the decades between.

Projections of water rights classification conversion due to urbanization can impact the yield from

the Amistad-Falcon system as a result of demands being met from different storage pools. The Firm

Yield of the system used as the basis for the existing water supplies and water management

strategies uses current water right class distribution, but does not include an assumption of

urbanization in the yield calculation. As the rate of conversion from irrigation to municipal lands,

and therefore water rights, is projected to continue over the planning horizon, the impact to the

firm yield will be estimated and reported under the discussion of cumulative effects of the proposed

projects and strategies on the planning area.

Nueces Rio Grande WAM

The Nueces-Rio Grande WAM (downloaded from TCEQ 6/21/18) has been run by Black & Veatch

on 6/27/18 without any modifications to estimate firm yield. Nueces-Rio Grande WAM has a period

of record from 1948 through 1998. There are only 58 water rights in total, and only 4 that have a

firm yield on a monthly basis. The two water rights in Region M with a firm yield are shown in

Table 2.

Identification of Potentially Feasible Water Management Strategies1 The following documented process used by the RWPG to identify potentially feasible WMS was

Approved by the Rio Grande Regional Water Planning Group meeting unanimously January 24 ,

2018

In the development of the 2021 Rio Grande Regional Water Plan (Region M Plan), the process for

Identification of Potentially Feasible Water Management Strategies outlined below will be

followed.2

The 2021 Region M Plan is an update of the 2016 Region M Plan, but will require some modification

as a result of updated projections and changes in planning rules:

i. There are updated projections for population, GPCD, and municipal water demand

based on the data from the State Demographer’s Office, the Water Use Survey, and

local input.

ii. The Texas Water Development Board (TWDB) has shifted population and water

demand projections from city-based WUGs to utility-based WUGs.

iii. There are updated non-municipal water demand projections based on updated data

and revised methodologies.

iv. Groundwater availability will be based the Modeled Available Groundwater (MAG)

values from the Groundwater Management Area (GMA) process where those

projections exist.

v. Non-relevant aquifers (aquifers or portions of aquifers considered non-relevant in

the GMA process) may be evaluated as sources.

vi. The Rio Grande WAM Run 3 adopted by the TCEQ as the current WAM will be used

to determine Firm Yield from the Amistad-Falcon Reservoir System.3

These changes will affect the demand projections, existing supplies, and/or new supplies from

Water Management Strategies (WMS). Hence, the RWPG will be evaluating WMS from the 2016

Region M Plan to determine if they are still viable in the 2021 Region M Plan and soliciting feedback

from WWPs and WUGs in Region M.

1. Current water planning information, including specific WMS of interest, will be solicited

from Water User Groups (WUGs) and Wholesale Water Providers (WWPs) in Summer 2018.

a. Solicitation of planning information will include a draft list of WMS deemed

potentially feasible to meet projected needs.

b. Draft list will generally include the recommended WMS in the 2016 Region M Plan,

WMSs in local water plans, and/or other strategies perceived to be of interest to

WUGs/WWPs.

c. WUGs/WWPs will be encouraged to classify each water management strategy on

their draft list as recommended, alternative, or rejected and provide comments.

2. A lists of potentially feasible WMSs will be prepared based on an initial technical evaluation

and the comments received, which will be available for consideration by the RWPG by early

2019.

3. Additional WMS may be brought forth to the RWPG for consideration until March of 2019.

4. Potentially Feasible WMS will then be evaluated by metrics developed and weighted by the

RWPG.

Re: Hydrologic Assumptions for the 2021 Rio Grande Regional Water Plan (Region M)

Mr. Walker,

The Rio Grande Planning Region intends to rely on current Water Availability Model (WAM) Run

3 estimates of Firm Yield and Modeled Available Groundwater to establish availabilities in the

2021 Rio Grande Regional Water Plan. The following assumptions have been approved by the

Rio Grande Regional Water Planning Group at the August 1, 2018 scheduled Board Meeting,

and are submitted here for your review.

Surface Water

1. The most current WAM Run 3 will be used for all Surface Water Rights Modeling for

existing supplies and future WMS;

a. Full exercise of existing surface water rights;

b. Zero effluent discharges unless specifically required by a surface water right

(hydropower, industrial rights, etc.);

c. Best available water rights information as of June, 2018; and

d. In the evaluation of the cumulative effects of water management strategies, the

Rio Grande WAM Run 3 may be used to estimate the impacts of future

urbanization (and the resulting reclassification of water rights) on the firm yield of

the system.

2. Reservoir capacities for Amistad and Falcon will be based on the current estimates for

sedimentation in 2020 and 2070, and a linear interpolation will be used to determine

capacity for the decades between.

a. Existing supplies will be based on the 2020 Firm Yield

b. Projected supplies and WMS will rely on estimated decadal averages of Firm Yield

3. Period of record for simulations:

a. Rio Grande WAM: 1940 – 2000

b. Nueces-Rio Grande WAM: 1948 – 1998

4. The Rio Grande WAM will be run to be consistent with the applicable variances submitted

by Region E and Region F:

a. Irrigation demand patterns above Fort Quitman will be modified so that diversions

only occur March through October, which is consistent with the operations of the

Rio Grande Project.

b. Flows from San Solomon and Griffin Springs have been corrected to enter

upstream of Balmorhea in the Pecos Basin rather than downstream of water right

diversion points.

c. Water rights for three users in Region E were removed because the right was not

recognized for these claimants in adjudication.

Groundwater

1. Availability for existing and future supplies for the Carrizo-Wilcox, Yegua Jackson, Gulf

Coast, and other minor aquifers will be in accordance with Modeled Available

Groundwater estimates, as calculated by TWDB on or before June 1, 2018. Region M may

pursue reallocation of MAG volumes, and will do so in coordination with TWDB.

2. The non-relevant DFC-compatible aquifer availabilities provided by TWDB (May 16, 2018)

will be included as groundwater available for current and future use.

Reuse/Recycle Water

1. Source water available for a reuse water management strategy will be determined based

on the estimated amount of water returned to a utility’s WWTPs for each decade, less

the amount of reuse water already being utilized as existing supply.

a. The amount of water returned to a utility’s WWTP will be estimated at 50% of the

utility’s projected water demands, adjusted for water conservation and drought

management strategies, unless site-specific information is available

Example: [50% * (projected water demands for a utility - conservation WMS

volumes - drought management WMS volumes)] – existing reuse supply

i. For Direct Reuse, this calculation will set an upper limit to the volume of

reuse water available, and will not require any WAM modeling, since Run

3 assumes no return flows.

ii. For Indirect reuse, treated effluent discharge volumes returned to the Rio

Grande would be limited by this calculation, and the effluent could be

entered as a return flow in the WAM to assess downstream availability.

There are no current or proposed future indirect reuse project in Region

M.

2. Existing and future non-potable reuse supplies will be shown to meet no more than 10%

of municipal demands. Manufacturing and steam-electric use of non-potable water will

be considered on a case-by-case basis.

• Rio Grande WAM (downloaded from TCEQ 6/29/18)

• Nueces – Rio Grande WAM (downloaded from TCEQ 6/21/18)

• Southern Carrizo-Wilcox-Queen City-Sparta GAM

• Gulf Coast Aquifer System (southern portion) GAM

• Yegua-Jackson Aquifer GAM

• Any additional currently-approved WAM or GAM necessary
