Chapter 48 Paper and paperboard; articles of paper pulp, of paper or of paperboard Chapter notes 1. For the purposes of this chapter, except where the context otherwise requires, a reference to 'paper' includes references to paperboard (irrespective of thickness or weight per m2). 2. This chapter does not cover: (a) articles of Chapter 30; (b) stamping foils of heading 3212; (c) perfumed papers or papers impregnated or coated with cosmetics (Chapter 33); (d) paper or cellulose wadding impregnated, coated or covered with soap or detergent (heading 3401), or with polishes, creams or similar preparations (heading 3405); (e) sensitised paper or paperboard of headings 3701 to 3704; (f) Paper impregnated with diagnostic or laboratory reagents (heading 3822); (g) paper-reinforced stratified sheeting of plastics, or one layer of paper or paperboard coated or covered with a layer of plastics, the latter constituting more than half the total thickness, or articles of such materials, other than wall coverings of heading 4814 (Chapter 39); (h) articles of heading 4202 (for example, travel goods); (ij) articles of Chapter 46 (manufactures of plaiting material); (k) paper yarn or textile articles of paper yarn (Section XI); (l) articles of Chapter 64 or 65; (m) abrasive paper or paperboard (heading 6805) or paper-or paperboard-backed mica (heading 6814) (paper and paperboard coated with mica powder are, however, to be classified in this Chapter); (n) metal foil backed with paper or paperboard (generally Section XIV or Section XV); (o) articles of heading 9209; - (p) articles of Chapter 95 (for example, toys, games, sports requisites); or (q) articles of Chapter 96 (for example, buttons, sanitary towels (pads) and tampons, napkins (diapers) and napkin liners for babies). 3. Subject to the provisions of note 7, headings 4801 to 4805 include paper and paperboard which have been subjected to calendering, supercalendering, glazing or similar finishing, false water marking or surface sizing, and also paper, paperboard, cellulose wadding and webs of cellulose fibres, coloured or marbled throughout the mass by any method. Except where heading 4803 otherwise requires, these headings do not apply to paper, paperboard, cellulose wadding or webs of cellulose fibres which have been otherwise processed. 4. In this Chapter, the expression 'newsprint' means uncoated paper of a kind used for the printing of newspapers, of which not less than 50% by weight of the total fibre content consists of wood fibres obtained by a mechanical or chemi- mechanical process, unsized or very lightly sized, having a surface roughness Parker Print Surf (1 MPa) on each side exceeding 2.5 micrometres (microns), weighing not less than 40 g/m2 and not more than 65 g/m2 and applies only to paper: (a) in strips or rolls of a width exceeding 28 cm; or (b) in rectangular (including square) sheets with one side exceeding 28 cm and the other side exceeding 15 cm in the unfolded state 5. For the purposes of heading 4802, the expressions 'paper and paperboard, of a kind used for writing, printing or other graphic purposes' and 'non-perforated punchcards and punch-tape paper' mean paper and paperboard made mainly from bleached pulp or from pulp obtained by a mechanical or chemi-mechanical process and satisfying any of the following criteria: For paper or paperboard weighing not more than 150 g/m2: (a) containing 10% or more of fibres obtained by a mechanical or chemi-mechanical process, and (1) weighing not more than 80 g/m2; or (2) coloured throughout the mass; or (b) containing more than 8% ash, and (1) weighing not more than 80 g/m2; or (2) coloured throughout the mass; or (c) containing more than 3% ash and having a brightness of 60% or more; or (d) containing more than 3% but not more than 8% ash, having a brightness less than 60%, and a burst index equal to or less than 2.5 kPa.m2/g; or (e) containing 3% ash or less, having a brightness of 60% or more and a burst index equal to or less than 2.5 kPa.m2/g. For paper or paperboard weighing more than 150 g/m2: (a) coloured throughout the mass; or (b) having a brightness of 60% or more, and (1) a caliper of 225 micrometres (microns) or less, or (2) a caliper of more than 225 micrometres (microns) but not more than 508 micrometres (microns) and an ash content of more than 3%; or (c) having a brightness of less than 60%, a caliper of 254 micrometres (microns) or less and an ash content of more than 8%. Heading 4802 does not, however, cover filter paper or paperboard (including tea-bag paper) or felt paper or paperboard. 6. In this chapter, 'kraft paper and paperboard' means paper and paperboard of which not less than 80% by weight of the total fibre content consists of fibres obtained by the chemical sulphate or soda processes. 7. Except where the terms of the headings otherwise require, paper, paperboard, cellulose wadding and webs of cellulose fibres answering to a description in two or more of the headings 4801 to 4811 are to be classified under that one of such headings which occurs last in numerical order in the nomenclature. 8. Chapter notes

1. For the purposes of this chapter, except wherethe context otherwise requires, a reference to'paper' includes references to paperboard(irrespective of thickness or weight per m2).

2. This chapter does not cover:

(a) articles of Chapter 30;

3. Subject to the provisions of note 7, headings4801 to 4805 include paper and paperboard whichhave been subjected to calendering,supercalendering, glazing or similar finishing, falsewater marking or surface sizing, and also paper,paperboard, cellulose wadding and webs ofcellulose fibres, coloured or marbled throughoutthe mass by any method.

Except where heading 4803 otherwise requires,these headings do not apply to paper,paperboard, cellulose wadding or webs ofcellulose fibres which have been otherwiseprocessed.

4. In this Chapter, the expression 'newsprint'means uncoated paper of a kind used for theprinting of newspapers, of which not less than 50%by weight of the total fibre content consists ofwood fibres obtained by a mechanical or chemi-mechanical process, unsized or very lightly sized,having a surface roughness Parker Print Surf (1MPa) on each side exceeding 2.5 micrometres(microns), weighing not less than 40 g/m2 and notmore than 65 g/m2 and applies only to paper: (a) instrips or rolls of a width exceeding 28 cm; or (b) inrectangular (including square) sheets with one sideexceeding 28 cm and the other side exceeding 15cm in the unfolded state

5. For the purposes of heading 4802, theexpressions 'paper and paperboard, of a kind usedfor writing, printing or other graphic purposes' and'non-perforated punchcards and punch-tape paper'mean paper and paperboard made mainly frombleached pulp or from pulp obtained by amechanical or chemi-mechanical process andsatisfying any of the following criteria:

For paper or paperboard weighing not morethan 150 g/m2:

(a) containing 10% or more of fibres obtained bya mechanical or chemi-mechanical process, and

(1) weighing not more than 80 g/m2; or(2) coloured throughout the mass; or

(b) containing more than 8% ash, and(1) weighing not more than 80 g/m2; or(2) coloured throughout the mass; or

(c) containing more than 3% ash and having abrightness of 60% or more; or

(d) containing more than 3% but not more than8% ash, having a brightness less than 60%, and aburst index equal to or less than 2.5 kPa.m2/g;or

(e) containing 3% ash or less, having abrightness of 60% or more and a burst indexequal to or less than 2.5 kPa.m2/g.

For paper or paperboard weighing more than150 g/m2:

(a) coloured throughout the mass; or

(b) having a brightness of 60% or more, and(1) a caliper of 225 micrometres (microns) orless, or(2) a caliper of more than 225 micrometres(microns) but not more than 508 micrometres(microns) and an ash content of more than3%; or

(c) having a brightness of less than 60%, a caliperof 254 micrometres (microns) or less and an ashcontent of more than 8%.

Heading 4802 does not, however, cover filterpaper or paperboard (including tea-bagpaper) or felt paper or paperboard.

6. In this chapter, 'kraft paper and paperboard'means paper and paperboard of which not lessthan 80% by weight of the total fibre contentconsists of fibres obtained by the chemicalsulphate or soda processes.

7. Except where the terms of the headingsotherwise require, paper, paperboard, cellulosewadding and webs of cellulose fibres answering toa description in two or more of the headings 4801to 4811 are to be classified under that one of suchheadings which occurs last in numerical order inthe nomenclature.

8. Headings 4803 to 4809 apply only to paper,paperboard, cellulose wadding and webs ofcellulose fibres:

(a) in strips or rolls of a width exceeding 36 cm;or

(b) in rectangular (including square) sheets withone side exceeding 36 cm and the other sideexceeding 15 cm in the unfolded state.

9. For the purposes of heading 4814, the expression'wallpaper and similar wallcoverings' applies onlyto:

(a) paper in rolls, of a width of not less than45cm and not more than 160cm, suitable for wallor ceiling decoration:

(1) grained, embossed, surface-coloured,design-printed or otherwise surface-decorated (for example with textile flock),whether or not coated or covered withtransparent protective plastics;(2) with an uneven surface resulting from theincorporation of particles of wood, straw, etc;(3) coated or covered on the face side withplastics, the layer of plastics being grained,embossed, coloured, design-printed orotherwise decorated; or(4) covered on the face side with plaitingmaterial, whether or not bound together inparallel strands or woven;

(b) borders and friezes, of paper, treated asabove, whether or not in rolls, suitable for wallor ceiling decoration;

(c) wallcoverings of paper made up of severalpanels, in rolls or sheets, printed so as to makeup a scene, design or motif when applied to awall.

Products on a base of paper or paperboard,suitable for use both as floor coverings and aswall coverings are to be classified in heading4823.10. Heading 4820 does not cover loose sheetsor cards, cut to size, whether or not printed,embossed or perforated.11. Heading 4823 applies, inter alia, toperforated paper or paperboard cards forjacquard or similar machines and paper lace.12. Except for the goods of heading 4814 or4821, paper, paperboard, cellulose waddingand articles thereof, printed with motifs,characters or pictorial representations, whichare not merely incidental to the primary useof the goods, fall in Chapter 49.

2. For the purposes of subheadings 4804 21 and 4804 29,'sack kraft paper' means machine-finished paper, ofwhich not less than 80% by weight of the total fibrecontent consists of fibres obtained by the chemicalsulphate or soda processes, in rolls, weighing not lessthan 60 g/m2 but not more than 115 g/m2 and meetingone of the following sets of specifications:

(a) having a Mullen burst index of not less than3.7kPa.m2/g and a stretch factor of more than 4.5% inthe cross direction and of more than 2% in themachine direction;

3. For the purposes of subheading 4805 11, 'semi-chemicalfluting paper' means paper, in rolls, of which not lessthan 65% by weight of the total fibre content consists ofunbleached hardwood fibres obtained by a combinationof mechanical and chemical pulping processes, andhaving a CMT 30 (Corrugated Medium Test with 30minutes of conditioning) crush resistance exceeding 1.8newtons/g/m2 at 50% relative humidity, at 23°C.

4. Subheading 4805 12 covers paper, in rolls, made mainlyof straw pulp obtained by a combination of mechanicaland chemical pulping processes, weighing 130 g/m2 ormore, and having a CMT 30 (Corrugated Medium Test with30 minutes of conditioning) crush resistance exceeding1.4 newtons/g/m2 at 50% relative humidity, at 23°C.

5. Subheadings 4805 24 and 4805 25 cover paper andpaperboard made wholly or mainly of pulp of recovered(waste and scrap) paper or paperboard. Testliner mayalso have a surface layer of dyed paper or of paper madeof bleached or unbleached non-recovered pulp. Theseproducts have a Mullen burst index of not less than 2kPa.m2/g.

6. For the purposes of subheading 4805 30, 'sulphitewrapping paper' means machine-glazed paper, of whichmore than 40% by weight of the total fibre contentconsists of wood fibres obtained by the chemical sulphite

process, having an ash content not exceeding 8% andhaving a Mullen burst index of not less than 1.47kPa.m2/g.

7. For the purposes of subheading 4810 22, 'lightweightcoated paper' means paper, coated on both sides, of atotal weight not exceeding 72g/m2, with a coating weightnot exceeding 15g/m2 per side, on a base of which not lessthan 50% by weight of the total fibre content consists ofwood fibres obtained by a mechanical process.

Customs duties shall be suspended in respect of goods intended for incorporation in the ships, boats or other vessels classified at the following CN codes 8901 10 10; 8901 20 10;8901 30 10; 8901 90 10; 8902 00 10; 8903 91 10; 8903 92 10; 8904 00 10; 8904 00 91; 8905 10 10; 8905 90 10; 8906 10 00; 8906 90 10 for the purposes of their construction, repair, maintenanceor conversion, and in respect of goods intended for fitting to or equipping such ships, boats or other vessels.2. Customs duties shall be suspended in respect of:(a) goods intended for incorporation in drilling or production platforms:(1) fixed, of subheading ex 8430 49, operating in or outside the territorial sea of Member States, or(2) floating or submersible, of subheading 8905 20, for the purposes of their construction, repair, maintenance or conversion, and in respect of goods intended for equipping the saidplatforms.(b) tubes, pipes, cables and their connection pieces, linking these drilling or production platforms to the mainland.

( 9 ) TM571-The following shall be prohibited:a) the export of or removal from the territory of the Community of, andb) the dealing in, Iraqi cultural property and other items of archaeological, historical, cultural, rare scientific and religious importance, if they have been illegally removed from locations in Iraq,in particular, if:i) the items form an integral part of either the public collections listed in the inventories of Iraqi museums, archives or libraries' conservation collection, or the inventories of Iraqi religiousinstitutions, orii) there exists reasonable suspicion that the goods have been removed from Iraq without the consent of their legitimate owner or have been removed in breach of Iraq's laws and regulations.These prohibitions shall not apply if it is shown that either:a) the cultural items were exported from Iraq prior to 6 August 1990; orb) the cultural items are being returned to Iraqi institutions in accordance with the objective of safe return as set out in paragraph 7 of UNSC Resolution 1483 (2003).

( 10 ) CD589-It shall be prohibited to import, export, transfer, or provide brokering services related to the import, export or transfer of, Syrian cultural property goods and other goods ofarchaeological, historical, cultural, rare scientific or religious importance, including those listed in Annex XI, where there are reasonable grounds to suspect that the goods have been removedfrom Syria without the consent of their legitimate owner or have been removed in breach of Syrian law or international law, in particular if the goods form an integral part of either the publiccollections listed in the inventories of the conservation collections of Syrian museums, archives or libraries, or the inventories of Syrian religious institutions.

( 11 ) CD483-If the declared goods are described in the "CG" footnotes linked to the measure, an export licence must be presented( 12 ) CG024-Between 50 and 100 years old, with a value corresponding to or exceeding 50000 Euro

( 14 ) TM572-It shall be prohibited to import, export, or transfer Syrian cultural property goods and other goods of archaeological, historical, cultural, rare scientific or religious importance, includingthose listed in Annex XI of Council Regulation (EU) No 36/2012, where there are reasonable grounds to suspect that the goods have been removed from Syria without the consent of theirlegitimate owner or have been removed in breach of Syrian law or international law, in particular if the goods form an integral part of either the public collections listed in the inventories of theconservation collections of Syrian museums, archives or libraries, or the inventories of Syrian religious institutions.The prohibition shall not apply if it is demonstrated that:(a) the goods were exported from Syria prior to 9 May 2011; or(b) the goods are being safely returned to their legitimate owners in Syria.

( 15 ) CD970-If the goods declared are described in "MG" footnote linked to the measure an authorisation must be presented for the export, purchase or transport to DPRK of goods and technologyaccording to Regulation (EU) 2017/1509 (Annex II, Part VI).

( 16 ) CD974-It shall be prohibited to sell, supply, transfer or export, directly or indirectly, the goods and technology, including software, listed in Annex II, whether or not originating in the Union, toany natural or legal person, entity or body in, or for use in the DPRK (Article 3.1.(a) of Regulation (EU) 2017/1509). By way of derogation from Article 3.1. the competent authority of the MemberStates, may authorise, under the terms and conditions it deems appropriate, the direct or indirect supply, sale, transfer or export of the items and technology, including software to DPRK fromAnnex II of Regulation (EU) 2017/1509 (Article 8.1.)

( 17 ) MG805-Filament winding machines and related equipment: filament winding machines or fibre/tow-placement machines, of which the motions for positioning, wrapping and winding fibrescan be coordinated and programmed in two or more axes and which are designed to fabricate composite structures or laminates from fibrous or filamentary materials, coordinating andprogramming controls and precision mandrels for such equipment

( 18 ) CD972-If the goods declared are described in the "MG" footnote linked to the measure import, purchase or transfer, directly or indirectly, the goods and technology listed in Annex II from theDPRK, whether or not originating in the DPRK shall be prohibited (Article 3.1.(c) of Regulation (EU) 2017/1509).

( 19 ) CD572-The wastes mentioned in Article 3 (1) of Regulation (EC) No 1013/2006 shall be subject to the procedure of prior written notification and consent.( 20 ) CD573-The wastes mentioned in Article 3 (2) of Regulation (EC) No 1013/2006 shall be subjected to the general information requirements laid down in Article 18 of the same Regulation, if the

amount of waste shipped exceeds 20 kg( 21 ) CD574-If the wastes listed in Annex III (green list) display certain hazardous characteristics, the relevant provisions shall apply as if these wastes had been listed in Annex IV (amber list). See

Article 3 (3) of Regulation (EC) No 1013/2006.( 22 ) CD576-Exports from the Community of the wastes, listed in Article 36 of Regulation (EC) No 1013/2006, are prohibited if they are destined for recovery in countries to which the OECD Decision

does not apply (C(2001)107/Final of the OECD Council concerning the revision of Decision C(92)39/Final on control of transboundary movements of wastes destined for recovery operations).( 23 ) CD577-The waste explicitly destined for laboratory analysis (Article 3 (4) of Regulation (EC) No 1013/2006) to assess either its physical or chemical characteristics or to determine its suitability

for recovery or disposal operations shall not be subject to the procedure of prior written notification and consent. Instead, the procedural requirements of general information requirementsshall apply (Article 18 of Regulation (EC) No 1013/2006). The amount of such waste exempted when explicitly destined for laboratory analysis shall be determined by the minimum quantityreasonably needed to adequately perform the analysis in each particular case, and shall not exceed 25kg.
