Snow Gala—Come out and celebrate thewinter season at this year’s SnowGala on November 8, 2003 at theFour Points by Sheraton in SantaMonica. The venue is beautifulwith a view of the city lights ofSanta Monica. The food isdelicious with a choice ofchicken, salmon or vegetarian

pasta.

No host bar opens at 6 PM and dinner isserved at 7 PM. Manand Woman of theYear coronationfollows. The eveningends with dancing toa great band,L’amour, personallypicked out by IrisWilliams, LAC VPMembership, whosemusical expertise

will make sure your feet will betapping as your body isswaying with the rhythm ofthe beat.

There will also be fabulousdoor and raffle prizes andpossibly a silent auction offur accessories. Raffle ticketsare only $1 each or a bookof 11 for $10. Remember,50 percent of the proceeds goto your club. Dinner tickets are$45 until November 3rd, thenthey will be a whopping $65.

Man & Woman of Year—Judith Miller is chairing theMan and Woman of the Yearcontest. Every club should have

a candidate because thecompetition is all about clubparticipation of individuals overthe past two years.

Shop Til You Drop—Another great event to put onyour calendar is a day ofshopping and riding theVirtual Snow ski ramp at

H&H Jobbers in RedondoBeach. This is a new event

that we are co-hosting withOrange Council.

There will be food, music, prizes,dancing, deep discounts, and agreat way to try on new winterclothes for men, women andchildren. The clothes are atdiscounted prices. So come outand shop ‘til you drop on Sunday,October 5, 2003, noon to 5PM.

Race/Ski/Board Camp—You’ll be able to wear your newclothes at Rokka’sSki/Snowboard/Race Camp atMammoth December 8–12,2003 and LAC’s Ski/Snow-board/Race camp December15–19, 2003. Moreinformation and prices will beforthcoming. It’s the best wayto learn to ski/snowboard orimprove upon your form andracing technique.

2005 FWSA Convention—At the Far West board meetingthis past July in Reno, Nevada,Catherine Ohl, LAC VPCommunications, made apersonal appearance to presentthe LAC proposal to have the2005 FWSA Convention (theimportant 75th anniversary ofFar West) to be held in LongBeach, California.

When you see her give her a bigthank you because she made anincredible presentation. Shechanged the minds of manyboard members. WithoutCatherine’s diligence and hardwork we wouldn’t be able tosay: Los Angeles Council willbe hosting the Far WestConvention in 2005 at theWestin in Long Beach at thebeach. Congratulations!!

Mark your calendars. The date isJune 9–12, 2005. Because of theanniversary celebration, thisconvention will be like no other.

California Seller of Travel—At the LAC President’s meetingin July we discussed the need todo business with a touroperator who has a CaliforniaSeller of Travel number (CST).

The first sentence of the statue(California Business &Professions Code Section17550-17550.59) states: “Sellerof travel” means a person whosells, provides, furnishes,contracts for, arranges, oradvertises that he or she can ormay arrange, or has arranged,wholesale or retail air or seatransportation either separatelyor in conjunction with othertravel services.

Note that this only applies toair and sea transportation anddoes not apply to Mammothbus trips. If your club goesdirectly and arranges your owntrip with air transportation, youneed to have a CST!

If you go through a tour operator,you are still promoting andadvertising the trip. Make sureyour tour operator has a validCST. This CST number should

be on all your promotionalmaterial. You will see the CST onthe flyers for the Whistler andSalt Lake trips.

Even this may not alwaysprotect your club. If all moniesare paid directly from theparticipant to the tour operator,then you are okay. However, ifyou want to keep track of themoney and send just one checkto the tour operator, ask yourtour operator to provide youwith a Letter of Agency statingthat your club is acting as theiragent in collecting the moneysfor this trip and you are notbeing paid to do so.

Salt Lake City— February 19–23, 2004Salt Lake City is getting someinterest. Please download theflyer from our website andadvertise it to your club. We’llleave on Thursday evening andreturn home Monday eveningwith a full 4 days of skiing.

Ski Fitness Skiing is a demanding sport. Itsubjects your body to repeatedstresses and involves strenuousexertion at high altitude.

The fitter you are, the better andlonger you will be able to ski eachday, and the lower your risk ofinjury will be. Any fitness programshould include the following.

Anaerobic Fitness— Skiing calls for anaerobic fitness, thestrength and ability to sustain shortbursts of exertion. Skiing bumps,short radius turns and schussing allrequire power, as well as stamina.

Aerobic Fitness— Perhaps most importantly, you needto be aerobically fit in order toexercise in the thin mountain air.There's only one way to achieve

this, and that's though some sort ofprogram of exercise which raisesyour heart rate and keeps it thereover a period of at least 15 minutes.

Coordination, Balance andFlexibility—Finally, your ski fitness programshould improve your co-ordination,balance and flexibility, allowingyou a more dynamic range ofmovement. �

Our favorite opponent is ateam that is based inthe South Bay, and hasaffiliation to StanfordUniversity. But, theylove to drink, surprise… BEER, and love tohave fun playingsoftball. Such a greatbunch of people.

Park, Alberta, Canada is undernew ownership.

Vail Decentralizes Marketing—Vail Resorts announced arestructuring of its marketingorganization today, whicheliminates the top levelpositions of senior vicepresident of marketing and vicepresident of sales anddistribution. United Park City Mines Sells Land—On July 18, United Park CityMines Company completed itsmerger with Capital GrowthPartners LLC. The significanceof the deal to the mountainresort industry lies in the factthat United Park City Minesowned land that both DeerValley and Park City lease aspart of their ski resorts.

United Park City Mines has beenactively seeking a buyer becausethey lacked the necessary fundsfor real estate development on theold mining land. Capital GrowthPartners specializes in real estatedevelopment, but sees no changesfor the two Utah resorts.

Congratulations to Lance Armstrong onhis five-peat of the Tour de France and toTyler Hamilton on his amazing 4th placefinish in spite of the broken collarbone hesustained in a Stage 1 pile-up. As Iwatched the drama unfold daily, I thoughtit might be a good idea to reiterate theBicycle Rules of the Road.

Failure to obey the Rules of the Road isthe major contributing factor in acci-dents for which cyclists are at fault.

Definition of a Bicycle—There is a technical definition of a bicycle.Adult tricycles are considered to be bicy-cles under the vehicle code, but child tricy-cles, in which the pedals directly drive thewheels, do not qualify.

Cycling-Specific Rules—The following summary is not meant toprovide legal advise but to alert you tothe rules for your safety.

• Cyclists obey the same rules as motorvehicles, and have the same rights.

• Bicyclists have to ride in the samedirection as vehicular traffic, both onand off the roadway (e.g., when on ashoulder), but this requirement doesnot apply on sidewalks.

• Sidewalk riding is subject to local laws.

• Lights/reflectors must be used at night.

Traffic Laws—

The rules are nearly identical for cyclistsand motorists, with each having equalrights to use public roads. Please notethat bicycles are allowed on every road inCalifornia except certain freeways andtoll bridges. There is no legal require-ment for cyclists to use a sidewalk or off-road bicycle path.

Cyclists Responsibilities—Since cyclists have the same rights andresponsibilities as drivers, the use of alco-holic beverages is treated similarly (i.e.,you should not assume that you can usea bicycle to avoid a DUI conviction.)

Right Side Rule—

The "stay to the right" law is often mis-understood. It applies only on the road-way (not the shoulder or areas normallyused for parking) and when riding at lessthat the normal speed of traffic on theroadway.

The roadway is that portion of the roadused for vehicular travel, so there is norequirement to ride on the shoulder ofan area marked for parking when no carsare there. There are numerous exceptionsas listed below under “exceptions.”

In addition, on multi-lane one-wayroads, you may use either edge of theroadway.

Bike Lanes—The requirement to use a bike lane issimilarly misunderstood and, like theright-side-of-the-roadway rule, appliesonly when riding at less than the normalspeed of traffic. There are also the samenumerous exceptions (see below).

Furthermore, the rule applies only tothose bike lanes established according tostate standards. Not all bike lanes meetthat test. Unfortunately, the legality ofthe bike lane depends on when the bikelane was installed, which is not visuallyobvious.

Exceptions—

The "stay to the right" and bike lane ruleshave numerous exceptions, includingpreparing for a left turn, avoiding debris orother hazards, passing slower bicyclists orvehicles, conditions that make it unsafe fora vehicle and bicycle to pass side by side,and approaching a place where a right turnis permitted. The latter exception includesdriveways, not just intersections.

Use of the Shoulder—

Bicycles can, at the rider's discretion, usea shoulder, but must go in the samedirection as vehicles when on a roadwayor shoulder.

Hand Signals—Like other vehicles, bicyclist must signalbefore turning if other vehicles are affect-ed. The official hand signals are extendedfor bicycles to allow a cyclist to signal aright turn by pointing right with the righthand. Unfortunately, sometimes you haveto keep your hands on the brakes or han-dlebars (especially when crossing reflectordots), and the law does not consider thisneed explicitly. —

Lights at Night—Cyclists are required to use afront light at night, togetherwith rear, side, and pedal reflec-tors. A rear light is highly rec-ommended.

Miscellaneous—A cyclist and any passengermust ride astride a seat, andpackages may not be carriedif the hands are preventedfrom reaching the handle-bars. Brakes have to be func-tional.

Rules for Drivers—Drivers have two obligations aroundbicycle lanes:

• to stay out of them when not turningacross them

• to merge into the bike lane within 200feet of the turn before turning across one.

There is also a specific requirement fordrivers to pass to the left of a cyclist,leaving a safe distance, when passing.

Rules for Pedestrians—No pedestrian shall proceed along a bicy-cle path or lane where there is an adja-cent adequate pedestrian facility.

Cyclists should be particularly wary ofjay-walking pedestrians. A frequentlyoccurring tableau in California consistsof a jogger running along a bike-lanestripe, against the flow of traffic, usuallywearing headphones. �

Record Sentence forColorado Slope Collision—Michael Wolff received the longestsentence in Colorado history for a skiresort accident. After plowingthrough a class of children (5-6 yrs.old) at Sunlight in March, sobriety

tests were performed onthe 20-year-old snow-boarder and he was foundto be seriously inebriated.

Two of the children wereinjured. The court handeddown an 8 month jailterm for child abuse. Aspart of the sentence,Wolff must write lettersof apology, serve threeyears probation onrelease and pay $9,300in restitution.

$2.9 Million Awarded in Accident— A British Columbia Supreme Courtjury recently awarded a former highschool student $2.9 million indamages in a personal-injury lawsuitstemming from a terrain parkaccident during a high school outingin January 2000 at Blackcomb.

Travis Murao, now a quadriplegic,sued his teachers, his school districtand Blackcomb for his injuries. Thejury found Blackcomb 70%responsible for the accident, theschool district 15% liable and Muraohimself, a novice snowboarder at thetime, 15% to blame.

It is unclear what effect the rulingwill have on future school outingsin B.C. Now that a district hasbeen found negligent for injuriessustained by a student on a schoolouting, schools may cut back oreliminate ski/ride trips.

Ski Resorts Show Progress on Environmental Issues—The third annual SustainableSlopes Annual Report released bythe National Ski Areas Association(NSAA) details the skiindustry’s progress inimplementing itsEnvironmental Charterfor Ski Areas over the pastseason.

Seventy-nine resorts from 25 statesmeasured their progress inimplementing environmental bestpractices this past spring in 21areas of environmentalstewardship.

The four areas in which resortsscored the highest include: protectingwetlands and riparian areas;protecting scenic values or “visualquality”; planning, designing andconstructing facilities in anenvironmentally sensitive manner;and properly handling potentiallyhazardous waste.

The four areas that resorts need toimprove on in the future include:energy use for lifts; reusingproducts to reduce waste; energyuse for vehicle fleets; and energyuse for snowmaking.

The assessment helped resortsquantify reductions in CO2, aprincipal greenhouse gas associatedwith global warming. Collectively,resorts helped eliminate theemission of 222,608,369 poundsof CO2 through energyconservation, wastereduction/recycling andtransportation-related projects

Do Snowboarders Need Lifts?A whopping 2.5 millionsnowboarders report they don’tvisit ski areas, according to a

survey conducted bythe National SportingGoods Association

(NSGA). The surveytallied 5.5 million

snowboarders nationwide,including 3 million who

turn up at resorts.

It has been postulated thatmany 10- to 14-year-

olds buy inexpensiveboards at Wal-Mart,Target, Costco andlocal ski shows, then

ride on any local hill they canfind—in their backyard, publicparks and golf courses.

If the number of non-resort riders iseven half the 2.5 million NSGAreports, it indicates a significant baseof riders which may be turning up atresorts in the very near future. �
