I tIivoluzlztarv Resettlement: impacts of development projects may result in losses,

unavoidable relocation that people affected have no option but have to rebuild their lives

incomes and assets elsewhere.

Resettleine,zt Plai is a time-bound action plan with resettlement strategy, objectives,

impacts, entitlement, socio-economic survey, policy framework, legal framework,

measures to minimize impacts, resettlement sites, compensation, income restoration,

resettlement implementation arrangement, resettlement schedule, participation and

I consultation, grievance redresses, monitoring and evaluation, and possibly indigenous

people development plan.

I Project Affected Persons (PAPs) or Displaced Personts (DPs) indicates any juridical

person who may be an individual, a household, or a private or pubic firm on account of

| the execution of a project, or any of its components or sub-projects or parts thereof would

have their:(i) right, title or interest in any house, land or any other asset acquired or possessed,

U in full or in part; or

(ii) business, occupation, \vork, place of residence or habitat adverselv affected: or

|(iii) Standard of livin ad% erselv affected.

ColpeLnsationl means payment in cash or a kind to replace losses of land. housin Lz

income, and other assets caused by a project.

Replacementt cost is a sufficient cost to replace lost assets and cover transaction costs.

(i) For agricultural land, replacement cost of an affected plot is the value to buy a

affected plot plus the cost of preparing the plot to a level similar to those of the

affected plot, plus the cost of any registration and transfer taxes.

(ii) For land in urban areas, it is a pre-project market value of a plot with equal size

located in the vicinity of the affected plot, plus the cost of any registration and

transfer taxes.(iii) For houses and other structures, it is market costs of materials to build a

replacement structure with an area and quality similar or better than those of the

affected structure. Or it is the cost to repair a partially affected structure, plus the

cost to transport building materials to the construction site, plus the cost of any

labor and contractors fees, plus the cost of any registration and transfer taxes.

In process to determine replacement cost, depreciation of asset and value of salvableI materials are neither taken into account nor the value of benefits derived from the

project.

Cenisuis is a data collection technique of completing enumeration to all PAHs and their

assets through a household questionnaire. Objectives of the census are (i) to prepare a

complete inventory of PAHs and their assets as a basis for compensation, (ii) to identify

non-entitled persons, and (iii) to minimize impact of later influx of "outsiders" to project

area.

Socio-econzo,nic suirvey is carried out in order to collect profile data of PAHs and to

prepare for Resettlement Plan. A sample about 20% of PAHs is surveyed through a

household questionnaire. The survey result is used (i) to assess incomes, identifyproductive activities, and plan for income restoration, (ii) to develop relocation options,and (iii) to develop social preparation phase for vulnerable groups.

| CCtt-off da(te determinles eligibilitv for entitlement. The cut-off date couldl also be the date

the project area was delineated, prior to the census, provided that there has been an

cfftectivc public dissemination of information on the area delineated, and systematic andI continuous dissemination subsequent to the delineation to prevent further population

influx.

Vulnerable -ro,tp is defined as indigenous people, ethnic minorities, the poorest, women,

children, the aged, the disabled, and other socially/economically vulnerable groups who

could adversely affected from a project.

Grievance Redress procedures are set out the time frame and mechanisms for resolutionsI of complaints about resettlement from PAHs. Gnrevance redress can be carried out

through informally-constituted local committees with representation from key stakeholder

|groups. Grievances can also be addressed through formal channels. With an unresolved

grievance, it will be dealt with at progressively higher levels.

EXECUTIVE SUiNlI;IARY

I 1. Tlte Project anid Resettlemnent Plan

The 220 kV substation in Binh Tan is a subproject of the Transmission and DistributionProject that would be constructed to meet the demand of power consumption of Ho ChiIMinh City in the period of 2001-2010. This subproject includes (i) Binh Tan 220 kVsubstation; (ii) a short transmission line 220-1 10 kV with a length of 88 meters; and (iii)Access road. The subproject would acquire land from eight families only and thereforeonly an Abbreviated Resettlement Plan is prepared. According to the World Bank's OPI A4.12, an Abbreviated Resettlement Plan mainly covers the following minimum elements:(1) a census survey of displaced persons, and valuation of assets; (2) description ofcompensation and other resettlement assistance to be provided: (3) consultation withdisplaced persons about acceptable alternatives; (4) institutional responsibility forimplementation and procedures for grievances redress;: and (5) a timetable and budget.

2. Objectives of Resettlemient Pl/aii

The main objectives of resettlement plan are (i) to minimize adverse impacts on landacquisition; and (ii) in unavoidable case, a resettlement plan will be prepared in order tomiiake sure that DP can improve or otherwise will be at least restored their livelihood aspre-project implementation.

3. LeLgalfitameivork

Abbreviatdd Resettlement Plan (ARP) for this project is based on laws and relevantI Decrees of Viet Nam related to compensation and resettlement and OP 4.12 oninvoluntary resettlement of the World Bank. Eligibility for compensation and/orrehabilitation entitlement and other assistance includes all individuals, households andinstitutions who will be affected by the project, either temporarily or permanently.

4. Project impacts

The project will impact on:

Permanent land acquisition for the substation, access road; connection towerand underground cable line.I - Permanent houses, structures, trees, crops and other assets.Temporarily acquired land required during the construction of the project.

I The survey results are shown as follows:There will be a total of 08 affected households with 14 persons. Of which, numberof households to be fully affected on houses and has to be relocated is 08 families.

There are no impacts on natural preser-vingy zones, vestigTes, and pagodas or

5. Entitleiment policy

All of project affected individuals, families; institutions in the project area wvill be

compensated for their lost assets and will be assisted with allowances and subsidies in a

transition period to make sure that they could at least restore their livelihood.

Compensation costs and allowances will be based on decision of HCNICPC and at the

replacement values.

6. Participationt anid conzsiltationi

The consultants of PECC2 have carried out consultation wvith the DP. The consultation

includes asking the DP with some formal questions in a questionnaire (such as options for

compensation in cash or in kinds, opt to be resettled to resettlement site or self-relocation

with cash compensation etc.). The consultants have also asked PAPs about the proposed

economic restoration programs and any special needs required for resettlement in order to

shorteni the transition period.

7. Comnplaiuit aint! nlonitorin-

DuL-inig the project implementation, the DP's complaints wvill be dealt with according to

the regulations of Vietnamese laws. The complainant wvill be treated fairly and to be

gided by related agencies on the ordet, procedures. In addition, no fee will be charged

for their complaints.

The implementation of the RP shall be constantly supervised and monitored by the

Project Management Unit under the Power Company of Ho Chi Minh City and all

relevant local authorities to make sure that the RP will be implemented smoothly.

8. Inistituttionial arrangemeents

The Power Company of Ho Chi Minh City and its Project Management Unit will be

mainly responsible for all of operations on investment guidelines, investigation and

design, project construction as well as supervision of compensation and resettlement ofI the project. The Project Management Unit is also responsible for directly guiding the

whole implementation process of the project including RP implementation to all related

institutions. To successfully implement the RP, PMU will be assisted by HCMfPC city,

district and ward authorities.

RP implementation xvill be implemented in a close linkage to the civil works. The detail

schedule of RP implementation will be planed later at the detail design phase of the

project. The project affected persons w ill be clearly informed about the quantity of their

loss assets, entitlement policy, compensation unit cost, compensation amounts and RP

implementation schedule.

10. Cost estimate

Total compensation cost is estimated at about 18,526,526,685 equivalent to USD 1.176

million (The rate of exchange is ViND 15,750 per USD). This cost including costs for

compensation. rehabilitation activities alloxvances, as well as administrative management.

I 1 . INTRODUCTION

1.1 The subproject

Ho Chi Minh City is the biggest one of Viet Nam. Its power consumption is at a high rateand increasing rapidly from time to time. According to a forecast by the Energy Institute,the total capacity of substations needs to be increased about 70% up to 2010 to meet withdemand of industry, domestic use. Its current power network needs to be upgraded andexpended through many programs such as national program, city program and programsof some international donors such as the World Bank and Asian Development Bank.

1.2 Objectives of Resettlement

Principles and objectives of this RP are defined in accordance with Vietnamese laws theand OP 4. 12 of the World Bank on involuntary resettlement.

- Involuntary resettlement and loss of means of livelihood are to be avoided wherefeasible through exploring all viable alternatives. But when, after examined, if it isproved unavoidable, then effective measures to minimize impact and tocompensate for losses must be agreed with the people who will be affected:

| People to be resettled involuntarily and people wvhose means of livelihood w.ill behinldered or lost muLst be sufFiciently compensated and supported by the projectplroponenlts a timely mannier;

The project proponents must make efforts to enable the people affected by theproject to improve their standard of living, income earning opportunities andI production levels, or at least to restore them to pre-project levels. Measures toachieve this include: providing land and monetary compensation for losses (tocover land and property losses), supporting means for an alternative sustainablelivelihood, and providing the expenses necessary for relocation and the re-establishment of a community at relocation site; and;

- Appropriate participation by the people affected and their communities must bepromoted in planning, implementation and monitoring of involuntary resettlementplans and measures against the loss of their means of livelihood.

To achieve these objectives, Resettlement Plan should be designed so as to follow theimprovement or at least a maintenance of the PAP's pre-project living standards.

2. LEGAL FRAiMIEWORK

This Abbreviated Resettlement Plan is prepared in accordance with the project| resettlement policy. This policy is developed based on the relevant laws of Viet Nam and

land law 2003.- Decision No. 153/2004/QD-TTg of Prime Minister on August 17, 2004 promulgating

the strategy orientation for sustainable development in Viet Nam (Vietnam's agenda

21).I - Decree 197/2004fND-CP on December 03, 2004 on compensation, support and

resettlement when land is recovered by the State.

- Circular 116/2004/TT-BTC on December 7, 2004 guiding the implementation of

I compensation, support and resettlement when land is recovered by the state.

- Decree 1SS/2004/ID-CP on November 16, 2004 on metlhods to determine land prices

and assorted land price brackets.

- Circular 114/2004iTT-BTC on November 26, 2004 guiding the implementation of the

Government's Decree No. 1 88 20047'ND-CP on methods to determine land prices and

assorted land price brackets.

3. EFFORTS IN MINIMIIZING LAND ACQUISITION

The site of Binh Tan substation was selected based on the considerations of technical,

I environmental and social viewpoints. These issues were carefully studied by checking at

the site and through consultation with local people, Binh Tan district authorities. There

are several alternatives that were studied. The site was selected with a shortest distance to

connect to the existing grid so that it would minimize impact to people under the right of

affected by all different categories (on land, building, crops and trees etc.).

4. SIOECONOMIC CONDITION, CENSUS AND INVENTORY

4.1 The socio-economic condition of DPs

The socio-economic survey was carried out for all of the DPs (08 households). Average

of family size is 02 persons. Of which, woman is 48.56%, and man is 51.44%.

Ilost of the DPs are doing business or working as government staff or in private firmns.

Few DPs are doing farming as a second occupation. But income from farming is quite

small compared to other sources. The average income of the affected families is about

VND SO million per year.

IMost of the DPs have electricity, running water or drilling well, television, telephone,

motorbike, refrigerator and furniture. MIost of the DPs have main houses of more than 100

m2 and good sanitation facilities.

A summarv of socioeconomic survey results is shown as in table 1.

4.2 Lanid acquisition impacts

Impacts on land include temporary ones in the construction time and permanent land

acquistion for constructing the substation, access road and pole foundations. There are OS

IHHs who will be fully affected on houses. Of these, 06 HH remain land to reorganize

their new houses (do not have to displace) and 02 HH do not remain residential land and

have to be relocated. Land acquisition is summarized as in a table no. 2, 3 and 4 below.

I 5. PRINCIPLES, ELEGIBILITY TO COMPENSATION AND ENTITLEIMENT

* 5.1 Principle

| Resettlement Plan should be designed to achieve an improvement or at least maintenance

of the PAH's pre-project living standards.

(a) Both Resettlement and land acquisition must be minimized as much as

possible

| (b) Resettlement distance must be minimized. If the agricultural replacementland needs to be given, then it should be as close as possible to the landacquired.

(c) Cash compensation for land, houses or structures shall be given at thereplacement costs free from depreciation cost of the salvage of the old

construction materials. Trees shall be compensated at replacement cost (thecost of a seedling plus annual income from the tree multiplied by the

number of years that it takes for the seedling to be harvestable). Cash

compensation for crops shall be given at market price rates.

(d) Resettlement transition period must be minimized and compensation should

be paid to PAHs at least one month before the start of constructionactivities. No land clearance if a full compensation has not been done.

(e) Resettlement and land acquisition plans and all replacement alternatiVes

should be carried out following consultation with the PAPs and it should

have their popular acceptance. The plans are also required to be approved

by local Authlorities.() Resettlemenit and compensation programs must provide adequately

institutional arrangements to warrant effective and timely implementationand proper monitoring.

(h) The prev ious level of comimunitv services and resource should be

5.2 Displaced Persons and eligibility

The DPs include the following persons to be identified by the baseline information

collected for the Resettlement Plan:

(a) persons whose houses are partly or fully affected (temporarily or permnanently)

by the project;

(b) persons whose residential and/or agricultural land is partly or fully affected

(permanently or temporarily) by the project;

(c) persons whose businesses are partly or fully affected (temporarily orI permanently) by the project; and

(d) Persons whose crops (annual and perennial) and trees are affected partly orI fully by the Project.

I The displaced or project-affected people eligible for compensation will include: (a)those

vho have formal legal rights to land or other assets; (b) those who initially do not have

formal legal rights to land or other assets but have a claim to legal rights based upon the

laws of the country; upon possession of documents such as land tax receipts and residence

certificates; or upon the permission of local authorities to occupy or use the project

affected plots; and (c) those who have no recognizable legal right or claim to land they

are occupying.

Persons covered under (a) and (b) are provided compensation for land they lose, and other

assistance. Persons covered under (c) are provided resettlement assistance, in lieu of

compensation for the land they occupy, and other assistances, as necessary, to achieve the

objectives set out in this policy, if they occupy the project area prior to the cut-off dates

defined in the RP. Persons who encroach on the project areas after the cut-off date

defined in the RP are not entitled to compensation or any other forms of resettlement

assistance. The ciut- off date of this RP is October 14, 2004.

5.3 Impact Categories

By the nature of the project impacts based on the survey of the DPs, the impact categories

could be classified as belowv:

All persons own lands and properties on it, which will be permanently acquired for the

Besides the direct compensation for the losses, the DPs are also entitled tosubsidies/allowances to restore their livelihood as stipulated in the Decree No.197, 2004

of GOV. These allowances/ subsidies are as below:

(a) Subsidv for moving to new site (transport allowance)

This allowance is for DPs who have to be relocated to new sites: i) PAPs who haveto relocate within the City will be entitled to an allowance from VNND 1,000,000 to|V N,'D 3,000,000; ii) PAPs who have to relocate out of City will be entitled to

transport allowance of VND 3,000,000 to VND 5,000,000. This subsidyallowance is for the transportation of their salvageable materials and livingfacilities from affected site to the relocating sites.

(b) Relocation Subsidy for Resettlement

This subsidy allowance is a food allowance for DPs who will be relocated or

reonzanized in remaining land, and therefore they have to reconstnict their newhouses. Each member of PAHs will be equivalently subsidized 30kg rice per

nmonth in six months.

(c) Rehabilitation Allowance

I Vulnerable groups (the elderly, woman-headed householder, disable etc.,) and DPswho are permanently affected more than 20%o of total productive land area and or

lost permanently more than 20% of their incomes will be entitled to training \vith

5.000,000 VND; person.

(d) 13onus for self-relocation

DPs opting for self-relocation will be received a bonus package of VN"'D20,00,000 per HH

6. RELOCATION AND ECONOMIC RESTORATION PROGRANIS

As described in (4) above, there are only two HH have to move to new sites, theI remaining six HH will reorganize houses in their remaining land. Thus, relocation site for

the DP is not necessary. Through consultation with the DPs, all DPs agreed to receivecompensation in cash to manage relocation themselves. In the implementation period, theDP will be assisted by PMU and local authorities in purchasing and constructing their

houses.

There is only one HH losing more than 20% of total productive land and this family willbe entitled to an economic restoration assistance . It is VND 5,000,000 per HH and thisfamily will be assisted with vocational training or any activity of economic restorationwhich the family prefers.

7. CONSULTATION AND PARTICIPATION

Information dissemination to, consultation with and participation of the affected people

and involved agencies are to (i) reduce the potential of conflicts, (ii) minimize the risk of

project delays, and (iii) enable to design the resettlement and rehabilitation program as a

I comprehensive development program to fit needs and priorities of the affected people,

thereby maximizing economic and social benefits of the project investment.

The objectives of the Public Information Campaign and PAP Consultation Program are as

follow ing:

- To fully share information about the proposed project, its components and its activities

associated with the affected people.

- To obtain information about needs and priorities of the affected people as well as

information about their reactions/feedback to proposed policies and activities.

- To obtain cooperation and participation of affected people and communities vhen

implementing the resettlement plan.

- To ensure transparencv in all activities related to land acquisition, resettlement and

re habilitation.

Binh Tan district authiorities and DP were consulted through surveys and for the RP on

issuLes such as (i) alternatives of substation sites. route of the access road and cable: (ii)I DP's cloice to modes of compensation (in cash or in kind); (iii) compensation unit cost

recently issued by H-ICNICPC: and (iii) implementation arraneement (pavment, complaint

| meclhainismii, monitoring etc.)

Feedback of Binh Tan district and DP on the proposed project sites and relocation

preference wvere taken into account by engineers and resettlement planners.

The consultations were carried out through questionnaire of survey, meetings and

individual interview. The consultation and participation will be continued through the

whole period of th RP implementation.8. INSTITUTIONAL ARRANGEiMIENT

HCMCPC, its power company of HCMC, PMU and other administrative levels will be

responsible for implementing the RP. The co-ordination between the project developer

and local authorities should be made closely in order to implement the RP smoothly and

effectively and to minimize a delay of the project.

8.1 Institutional Arrangements

The following institutions/agencies wvill be involved in implementing the RP:

- People's Committee of Ho Chi Minh City and Binh Tan district

- Power company of HCMC and its Project Management Unit

- Departments of Finance, construction and Natural Resources and Environment

8.2 The functions, taskforce and responsibilitv

HCNICPC:

HCMC PC is responsible in directing compensation and resettlement to Binh Tan

compensation, support and resettlement council. It will be also responsible for approval of

compensation plan and involves to complaint redresses.

Power company of HCMIC and its Project iMIanagement Unit:

U Powver company of HClMC and its Project Management Unit are responsible for

implemllenting the RP, including impact survey, payment of entitlements, implementation

of restoration program, resolution of complaints, internal monitoring.

City Department of Finance. Department of Construction and DONRE:

The city Department of Finance is responsible for researching and issuing unit prices of

compensation and then proposing to City PC for approval. At the beginning of the RP

I implementation, the Department of Finance wvill closely co-ordinate wvith the Department

ot Constr-uction. DONRE, People's Committee of the district in order to evaluate the

zappliedL unit prices in the RP and propose to City PC for adjustment if necessary. It is to

ensure that the compensation unit costs are at replacement values at the time of

compensation payment to the DPs.

District Compensation council

The District Compensation, support and resettlement council is mainly responsible to:

- Assist PMU in preparing detailed plans for compensation and resettlement.

- Conduct inventory of impacts, prepare detailed implementation plan for

I compensation and resettlement, pay compensation to PAP and help them in

moving out of the project affected areas.

- Solve complaints at the district level.

Ward People's Committees

Ward People's Committees will be responsible to:

- Contribute to census and inventory surveys.I - Co-ordinate wvith Compensation, Support and Resettlement council of district

on issues related to RP implementation such as public meetings, informnation

dissemination, compensation/ allowance payment to DPs.

Transfer all feedback by DPs to District authorities and settle the complaints at

the ward level. Suggest the solution for the outstanding issues (if any).

The DPs are responsible for carefully checking on their lost assets in the DMS form and

them in purchasing land and reconstructing their houses and to be sure that, no

land clearance if these DPs haven't completed the reconstruction of their houses at

new sites yet.

The impacted DPs on houses and land after receiving full compensation and

subsidies are requested to move out of the affected portion of the houses for

clearing land at least 1.5 days before the work commenced.

4. RP implementation process

RP implementation will include three major actions as below:

a) General action: Just at once when beginning the project implementation

work.b) Separate action: at several times, once for each component of the project..

9.2 Basic actions of the project

1. ActionI 1: Establish Comttpenlsation, Su(pport antd Resettleniienlt couIItcil.

Just after the investment approval of the project, Binh Tan district w,ill establish

Compensation, Support and Resettlement council. The Power Company of HCMC

and its PMIU sets up a Compensation and Resettlement team.

2. A ctioIn 2: Detail illeasu(remtl enl t Su(rvey

District Compensation, support and Resettlement Council carries out the Detail

Mleasurement Survey of affected assets and together with other related agencies to

evaluate for the applied unit costs in the RP and propose to City PCs tor

readjusting thesc prices (if it is necessary). It is to ensure that the DPs are

compensated with replacement costs at the time of RP implementation.

3. A ctioni 3: Prepare comitpeLisationj plaia

Compensation and assistance are paid for DPs affected on houses, and then for

DPs affected on other properties. The DPs are permanently lost more than 20% of

total productive land area or incomes will be entitled to rehabilitation assistance.

6. Actioni 6: MIonitorinig

During the project implementation, PMU will monitor all actions of the RPI implementation and rehabilitation programs. Because of small scale of land

acquisition impact, independent monitoring might not be necessary or only

individual might be hired by the Power Company of HCMC for this task.

Monitoring includes the following issues:

are carried out as stated in this RP.

b) Mlonitoring the availability of budget for compensation and compensation costs

to make sure that the DP are paid at the replacement costs.

c) Mlonitoring if compensation to the DP is in a timely manner.

d) Investigate and fairly assess each case of complaint and grievance.

* e) PNMUL will prepare a quarterly detailing report on progress of RPimplementation. The report should be sent to relevant authorities.

9.3 Implementation schedule

One of RP provisions is that, RP will be carried out to meet safety purpose of landI clearance and implementation of civil wvork.

The RP implementation schedule wvill be wvith the main followving steps:

(I) Preparation work, definition of scope and amount of project investment

(2) Survey wvork for the RP: October, 2004

(3) RP reviewed by relevant authorities and approved by EVN, cleared by the

WVorld Bank: February- April, 2005(4) Establishing Compensation, Support and Resettlemiient Council of Binh Tan

district: May, 2005(5> > ) Information campaign: June, 2005I (7) Compensation Payment, land clearance for the project construction: About

05 months before the beginning of civil work (according to bidding plan). A

(S) Implementation of economic rehabilitation programs: In the same time of

compensation delivery.(9) Mvonitoring of RP implementation and evaluation: Through whole period of

implementing RP.(10) Commencing with Civil works of the project: After full compensation and

completion of house construction of DP at new sites.

All RP activities must be satisfactorilv completed before PMU give a no objectioti

for award of contract for thte siub-projects.

10. COMPLAIN MIECHANISiMI

To ensure that the DPs have opportunities to express their grievances related to any

aspect of compensation and resettlement, detailed procedures of grievances have

been established for the project. Its objective is to respond to grievances of the DPs

speedily and transparently. Actions of the mechanism must be convenient,

transparent and fair. By resolving grievances at the project level, implementation

of the project would be more effective ascertained. The procedures of grievancesare as follows:

Stage 1: At wvard level

If any person is aggrieved by any aspect of RP implementation, he/she can lodgean oral or written grievance to ward authorities. Ward People's Committee willresolve the issue within 15 days

I Stage 2: At district level

I If a complainant is not satisfied with decision in stage 1, he or she can bring thecomplaint to district PC. Within 15 days from the date of the receipt of his/herpetition, district wvill reach a decision on the complaint.

Stage 3: At citv or district court level

If the PAP is still dissatistied wvith the decision, he/she can appeal to the DistrictPeople's C'ourt (DPC) in accordance with the i Civil Procedure Act" or to-ICMNICPC within 15 davs of receivinmz the decision of the district without bein(z

charged. No fees will be chlarged to complainant.

11. COST ESTIMlATE

Compensation cost estimate for house, structure, residential land, agricultural land, treesand crops etc., are based on Compensation and resettlement policies of HCMC:

Compensation unit costs for lands (Decisions no. 316/2004/QD-UB datedDecember 24, 2004).

- Compensation units cost for building and other structures (Decision no. 118/QD-UB dated April 28, 2004.

| Cost for RP consists of:

- Compensation for permanent land acquisition- Compensation for trees and crops- Compensation for houses and structures- Subsidy, allowance for rehabilitation consist of relocation subsidy, transport

allowance, training subsidy etc.- Management cost, and

| - Contingency cost.
