VERIFYING DEFENSE EXHIBITS
COURT REPORTER: All rise.
THE COURT: Good morning, please be seated.
MR. KIYUNA: Morning, judge.
THE COURT: Okay, we are taking up in the matter of
State of Oregon v. William James Esbensen, in case number 12-
09-4824C and in the matter of State of Oregon v. Raymond Scott
Kangas, in case number 12-09-4828C.
So, when we ended yesterday we were trying to make
sure we had all of Mr. Esbensen s exhibits correct because we
had some number changing. So can we get that taken care of?
MS. GERBER: Yes, judge. I do want to apologize
(INAUDIBLE) for how late I am, but I had a mentally ill client at
SRCI that I had to deal with; him and his family, and I apologize
for that.
THE COURT: Okay.
MS. GERBER: Just had a conflict at the last minute. We
had exhibits 1 through well, 1000 through 1037 we d move to
admit at this point. Mr. Dugan s had a chance to see them. I m
not sure if he has any...
THE COURT: Which ones? 1000...
MS. GERBER: 1000 to 1037.
COURT REPORTER: And I believe there s no
(INAUDIBLE).
THE COURT: So let s just make sure we got them
identified correctly. I have as 1000, the 45t Parallel Grower

Contract; 1001, an application for OMMP card. That was not
offered is that correct?
COURT REPORTER: That s correct.
MS. GERBER: Yes.
THE COURT: Okay. So we re looking at 1000, then
1002, and 1003 are the photos of the 45th Parallel. Do you have
any objection to 1000, 1002, or 1003?
MR. DUGAN: Uh, no.
THE COURT: Okay. Mr. Kiyuna, if you have an
objection speak up; otherwise I m just going to expect they re
coming in, alright?
MR. KIYUNA: Okay. No objection, judge.
THE COURT: Okay. Then we had 1004 is the Malheur
Federal Credit Union designation; 1005 was hearings on March
1s
, 2003 involving Judge Sullivan. I m not quite sure what those
are. Um, Mr. Dugan, do you have an objection to 1004 or 1005?
MR. DUGAN: Um, 1005, again was what Your Honor?
THE COURT: Well it s listed here as hearings on March
P
of 2003 of Judge Sullivan.
COURT REPORTER: And, judge, (INAUDIBLE) record I
have it as Mark Young s sentencing transcript.
MR. DUGAN: I have it as Mark Young s sentencing
transcript as well.
COURT REPORTER: That s just what I heard in court
and that s what I identified on my list.

MR. DUGAN: And I m not prepared to stipulate
(INAUDIBLE).
THE COURT: Can I see can I just see the exhibits?
MS. GERBER: What was the last number so I can just
add the number.
THE COURT: Well, if I can just get them starting with
well, the 37 of them, the 37 of them that we have I m just
going to go over and see the objections and make sure we have
them down right.
MS. GERBER: Absolutely. Unfortunately I wasn t taught
in law school how to do this, judge. My staff is not
(INAUDIBLE).
THE COURT: Okay, give me just a second. Alright,
here s what we re going to do. For what s in order, I have put
1000, 1002, and 3, 4, 6, 8, 10, 1012, 13, 14, 15, 16, 17, 18, 19,
20, 21, a second document entitled exhibit 1021, 1022, 23, 24,
25, 26, 28, 29, 31, 32, 34, and at the very end, don t lose it,
1037.
I have taken out of the mix one that s entitled 1023,
which seems to be a duplicate of one that s already in.
So here s what we re going to do for a moment. We re
going to take a few minutes here, so Mr. Dugan whoa, you
got that one dropping, and then this is the one I pulled out. Mr.
Dugan and Ms. Gerber, Mr. Kiyuna, if you d please take a look at
those, make sure that they tie in with the exhibit lists and the

numbers there and so the state can identify the ones that they
object to. And then we ll have to go through those steps. So, take
a couple of minutes to do that.
(RECESS)
THE COURT: Exhibit 1 0 0 0, 45th Parallel Compassion
Group, LLC, a designated grower contract. Any objection?
MR. DUGAN: No.
MR. KIYUNA: No.
THE COURT: Okay. Exhibit 2, which is a picture of the
inside of the 45th Parallel, and exhibit 3, which is also a picture
designated as the inside of the 45th Parallel. Any objections?
MR. DUGAN: Uh, no. I think that was already entered
though.
THE COURT: Right, I m just going to go through them
so that there s no question for the record. Exhibit 104, the
Malheur Federal Credit Union authorization designation.
MR. DUGAN: No, no objection.
THE COURT: Okay. Exhibit 1 0 0 6, a 45th Compassion
Group, LLC designated grower contract.
MR. DUGAN: No objection.
MR. KIYUNA: No objection.
THE COURT: Um, I kind of guess that from you Mr.
Kiyuna, but you speak up if there s an objection, okay?
MR. KIYUNA: Okay.

officer records for Bradley Williams.
MR. DUGAN: No objection.
THE COURT: Exhibit 1010, which is the...
MR. DUGAN: I object to that.
THE COURT: ...(INAUDIBLE) for Ms. Gardner.
MR. DUGAN: That contains a lot of hearsay. It also is
improper impeachment. It just doesn t you know, that just isn t
the way you go about impeachment.
THE COURT: We ll take that up again in a few minutes.
I m going to go through all these first. Exhibit 1012, Jonathan
Alden Turner s petition to plead guilty.
MR. DUGAN: Um, Mr. Turner didn t testify so that s,
um, um, I m not sure what the relevance is at all, um, to that. It s
not impeachment because he didn t testify, so we d object to that.
THE COURT: I think this was the point of showing that
other defendants got other offers; and I think I limited some of
the discussion on that. I m going to go ahead and receive 1012.
Then exhibit 1013 for Ryan Lowe, which would ve been
the same.
MR. DUGAN: The same objection.
THE COURT: Yeah, I ll receive 1013. And then we have
a couple pictures of the inside of the 45th Parallel given with the
area that Ms. Smith-Mott testified to seen in to see Mr. Esbensen.
Uh, exhibit 1014 and 1015. Any objection?
MR. DUGAN: No objection.

THE COURT: Then I have a Public Health Division...
MR. DUGAN: No objection.
THE COURT: ...letter to Dr. Hatlestad, 1016.
MR. DUGAN: That s also Dustin Hankins medical
report, so.
THE COURT: Okay. Then I have exhibit 1017, which is
the affidavit for a search warrant from Detective or Sgt.
Williams.
MR. DUGAN: Um, I don t have any objection. The
court s already seen that at the motion of suppress, so.
THE COURT: Okay, 1017 is received. Then I have
here. Thank you.
COURT REPORTER: And, judge (INAUDIBLE) to the
ones that he didn t object to (INAUDIBLE).
THE COURT: Yeah, I m receiving them. If I didn t say
that yet, yes. The one I ve not done anything with is 1010. Then
exhibit 1018, Eric Charles Winn, a petition to enter a plea of
guilty. Any objection to that?
MR. DUGAN: Well, again, it s improper impeachment
but so I ll object on that basis.
THE COURT: Exhibit 1018 is received. Then I have
exhibit 1019, which is the 45th Parallel transaction summary
consisting of a whole slew of pages. Any objection to that?
MR. DUGAN: Your Honor, before that s admitted I d
like to ask a couple of questions of Mr. Esbensen on that.

that. Then in exhibit 1020 there s a Stony Grow Gardens What
Does It Cost To Produce, updated May, 2011, by Mike Mullins, a
master gardener for Stony Grow Gardens.
MR. DUGAN: And I ve objected to that based on
relevance.
THE COURT: Okay. Then I have so I m not going to
receive that yet, exhibit 1021, um, the petition to enter a plea of
guilty for Mitchell Rowland. I take it s the same objection?
MR. DUGAN: Yes.
THE COURT: Okay, and that would also be for 1021A,
for Tony Manzo, a petition to enter a plea of guilty...and Mark
Young s petition to enter a plea of guilty in 1022.
MR. DUGAN: Yes.
THE COURT: I ll I take you ll have the objections
for all three and I will receive all three.
MR. DUGAN: Okay.
THE COURT: Then for defendant s exhibit 1023, the

MR. DUGAN: No.
THE COURT: Exhibit 1023 is received. So all except

have I think the calculations that Mr. Esbensen had laid down
for some of the checks and such.
MR. DUGAN: I don t object.
THE COURT: Exhibit 1025. I have them in my notes I
was just trying to remember off the top of my head there. 1025 s
received. Then I have 1026, which is entitled the 45th Parallel

MR. DUGAN: No.
THE COURT: 1026 is received. Then I have exhibit
1028, the petition to plead guilty for Tricia Ellen Gardner. I will
take your same objection and I ll receive 1028. Then there s a
exhibit 1029, it s entitled 45th Parallel Kerry Rhoan trial
3/3/2014, begin investigation.
MR. DUGAN: No objection.
MS. GERBER: And, judge, those are the oh, I m
sorry.
THE COURT: Okay, so exhibit 1029 is received. Then I
have what I think was offered at the end of the day yesterday,
1031, which dealt with the telephone phone call that I m going to
be listening to later.
MR. DUGAN: Um, I...
MS. GERBER: It s the undercover wire tap.
MR. DUGAN: I don t have any objection to that. I m not
sure if it s a telephone phone call or the...

MR. DUGAN: And the two pages of Dustin Bloxham s

MS. GERBER: Mmm Hmm (INDICATING YES).
THE COURT: Okay, thank you. I ll trust that s what it
means. I haven t looked, really. Then I have a criminal subpoena

had no objections to those that I ve received thus far?
MR. KIYUNA: Uh, that s correct, judge. For the record I
have no objections to all those just mentioned.
THE COURT: Okay, so the ones we ll need to go over
and discuss yet are exhibits 1 0 1 0, which is the LEDS printout for
Ms. Gardner. The multitude of transaction summaries for the 45th
Parallel in exhibit 1 0 1 9. For 1 0 2 0, which is the What Does It
Cost Us To Produce Medical Marijuana Indoors in Oregon. The
criminal subpoena duces tecum for the grand jury in case (sic)
number 1 0 3 2. The request for follow up in exhibit 1 0 3 4. Um, and
the transcript from 1 0 3 6. So, give me just a second. Here you go.
Those are not received yet.
MS. GERBER: Would you like...do you want argument
on those, judge?
THE COURT: What I d rather do is, um, if you want to
I d like to get Mr. Esbensen...
MS. GERBER: I ll be quick.
THE COURT: ...up again. And then if you have questions
to ask him and when you want to offer them or at the very end,
once we ve taken all the testimony, if you want to make your
arguments. I d rather get testimony done...
MS. GERBER: Okay.
THE COURT: ...before we start arguing everything. Give
me just a second. Okay, Mr. Esbensen, if I could have you please
come up. And we ll put you under oath again since it s a new day.

sworn by the Clerk of the Court, was examined and testified on
his oath as follows:
DIRECT EXAMINATION
BY MS. GERBER:
Q
Um, Mr. Esbensen, I always put the emphasis on that,
too, Esbensen. Um, how many times would you say that you and
the other members of the 45th Compassion Group met in your
home or a home in Boise with Mr. Rhoan to talk about the
organization?
A robably less than ten.
Q
And would you say the same is true regarding the 45th
Parallel, LLC?
A
es.
Q
Okay. And I want to ask you, did something happen with

A
eah, his daughter passed away last night.
Q
And that was from a drug...
A
he drowned from a drug overdose. She was
(INAUDIBLE) years old.
Q
And...
THE COURT: How old?
A
7.
Q
And was that from pills?
A
es, ma am.
Q
And is that one of the reasons, not that it would have
been originally, is that a good example of one of the reasons why
you began this program?
A
bsolutely. We actually had Kelly as a club member and
worked with the clinic. Uh, got her off of pills. We were raided
and she got back on them and she went to rehab and got out a
couple of months ago and was doing good, had a job, and wasn t
actually using street pills anymore but using doctor prescribed
pills.
MR. DUGAN: I don t know if this is relevant. I ll object
to any further testimony about that.
MS. GERBER: I ll move on.
THE COURT: Okay.
Q
Mr. Esbensen, in your experience in the many years of
doing this, and you ve also talked to Dr. Hatlestad, how prevalent

is the overdose and use of prescription medication?
MR. DUGAN: I m going to object, Your Honor, there s
no basis of knowledge.
THE COURT: Sustained. Go ahead, ask another question.
Q
Do you have a medicinal marijuana strain that assists
people with withdrawals from pain medication?
A
es
Q
And, um, you use that strain often for youngsters? When
I say youngsters I mean younger people, not minors.
A
es, for any age, it didn t matter.
Q
Okay. And everyone that worked at the 45th Parallel,
LLC, were they registry cardholders?
A
es
Q
Every one of them?
A
es
Q
And often you had mentioned that you gave away for
free, um, medicinal marijuana in the 44t
(sic) Parallel club. Can
you tell me about that? How often and how much and why? I know
it s a multi-faceted question but...
A
m, there s there s a lot of different reasons. A lot
of folks around here are indigent and don t have a lot of money
and the other club members would donate extra, if possible. We d
have growers donate extra so we could give it away to the
patients. For the patients that the 45th Parallel was growing for,
uh, we gave them each an ounce a month for free; and then at

m yeah they knew who their grower was just like the
grower knew who their patient was. And they did sign and agree
to not be in contact with the grower. And the main reason was for
securities for the growers because medical marijuana is so
valuable on the streets and for their privacy.
Q
And are there older people who come into your club?
A
eah, the average age was about 56.
MR. DUGAN: I m going to object, relevance.
THE COURT: Well, that s been said a few times. That s
alright, go ahead.
Q
And the people that if they didn t have your services,
for example, they would have to go when they needed their
medication to someone else s house, their grower for example,
and meet with them personally?
A
hat s correct.
Q
So you were like a conduit for those type of people who
otherwise couldn t get around or it makes it easier for them to
not have to go to their grower?
A
bsolutely. We had a couple customers we had they
were bedridden and couldn t get out of their house.
Q
nd how would that work? Would you bring that to
them?
A
eah we would send somebody over there to help them.
Q
Would you send somebody over there who was a registry
cardholder?

eah, it was somebody affiliated with the 45th Parallel;
probably Scott, myself, Kelly.
Q
And Adrian Kershaw that was brought up and discussed,
and I ll just handle that quickly. What was the issue between you
and her, if any?
A
ell, a lot of our patients have a lot of different needs
and stuff and we tried to accommodate them in any way we can.
And she she she had some special needs when she came in
and explained them to us. Um, I explained our program. It takes
90 to 120 days to grow their medicine once we agree to become
their grower and that s when they can start receiving one free
ounce a month. And in her case I actually gave her an ounce
immediately the day she signed up because she was in a lot of
pain and stated that she really needed some medicine. And also I
gave her two more ounces over the next 90 days and it just wasn t
enough for her and she kind of made a scene in my office when
there s other customers out in the lobby, and as she stated in her
own testimony she stood up, and I stood up, and her mother stood
up and I asked her to leave.
Q
You didn t attempt to assault her in any way?
A
ever, no.
Q
Okay. In fact you were um were you the patient
caregiver or grower for her mother?
A
was.
Q
Okay. And in terms of any kind of reimbursement to you

ESBENSEN W. - D.
or donation price to the club, um, did you have occasion where
cardholders would come in and donate more or give more?
A
ure.
Q
And what was the circumstances underlying this?
A
m, they just realized the need of the club and the need
of the patient and appreciated what we were doing there and
wanted to help out in any way shape or form.
Q
And this is I know the judge wants to move along so
you could maybe summarize this quickly. But in terms of what
you knew about your ability to run that club, did you travel
around the state at all and visit other collectives?
A
es we did.
THE COURT: Other what?
MS. GERBER: Clubs, collectives, there s dispensaries;
now it s a dispensary.
THE COURT: Alright, that was just the first time I d
heard it used as a collective. Sorry, go ahead.
A
es, we did. Me and other members traveled all over the
state; southern Oregon, Portland, visited a multitude of different
collectives, dispensaries, clubs, ran on a multitude of different
platforms: some super shady, some super scary, and some really,
really professional.
Q
And would you say that how many clubs at the time you
were running your club existed on the other side of the state, so-
to-speak, like the Portland area, metro area, compared to here?

MR. DUGAN: I m going to object as hearsay.
THE COURT: Sustained.
Q
Based on your knowledge of traveling around the state
and being in the Portland area, the metro area, are there more
clubs when you were running your club than here?
A
bsolutely.
Q
How many more?
A
couple hundred.
Q
Um, and I want to talk just briefly about your contact
with local law enforcement or just the local government agencies
here in Malheur County. Can you tell me a little bit about this
town hall meeting that you went to?
A
ell yeah, before we ever opened up we went to the
State Police. I identified who I was, what we were doing or going
to do to help facilitate the needs between the growers and the
patients. And gave them my card, gave them my number, asked
them if they had any questions or any concerns to contact me at
any given time and I d love to meet them at the club and show
them how it worked or I was willing to work with anybody.
Q
Well, I m assuming Mr. Dugan will ask this on cross,
but when you received that letter from the Department of Justice,
did you then go talk to the State Police about that at all?
A
o.
Q
And why not?

hey re not they re not federal agents.
Q
Okay. And were you a member locally of any boards
chambers of commerce, anything like that where people knew who
you were at what you were doing? Were you involved in the
community at all?
A
es we were a member of the chamber of commerce for
two years. And if I can go back to the previous question on the
town hall meeting that I didn t answer. I we decided to have a
town hall meeting and invite the sheriff, the city police, uh, we
ran a newspaper article in the Argus Observer and invited the
whole town to show up. We had speakers. We had a federal
medical marijuana patient speak there. We had Lee Burger, a
Portland attorney speak there on the laws of medical marijuana.
And we had some other people who run other organizations, non-
profits, for patients.
Q
And how long did the club exist before the raid?
A 2 months.
Q
And had you been approached by anybody from the
Malheur County Sheriff s office in that 22 months about whether
or not you were operating a legal operation?
A
m, I did have one person...
MR. DUGAN: I m going to object, calling for hearssay.
MS. GERBER: Just asking if they contacted him not
what they said.
THE COURT: Overruled.

That letter from the Department of Justice.

bsolutely.
Q
And how did that compare to yours?
A
h, quite more expensive from what we offered.
Q
Can you give me an example?
A
nywhere from 13 to 17 a gram, 3 3 0 an ounce.
Q
Did you ever see price points or reimbursement points
for the, what is it, Grand Daddy Pops, is that what it s called?
A
eah, Purps.
Q
And, Purps, I m sorry. Um, and you were able to look
and you (INAUDIBLE) other collectives or co-ops were using?
A
16 and 17 a gram.
Q
And it came up a little bit during the trial as compared
to what the, um, OMMP provides. Why did you only permit a
patient, as part of the contract, to have one ounce per week?
A
m, the last thing I wanted was Brad Williams coming
to our door and saying, hey...
MR. DUGAN: I m going to object, Your Honor, that s
not responsive to the question...
THE COURT: Sustained.
MR. DUGAN: ...and it calls for hearsay.
THE COURT: Well, the big thing is you can answer your
question about law enforcement you don t need to address it
there. The question is why did you do one ounce per week. You
started to say because you didn t want...
A
e didn t want it on the street, Your Honor. We didn t

want it being re-sold on the street.
Q
You want to put some controls in place?
A
ight. As a medical marijuana user myself I very
rarely does somebody need a pound of weed in a setting. I mean
the only reason you would would be to turn it into some type of
extract.
Q
Before you invested in the club and started it, um,
obviously your wife s employed. Were you you were running a
car business?
A
had a car lot, yes.
Q
Okay. And how were your finances and credit back then?
MR. DUGAN: I m going to object on relevance.
MS. GERBER: Judge, would you like a response?
THE COURT: What was that?
MS. GERBER: Would you like me to respond?
THE COURT: Mmm Hmm (INDICATING YES).
MS. GERBER: Uh, Mr. Dugan has alleged that Mr.
Esbensen and others have delivered marijuana for consideration.
Consideration includes many things including finances which he s
raised. Um, I think it s relevant to inquire into my client whether
he made a profit off of what he did with this club.
THE COURT: Yeah, overruled, go ahead. But I just I
know it was discussed last night we weren t going to have a lot
more questions...
MS. GERBER: You re right and I was late.
