I, Elizabeth Kristen declare that:
1. I am counsel of record for the class of plaintiffs in this matter, and amlicensed to practice law throughout California.
2.
The Legal Aid SocietyEmployment Law Center (Legal Aid) andZelle Hofmann Voelbel & Mason LLP jointly represent the class in this matter.
3. I make this declaration in support of Plaintiffs Bill of Costs. I havepersonal knowledge of the facts stated herein, except as to those matters alleged on
information and belief, and as to those matters I believe them to be true. If called upon
as a witness, I could and would competently testify thereto.
4. The Bill of Costs separately and specifically states each item of taxablecosts claimed. All of the costs incurred by Legal Aid are accurate and were actually and
necessarily incurred in this case.
5. I prepared the Bill of Costs filed herewith. I am attaching invoices insupport of the bill of costs as described herein. Each item of taxable costs claimed is
described below.
Court Filing Fee (Local Rule 54-3(a)(1))
6. Attached hereto as Exhibit A is a true and correct copy reflectingpayment to the Clerk of the Court for the filing fee for this case. This fee was $350.00.
Fees for Service (Local Rule 54-3(a)(2)
7. Attached hereto as Exhibits B and C are true and correct copies ofinvoices for service of process on the State Defendants ($60) and the Federal Defendants
($38.20). These fees total $98.20.
Fees For Reporters Transcripts (Local Rule 54-3(b))
8. Attached hereto as Exhibit D is a true and correct copy of an invoice forthe reporters transcript of the October 14, 2010, motion to dismiss hearing. This fee
totals $194.00. This transcript was necessarily obtained for use in the case because the
hearing regarding the first motion to dismiss provided important information about the

Fees For Exemplification of Government Records (Local Rule 54-3(d)(1))

Attached hereto as Exhibits E and F are true and correct copies reflectingthe costs incurred for copying the Secretary of States records regarding registered
domestic partners. These fees total $40.
Fees for Reproducing Disclosure or Formal Discovery Documents (Local Rule 54-
3(d)(2))
10. The formal discovery and disclosure documents in this case consisted ofPlaintiffs Initial Disclosures (4 pages); documents bates labeled MD00001-MD000114
(114 pages); Plaintiffs First Set of Requests for Admission (6 pages); and Plaintiffs
First Set of Interrogatories (7 pages). The total number of pages was therefore 131
pages. Legal Aid charges $0.09 per page. Therefore, plaintiffs incurred $11.79 in
copying costs.
