1) The Victor Harbor RecreationCentre was built in two stages in1985 & 1999. It consists of 2Stadiums, the Inman room withkitchen/servery and theHindmarsh room.

2) The Recreation Centre issituated at5 George Main Road, VictorHarbor (opposite the Counciloffices) and is available for hirefor many purposes from selectsporting activities, fitness/danceclasses/production, filmevenings, lectures, weddings,meetings and catered events.

3) Each of the areas cater forvaried seating and capacities(refer to attached plan) whichcomplies with Fire Regulationsand the Building Code ofAustralia D1.6.

4) 3 PHASE POWER supply isavailable but only from the mainswitchboard located outside theCanteen in the entrancehallway. Should you requirespecial access to the supply, oryou are only hiring the Inmanroom then you will be requiredto make special arrangementsfor access with Council prior toyour event.

5) Chairs and tables are providedwithin the Inman/Hindmarshrooms.Hirers are responsible forsetting up any furniture requiredfor their use and at the end ofthe hire period, ensuring allfurniture is replaced in theoriginal position in which it wasfound. Note that;

Furniture must not bedragged on the floorsurface; and

Chairs are not to bestacked in front of anyfire fighting equipment.

The chairs are not numberedand are not permitted to bemarked in any manner.Numbering can, however, beachieved by placingidentification on the floor at theend of rows. Adhesive of anykind is not permitted on floorsurfaces.

6) It is the Hirer’s responsibility toremove all goods at theconclusion of the hire period.Any items not removed will bediscarded at a ‘cost for time’fee.

7) The Hirer shall ensure that alldoors and windows are securelyfastened, electrical items andlighting are switched off whenleaving the facility.

Disability Access

Access for wheelchair users andpeople with limited mobility isavailable. Male & Female disabilitytoilets are available within thebuilding. In considering placementof seating, hirers are encouraged toconsider the needs of disabledpersons near to access points.

Hirers are encouraged to giveconsideration to any hearing orvision impaired person by locatingthem closer to the front of anyevent.

Hearing Loop Amplifier

The Inman Room is fitted with aHearing Loop Amplifier (HLA) toassist hearing impaired personswho wear a hearing aid fitted with aT-switch (or telecoil). To access theloop signal, the public addresssystem/microphone or other audiosource must be connected to theoutlet located at the front of thestage and the amplifier turned onusing the key supplied by Council.

Insurance Requirements

1. All regular Hirers of the facilitymust hold a current generalpublic and products liabilityinsurance in accordance withthe attached General Termsand Conditions of Hire 2.1 &2.2.

2. An individual or one off eventbooking may be consideredupon application only, to becovered under Council’sGeneral and Products Liabilityonly where the hirer would notbe expected to have PublicLiability Insurance eg.Community group, privatefunction, one-off meeting. Forany event covered under theCouncil’s General and ProductsLiability cover, note that a $500excess fee will be passed to theHirer in the event of any claim.Council reserves the right torefuse any such application thatmay be deemed a risk.

Fees

1) All hiring is at the discretion ofthe Council and fees andconditions of the hire aresubject to change from time totime as deemed necessary bythe Council.

DamagesThe Hirer is responsible for thecosts of repairing any damage thatoccurs to the structure, fixtures,fittings etc. including any externalareas of the facility during the periodof hire. Liability for damage isaddress in the General Terms andConditions of Hire.

AlcoholThe sale or consumption of liquor inthe Recreation Centre is forbiddenwithout a relevant Liquor Licence.Instructions in relation to liquorlicence requirements are attached.If the Council does not receive acopy of the approved Liquor Licencefrom the licensing authority forevents at which alcohol is intend tobe supplied, the keys will not bemade available for the venue.

Cleaning

Hirers are responsible for cleaningthe venue in accordance with theGeneral Terms and conditions ofHire.

Rubbish bins are provided butHirers will need to contact theCouncil if additional rubbish bins arerequired for an event.

All facilities, approaches and toiletsmust be left in the same manner asfound at the commencement of thehire period.

The Hirer must ensure that theRecreation Centre is left in a cleanand tidy condition to the Council’ssatisfaction at the conclusion of thehire period. This includes (but is notlimited to) ensuring that the kitchenis clean and the floor surfaces areswept or static mopped (No waxes

or other chemicals are to be usedon the floor surfaces) if necessary,lukewarm water and detergent isrecommended. Failure to do so mayresult in additional cleaning feesbeing charged. Any breakages orfaults are to be reported to Councilas soon as practical.

Additional cleaning charges mayapply for removal of confetti, glitteror streamers.

Kitchen/ServeryA hire fee for use of the Inmanroom kitchen/servery area includes2 fridges, 2 pie warmers, 2 largeurns, oven, a microwave and limitedcrockery.

There is no provision for linen,cutlery, or glassware etc. All otherrequirements are to be supplied bythe Hirer such as; cleaningmaterials. Note; any additionalelectrical items brought into theCentre must comply with current tagand testing requirements.

No portable cooking apparatus is tobe brought into and used within thekitchen (eg. BBQ), other than for thepurpose of reheating food and thenwith the Council’s permission.

DecorationsDecorations are permitted in theGeneral Purpose Room; however,NO nails/screws/sticky tape/tackscan be used to affix suchdecorations to any painted wall.Note: ceiling tiles can be lifted tohang decorations if required.Should Council have to repair anydamage to painted surfaces, thedamaged area will be repainted andthe cost passed directly to the hirer.

Lighting and MechanicalEquipmentAny additional lighting, sound orother specific mechanicalrequirements together with allrelated costs shall be theresponsibility of the Hirer and mayonly be used in accordance with thisAgreement.

The Hirer is responsible for ensuringthe correct test and tagging of allequipment (including contractor’sequipment) complies with currentWHS legislation.

1. Nature & Commencement of Hire Agreement

1.1. These General Terms and Conditions together with the attached information (including the GeneralInformation Schedule, Prohibited Conduct Schedule, Safety Schedule, WHS Checklist andApplication Schedule) and any Special Conditions notified in writing to the Hirer by the Councilcomprise the entire terms of the hire agreement between the Council and the Hirer in relation to theRecreation Centre (“the Agreement”).

1.2. Any Special Conditions prevail to the extent of any inconsistency with these Terms and Conditionsand/or the balance of the Agreement.

1.3. The Agreement does not take effect until:

1.3.1. the application has been approved by the Council;

1.3.2. the Council has received payment of the applicable fees and bond; and

1.3.3. the Hirer has provided the Council with evidence (to the Council’s satisfaction) that theHirer has taken out any insurance as required by the Agreement.

1.4. For the avoidance of doubt, to the extent that this Agreement permits the Hirer to undertakeactivities that are regulated under the Council’s Local Government Land By-law, then the Hireris deemed to have permission under the By-law to undertake those activities in connectionwith the Hirer’s use of the Recreation Centre.

2. Insurance

2.1. Unless the Council requires otherwise or clause 2.2 applies, the Hirer must hold a currentgeneral public and products liability insurance policy (in the name of the Hirer) for a minimumamount of $10,000,000 per claim.

2.2. If the Hirer is covered by the Council’s General and Products Liability insurance , then in theevent of any claim, the Hirer agrees:

2.2.1. to pay on demand by the Council, either the claim fee stipulated in the GeneralInformation Schedule or, the amount of the excess payable by the Council in relation tothe claim (whichever is the greater amount); and

2.2.2. that if the Hirer does not make payment as required under clause 2.2.1, then theCouncil may recover that amount from the Hirer as a debt.

2.3. The Hirer is responsible for, at its cost, insuring all of the Hirer’s property and equipment that isbrought into the Recreation Centre. The use of such property and equipment in the RecreationCentre is at the Hirer’s own risk and the Council is not responsible for any damage to or loss ofany property or equipment that the Hirer brings or stores in the Recreation Centre either priorto, during or after the hire period.

3. Indemnity

As a continuing obligation and except to the extent caused by the Council's negligence, the Hirerindemnifies and holds harmless the Council from and against all actions, costs, claims, damages, chargesand expenses whatsoever that may be brought, made or claimed against or otherwise incurred by theCouncil as a result of the Hirer’s use of the Recreation Centre and/or a breach of the Agreement by theHirer.

4. Release

The Hirer releases, to the extent permitted by law, the Council from all actions, liabilities, penalties, claimsor demands for any damage, loss, injury or death occurring in the Premises except to the extent that theyare caused by the Council's negligence.

5. Compliance with Laws

The Hirer must, at the Hirer’s cost and expense, comply with all applicable laws and all of theCouncil’s reasonable directions in relation to Hirer’s use of the Recreation Centre (including the useof the Recreation Centre by the Hirer’s or the Hirer’s agent, visitors or invitees). This includes,without limitation, compliance with:

5.1. the Liquor Licensing Act 1997 in relation to the sale and responsible service of alcohol;

5.2. the Food Act 2001 in relation to the sale of food;

5.3. the Hirer’s duties under the Work Health and Safety Act 2012 and/or all reasonable directionsof the Council regarding work health and safety in the Recreation Centre; and

5.4. the Copyright Act 1968 as necessary in respect of public performances and exhibitions ofcreative works (specifically, a licence may be required for any performance/concert from theAustralian Performing Right Association (“APRA”). Further information regarding the Hirer’sobligations in this regard can be obtained from APRA via phone on (02) 99357900 or refer:www.apra-amcos.com.au ).

6. Safety & Notification Obligations

6.1. The Hirer must comply with its respective obligations set out in the attached Safety Schedule.

6.2. Notwithstanding anything in the Agreement, the Council reserves the right to halt or cancel anevent or production in the Recreation Centre if the Council reasonably considers that it is unsafefor the event/production to continue.

6.3. The Hirer must immediately notify the Council in writing of any occurrence or accident duringthe hire period that the Hirer considers may give rise to a public liability claim. In making suchnotification, the Hirer must provide all information and assistance as may be reasonablyrequested by the Council in relation to the occurrence or accident or any matters arising fromit.

7. Alcohol

The Hirer must not sell or allow the consumption of liquor in the Recreation Centre without a relevantLiquor Licence and other than in accordance with the conditions of such licence.

8. Alterations

The Recreation Centre is hired in a standard capacity for lighting and seating. Alterations to thisstandard and/or to any structures or equipment in on or around the Recreation Centre are notpermitted without the Council’s prior written consent (which consent may be withheld in theCouncil’s absolute discretion).

9. Damage

9.1. The Hirer must not cause, suffer or permit any damage to the Recreation Centre.

9.2. In the event any damage is caused to the Recreation Centre and/or the external areas(including as a result of an act of vandalism) during the hire period, the Hirer must:

9.3. immediately notify the Council upon becoming aware of it; and

9.4. pay to the Council any cost incurred by the Council in making good that damage, but only tothe extent that it can be attributed to the Hirer, its contractors, agents or invitees.

10. Hirer’s Obligations

10.1. The Hirer agrees to fully co-operate with the Council (including its contractors, staff andagents) at all times during the hire period and to comply with all reasonable requests anddirections issued by the Council in relation to the Hirer’s use of the Recreation Centre.

10.2. The Hirer acknowledges and agrees not to undertake any of the actions listed in theProhibited Conduct Schedule during the hire period or at all.

10.3. The Hirer is, at all times, responsible for the behaviour and safety of all persons attendingthe Recreation Centre at its invitation during the hire period and shall use its best endeavoursto ensure that all such persons attending conduct themselves in a lawful and orderly mannerand do not cause an nuisance or unreasonable disruption to persons in or lawfully in thevicinity of the Recreation Centre.

10.4. The Hirer agrees to conduct the event for which the Recreation Centre is being used in aproper, orderly and lawful manner and will not cause, suffer or permit any act, matter or thing,that may injure the reputation of the Council.

10.5. At the conclusion of the hire period the Hirer must ensure that:

10.5.1. the Recreation Centre is left clean and tidy and in the same manner as found at thecommencement of the hire period. For this purpose the Hirer must ensure that anyrubbish resulting from the Hirer’s use of the Recreation Centre is placed in the binsprovided;

10.5.2. all the Hirer’s property and equipment is removed from the Recreation Centre. TheHirer agrees that any property that it leaves in the Recreation Centre after the hireperiod may be removed and disposed of by the Council at the Hirer’s cost (which costsmay be deducted from any Bond paid by the Hirer); and

10.5.3. the Recreation Centre is secure, including by way of all doors and windows beinglocked and fastened, and that electrical items and lighting are switched off.

10.6. If the Hirer has fails to comply with its obligations under clause 10.5.1, then the Councilmay undertake any necessary cleaning or reinstatement works and recover its reasonablecosts from the Hirer, including from any Bond paid by the Hirer.

11. Cancellation by the Council

The Council may terminate the Agreement:

11.1. immediately upon any breach by the Hirer that is not reasonably capable of beingremedied; or

11.2. upon any breach by the Hirer that is reasonably capable of being remedied if the Hirerdoes not remedy that breach within such timeframe as specified by the Council; or

11.3. immediately, where the Council considers it is necessary to do so in the interests of publicsafety, by giving notice in writing to the Permit Holder.

12. Bond

As soon as practicable upon the return of the venue keys to the Council at the completion of the hireperiod or, if the Agreement is terminated by the Council, the Council will inspect the RecreationCentre and, within 7 days of that inspection, refund the bond paid by the Hirer less any amount thatis payable to the Council by the Hirer under this Agreement, in which case that amount may beoffset against the amount of the bond that is to be refunded.

making modifications oralterations to the building and/orits fixtures without the priorapproval of the Council. Thisincludes the installation of anyobject or structure;

the construction of, or use ofprops, load bearing structures,steps or scaffolding unlessEngineering Certification has firstbeen obtained by the Hirer andapproved by the Council beforethe commencement of the hireperiod;

the fixing of any bracing,framework, strapping orsuspension of any kind.

the use of nails, screws,adhesive tape, tacks, blue tack,sticky tape etc. on any paintedwall or surface.

the use or storage of anyhazardous substance withoutapproval by Council before thesubstance is brought to the site.

fixing of posters or advertising onthe façade or walls;

the use of electrical items, soundor other specific equipment that isbrought into the Recreation Centreother than in accordance with theSafety Schedule;

the use of portable cookingapparatus except for the purposeof reheating food and only then,with the Council’s approval;

use of waxes or other chemicalson the hall floor. (wet moppingpermitted.)

using tables and/or chairs to workat heights;

smoking within the building

Dragging of chairs on floorsurfaces.

Bouncing of balls or conduct thatcreates a disturbance in the mainentrance or to other hirers.

IT IS THE RESPONSIBILITYOF THE COUNCIL TO:

Provide and maintain a safeenvironment to work/performin.

Ensure anycables/leads/cords/electricalequipment installed by Councilare fixed and tagged andtested in accordance with WorkHealth Safety Legislation.

Advise the Hirer of any knownhazards, the risk controlmeasures in place to mitigatethe impact of them: and therequirements for compliancewith any hazard mitigationstrategy.

Advise the Hirer of theevacuation plan and location offire safety equipment (referattached plan).

IT IS THE RESPONSIBILITY OFTHE HIRER (INCLUDING ITSVOLUNTEERS, SUPPLIERS,CONTRACTORS / EMPLOYERSETC.) TO:

To report any damage toproperty or any significantincident to the Council as soonas is reasonably practicable.

Ensure strict compliance withall applicable Work, Health andSafety legislation. (refer theWork, Health and Safety Act2012 and Work, Health andSafety Regulations 2012)including in connection with:

the rigging of scenery andlighting for performances.

the fixing of cords/cables/leadsin position to prevent trip and

other hazards.

Implementing appropriatecontrols to eliminate (to theextent possible) and/or mitigaterisks to safety, arising from theHirer’s use of the RecreationCentre and

the tagging and testing ofequipment brought into theRecreation Centre by acompetent person. Records oftesting must be maintained andprovided to the Council upon itsrequest. Any equipment thathas not been tagged or testedor that presents, in the opinionof the Council, a hazard to thesafety of any person may beremoved by the Council

o Ensure a safe environment forall persons and patronsusing/visiting the RecreationCentre during the hire period:

o Ensure that children inthe Recreation Centreare supervised at alltimes and not leftunattended.

o Notify the Council of anyinstallations/modifications or alterations to thebuilding or its fixturesthat maybe made duringthe hire period.

o Ensure persons using andvisiting the RecreationCentre are familiar with theEmergency Plan and thelocation of Emergency Exitdoors; and delegateperson’s to takeresponsibility forcoordinating the evacuationof all persons from the inthe event of anyemergency. The location of

the Assembly area and safeexit routes should be knownand used.

o Ensure a 1200mm cleartotal area must bemaintained in front and atsides of all exit doors tocomply with FireRegulations. And noequipment/item is storedwithin one (1) metre of anyfire extinguisher.

o Ensure that no specialeffects , including hazer’s,smoke/dry ice machines,gun powder, candles,flammable liquids, fireworksor similar are used in allareas of the RecreationCentre due to FireRegulations. Aerosolsshould not be used in thebuilding as they can triggerthe fire alarm

o Strictly enforce theprohibition against smokingin the Recreation Centreincluding: no smoking within5 metres of any externaldoor, window or airconditioning unit.

Booking ProcedureAll bookings are to be madethrough the City of Victor HarborCouncil office.

A completed application form isrequired but is not consideredapproved, until such time as allconditions are met and fees arepaid.

FeesUnless special arrangementshave been made with the Council,all fees are payable at leastseven days prior to the requireddate or the booking will lapse.

CancellationsCancellations with less than 48hours notice will result in all hirefees paid being forfeited.

The Council may disregard anybooking that is not confirmedwithin the terms of this agreementand reserves the right to re-letunconfirmed bookings.

Unless all pages of thisAgreement are signed andacknowledged, this booking is notconsidered confirmed.

KeysA $50 CASH key deposit isrequired on collection of anykeys.

In the event of an early morningbooking the keys can be obtainedfrom the Council office in theafternoon of the last working dayprior. In the case of an afternoonbooking the key may only becollected no earlier than 2 hoursprior to the event. At the

conclusion of the hire period, allkeys provided must be returnedno later than 12 noon the nextworking day at which time thedeposit will be refunded.

The key/s you will be suppliedopens the main front door andareas of hire per the plan.

Loss of any key will require thelocks to be changed and newkeys issued. Please note that thisis a Secure Locking System andkeys cannot be cut at aLocksmith.

Access & Security

It is imperative that in/out timesare accurate. Hirer’s are notpermitted to enter the hiredfacilities outside of thespecified booking times for anyreason.

Council makes arrangements withsecurity patrols to monitor Councilbuildings. A report is given toCouncil who has accessed thebuilding. It is for this reason thataccess is given only inaccordance with youragreement/booking.

BondA security bond is required tomake good any damage or tocover additional cleaning orsecurity call out expenses shouldthis be necessary.

A bond set at Council’s discretion(payable on confirmation of thebooking) is required for all hirer’s.

The bond will be refunded in fullat the completion of the hire(within approx. 21 days) only if

the facility has been left in acondition to the completesatisfaction of the Council.(Please refer to the ‘GeneralInformation Schedule –Cleaning’).
