Four school board members were re-cently appointed by MSBA Presi-

dent Marian Barksdale to serve during her one-year term.

DeSoto County board members take oath of officeTwo new members of the DeSoto County School Board of Trustees and one

returning member took the oath of office, administered by newly elected Circuit Court Judge Gerald Chatham, earlier this month. Theron Long and Milton Nichols were the new faces, and Stephen Dodd was re-elected to serve his seventeenth year on the board. Long was elected to the Hernando area’s District 5 seat to fill a vacancy left by a board member whose husband was transferred to Maine. Long was a principal and coach in DeSoto County Schools for 44 years. The other newcomer to the school board, Milton Nichols, is a former mayor of Olive Branch. The retiree says that among his many new board responsibilities, he looks forward to becoming proficient on the computer, since all the actions of the board are paperless.

Has there been a change in the employee tax rate for social security for 2011?Yes, the rate has been reduced for the employee from 6.2% to 4.2%.  The employer rate has not changed.  Employers should implement the 4.2% employee social security tax rate as soon as possible. For more information please see IRS Notice 1036. DJC, DJCB Does our cafeteria plan provider have to be approved by the State Auditor?Yes.  Section 25-17-9 provides that only cafeteria plan providers who are on the State Auditor’s list of approved providers shall, directly or indirectly, provide caf-eteria plan services to a state agency or local government entity.  The most current list of approved providers is on the State Auditor’s website.  Note that each provider must renew their application annually or they will be removed from the approved list. DJCB  Does Section 31-3-21 require a nonresident bidder’s local preference law to be submitted at the time the bid is submitted?Yes. Section 31-3-21 requires a copy of a nonresident bidder’s current state law, pertaining to its treatment of nonresident contractors, be submitted at the time the bid is submitted. (Attorney General’s Opinion to Sherard dated October 7, 2010) DFA May a member of a school district board of trustees whose term expires Janu-ary 2011 and who is not seeking re-election continue to serve after the expira-tion of his term if no candidate will be on the November ballot seeking the office?The board member in question is only entitled to remain in office until the expira-tion of his current term. REMINDER RE: Earning Required Board Credit

MSBA Board policy now requires school board members to earn state-mandated credit in the state. The decision made by the MSBA Board of Directors in the 2008-09 school year was that “Effective with the 2010-2011 school year, school board members will no longer be allowed to obtain their 6-hour, state mandated school board member training credit by attending the NSBA Annual Conference or the NSBA Southern Region Conference.” Attendance at these NSBA

meetings still count toward the MSBA School Board Honors Program.

Gov. Barbour proclaims February 13-19 as School Board Member Recognition Week in MS

At MSBA’s request, Governor Haley Barbour has proclaimed February 13-19 as School Board Member Recognition Week in Mississippi, calling upon all citizens to join in recognizing school board members for their dedication to the education of the state’s children.

Earlier this month, MSBA posted School Board Member Recognition Week (SBMRW) ideas, art and samples of an editorial, local proclamation, and other recognition week activities on its website. A letter-size copy of Governor Barbour’s proclamation and enough appreciation certificates for every school board member in each district were mailed to districts by MSBA. The certificates signed by MSBA Executive Director Michael W. Waldrop, Ph.D., had space for the signature of the district superintendent.

The position involves traveling to eve-ning school board meetings throughout the state.

ESSENTIAL JOB FUNCTIONS: The person hired for the position will main-tain close communications and working relationship with the Executive Director; make recommendations concerning board training and conference needs; act on behalf of the Executive Director in his or her absence, consistent with MSBA policy and guidelines; and be creative in stimulating increased revenue streams for the association.

Healthy School Board Award Application due Feb. 10

The Mississippi Department of Education’s Office of Healthy Schools is taking applications for the 2011 Mississippi Healthy School Board Award. This distinguished honor is given to a Mississippi public school district that has made notable achievements in the implementation of school health programs. School districts have until February 10 to apply for recognition in the awards program, which carries a prize of $5,000 for the school district selected.

The award will be presented February 23 during MSBA’s 39th Annual Conference in Jackson.
