Also covered will be caselaw, commission cases and current law application tounemployment insurance hearings.

Enforcement and RecordkeepingThis session will familiarize employers with the typicalwage/hour investigation conducted by state andfederal investigators. We will cover the records youmay need to make available, the authority of theenforcement agencies to review records andconduct interviews, and the hearing and appealprocesses used by the agencies. We will alsodiscuss the potential court and lawsuit processes towhich employers may be subjected.

Independent Contractors or Employees? Enforcement agencies have been very active in eval-uating the use of independent contractors. Thissession will address the legal differences betweenthese different relationships, and provide tips onavoiding liability for making the wrong designation.

Overtime This session will familiarize employers with overtimerequirements, and which employees are properlyexempt from overtime. We will also cover properovertime calculations, and typical practices whichmay deprive an employer of the exemptions.

“Off the Clock”This session will address what constitutes “work” forwhich wages must be paid. We will cover the issuesof internships and volunteers, as well as many othercircumstances where in which employers may – ormay not – be required to pay employees.
