RESOLUTION NO. 5977 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARPINTERIA CITY COUNCIL EXERCISING THE CITY'S EMERGENCY POWERS TO REQUIRE MEMBERS OF THE PUBLIC AND WORKERS TO WEAR FACE COVERINGS TO PREVENT THE SPREAD OF COVID-19 WHEREAS, Government Code Sections 8558 and 8630, ef seg., Health and Safety Code Section 101080, and Chapter2.40 of the Carpinteria Municipal Code ('CMC"), empower the City of Carpinteria ("City") Director of Emergency Services to make and issue rules and regulations on matters reasonably related to the protection of life and property during proclaimed local emergencies; and WHEREAS, on March 4,2020, Governor Newsom declared a state of emergency to make additional resources available, to formalize emergency actions already underway, and to help the state prepare the effects of Novel Coronavirus (COVID-19); and WHEREAS, on March 11,2020, Governor Newsom and California Department of Public Health officials recommended that non-essential gatherings should be postponed or cancelled across the state until the end of March, in order to implement social distancing guidelines intended to protect all individuals, particularly those who are at high risk of severe illness for COVID-19, and to slow further spread of COVID-19; and WHEREAS, on March 12,2020, the County of Santa Barbara ("County") Local Health Officer declared a local health emergency exists in the County due to an imminent and proximate threat to public health, within the meaning of Section 101080 of the Health and Safety Code, by the introduction of COVID-19 in the County, and directed local agencies in the County to implement Governor Newsom's social distancing guidelines; and WHEREAS, on March 17,2020, the California Department of Public Health and County Public Health Department directed all bars, nightclubs, pubs, breweries and wineries to close immediately; and restaurants and other food facilities offering on-site dining should immediately transition to only offering delivery or take-out service as part of the public health effort to slow the spread of COVID-19; and WHEREAS, on March 17,2020, the City Director of Emergency Services issued a Proclamation of Local Emergency by the Director of Emergency Services for the COVID-1 I Pandemic ("Proclamation"); and WHEREAS, the City's Proclamation was found necessary and ratified by the City Council at its regular meetings on March 23,2020 (via adoption of Resolution No. 5954) and re-ratified by the City Council on April 13,2020 (via adoption of Resolution No. 5954) and May 13,2020 (via adoption of Resolution No. 5969) in order to utilize all 20946734

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARPINTERIA CITYCOUNCIL EXERCISING THE CITY'S EMERGENCY POWERS TO REQUIRE

MEMBERS OF THE PUBLIC AND WORKERS TO WEAR FACE COVERINGS TOPREVENT THE SPREAD OF COVID-19

WHEREAS, Government Code Sections 8558 and 8630, ef seg., Health andSafety Code Section 101080, and Chapter2.40 of the Carpinteria Municipal Code('CMC"), empower the City of Carpinteria ("City") Director of Emergency Services tomake and issue rules and regulations on matters reasonably related to the protection oflife and property during proclaimed local emergencies; and

WHEREAS, on March 4,2020, Governor Newsom declared a state ofemergency to make additional resources available, to formalize emergency actionsalready underway, and to help the state prepare the effects of Novel Coronavirus(COVID-19); and

WHEREAS, on March 11,2020, Governor Newsom and California Department ofPublic Health officials recommended that non-essential gatherings should be postponedor cancelled across the state until the end of March, in order to implement socialdistancing guidelines intended to protect all individuals, particularly those who are athigh risk of severe illness for COVID-19, and to slow further spread of COVID-19; and

WHEREAS, on March 12,2020, the County of Santa Barbara ("County") LocalHealth Officer declared a local health emergency exists in the County due to animminent and proximate threat to public health, within the meaning of Section 101080 ofthe Health and Safety Code, by the introduction of COVID-19 in the County, anddirected local agencies in the County to implement Governor Newsom's socialdistancing guidelines; and

WHEREAS, on March 17,2020, the California Department of Public Health andCounty Public Health Department directed all bars, nightclubs, pubs, breweries andwineries to close immediately; and restaurants and other food facilities offering on-sitedining should immediately transition to only offering delivery or take-out service as partof the public health effort to slow the spread of COVID-19; and

WHEREAS, on March 17,2020, the City Director of Emergency Services issueda Proclamation of Local Emergency by the Director of Emergency Services for theCOVID-1 I Pandemic ("Proclamation"); and

WHEREAS, the City's Proclamation was found necessary and ratified by the CityCouncil at its regular meetings on March 23,2020 (via adoption of Resolution No. 5954)and re-ratified by the City Council on April 13,2020 (via adoption of Resolution No.5954) and May 13,2020 (via adoption of Resolution No. 5969) in order to utilize all

resources necessary to respond to COVID-19 and receive any State and Federalassistance and funds that may be available; and

WHEREAS, the Proclamation invokes in the City all powers and mechanisms setforth in the California Emergency Services Act (Government Code sections 85b0, efseg.), CMC Chapter 2.40, and all other applicable federal and state laws, and Cityordinances and resolutions, to be used by authorized City personnel; and

WHEREAS, on March 19,2020, Governor Newsom issued Executive Order N-33-20 instructing all individuals living in the State of California to stay home or at theirplace of residence, except as needed to maintain continuity of operation of federalcritical infrastructure sectors and additional sectors as the State Public Health Officermay designate as critical to protect health and well-being of all Californians ("essentialbusinesses"); and

WHEREAS, on May 4,2020, Governor Newsom issued Executive Order N-00-20, which is incorporated herein by reference, to allow re-opening of lower-risk businessand spaces ("lower-risk businesses") in Stage Two of the State's Resilience Roadmap;and

WHEREAS, on May 8, 2020, the County Health Officer issued Santa BarbaraCounty Health Officer Order ("County Health Office Order") 2O2O-8.1, which furtherclarifies the lower-risk businesses eligible to be open for limited operations within theCounty; and

WHEREAS, the California Department of Public Health provided guidance oncloth face coverings for the general public to utilize while outside their reóidence;

WHEREAS, the centers for Disease control and prevention ("cDC")recommends cloth face covering be worn in public setting where other social distancingmeasures are difficult to maintain, such as in grocery stores and pharmacies; and

WHEREAS, on April 5, 2020, April24,2020, and May g,2o2o,the county HealthOfficer Orders (No. 2020-7,2020-8, and 2020-8.1, respectively) requiring food fãcilityworkers to wear face coverings. These County Health Officer Orders do not requireworkers of other essential and lower-risk businesses and members of the public to wearface coverings; and

WHEREAS, as of May 12,2020, the California Department of Public Healthreported a total of 69,382 total cases of COVID-19 in California and 2,847 fatalities; and

WHEREAS, as of May 12,2020, the County Public Health Department reporteda total of 1 ,362 positive cases of COVID-19 in the County and 1 1 deaths; 23 cases arein South County Unincorporated Areas, including Montecito, Summerland and the City;and

WHEREAS, workers and members of the public visiting and patronizing essentialand lower-risk businesses face increased risk of exposure due to contacts with andproximity to others in indoor settings, which may be reduced if they wear face coverings,

WHEREAS, the City Council finds that these conditions of peril warrant andnecessitate that members of the public and workers at essential and lower-riskbusinesses wear cloth face coverings to prevent the spread of COVID-19 in order toprotect public health and safety.

NOW, THEREFORE, THE CITY COUNCIL HEREBY RESOLVES AND ORDERSTHAT:

Section 1. lncorporation of Recitals. All the recitals set forth above are true,correct, and valid, and are hereby incorporated and adopted as findings of the CityCouncil as though fully set forth herein.

Section2. Definitions.

A. "Essential business" is defined as any business or organization allowed tooperate by the County Health Officer Orders 2020-8 and 2020-8.1,1 as may beamended. The list of essential businesses set forth in Attachments A and B to CountyHealth Officer Order 2020-8.1 is incorporated by reference and attached hereto asExhibit A, which may be amended as specified in Section 5.

B. "Face covering" means a covering made of cloth, fabric, or other soft orpermeable material, without holes, that sits close to the face and covers the nose andmouth and surrounding areas of the lower face, and that does not impair the wearer'sbreathing. A face covering includes, but is not limited to, gaiters, scarves, such asfabric masks, scarves, bandanas, or other homemade covering made from readilyavailable clothing. A face covering need not be medical-grade or N95 respirators.

C. "Lower-risk business" is defined as any business or organization allowedto operate County Health Officer Order 2020-8.1, as may be amended. The list of lower-risk businesses set forth in Attachment B to County Health Officer Order 2020-8.1 isincorporated by reference and attached hereto as Exhibit A, which may be amended asspecified in Section 5.

D. "Social distancing measures" means social distancing measures includedin guidelines published by the California Department of Public Health and as defined inCounty Health Otficer Order 2020-8.1, as either may be amended, which include, butare not limited to, maintaining at least a six (6) foot distance from all persons who arenot part of the same household or living unit and not gathering in groups.

E. "Worker" for the purpose of this Resolution includes any employee,contractor, owner, or volunteer.

Section 3. Use of Face Covering.

A. Face Covering Required. All workers and members of the public shallwear a face covering while present at an essential or lower-risk business (includingstanding in-line to enter or transact business with one of these businesses).

B. Face Covering Not Required. Notwithstanding Section 3(A), a facecovering is not required when:

1) A person is in a personal office or other confined space where othersoutside of that person's household or living unit are not present, as long as the publicdges not regularly visit the room. For example, and without limitation, abank manager,office worker, accountant, attorney, or repairperson is not required to wear a facecovering if that person is alone in a confined space (i.e., with walls and a door) notregularly visited by the public, but that individual must put on a face covering whencoworkers are nearby or when visited by a clienVcustomer, and anywhere members ofthe public or other coworkers gather or are regularly present; or

2) Wearing a face covering would create a health or safety risk to theperson, based on their type of activity, as determined by local, state, or federalregulators or workplace safety guidelines,

C. Face Coverinq Recommended. Face coverings are recommended, butnot required, in all other public settings where it is not possible to comply with socialdistancing measures.

D. Face Coverinq Not Recommend. Notwithstanding Sections 3(A)-(C), dueto risk of suffocation, face coverings are not recommended for (1) any child two'years oryounger, and (2) anyone who has trouble breathing or is unconscious, incapacitated, orothenryise unable to remove the face covering without assistance.

section 4. Essential and Lower-Risk Business Requirements.

A. All essential and lower-risk businesses shall:

1) Prohibit entry, refuse service or bar queuing or lining up forentry/access to any person not wearing a face covering;

2) Prominently post signage in at least one location readily visible tomembers of the public and workers describing these face covering requirements;

3) Provide face coverings without charge for the use of its workers; and

4) Ensure that their workers have access to clean, sanitary face coveringfor each shift and ensure that all reusable face covering are cleaned, washed andsanitized at least daily in compliance with federal, state and local guidance.

B. All essential or lower-risk business may provide without charge or sell facecoverings to any member of the public present at their essential or lower-risk business.

Section 5. Amendments to List of Essential and Lower Risk Businesses. Giventhe changing definition of essential and lower-risk businesses under state guidance andCounty Health Officer Orders, the City Council authorizes the Director of EmergencyServices to update and amend Exhibit A consistent with amendments to the CountyHealth Officer Order 2020-8.1 or related County Health Officer Orders.

Section 6. Hardship Exception. Notwithstanding Section 3, a face covering is notrequired to be worn by a person if a medical professional has advised that person thatwearing a face covering may pose a health or safety risk.

Section 7. Enforcement.

A. No person, essential business or lower-risk business shall be prosecutedfor a violation of this Resolution unless they continue to engage in prohibited conductafter having been notified at least once by a law enforcement officer, other City-designated volunteer, or employee that the conduct violates the Resolution.

B. Essential and lower-risk businesses that do not adhere to this Resolutionmay be subject to immediate business license suspension and mandatory closure forthe duration of this Resolution.

Section 8. Violations. Violations of this Resolution constitute a threat to publichealth and safety, and may be punishable as a misdemeanor as set forth in Chapter1.08 of the Carpinteria Municipal Code.

Section 9. Severability. lf any section, subsection, sentence, clause, phrase or wordof this Resolution is for any reason held to be invalid and/or unconstitutional by a courtof competent jurisdiction, such decision shall not affect the validity of the remainingportions of this Resolution.

Section 10. Effective Date and Termination. This Resolution shall become effectiveimmediately and shall continue until the earlier of: (1) it is terminated by the City Councilor (2) the conclusion of the local emergency.

Section 11. Scope. This Resolution does not expand the definitions of essential orlower-risk business under County Health Officer Order 2020-8J, as may be amendedAll essential and lower-risk businesses and persons also shall comply with all socialdistancing measures and directives not in conflict with this Resolution.

Section 12. Environmental Determination. The City Council finds that the adoptionand implementation of this resolution are exempt from ihe provisions of the CaliforniaEnvironmental Quality Act (.CEQA') under CEQA Guideline section 15061(bX3) in thatthe City Council finds there is no possibility that the implementation of this resolutionmay have significant effects on the environment.

vi. no tangible items of any kind, including food products, may be transferredto persons in the motor vehicles.

c. Notwithstanding the above, one or more persons, not exceeding five, mayenter nearby buildings as necessary to put on the presentation.

Food and goods delivery servicesFood banks and other organizations that provide assistance to the disadvantagedFood preparation facilities: Food facility workers may not work while ill. "Foodfacility" or "food facilities" means all licensed food facilities, as defined by Section113789 of the Health and Safety Code. No food facility worker or volunteer maywork or volunteer in a food facility with symptoms of COVID-19.

a. The symptoms requiring exclusion from a food facility as defined by theSanta Barbara County Health Officer are found in Attachment A.

b. Food facility workers or volunteers who have had symptoms of COVID-19as defined by the Santa Barbara County Health Officer (Attachment A) shallreturn to work only when they have been free of symptoms for at least 72hours without medication AND at least seven (7) days have elapsed sincethe onset of symptoms.

c. allowed.

ii. Facial covers required. "Facial covers" means a cloth cover that fullycovers the tip and nostrils of the nose and the mouth. All food workersshall wear protective facial covering while engaged in food preparation,serving, and kitchen maintenance activities. Facial covers shall beprovided by the employer and shall be maintained in a clean and sanitarymanner.

iii. Must consume food away from premises. The exception for take-out food activities is designed to enable persons who are confined totheir places of residence to obtain prepared food to take back to theirplaces of residence for consumption. The take-out food shall not beconsumed anywhere within the line-of-sight of a person standing infront of the facility that sold the food. No on-site dining, whether insideor outside (including shared patios, courtyards, or food courts) ispermitted. Facilities shall remove, rearrange, or othenvise makeunavailable for use alltables, chairs, or other customer seating, or diningfixtures on their premises.

b. Sk-foot spacing must be maintained. Licensed food facilities that provideand offer food to consumers for pick up must require patrons who are orderingfood and beverages to be and remain at least six (6) feet apart from eachother while inside the facility. All persons waiting in line or otheruisecongregating outside a food facility selling food via take-out, delivery, ordrive- thru shall maintain a distance of at least six feet from all other persons.Food facilities shall be responsible for assuring that the six-foot socialdistancing requirement is observed at alltimes.

c. Violators subject to permit suspension. Food facilities not adhering to theState's Stay-at-Home Order or this Order may be subject to immediate permitsuspension and mandatory closure for the duration of this Order, includingextensions of this Order.

Golf Courses, Public and Private: to provide accommodations for personswho wish to golf as a form of outdoor activity, public and private golf courses mayoperate provided they strictly enforce social distancing requirements and enforcethe following additional protocols:

a. Only single occupant motorized carts are allowed and each cart must besanitized before next use;

b. No more than four golfers are allowed per group and each group must bestable (i.e., persons may not substitute in or out of the group);

c. A distance of at least 30 feet shall be maintained between groups of golfersat alltimes;

d. All ballwashers shall be covered and flag pins shall be removed and the cupon each green shall be inverted or otherwise installed to eliminate high-frequency touch services on the greens and tees;

e. Persons may use a driving range provided that range balls are properlysanitized before distribution to customers (stand-alone golf driving rangesmay also operate);

f . Practice putting greens shall remain closed;
