■ Overview _ Customs registration of Intellectual Property Right(IPR) means the system of registering information on knowledge owned by IPR holders as well as concerns of intellectual property infringement to customs for efficient protection of IPRs in the customs clearance procedure.

■ How to register _ Customs registration of IPR can be conducted through post, visit to the IPR Recordation Center, and/or registration on the Internet. IPR to be registered include 6 rights, viz. trademark right, copyright, plant variety protec-tion right, geographical indication right, patent and design right.

Ⅱ. IPR Seizures during Customs Clearance

1) Overview ■ The number of IPR Seizures detected during the clearance

procedure by Korea Customs Service(KCS) was 52,423 cases in 2018, up by 360% compared with 11,384 cases in 2017.

- The reason for this significant increase in the detection cases of postal items infringing IPR is due to the increased efficiency of work through the strengthening of inspection and on-site authentications regarding carried-in goods of small amounts that may have concerns about IPR infringement.

■ For the results of detection in case of IP rights, trademark accounts for 99.7% (52,260 cases) of all cases, projecting the highest numbers for IPR infringement.

■ Regarding the detection results in terms of customs clear-ance types postal items and express cargo showed the highest numbers in terms of the number of cases in the previous year. Further, items to be controlled possessed the largest share in terms of weight, but in 2018, postal items accounted for the largest share in both the number of cases and by weight.

■ In terms of items of goods, detection of shoes and watches significantly increased compared to 2017, and the detection of Machinery/Appurtenance decreased.

■ In terms of country of shipment, China accounted for the largest share at 92.9% (48,701 cases).

Ⅳ. Major Cases of IPR Seizures

In order to effectively respond to IPR infringing items based on interna-tional postal items, Korea Customs Service(KCS) has strengthened customs clearances since November 26th, 2018.

Based on the regulations of the Universal Postal Union, postal items put on hold due to potential IPR infringement were sent back to their respective countries after a certain period of time, even if those parcels were catego-rized as non-treatable items. This, however, raised problems of those exact same items being sent back into Korea.

Accordingly, for effective protection of IPR and domestic consumers, crack-down on postal items involving IPR infringement was made stricter, and the system was improved to ensure that detected articles are allowed to be dis-posed or sent back after the parts involving IPR infringement are removed.

As for postal items infringing upon IPR, about 45,000 cases were detected in 2018. This shows a rapid increase by 7 times compared to the previous year. Such items seized since November 2018 have been disposed of since 2019 after the procedure of public announcement about disposal. KCS will continue to strengthen inspection on postal items infringing upon IPR even after 2019.

Case 1.

In March of 2018, Incheon Airport International Postal Customs conducted intensive crackdowns on postal items suspicious of IPR infringement. In ad-dition, advanced inspections were made on the recipients of the postal items brought in domestically through international post.

As a result of the intensive crackdown, 3,100 items(market value of 12.1 billion won for authentic goods) including Rolex and Hublot watches, Gucci handbags, and Valenciaga shoes were seized in Hanam, Ansan, Daegu, and Pohang.

Most of the smugglers were small scale sellers who had stores in large domestic open markets. The seizures were all confiscated, 5 domestic dis-tributors were booked on charges of smuggling, and 2 of them were sent to the prosecutor's office.

Case 2.

Intensive Crackdown on Fake Shoes at Incheon Airport International Postal Customs

Korea Customs Service(KCS) conducted a joint crackdown on illegally cop-ied toys along with the Ministry of Culture, Sports and Tourism(MCST) and Korea Copyright Protection Agency(KCOPA) as possible increase in the distri-bution of fake toys was expected(May-June, 2018).

Such actions were focused on dealers who distributed a large amount of fake items on online open markets using the internet. The crackdown was conducted jointly with the special judicial police of the MCST in order to im-plement an intensive crackdown on pro-duction·import·distribution and habitual selling of illegally copied products.

Search and seizure was conducted on 3 sellers of illegally copied products locat-ed in Yongin City of Gyeonggi province, and Gwangju Metropolitan City. A total of 13,140 articles (value of 300 million won) including fake characters such as block toys of Lego were seized, and 3 distrib-uters were booked without detention.
