The New Jersey Open Public Meeting Law was enacted to insure the right of the public to haveadvance notice of and to attend the meetings of the public bodies at which any business affectingtheir interests is discussed or acted upon.

In accordance with the provisions of this act, the Fair Lawn Board of Education has caused noticeof this meeting to be published by having the date, time, and place thereof distributed to thepersons on the approved list, posted in the Board of Education Administrative Office and sent toThe Bergen Record and The Star Ledger.

The announcement/posting for the Regular Monthly Meeting, along with the date, place, andtime thereof, was distributed on May 26, 2021.

5. Superintendent Report/Comments- Board President thanked the entire district for the extraordinary year that is coming to a close.Students, parents, teachers, administration and the community for getting Fair Lawn through thisyear.- Mr Norcia Congratulated the Class of 2021, thanks to the various departments that played anintegral role in the moving up and graduation ceremonies events that took place over the last twoweeks. Heartfelt congratulations to all of the students.- The Safe Return Plan was presented by Dr. Natalie Lacatena & Mrs. Camille DeFranco.

Pursuant to N.J.A.C. 6A:23A-16.10 (c) 3, the School Business Administrator/Board Secretarycertifies that as of May 31, 2021 no budgetary line item account has obligations and payments(contractual orders) which in total exceed the amount appropriated by the Fair Lawn Board ofEducation pursuant to N.J.S.A. 18A:22-8.1 and N.J.S.A. 18A:22-8.2 and no budgetary line itemaccount has been over-expended in violation of N.J.A.C. 6:23-2.12 (a) 1.

B. Board Treasurer’s Report - May 2021

Pursuant to N.J.A.C. 6A:23A-16.10 (c) 4, the Fair Lawn Board of Education certifies that as ofMay 31, 2021 and after review of the Secretary’s Monthly Financial Report and the Treasurer’sMonthly Financial Report and upon consultation with the appropriate district officials, to the bestof the Board’s knowledge, no major account or fund has been over-expended in violation ofN.J.A.C.6A:23A-16.10 (a) 1 and that sufficient funds are available to meet the district’s financialobligations for the remainder of the fiscal year.

WHEREAS, on April 3, 2021, the Fair Lawn Board of Education published an advertisementwhich solicited qualifications for legal services; AND

WHEREAS, on April 20, 2021, the Board received and opened eleven (11) submissions ofqualifications for the provision of legal services; AND

WHEREAS, a committee was established to evaluate the submissions in accordance with thecriteria set forth in the request for qualifications; AND

* Compensated on an hourly basis at an hourly rate of $175.00 per hour for performinglegal services for, or on behalf of, the Board, except as set forth herein.

The School Business Administrator/Board Secretary pursuit to N.J.A.C. 5:34-9.1 (c) certifies theneed for this contract for Automated Logic Contracting Services Inc. to continue to providesupport and maintenance to the district’s building automation system.The term of contract shallbe from July 1, 2021 through June 30, 2023.

D. Approval to Provide Sound and PA Systems Additions to Thomas Jefferson Middle School

F. Acceptance of Proposal for Architectural Services to Update the District-Wide Long RangeFacilities Plan

WHEREAS, on May 27, 2021 the Board accepted Solutions Architecture Corp.’s submission ofqualifications in response to the Board’s request for qualifications; AND

WHEREAS, the Board’s request included a request for a proposal for architectural services toupdate the District-Wide Long Range Facilities Plan; AND

WHEREAS, the District-Wide Long Range Facilities Plan must be updated every five years andwas last updated in June 2017; AND

WHEREAS, an updated District-Wide Long Range Facilities Plan will be required forpreparation of the 2022-2023 District Budget;

NOW THEREFORE, the Board accepts Solutions Architecture Corp.’s proposal forarchitectural services to update the District-Wide Long Range Facilities Plan for a Not-to-ExceedFee of $27,000 plus reimbursable expenses.

G. Approval of Microsoft Licensing

WHEREAS, the Fair Lawn Board of Education, pursuant to P.L.2011.c.139; N.J.S.A18A:18A-et.seq. and N.J.A.C. 5:34-7.29(c) and per Local Finance Notice No. LFN 2011-35, mayby resolution and without advertising for bids, purchase any goods under thenationally-recognized National Cooperative Purchasing Alliance (NCPA) pricing system for anynational and/or regional cooperative entered into on behalf of the State by the Division ofPurchase and Property in the Department of the Treasury; AND

WHEREAS, the Fair Lawn Board of Education may enter into contracts with the referencedNCPA pricing system through this resolution and properly executed contracts, which shall besubject to all the conditions applicable to the current NCPA pricing system; AND

WHEREAS, the Fair Lawn Board of Education intends to enter into a contract withJourneyEd.com Inc. (NCPA contract) through this resolution and properly execute contracts,which shall be subject to all conditions applicable to the current National Contract Programcontracts; AND

NOW, THEREFORE BE IT RESOLVED, that the Fair Lawn Board of Education authorizesthe Purchasing Agent to purchase certain goods or services from those approved NationalContract Program Vendors such as JourneyEd.com Inc., pursuant to all conditions of the NationalContract Program contracts; and

BE IT FURTHER RESOLVED, that the Fair Lawn Board of Education does hereby authorizethe district purchasing agent to award the contract between the Fair Lawn Board of Education and

H. Approval of Shared Services Agreement- Technology Support Services

BE IT RESOLVED, that the Fair Lawn Board of Education approves the Shared ServicesAgreement, commencing on July 1, 2021 to June 30, 2022 for two Level I Technicians. The levelI Technicians shall provide the following services to Fair Lawn Public Schools for five days perweek:

1. Overall technical support services, including the troubleshooting, diagnosis andcorrection of any and all problems with Fair Lawn’s hardware and software systems andcomponents;

2. The set-up, installation, breakdown and configuration of Fair Lawn Public Schoolscomputer hardware and software systems and components;

3. General network administration services.

Fair Lawn shall pay Bergen Tech Eighty thousand five hundred dollars for each technician($80,500.00), total for 2 technicians One hundred sixty one thousand dollars ($161,000.)

BE IT FURTHER RESOLVED, that the Fair Lawn Board of Education agrees to abide by theagreement as provided by Bergen County Technical School District Board of Education andauthorize the Board President and Superintendent of Schools to execute the agreement.

I. Shared Services Agreement with Bergen County Technical Schools

BE IT RESOLVED, that the Fair Lawn Board of Education approves an agreement with theBergen County Technical Schools, for July 1, 2021 through June 30, 2022 on an as-needed basisat the direction of the Chief School Administrator.

The services to be provided include: Level I - Support Technician at an hourly rate of $80; LevelII - Server Administration at an hourly rate of $95; Level III - Network Administration at anhourly rate of $110.

J. Approval of Replacement of VMWARE Storage Array

That the Board of Education approves the purchase of VMWARE storage array replacements forboth the High School and Thomas Edison School from Presidio Networked Solutions GroupLLC, an authorized distributor for Pure Storage Inc., using the NJ State Contract #89981 for PureStorage Inc. including a 36-monthly premium gold 24/7 support subscription and install servicefor a total amount $126,406.22.

K. Acceptance of CDW-G E-Rate Category 2 Bid for Network Equipment

WHEREAS, the Fair Lawn Board of Education applies for annual funding through the Schoolsand Libraries Program of the Universal Service Fund, more commonly known as the “E-Rate”Program, which provides discounts to eligible entities for data network equipment and relatedservices.

WHEREAS, the Fair Lawn Board of Education posted FCC Form 470 number 210021961 inaccordance with E-Rate Program rules to initiate the competitive bidding process to solicitbids for eligible equipment from vendors to enable network upgrades for funding year 24(2021) which is effective as of April 1, 2021 and terminates on September 30, 2023.

NOW, THEREFORE, BE IT RESOLVED, that the Fair Lawn Board of Education hasconsidered the recommendation and hereby authorizes the School Business Administrator toexecute one or more purchase orders to CDW-G for network equipment and related servicestotaling $47,553.61.

L. Approval to Participate in the NJSIG Indemnity and Trust Agreement

WHEREAS, N.J.S.A. 18A:18B-1, et seq., enables boards of education to join with other boardsof education in school board insurance trusts for the purpose of forming self-insurance pools;AND

WHEREAS, the New Jersey Schools Insurance Group (“NJSIG”) is a joint insurance fundauthorized by N.J.S.A. 18A:18B-1, et seq. to provide insurance coverage and risk managementservices for its members;AND

WHEREAS, the Fair Lawn Board of Education, hereinafter referred to as the “EducationalInstitution,” has resolved to apply for and/or renew its membership with NJSIG; AND

WHEREAS, the Educational Institution certifies that it has not defaulted on a claim, and has notbeen cancelled for non-payment of insurance premium for a period of at least two (2) years priorto the date of its application to NJSIG; AND

WHEREAS, the Educational Institution desires to secure protection, services, and savingsrelating to insurance and self-insurance for itself and its departments and employees; AND

WHEREAS, the Educational Institution finds that the best and most efficient way of securingthis protection and services is by cooperating with other boards of education in the State of NewJersey.

NOW THEREFORE, BE IT RESOLVED, THAT:

1) This agreement is made by and between NJSIG and the Educational Institution;

2) The Educational Institution joins with other boards of education in organizing and becomingmembers of NJSIG pursuant to N.J.S.A. 18A:18B-3(a), for a period of three years, beginning onJuly 1, 2021, and ending July 1, 2024 at 12:01 a.m.;

3) In consideration of membership in NJSIG, the Educational Institution agrees that for thosetypes of coverage in which it participates, the Educational Institution shall jointly and severallyassume and discharge the liabilities of each and every member of NJSIG to such agreementarising from their participation in NJSIG. By execution hereof the full faith and credit of theEducational Institution is pledged to the punctual payment of any sums which shall become dueto NJSIG in accordance with the bylaws thereof, the plan of risk management, this Agreementand any applicable statute or regulation;

4) The Educational Institution and NJSIG agree that NJSIG shall hold all monies paid by theEducational Institution to NJSIG as fiduciaries for the benefit of NJSIG claimants all inaccordance with applicable statutes and/or regulations;

5) NJSIG shall establish and maintain Trust Accounts in accordance with N.J.S.A. 18A:18B-1, etseq. and such other statutes and regulations as may be applicable;

6) By adoption and signing of this resolution, the Educational Institution is hereby joining NJSIGin accordance with the terms of this Indemnity and Trust Agreement and Resolution to Join /Renew Membership, effective the date indicated below, for the types of insurance as indicated inthe Insurance Binder issued by NJSIG;

7) The Educational Institution hereby ratifies and affirms the bylaws and other organizational andoperational documents of NJSIG, and as from time to time amended by NJSIG and/or the State ofNew Jersey, Department of Banking and Insurance, in accordance with the applicable statutes andregulations as if each and every one of said documents were re-executed contemporaneouslyherewith;

8) The Educational Institution agrees to be a participating member of NJSIG for the period hereinprovided for and to comply with all of the rules and regulations and obligations associated withsaid membership, including, but not limited to the NJSIG’s Plan of Risk Management;

9) The Educational Institution under its obligations as a member of NJSIG agrees to allow forsafety inspections of its properties, to pay contributions in a timely fashion and to comply withthe bylaws and standards of participation of NJSIG including the plan of risk management;

10) If NJSIG, in the enforcement of any part of this Agreement, shall incur necessary expense orbecome obligated to pay attorney’s fees and/or court costs, the Educational Institution agrees toreimburse NJSIG for all such reasonable expenses, fees and costs on demand;

11) The Business Administrator is hereby authorized in accordance with the Public SchoolContracts Law, N.J.S.A. 18A:18A-1, et seq., to execute such contracts and documentation withNJSIG as is necessary to effectuate this resolution;

12) The Business Administrator is directed to send a certified copy of this Indemnity and TrustAgreement and Resolution to Join / Renew Membership to NJSIG.

M. Approval of Insurance Coverages

WHEREAS, Arthur J. Gallagher Risk Management Services, Inc. (Gallagher) of Princeton, NewJersey, was appointed as the agent of record for Risk Management for the 2021-2022 school year,in accordance with NJSA 18A:18A-5.10; AND

WHEREAS, Gallagher issued requests for proposals for the district’s various insurancecoverages for the 2021-2022 school year including insurance coverages for liability, property,student accident and workers compensation; AND

WHEREAS, Gallagher has provided recommendations for coverage that would be mostadvantageous for the District regarding such coverages; AND

WHEREAS the estimated premiums for this recommended insurance coverage total $1,076,267;AND

NOW THEREFORE BE IT RESOLVED, that the Board authorizes the Business Administratorto enter into contracts for insurance coverage for the 2021-2022 school year as recommended byGallagher.

N. Rejection of Behavioral Health Services Provider Proposals

WHEREAS, on or about May 12, 2021, the Fair Lawn Board of Education published a Requestfor Proposals (RFP) advertisement which solicited proposals for behavioral and mental healthservices; AND

WHEREAS, on June 3, 2021, the Board received and opened three (3) proposals for theprovision of behavioral health services; AND

WHEREAS, a committee was established to evaluate the proposals and rank the proposals inaccordance with the weighting criteria set forth in the request for proposals; AND

WHEREAS, the committee has concluded that the District’s behavioral health servicesrequirements have changed since the request for proposals was issued; AND

WHEREAS the committee has determined that all proposals received should be rejected, and therequest for proposals should be reissued to include revised requirements; AND

NOW, THEREFORE, BE IT RESOLVED, based upon the recommendation of theSuperintendent of Schools, the School Business Administrator and the review committee, that theSchool Business Administrator is hereby authorized to advertise for requests for proposals forbehavioral health services in accordance with the District’s changed requirements for saidservices.

O. Approval of Mental Health Services Provider

WHEREAS, on or about May 12, 2021, the Fair Lawn Board of Education published a Requestfor Proposals (RFP) advertisement which solicited proposals for behavioral and mental healthservices; AND

WHEREAS, on June 3, 2021, the Board received and opened two (2) proposals for the provisionof mental health services; AND

WHEREAS, a committee was established to evaluate the proposals and rank the proposals inaccordance with the weighting criteria set forth in the request for proposals; AND

WHEREAS, the committee has issued a report which evaluates and ranks the proposals inaccordance with the weighting of criteria set forth in the specifications and presented arecommendation; AND

WHEREAS, the Board has reviewed the report and accepted the recommendation of thecommittee on which proposal should be accepted; AND

WHEREAS, the Board has concluded that the proposal submitted by Effective School Solutions,LLC is the most advantageous to the School District, price and other factors considered;

NOW, THEREFORE, BE IT RESOLVED, based upon the recommendation of theSuperintendent of Schools, the School Business Administrator and the review committee, that theBoard accepts the proposal submitted by Effective School Solutions, LLC in the amount of$581,400 and appoints Effective School Solutions, LLC as Mental Health Services provider forthe Board of Education for the 2021-2022 school year; AND

WHEREAS , there exists a need for mental health services, AND

WHEREAS, the Public School Contracts Laws (N.J.S.A. 18A:18A-5) requires that a resolutionauthorizing the contracting of a Professional Service without competitive bids be adopted:

NOW, THEREFORE, BE IT RESOLVED by the Fair Lawn Board of Education that EffectiveSchool Solutions, LLC, 121 Chonlon Road, Suite 310 New Providence, NJ 07974 , be contractedas the Mental Health Services provider for the Fair Lawn Board of Education for the 2021-2022school year without competitive bidding as a Professional Service in accordance with 18A:18A-5of the Public School Contracts Law; AND

NOW BE IT FURTHER RESOLVED that said contract with Effective School Solutions, LLCinclude addendums providing for an additional clinician and summer services for additional feesof $115,000 and $8,000 respectively.

P. Appointment of Medical Inspector

That the Board approves Dr. Shai Shoshani, M.D. as the medical inspector N.J.S.A. 18A:40-1 toprovide medical services as customarily provided by school medical inspectors in accordancewith the requirements of Title 18A of the laws of the State of New Jersey and regulationspromulgated thereunder, as well as under all other laws and regulations governing the practice ofmedicine for the 2021-2022 school year in the amount of $17,000.

Q. Acceptance of Proposal for the Scanning and Storage of the District’s Records as Requiredby Law

WHEREAS, Destruction of Public Records Act PL1953, c. 410 requires the District to maintainand dispose of paper and electronic records in the manner prescribed by law; AND

WHEREAS, the Board has received a proposal from FileBank Inc. for records managementservices at rates significantly discounted from the Ed Data Contract # 9172 rates; AND

WHEREAS, said rates are one time fees $53,511.51 for repackaging and assessment ofdocuments and $22,650 for scanning services for current human resources, payroll and specialeducation records and monthly fees of $3,462.16 for storage of electronic and physical documentsplus incidental fees for unscanned document retrievals; AND

WHEREAS, the Business Administrator has reviewed the proposal and recommends acceptanceof said proposal in order to facilitate the safe storage and legal destruction of District records,AND

NOW, THEREFORE, BE IT RESOLVED, the Board authorizes the Business Administrator tosign a contract with FileBank Inc. for services as summarized above and enumerated in theproposal on file in the Business Administrator’s office.

R. Approval of Renewal of A.S.A.P. Messenger, LLC Agreement

BE IT RESOLVED, that the Board approves the renewal of the agreement with A.S.A.P.Messenger, LLC for District Courier Services for the 2021-2022 school year for a daily rate of$295.

S. Approval ESS Northeast, LLC Addendum Rates

The Board will not be seeking an SDA Grant for this project aspart of the submission.

WHEREAS, NJSA 18A:21-2, N.J.A.C. 6A:23A-14.2, N.J.A.C. 6A:23A-14.4(a)1, and NJSA18A:7G-13 permits a Board of Education to establish and/or deposit into certain reserve accountsat year end; AND

WHEREAS, the aforementioned statutes authorize procedures, under the authority of theCommissioner of Education, which permit a board of education to transfer anticipated excesscurrent revenue or unexpended appropriations into reserve accounts during the month of June byboard resolution; AND

WHEREAS, the Fair Lawn Board of Education wishes to deposit anticipated current year surplusin excess of the maximum allowable surplus (Total Reserves Deposit), into Reserve accounts atyear end; AND

WHEREAS, the Fair Lawn Board of Education wishes that the amount of the Total ReservesDeposit deposited into the Emergency Reserve account be the lesser of $100,000 or the TotalReserves Deposit; AND

WHEREAS, the Fair Lawn Board of Education wishes that the amount of the Total ReservesDeposit deposited into the Maintenance Reserve account be the lesser of $4,000,000 or theremaining amount of Total Reserves Deposit after the deposit to the Emergency Reserve; AND

WHEREAS, the Fair Lawn Board of Education wishes that the amount of the Total ReservesDeposit deposited into the Capital Reserve account be the remaining amount of the TotalReserves Deposit after the deposit to the Emergency and Maintenance Reserves; AND
