AGENDA REGARDING ISSUE OF RAIN COATS ( BARSATI) & GUM BOOTS t o ISS/.11£
TO THE WORKERS OF ROAD WING OF MC, CHANDIGARH.
The Union members of the Co-ordination Committee of Govt & M.C
employees and workers has demanded to issue Rain Coat ( Barsati) & Gum boots to the
field staff workers of road wing of M.C. Chandigarh as in the ra iny season the workers are
compelled to work in the road side for opening the blockage etc. it is further intimated that
in the year 2003 , the C.M. MC has decided that one hundred Barsati be purchased and
issue to the field staff workers working in the Horticulture wing of MC ,This decision being
implemented in other wings of Engg. Dept! of MC, but not in the Road wing of MC,
Chandigarh .
It is intimated that matter regarding providing Barsati to the field workers is a
policy matter is to decided by the higher authority. However it is submitted that during the
matter ra iny season the road side have been generally blocked and these blockages are
opened by the field staff even during the rain .it is very difficult for worker to open the
blockage are open by the field staff even during the rain . it is very difficult for worker to
open the blockage without Rain Coat & Gum Boots . The demand of the union is genuine
and therefore it is recommended that the rain coat may also be provide to the workers of
Road wing of MC on the similar lines and as per decision of the CE MC as implement in
Horticulture Division of M.C. Chandigarh .

issued working under the control of Road Wing of MC is as under :-

agencies. As per the lowest rates, the financial involved to purchase the Rain Coat & Gum
Boots for 113rd (i.e 110 nos) workers is comes to Rs.1 ,95,580/- as per detail given below :-

Subject: - To make all the paid parking as Smart Parkings.
The paid parking system was introduced by the Municipal Corporation
Chandigarh 15 years ago and since then the parkings are being allotted to the contractors
on the basis of open auction. But in this system, it has been observed that the contractors
offer the bid at higher rates to more than the actual potential. It has also been observed
that the contractors overcharge and violate the terms and conditions of the contract to
bridge the gap of the earnings. The Enforcement staff of Municipal Corporation,
Chandigarh inspects the violations and the office imposes penalty on them from time to
time, but despite that the contractors continue to indulge in the violations like overcharging
as they adopt cost cutting short ways to make profit.
To provide better facilities and to provide convenience to the public it was
proposed to give all the parkings to big operators which could manage the parking system
smartly and an agenda was placed before F&CC 12.08.2016 in this regard. The Finance
& Contract Committee in that meeting passed a resolution vide Agenda item No. 264.2,
that “the paid parking areas of the whole city be made as smart parking along with terms &
Conditions. Further it was also resolved that the tender for all of the parkings be invited
and allotted in a single lot.
Accordingly the tender notice was published in various national and regional
news papers on 19.08.2016. The pre-bid meeting was held on 29.08.2016 and on the
request of the representative of the ITI Ltd, the Public Sector Undertaking/ Govt agencies
were exempted from having experience as mentioned in eligibility criteria.
Branding/advertisement only on one side of Smart Card was also allowed.
The Last date for uploading the tender documents was 14.09.2016 upto 12.00 noon
and technical bids were scheduled to be opened on 16.09.2016 at 3.00 P.M. The
technical Committee observed that only one company had uploaded e-bid/e-tender.

Keeping in view the orders of W/CMC the committee was of the view that the single tender
cannot be accepted and recommended that the competent authority may please decide
whether the terms & conditions of the DNIT may be reviewed to attract more companies to
compete in the tender or the tender may be re-invited on the same terms & conditions.
The matter was discussed with all the companies representative who had shown
their interest earlier to participate in the bid and they intimated that due to heavy reserve
price and hard terms & conditions they could not participate in the e-bid/e-tender. They
were of the view that the reserve price and other terms & conditions should be relaxed.
This also matches our view and experiences that parkings are being taken by the
contractors on artificially high rates which they cannot economically sustain and therefore
try to cut corners and big operators who may perform their responsibility properly find the
reserve bid price economically unsustainable.
It is pertinent to mention here that in the present tender documents the office has
made responsibility of the contractor to install the following infrastructure:-
1. Sign board to display the rate list and showing the signage for scooter / car parking.
2. Adequate number of CCTV Cameras to connect the parking areas including each entry and
exit point connected to server with data feed to M.C.Chandigarh.
3. Kiosks (Booth) at the entry and exit point of the parking
4. Marking of the car / scooter lanes.
5. E-ticketing machine / computer connected to central server.
6. Cones and chains for proper parking of the scooter and cars.
7. Barricades to control the vehicles.
After detailed discussion the committee approved the proposal to relax some
conditions which are reproduced below:-
Reserve Price:- Earlier the reserve price was fixed as Rs. 3.40 Crores. Now it is
proposed to fix the reserve price as Rs. 2.00 Crores.

The successful highest bidder is required to be deposit Bank Guarantee equivalent
to 5 % of the highest bid. Moreover, the highest bidder shall deposit three months‟ license
fee in advance for every quarter of the year, therefore, the F&CC approved the following
amendment in Security & Bank Guarantee clauses:-

F& C.C. further resolved that an agenda in this regard may also be
placed before the General House for consideration and approval. The committee
has also directed to float a short term tender notice in the meantime. However, the
tender will be allotted after approval of General House (The minutes of the meeting
are awaited).
Accordingly the office has published a tender notice in the National and
Regional Newspapers inviting E-Bids/tender from the interested parties to operate and

manage the 25 Paid Parkings. The last date of uploading the Bid is 29.09.2016 upto
12.00 Noon and the technical bid will be opened on 30.09.2016 at 3.00 P.M. Tender will
be allotted only after approval of General House. A copy of the tender document is
attached at Annexure ‘A’.
The agenda is therefore placed before the House of Municipal
Corporation, Chandigarh for consideration and approval.

Eligibility Criteria
The contractor shall have to fulfill the criteria of satisfactory execution of work as given
below:

a) One similar nature of work of operation and management of Car Parking having capacity of 500 & above cars.
OR
b) Two similar nature of work of operation and management of Car Parking having capacity of 300 & above cars.
OR
c) Three similar nature of work of operation and management of Car Parking having capacity of 200 & above cars.
The PSUs / Government Agencies are exempted from having experience as
mentioned in eligibility criteria.
*Preference will be given to the agencies, who have experience of running the
smart parkings.
Earnest Money Deposit:- An amount of Rs. 10.00 Lac in the shape of Demand
Draft of any scheduled bank is required to be deposited with the cashier of Parking
Branch, Municipal Corporation, Chandigarh.
CONDITIONS:-
1. The Earnest Money shall be in the shape of Demand Draft of any scheduled bank
payable at Chandigarh in favour of the Commissioner, Municipal Corporation,
Chandigarh. The participant will deposit the original Demand Draft of Earnest Money
with the Cashier of Parking Branch before opening of technical bid.
2. Scanned copy of EMD, Affidavit, Undertaking, turnover certificate of work experience
and other documents as specified in the press notice shall be uploaded to the e-
tendering website within the period of bid submission. However, certified copy of all the
scanned and uploaded documents (other than EMD) as specified in press notice shall
have to be submitted by the highest bidder only within a week physically in the office of
tender opening authority. Online bid documents submitted by intending bidders shall be
opened only of those bidders, who have deposited original Demand Draft of Earnest
Money with the cashier of MCC and whose other documents scanned and uploaded are
found in order.
The agency has to produce the original document as and when asked for by E.E. R-I.
The failure of agency to furnish the said original document will entail summarily rejection
of its tender/bid.
3. The bid submitted shall become invalid if :-i) The bidder does not upload the entire document as stipulated in the bid document.
ii) The hard copy of Earnest Money (in original) of Rs. 10.00 lacs is not submitted in
the office of SDE (Parking), MCC up to 29.09.2016 at 12.00 Noon as per prescribed
format given at Annexure „D‟.

iii) Any discrepancy is noticed between the documents as uploaded at the time of
submission of bid and hard copies as submitted physically by the highest bidder in
the office of tender opening authority.
4. Similar Work means: - Operation and Management of Car Parking.
5. The tender documents shall be uploaded in 2 covers:-
Cover (i) i) Shall contain scanned copy of deposit of Earnest Money as per Technical Bid.
DNIT.
ii) Certificates of work Experience.
iii) The bidder should furnish the Affidavit/Undertaking that I/we hereby declare that I/we have not been black-listed, debarred/suspended by any Govt./Semi/ Corporation/Pvt. Organization during the last seven years (Annexure-E)
iv) Average Turnover for the Last Three Years Ending 31 March 2015 should be Rs. 2.00 crore and duly audited by the Registered Chartered Accountant.
v) Operational Experience of Car Parking system.
vi) Methodology / working of the parking system. vii) Tentative technical details of the proposed services.
viii) Brief technical details of the equipments proposed to be used in the parking system.
ix) Standby arrangement and training module required for Smart/Computerized parking system
x) Solvency certificate of the bank for Rs. 2.00 Crore. xi) Requirement of labour license. xii) EPF, ESI/EDLI certificate to be attached.
Cover (ii) Financial Bid
Shall contain Financial Bid on the prescribed form i.e. Bid Sheet (Annexure F)
6. Visit of Site Interesting company/firm/individual etc can inspect the parking sites to
see the feasibility and potential. The interested parties/agency may visit
the parking sites and assess the potential of the parkings.
7. The interested parties should quote the BID in lump sum for a period of 3 years, however
the license fee will liable to be paid in quarterly installments in advance before 7th day of
the due month.
8. The Cover-1 shall be opened on 30.09.2016 at 3.00 P.M.
9. The Cover-2 shall only be opened of those Individual/Contractors/firm/agency
/Companies /Joint ventures/Consortium who Fulfill the Eligibility Criteria of the Tender
Notice/ Bid Notice on 31.03.2016

11. The Bidders shall have to submit their Bids online in Electronic Format with digital
signatures. For participation in e-tendering process, the Bidder needs to register
themselves on http://etenders.chd.nic.in/nicgep.
12. Instruction to Bidders regarding e-tendering process : –
i. Bids/offers without digital signatures will not be accepted by The Electronic
Tendering System. No bid/offer will be accepted in physical form and in case it
has been submitted in the physical form it shall be rejected summarily.
ii. Before submission of online Bids, Bidder must ensure that scanned copies of all
the necessary documents have been uploaded with the Bid.
iii. It will be mandatory for all the bidders to upload all the documents mentioned in
Annexure „G‟.
iv. The Department will not be responsible for any delay in online submission of the
Bids due to any reason whatsoever.
v. Bidder should get ready with the scanned copies of the EMD as specified in the
tender document. The original EMD and Hard copies of all the Eligibility
Documents as uploaded by the Bidder should be submitted only to the
designated Authority and within the stipulated time period.
vi. The details of EMD specified in the bid/offer documents should be the same as
submitted online (scanned copies) otherwise tender will be rejected summarily.
13. Average Annual financial turnover during the last 3 years, ending 31st March 2015
should be Rs. 2.00 crore duly audited by the Chartered Accountant.
14. Corrigendum/Addendum to this tender, if any, will be uploaded on the website mentioned
above. This may be noted by the contractor/bidder.
15. All disputes concerning in any way with these tenders are subject to Chandigarh
jurisdiction only.
16. The payment of Electricity Charges will be paid by the concerned companies/agency at
their own level to the electricity department, U.T., Chandigarh. Apart from this, Service
tax, Water Charges or others cess if, any, levied by Government of India/Chandigarh
Administration shall be borne by the contractor.
17. Telegraphic/conditional bids and bids/offers without Earnest Money shall not be
considered.
18. The validity of tenders shall be 90 days.
19. The undersigned reserves the right to reject any/all tenders/bid without assigning any
reason.

20. In case, the date of receipt/ opening of bid/offer is declared or happens to be a public
holiday, the tenders will be received/ opened on the next working day at the stipulated
time.
21. In case of failure in performance or default of responsibilities or breach of terms and
conditions of Agreement, action as per ‘policy on blacklisting 2009’ issued vide
Finance Department Chandigarh Administration Notification No .1927-F&PO (3) - 2009/
1170 Dt.27.2.2009 will be taken.
22. The Agency has to produce the original documents as and when, if asked for by E.E. R-
I. The failure of the Agency to furnish the said original documents will entail summarily
rejection of its tender.
23. Before submission of on-line Bids, Bidders must ensure that scanned copies of all the
necessary documents have been uploaded with the Bids as per Annexure G. Annexure
G is a guide and does not require to be uploaded.
24. The financial bid of only those bidders will be opened who has uploaded the scanned
copy of all the documents mentioned in Annexure ‘G’ and the parties who have
deposited original DD of EMD with the cashier of Parking Branch, MC, Chandigarh.

TERMS AND CONDITIONS OF 25 NOS. OF PAID PARKING AREAS (SINGLE LOT)
1. Period of license: - The period of license will be initially for three years, extendable upto
Five years on performance basis. In case of extension of the license, the licensor shall be at
liberty to modify the terms and conditions of the license by giving due notice to the
licensee in order to ensure smooth functioning of Paid Parkings provided the same are in
public interest and such modifications do not have any adverse financial implication on the
licensee.
In case the licensee desires to get the license extended beyond three years, he shall
have to submit his consent three months prior to the date of completion of three years of
license. The licensee shall also get extended the Bank Guarantee for one year in addition to
already submitted Bank Guarantee.
2. The successful/highest bidder shall deposit advance license fee for three months with in
seven days of issue of letter of intent. In case successful bidder fails to deposit the same,
the earnest money of the successful bidder shall be forfeited and he/she/they shall not be
allowed to participate in the E-Bidding/tendering/auction of Paid Parking Areas of
Municipal Corporation, Chandigarh for next two years.
3. Bank Guarantee :- The Successful Bidder Shall deposit a Bank Guarantee (BG) of amount
equivalent to 5% of the bid amount in favour of Commissioner, Municipal Corporation,
Chandigarh (MCC) within 7 days of issue of letter of intent. The bank guarantee should be
valid for a period of 66 months to cover the period of 05 years of license and another 6
months for finalization/closing of accounts.
In case successful bidder fails to complete the requisite formalities within the
stipulated period as per letter of intent, the licensor shall be at liberty to forfeit the amount
already deposited by him (including EMD) with the Municipal Corporation, Chandigarh
besides withdrawing the Letter of Intent.
4. Payment of license fee: The licensee shall deposit license fee in the shape of bank
draft drawn in favour of the Commissioner, Municipal Corporation, Chandigarh on
quarterly installment basis in the first week of every three months.

installment of License Fee shall commence from the date of taking over the
possession of each parking area from Concerned Sub Inspector (Enforcement).
5. Increase in license fee: In case of any revision in parking fee during the period of
license, the license fee shall be calculated proportionate to the percentile increase / decrease
in parking fee.
6. Late payment of installment/license fee:- In case of late payment of license fee, the
licensee shall be liable to pay interest at rate of 12% per annum from the first day of the
month on which the payment falls due and up to the date of actual payment but not later
than 30 days in any case.
In case the payment is not made within 30 days of the due date, the Additional
Commissioner/Joint Commissioner shall reserve the rights to cancel the license and forfeit
dues equivalent to the outstanding dues along with interest from the security deposit and
other incidental damages.
7. Infrastructure:- The successful bidder shall arrange the following infrastructure required
to operate and manage the paid parkings:-
I Sign board to display the rate list and showing the signage for scooter / car parking.
II Adequate number of CCTV Cameras to connect the parking areas including each
entry and exit point connected to server with data feed to M.C.Chandigarh.
III Kiosks (Booth) at the entry and exit point of the parking
IV Marking of the car / scooter lanes.
V E-ticketing machine / computer connected to central server.
VI Cones and chains for proper parking of the scooter and cars.
VII Barricades to control the vehicles.
VIII The agency /contractor / company will arrange the electricity connection at his/its
own level and make the payment of the bill thereof.
8. Responsibility of the Municipal Corporation, Chandigarh:_
I Major and Minor repairing of roads and road gullies in parking area.
II Repairing of parking lights.

9. Agreement:- The licensee shall execute an Memorandum of Understanding/License Deed
on stamp papers within 7 days of issue of letter of intent. All costs in this regard shall be
borne by the licensee. The original copy of license deed shall be deposited with licensor.
10. Manpower:- The license shall deploy sufficient manpower in each paid parking to
avoid inconvenience to the general public. Accordingly, minimum two persons each should
be deployed at entry and exit gate and one person at distance of each 50mtrs inside the
parking area to facilitate the public to park their vehicle in proper manner. In case of non
deployment of person at each 50 meters, a penalty of Rs.1000/- will be imposed on each
occasion.
11. Usage of premises:- The licensed premises/sites shall be used only for allowing parking of
vehicles for which the license is granted.
(i) The licensee shall have to hand over vacant possession of the site/premises to
the concerned SDO (Road) Or authorized person of MCC after
completion/termination of the Contract Period.
(ii) The licensee shall not transfer/sublet the license to a third party directly or
indirectly.
(iii) The licensee shall install suitable size of boards at entry point indicating
therein that user is entirely responsible for getting the token issued at the
entry point. In case he does not produce the token or loses it, he will be liable
to pay penalty of Rs. 20/- in case of a four-wheeler and Rs. 10/- in case of a
two-wheeler on production of Id/RC/DL to the satisfaction of the licensee.
(iv) The Additional Commissioner/Joint Commissioner, MCC or any authorized
official may enter upon the premises at any reasonable time and in any
reasonable manner to inspect the premises for ascertaining that the licensee
is duly observing terms and conditions of allotment.
(v) All the parking attendants/supervisor will wear the name plates. They should
have minimum qualification of middle pass and should not have age less
than 18 years. In case of default, a penalty of Rs.1000/- shall be imposed in

respect of parking area, in which the violation will be found, on each
occasion.
(vi) The Licensee will supply the list of staff employed by him for the each paid
parking area every month. In case of default the licensee shall be liable to
pay penalty of Rs.2000/- per month.
12. Issue of Parking Slips : - The parking slips shall be issued at the entry point by the
licensee. The parking slips and fee will be collected at the exit point. Parking slips shall
only be issued by computerized device like E-Ticketing Machine etc. The Licensee shall
always keep extra devices to ensure zero breakdown time. In case of default, a penalty of
Rs.1000/- shall be imposed in respect of each parking area, in which the violation will be
found, on each occasion.
13. Smart Parking Solution:- The contractor has to deploy smart parking solution in the
parking area to ensure the followings:-
a. All ticketing by electronic machine with real time data coming to central server which
can be check by MCC at their computer or mobile. In no case manual ticketing shall be
allowed.
b. CCTV coverage of parking area with 100% recording at central server and feed to
officials authorized by MCC.
c. Mobile applications for at least IOS, Window, Android platform where public can get
requisite information about parking and authorized MCC officials can get real time
access to data , KPIs and other information about parking management.
d. Boom barriers are preferred if not mandatory.
e. System for using Smart card based passes and Smart card based payment system with
card issuance and recharging facility at each parking.
f. Smart Card to be used as free parking passes are to be provided by the contractor
without any cost to the Municipal Corporation as per requirement. Smart card based
paid monthly passes should be issued by the contractor without charging any thing for
the card. However, the contractor may charge Rs.100/- as security for the smart passes
from the applicant.
g. Branding/ advertisement only on one side of Smart Card is allowed.

The Licensee is liable to deposit the amount of penalty imposed upon him, if any, with this
office within a period of 10 days from the date of issue of orders of such penalty. In case the
Licensee does not deposit the amount of penalty imposed upon him, with this office, within
a period of 10 days from the date of issue of orders of penalty, the Licensee shall also be
liable to pay 5% more on compounding basis of the amount of penalty after the lapse of
every 10 days.
19. Taxes: - The licensee shall be liable to pay all taxes as applicable including service
tax and as imposed by any competent authority, from time to time, during the currency of
the license period.
20. Damage to property: The licensee shall be responsible for protecting the property
of the MCC during the license period and he shall be liable to pay in case of damage, if any.
The damage will be assessed by Addl./Joint Commissioner in consultation with the
Engineering Department of MCC. The recovery of the same will be charged on penal rate as
per schedule of Engineering Wing.

21. Theft of vehicles:- The licensee shall be responsible for damage and theft(s) of
vehicle(s) from parking areas, but, the licensee shall not be liable for theft of any article (s)
kept in the vehicle. The Licensee and the licensor shall not be held responsible for any
theft/damage to the vehicle before and after parking hours, even though the parking token
was issued.
22. Uniform:- All employees of the licensee shall wear proper uniform during duty hours as
mentioned below. They will all wear name plate on the shirts:-
(a) Shirt Light Brown(T-Shirts for summer)
(b) Pant Dark Brown
(c) Belt Brown
(d) Shoes Black
(e) Full sleeve sweater Brown
and Jacket (for Winters)
(f) Turbans for Sikh Khakhi.
OR
Uniform of the workers of the company / agency approved from the MCC.
23. Sign Boards:-Appropriate sign boards shall be provided by the licensee at the site duly
indicating the name of the licensee his/her telephone number (s) and rates of parking fees in
three languages i.e. English, Punjabi and Hindi.
24. Temporary closure of parking area:- The Additional/Joint Commissioner may close
the parking area in case the parking area is required to be closed temporarily due to any
unforeseen reason(s) or administrative reason(s). The MCC shall duly compensate for the
closed period on pro-rata basis.
25. Timings of parking: - The timing of the parking shall be from 8.00 A.M. to 12.00
(Midnight) except for Paid Parking Areas in front of Dr.Sahib Singh and Empire Store,
Sector 17, Chandigarh for which the timings shall be 11.30 AM to 12.00 (Midnight)). The

agency/licensee will ensure that parking attendants are available for watch and ward of
vehicles. In case of default penalty Rs.1000/- shall be imposed on each occasion.
26. Applicability of Capital of Pb. Act 1952: All terms and conditions shall be governed by
the provisions of Capital of Punjab (Development and Regulation) Act, 1952 and Rules
framed there under from time to time.
27. That No addition/alteration in the name of the licensee shall be allowed after allotment.
Notwithstanding the specification of share, liability of all partners of licensee(s) shall
continue to be joint and several.
28. Address of licensee: - The licensee shall declare his postal and permanent address
and same shall be got verified from the concerned District Magistrate. The licensee shall
submit residential proof e.g. copy of ration card/electricity bill, voter identity card etc. In
case of any change of residential address the licensee shall duly intimate the same to the
Addl./ Joint Commissioner, MCC.
29. Separate Parking for Handicap Person & Women:- A separate space shall be
earmarked for parking of vehicles of handicapped persons and women.
30. The licensee is not permitted to park other vehicles in areas which are specifically
earmarked for different categories of vehicles.
If any vehicle is found parked in an area other than the earmarked parking area or
the vehicles are parked in haphazard manner the licensee shall be liable to pay fine
equivalent to 10 times of parking fee per vehicle.
31. Employees of licensee: - All persons employed by the licensee in parking area shall be the
employees of licensee for all intents and purposes and such employees shall have no
relationship, what so ever, with the MCC. The licensee will pay minimum wages to his
employees at rats as fixed by the Labour Commissioner, Chandigarh Administration, from
time to time. The licensee shall not engage persons of age less than 18 years. The licensee
shall comply with all provisions contained in the Labour/EPF/ESI Acts and rules framed
there under payment of wage Act 1936, the Minimum wage Act 1948, the contract labour

(Regulation & Abolition) Act, 1970 and provisions of the Employees Provident and
Miscellaneous Provision Act, 1952 as amended from time to time.
32. Cancellation of license:- The license shall be liable to be cancelled by the
Additional/Joint Commissioner in case of occurrence of any of the following event(s) and in
the manner as mentioned against each:-
a) Non verification of antecedents of licensee:- In case of non/adverse verification of
antecedents of the licensee by the District Magistrate of place of residence of
licensee within 45 days of issue of letter by the Additional/Joint Commissioner, the
licensor shall be at liberty to cancel the license and forfeit security deposit of an
amount equivalent to 3 months license fee by giving one month notice.
b) In case it is found at any stage during the currency of license period that the
licensee or any of his partners/associates is/was a defaulter of MCC or
debarred/blacklisted by MCC, without giving any notice.
C) The licensee shall ensure that there is no mis-management, mis-conduct,
misbehavior or any obnoxious act on his part or by employees appointed by him. In
case of any report/complaint, the decision of the Additional Commissioner/Joint
Commissioner, MCC for imposing any penalty or such other action including
Cancellation as may be considered proper in the interest of public services shall be
final and acceptable to the licensee. However, the Addl./Joint Commissioner will
give an opportunity of hearing to the licensee and his employees before taking any
decision. In case of cancellation, three months notice is required to be served to the
contractor.
33. Termination of license: -The license shall stand terminated automatically on completion of
license period.
The licensee can request for premature termination of license after completion of
one year of the contract by giving three months notice or by depositing money equivalent
to three months licensee fee. However, it is made clear that Bidder/Licensee shall not be
allowed to give such notice before expiry of one year from the date of taking over the
possession.
In case the Licensee surrenders the paid parking lot prior to one year, the Licensor
shall recover the amount equal to the remaining period for completion of one year‟s

License fee plus Licensee fee equal to 3 months notice period, from the Security/Bank
Guarantee of the Licensee, lying with the Licensor.
In addition to above, it is also made clear that such a licensee who surrenders the
paid parking prematurely i.e. before completion of license period as per initial allotment or
subsequent extension, he/she shall not be permitted to participate in any subsequent E-
Bidding/tendering of parking lot for a period of three years from the date of handing over
the possession back to the Licensor.
If the licensor wants to terminate the license deed before the expiry date then the
licensor will give at least three months notice or pay money equal to three months license
fee. In an event of making payment as above, the Licensor will be entitled to take over
possession within 24 hours thereafter.
34. Arbitration: - All disputes and differences arising out or in any way touching upon
this license deed, whatsoever, shall be referred to the sole arbitration of the Commissioner,
Municipal Corporation, Chandigarh or any officer deputed by him to act as arbitrator. The
decision of the arbitrator shall be final and binding on both the parties. The provisions of
Arbitration and Consolation Act, 1996, and Rules framed there under and any statutory
modification/amendments thereof for the time being in force shall apply for such
arbitration.
It shall be an essential term of this contract that in order to avoid frivolous claims
the party invoking arbitrator shall specify the disputes based on facts and calculations
stating the amount claimed under each claim and shall furnish a “deposit-at-call” for ten per
cent of the amount claimed, in a scheduled bank in the name of Arbitrator, by his official
designation who shall keep the amount in deposit till the announcement of the award. In
the event of an award in favour of the claimant, the deposit shall be refunded to him in
proportion to the amount awarded with respect to the amount claimed and the balance if
any shall be forfeited and paid to the other party.
35. Jurisdiction of courts: - All disputes shall be subject to the jurisdiction of courts in
Chandigarh only

Note:- The Municipal Corporation, Chandigarh reserves the right to issue any subsequent
instructions for compliance depending upon the requirement of circumstances in public interest,
which shall be binding for all the Licensees of PPAs.

Back Ground: The General House of M.C. in its 192nd meeting held
on 30.04.2013 had approved the hir:ing of National · Meat and Poultry Processing Board as consultant. However the Board conveyed that it does not have the capacity to implement a project during construction phase but restricted to provide the consultancy services for the preparation of DPR only. It is pertinent to mention that 50% grant in aid for cost of plant & machinery and technical civil work can be availed in general areas up to a maximum of Rs 15 crores for each project under the centrally sponsored Scheme or National Mission on Food Processing for the rest of the 1 ih Five year plan.
The fresh sealed bids were invited by this office vide Memo.No.4086-88 dated 25.04.2016 after approval of Worthy Commissioner, Municipal Corporation Chandigarh, from the list of technical consultants (Flag-X) appointed by Ministry of Food Processing Industries, Government of India. Scope of Consultancy is as under:
i) Preparation of preliminary project report for approval of competent Committee/House.
ii) Preparation of report regarding different options for Machinery and Equ!pment required for this Plant.
iii) Preparation of Architectural Drawings, Structural Designs, Air Conditioning, E.I. Services, P.H. Services Rendering Plant, ETP and other allied services required for running, operation and maintenance of Automatic Poultry Processing Plant.
iv) Preparation of Tender documents such as DNIT's and scrutinizing, preparation of comparative statements of tender, justification of rates, etc. for approval from competent authority.
v) Agency to make all efforts for participation by quality firms in the tendering process.
vi) After hiring of successful tenderer, the Agency will provide supervision during execution of complete work.
vii) To arrange approval of all drawings and to arrange mandatory approval' from different authorities required before and after commissioning of the Automatic Poultry Processing Plant.
Out of thre~ firms, two firms submitted their financial bids since these firms already stand technically qualified by the said Ministry. The Committee constituted for opening the sealed bids after detailed deliberations and examining all aspects proposed that financial bids of both the firms have been considered and as per the comparative statement (Flag-X-1) M/s MITCON Consultancy and Engineering Services Ltd Pune has quoted the lower rate

NM PPB bas reviewed the scope of its consultancy services and at present NMPPB dnes
not have the capacity lo implement a project during constructi0n phase bul restricted to pr0vide the ccnsuitancy services for the 1Jreparalion ofDPR only.
You are therefore requested to convey the deci sion on the above said matter. NMPPI:

Subject : Installation of Biogas Generator at NISARGR JNA Biogas Plant of 5 MTPD Industrial Area Phase-1 , Chandigar .
The MOU was signed by Municipal Corpor2tion Chandigarh with
Bhabha Atomic Research Centre Mumbai on 2ylh November 2014 to install a
NISARGRUNA Biogas Plant of 5 MTPD (metric ton pe day) capacity at tile
factory Industrial Area Phase-1 , Chandigarh.
An agenda was placed before the Gener I House in its 216th
meeting held on 19.02.2015 regarding financial terms & c 1nditions. The General
House approved the payment of Rs.87 Lacs and % (Rs.4,35,000/-) of
consultancy charges for :onstruction of plant, mac~ ·1eries, sub systems,
installation, 0 & M for the first year. As per approval of G 'leral 1-.ouse the same
was released to the BARC.
The BARC has now intimated that e work allotted to
M/s Aviplast for the construction of plant and its c, eration for first year
amounting to Rs. 75 Lacs and Rs.12 Lacs was saved and lying with BARC
unspent. As per technology, the produced biogas has tc e used for generation
of electricity. In the MOU, the item Biogas Generator ✓as not included. The
construction of plant is completed but not yet functional c 1e to non-installation of
bio gas generator. The agency has now informed hat the total cost of
installation of bio gas generator at site is about Rs.18 Lac .
Keeping in view of above it is recommer ed that an amount of
Rs.6 Lacs may be released to the BARC for installatic 1 of biogas generator.
Thereby, the total construction amount will be enr need Rs.87 Lacs to
Rs.93 Lacs.
The agenda is placed before the General -jouse for approval to
deposit Rs.6 Lacs to BARC for getting installation of Biogas Generator and
