The powers and functions CYf the Connell shall be as follows: -:"
1. To advise the Government on any -educational pro~ blems' which may be refelTed to it by Government.
2. To approve, recommend and co-ordinate the Educational programmes submitted by Voluntary Educa .. ' tional . Organisations. .
3. To collect information wherever necessary on matters pertaining to the work of the CoUncil and suggest improvements in any branches of education.
4. To constitute wherever necessary sub-Committees .to consider any question and include in an sub-com .. mittee or. authorise the subo-committee to co-opt members not being ·members of the Council, subject to the condition that the number of such additional member's shall not exceed 50% of members of the Council on the subo-Committee.
5. To examine the present Rules and R~gulati6ns. whereby the Educational Services and Establishments are run and to propose to the Government necessary' alterations with a view to improving the efficiency of the sernces.
6. To make rules' for the transaction of its business, and
7. To perform such other functions as _ may be pres·· cribed by Government.
"The non~official membe~ of the ,Council ,shall be eligible to T. A. and D. A. and conveyance' allowances as admissible, to: Group 'A' Officers of the Government.
-The' expe;nditure on this ,aCcoWlt shall be debited to the Budget Head, 28 Education, F. 1 (1) (3) T, A.

Whereas by Government' Notification No. RD/LQN/283/79 dated 13-1·1983 published on -page 583-584 of Series TI, No. -43 of the Official Gazette dated 20-1-1983 it was notified under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as "the said Act") that the land specifie!l in the schedule appended to the said Notification (hereinafter referred to as the "said land")· was likely to -be needed for public purpose viz. Constructi~n -'of Distributory Dl of Salauli Irrigation Project, A vedem Village.
And Whereas the Government is of the opinion . that its .acquisition is urgently necessary.
The' Governm.ent 'is also pleased to direct under sub-section 1 of S·ection 17 of the said Act, ··that the Collector appointed lmder paragraph 2 below, shall at .any time on expiry of 15 days from the publication of notice relating to the said land under sub-section 1 of Section 9 of the said Act, take l>ossession of the said land.
2. The Goverrunent is also pleased to appoint under clause (c) of Section 3 of the said Act, the Special Land Acquisition Officer, Salauli Irrigation Project, Sanguem to perform the functions of a Collector for all proceedings hereinafter to be taken in respect of the said land and to direct him under Section 7 of the said. Act· to take order for· the acquisition· of the said land.
And Whereas the appropriate Government (hereinafter referred to as "the Government") is satisfied after _ considering the report made under sub-section (2) of Section 5A of the said Act, that the said land speqified in tp.e schedule

1; Whereas disciplinary inquiry in the case of Shri Suresh R. Ran.e.· Accowi~ Clerk of the Office of the Controller •. Weights and Measures. P.anaji has been initiated by the Con .. troller. Weights and Measures as Appointing Authority under his Memorandum dated 10th April, 1978;

And whereas. said Shri Rane approached' the Hon'ble .Judicial Commissioner's Court in Writ Petition No. 122 of 1980 and the said Court, by its order dated 14-8-1981, held that the· whole proceedings against. the petitioner had been vitiated and, therefore, liable to be set aside as violative of the provisions' contained in Article 311 of the Constitution;
3~ And whereas in view. of tl).e said judgement the existing Notification No. 5-3-74-CVD dated 2-8-1974 whereby the Controller of Weights and Measures -have been declared Appoip.ting Authority and Discip~nary Authority for' Group C posts in the Office of the said Controller cannot be made applicable to this special case.

This is an appiicatlon under Section 83C(2)of the I.D.A. 1947, herein8.fter called the Act, made by' the ahove applicant agajnst the above opponent, cialming from the ratter the tOtal amount of .Rs. 'i6,512/- as pel' the detaJIs given in the annexure to the "application.
2. It is applicant's case. that he was working for" the opponent as Store Clerk since 31·8-1976 till 13-l2-198O, date on which he" resigned. His"'"totaJ salary per month was Rs. 180/-. The Opponent has not paid his wages as per the Minimum Wages Act fixed by the Government from 31-8-1976 as well as D.A. as declared by the Government. He has claimed those amotmts ann. also others like Bonus, House Rent, etc.
3. The Opponent Company, in its written statement, has l'aised' a preliminary objection" saying that the applicant's claim is not ma:intainable under Section 33C(2) 0If the Act since the" main prayer of the applicant is for minimum wages under the" Mhlimum Wages Act" and Section 20 of this Act has provided regarding the competent authority before "whom such claim. is to be" filed, which procedure has" not been followed by the applicant; besides. it is contended that under Section 22 of the M'mimum Wages Act this application ought to have been made within a Period of 6 months from the 'date the claim has become due.
4. 'l'he applicant, although granted time, at his request. to reply to the prellmiuary objection raised by the opponent, did not fll~ any reply.
5. The following prelhnina;ry issue was framed by the Court:
"Whether it· is proved that this application is maintamable under Section 33C(2) of the Industrial Disputes Act, 1947 or Minimtun Wages Act, 1948?" -
O. Date was fixed "for arguments and, on the date so fixed, only the representative or the opponent remained pre-sent and argued the matter. -
7. I' have duly considered the objection raised by the Ld. Rep. of the"" Employer and I concur with his view that under Section 20 of the Minimum Wag .. Act the proper authority appointed by the Government to hear claims regarding Minimum Wages, which is the main prayer, of the applicant, is the Commissioner for Workmen's Compensation" i. e. the Labour Commissioner. Being so, this Court has no jurisdiction to entertain the claim filed by the applicant. Hence, l pass "the following order:
ORDER
