It is noted that M/s BMA Stainless Limited has proposed to set up 2 X 8 T Induction Furnace (Expansion Project) at village Debipur, P.O. Kalyaneshwarf, district Burdwan, West BengaL The project will be set up within the exi sting plant premises of 17.1 acres. The existing plant got Consent To Establish was obtained from the West Bengal Po llution Control Board on 19.1.2005 (2x8 T Induction Furnace), 30 .6.2005 (20 TPH Rolling Mill), 4.9.2006 (5000 TPM Steel Billets) and 22.11.2007 (Producer Gas Plant- 2700000 Nm 3 /Month) respectively. The ca pital investment for the existing project is Rs .10.8225 crores and not covered under the purview of the EIA Notification 1994. Further, the unit has obtained CTEs for the induction furnace, rolling mill and billet manufacturing unit prior to the EIA Notification 2006 dated 14.9.2006, hence the project is not covered under the purview of EIA Notification 2006. The latitude and longitude of the project site is 23"46'54.15''N and 86"50'4.40"E respectively. No Forest land is involved. No Defense Installation, Biosphere Reserve, Nati onal Park/Wild Life Sanctuary, E co logically Sensitive Area is located within 10 km radi us of the project site. No court case/litigation is pending against the proposed project. Total cost of the project is Rs.5.06 crores. Rs. 50 Lakhs and Rs. 6 lakhs is earmarked for the capital cost and recurring cos t per annum towards the environmental pollution control measures. Sir,

This is with reference to your letter dated 20.3.2014 along with EIA·EMP report seeking environmental clearance (EC) from this Ministry for the aforesaid project, under the provisions of the EIA Notification, 2006. The Terms of Reference (ToR) was awarded by MoEF&CC vide letter of even no. dated 13.11.2013 for preparation of EIA-EMP report.

2. The M inistry of Environment, Forests and Cltmate Change (MoEF&CC) has examined your application for EC for the aforesaid project. It is noted that M/s BMA Stainless Limited has proposed to set up 2 X 8 T Induction Furnace (Expansion Project) at village Debipur, P.O. Kalyaneshwarf, district Burdwan, West BengaL The project will be set up within the existing plant premises of 17.1 acres. The existing plant got Consent To Establish was obtained from the West Bengal Pollution Control Board on 19.1.2005 (2x8 T Induction Furnace), 30.6.2005 (20 TPH Rolling Mill), 4.9.2006 (5000 TPM Steel Billets) and 22.11.2007 (Producer Gas Plant- 2700000 Nm3/Month) respectively. The capital investment for the existing project is Rs .10.8225 crores and not covered under the purview of the EIA Notification 1994. Further, the unit has obtained CTEs for the induction furnace, rolling mill and billet manufacturing unit prior to the EIA Notification 2006 dated 14.9.2006, hence the project is not covered under the purview of EIA Notification 2006. 4. The basic raw materials required for manufacturing M.S. Billets are Sponge Iron (48,450 TPA), Pig Iron (17,100 TPA), Ferro AHoys (360 TPA) etc. The raw materials will be transported by road in covered trucks. The power requirement after the proposed expansion would be 20 MW [Existing: 12 MW; Addition at: 8 MW] which will be met from Damodar Valley Corporation.

5. It is noted that the Induction Furnace wUI be equipped with bag filter arrangement with 99.9% efficiency. Good housekeeping practices will be adopted to control the fugitive emissions.

6. The water requirement for the project would be 52 KLD [Existing: 40 KlD; Additional:12 KLD]and it will be met from existing bore wells and rain water harvesting pond. Application for permission for the drawl of 52 KLD wa ter has been submitted to State Water Investigation Directorate, West BengaL No industrial waste water will be generated in the plant. Domestic waste water generated from the project will be sent to the septic tank. Rainwater harvesting will be practiced with in the plant premises.

7. lt is also noted that the f ines co llected at Bag Fifter from Induction Furnace {200 TPA} will be recycled In the process. Induction Furnace Slag (5,662 TPA) will be utilized in road I area I land development. Out of the total plant area (i.e. l7.1 acres), 33% df total plant area Will be developed under green belt I plantation in a scientific manner around the plant boundary, roadside, office bu ildings and stretches of open land.

8. The proposed project activity is listed at S.No. 3(a) Secondary Metallurgical Industry under category 'B'. As the project site Is located within 10 km radius of inter-State boundary {West Bengal - Jharkhand Border), due to the applicability of the general condition the project has been treated as Category 'A' of the Schedule of EIA notlfication 2006 and appraised by the Expert Appraisal Committee (Industry) of MoEF.

9. The proposal was considered by the Reconstituted Expert Appraisal Committee (Industry) in its 201n meeting held during 23-2411!. June 2014. After detailed deliberations, the Committee recommended the project for environmental clearance. Public Hearing I Public Consultation meeting was conducted by the West Bengal Pollution Control Board on 28.2.2014.

hereby accords environmental clearance to the ab ove project under the prov1s1ons of EIA Notification dated 141

h September 2006 subject to strict compliance of the following Specific and

General conditions:

A. SPECIFIC CONDITIONS :

viL Measures shall be taken to reduce PM levels in the ambient air. Continuous stack monitoring facilities for ali the stacks shall be provided and sufficient air pollution control devices viz. Electrostatic precipitator (ESP), bag house, bag filters etc. shall be provided to keep the emission levels below 50 mg/Nm3 and installing energy efficient technology.

vf( Steps/Measures shall be taken for keeping emissions from project activities within prescribed limits in the context of the National Ambient Air Quality Emission Standards issued by the Mlnistry vide G.S.R. No. 826{E) dated 161

h November, 2009.

il!. Gaseous emission levels including secondary fugitive emissions fro(!! all the sources shall be controlled within the latest permissible limits issued by the Ministry vide G.S.R. 4l4(E) dated 301

h May, 2008 and regularly monitored. Guidelines I Code of Practice issued by the CPCB shall be followed.

Vehicular polfutlon due to transportation of raw material and finished product shall be controlled. Proper arrangements shall also be made to control dust emissions during loading and unloading of the raw material and finished product.

Total fresh water requirement from ground water source shall not exceed 52 KLD which will be met from bore wells and rain water harvestrng pond. Prior permission shall be obtained from the Competent Authority for water drawl from bore welL 'Zero' effluent discharge shall be strictly followed and no wastewater shall be discharged outside the premises.

Regular monitoring of influent and effluent surface, sub-surface and ground water shall be ensured and treated wastewater shall meet the norms prescribed by the State Pollution Control Board or described under t he E{P) Act whichever are more stringent.

Proper handling, storage, utilization and disposal of all the solid waste shall be ensured and regular report regarding toxic metal content in the waste material and its composition, end use of solid/hazardous waste shall be submitted to the Ministry's Regional Office at Bhubaneshwar., SPCB and CPCB.

A time bound action plan shall be submitted to reduce solid waste, its. proper utili~ation an_d

disposal.

Proper utilization of fly ash shall be ensured as per Fly Ash Notification, 1999 arid subsequent amendment in 2003 and 2009. All the fly ash shall be provided to cement and brick manufacturers for further lltilization and Memorandum of Understanding shall be submitted to the Ministry's Regional Office at Bhubaneshwar.

A Ri sk and Disaster Management Plan (including Earth quake and Seismic hazard) shall be prepared and a copy submitted to the Ministry's Regional Office at Bhubaneshwar, SPCB and

CPCB within 3 months of issue of environment clearance letter.

xi. As proposed, green belt shall be developed in at least 33 % of the project area. Selection of plant species shall be as per the CPCB guidelines in consultation with the DFO.

xii. All the commitments made to the public during Public Hearing/public consultation meeting held on 28.2.2014 shall be satisfactorily implemented and adequate budget provision shall be made accordingly.

xiil. At least 5 %of the tota l cost of the project shall be earmarked towards the Enterprise Social Commitment based on earlier Public Hearing Issues, locals need and item-wise details along with time bound action plan shall be prepared and submitted to the Ministry's Regional Office at Bhubaneshwar. Implementation of such program shall be ensured by constituting a Committee comprising of the proponent, representatives of village Panchayat and District Administration. Action taken report in this regard .shall be submitted to the Ministry's Regional Office at Bhubaneshwar.

xiv. The Company shaH submit within three months their policy towards Corporate Environment Responsibility which shall inter-alia address (i) Standard operating process/procedure to being into focus any infringement/deviation/ violation of environmental or forest norms/conditions, (il) Hierarchical system or Administrative order of the Company to deal with environmental issues and ensuring compliance to the environmental clearance conditions and (iii) System of reporting of non-compllance/violation environmental norms to the Board of Directors of the company and/or stakeholders or shareholders.

xv. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and faci lities such as fuel for cooking, mobile toilets, mobile STP, Safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

B. GENERAL CONDITIONS:

i. The project authorities must strictly adhere to t he stipulations made by the West Bengal Pollution Control Board and the State Government.

H. No further expansion or modifications tn the plant shall be carried out without prior approval of the M inistry of Environment, Forests and Climate Change {MoEF&CC),

iii. At least four ambient air quality monitoring stations should be established in the downward direction as well as where maximum ground level concentration of PM 10,

PM 2.s, 502 and NOx are anticipated in consultation with the SPCB. Data on ambient air quality and stack emission shall be _regularly submitted to this Ministry including its Regional Office at Bhubaneshwar and the SPCB/CPCB once in six months.

iv. Industrial wastewater shal l be properly collected, treated so as. t o conform to the standards prescribed under GSR 422 (E) dated 191

h May, 1993 and 31st December, 1993 or as amended f orm time to time. The treated wastewater shaH be utilized for plantation purpose.

vv The overall noise levels in and around the plant area shall be kept well within the standards (85 dBA) by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noi·se levels

should conform to the standards prescribed under EPA Rules, 1989 viz. 75 dBA (daytime) and 70 dBA (nighttime).

Occupational health surveillance of the workers shall be done on a regular basis and records maintained as per the Factories Act.

The company shall develop rain water harvesting structures to harvest the rain water for utilization in the lean season besides recharging the ground water table.

The project proponent shari also comply with all the environmental protection measures and safeguards recommended in the EIA/fMP report. Further, the company must undertake socio-economic development activities in the surrounding villages like community development programmes, educational programmes, drinking water supply and health care etc.

Re.quisite·funds ~hall be earmarked towa.rds capital cost and recurring cost/annum for environment pollution control measures to implement the conditions stipulated by the Ministry of Environment, Forests and Climate Change (MoEF&CC) as well as the State Government. An implementation schedule for implementing all the conditions stipulated herein shall be submitted to the Regional Office of the Ministry at Bhubaneshwar. The funds so provided shall not be diverted for any other purpose.

A copy of clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parishad/Municipal Corporation, Urban Local Body and the local NGO, if any, from whom suggestions/representations, if any, were received while processing the proposal. The clearance letter shall also be put on the web site of the company by the proponent .

The project proponent shall upload t he status of compliance of the stipulated environment clearance conditions, including results of monitored data on their website and shall update the same periodically. It shaH simultaneously be sent t o the Regional Office of the MOEF&CC at Bhubaneshwar. The respective Zonal Office of CPCB and the SPCS. The criteria pollutant levels namely; PM1o, 502, NOx (ambient levels as well as stack emissions) or critica l sectoral parameters, indicated for the projects shall be monitored and displayed at a convenient locat ion near the main gate of the company in the public domain.

The project proponent shall also submit six monthly reports on the status of the compliance of the stipulated environmental conditions including results of monitored data (both in hard copies as well as by e-mail) to the Regional Office of MOEF&CC, the respective Zonal Office of CPCB and the SPCB. The Regional Office of this Ministry at Bhubaneshwar I CPCB/ SPCB shall monitor the stipulated condit ions.

The environmental statement for each financia l year ending 31n March In Form-Vas is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of environmental conditions and shall also be sent to the respective Regional Office of the MOEF&CC at Bhubaneshwar by e-mail.

The Project Proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available

with the SPCB and may also be seen at Website of the Ministry of Environment, Forests and Climate Change (MoEF&CC) at http: //envfor.nic.in . This shall be advertised within seven days from the date of issue of the clearance letter, at least in two local newspapers that are widely circulated in the region of whfch one shall be in the vernacular language of the locality concerned and a copy of the same should be forwarded to the Regional office at Bhubaneshwar.

xv. Project authorities .shall inform the Regional Office as well as the M inistry, the date of financial closure and final approval of the project by the concerned authorities and the date of commencing the land development work.

10. The Ministry may revoke or suspend the clearance, If implementation of any of the above cond itions is not satisfactory.

11. The Ministry reserves the right to stipulate additional conditions if found necessary. The Company in a time bound manner shaH implement these conditions.

12. The above conditions shall be enforced, inter-alia under th~ provisions of the Water (Prevention & Control of Pollution} Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, Hazardous Wastes (Management, H~~ling and Trans boundary Movement) Rules, 2008 and the Public {Insurance) Liabil ity Act, 1991 a,tOng)with their .

SOCIAL IMPACT ASSESSMENT Social Impact Assessment Introduction The term “Social Impact” means all social and cultural consequences, including changes of people’s lift, production, social relations and organization pattern, brought about by any private or public activity, as well as cultural impacts, including changes of people’s behavior, the view of value and religion. The objective of a Social Impact Assessment (SIA) is to assess the possible social impacts that may be brought about by a development project, to understand, manage and control changes, to formulate, implement mitigation measures to minimize adverse social impacts or prevent from extension. In the assessment, the most important key is to carry out social intervention to settle, mitigate and eliminate the adverse impacts and manage the social impacts rationally. Social Impact Assessment is carried out, based on impacts to all the properties and assets identified along the project site. The socio-economic survey in the project area was carried out and the detailed relevant information. Objectives of Social Impact Assessment Study The main objective of conducting social survey is to provide inputs of social concerns and to avoid or minimize the adverse social impacts with the best possible solutions at minimum cost. The social reconnaissance exercise is intended to assess the negative impacts (direct, indirect or cumulative) and to suggest mitigating measures to avoid or at least minimize the adverse impacts on nearby communities and people. To minimize and or avoid the adverse impacts through suggested appropriate measures that can be adopted during the operation of the project. The above objectives can be summarized as follows: ― To identify Socio economic status of the study area; ― To collect base line demographic and socio-economic characteristics of the study area ― To gather from the villagers information on the awareness and opinion about of the project ― To know the perceptions and expectations of the respondents from the project authority ― To suggest an appropriate action plan for improving/ restoring the living standards of people in

the study area Rehabilitation & Resettlement Plan The proposed expansion project does not involve any displacement of persons and no rehabilitation or resettlement is necessary. Reconnaissance Survey of the Project Area The study team carried out extensive visits to collect social features within the study area. Other primary data has been collected by using structured and semi-structured questionnaires. Socio Economic survey was been carried out in all the directions within the 10 km radius of the study area to know their socio economic status that includes the basic amenities like education, health,

communication and transportation, drinking water facility, sanitation facility and their views, expectation and perceptions about the project. The consultations were carried out with both individuals and groups during the reconnaissance survey involving local people, directly and indirectly affected persons, public consultation involved information dissemination i.e. informing the people about the details of the project and to invite their suggestions and comments. Analysis of Data and Reconnaissance Exercise The data collected through the above steps were compiled to develop the social scenario of the project area and the sensitive components within that. The collected data was analyzed, tabulated, summarized and accordingly socio-economic features of the project area were assessed. The analysis will indicate the feasibility of the project and will help in suggesting various socially viable options and suggested mitigation measures to make the project socio-economically acceptable. Details of Project Area Study Area The study area was defined as an area within 10 km radius around the proposed project site. Total 86 villages are coming within the 10 km radius of the study area. The villages are from Salanpur, Kalna – II and Galsi-I of Burdhamman district of West Bengal and Nirsa-Cum-Chirkunda of Dhanbad District of Jharkhand state. Public Consultation

As part of the participatory approach, the project has been designed in due consultation with all the stakeholders. Public consultation is mandatory for any investment in infrastructural development program. The aim of the public consultation is to make the stakeholders aware about the developmental activities being undertaken and to incorporate their views for making sustainable plan during the design and to have successful completion of the project. Methods of Public Consultation Informal and formal consultations in the project area were conducted which adopted the following methodology:

(i) Walk over survey and informal discussion with people (ii) Individual interviews with villagers.

As per the data generated through the survey it is observed that the quality of life of the surveyed village is on an average with lack of basic amenities such as medical facility, sanitation condition is very poor which leads to the unhealthy environment and cause for various health problems. Drinking water facility is also very poor and unsatisfactory. Project proponent should work in certain area for improvement in the quality of life of the region. Socio economic survey was conducted in 7 villages of the study area. The questionnaire for the socio economic survey is attached in ANNEXURE I. The Demographic details of sampling villages are given below: Maithon is a census town in Nirsa CD Block in Dhanbad district in the Indian state of Jharkhand. As per 2011 Census of India Maithon had a population of 18,830, of which 9,942 were males and 8,888 females. Scheduled Castes numbered 2,830 and Scheduled Tribes numbered 1,128. As per 2011 census

the total number of literates in Maithon was 14,611 out of which 8,225 were males and 6,386 were females. Chirkunda is a city and a notified area in Dhanbad district in the state of Jharkhand, India. Chirkunda had a population of 39,121. Males constitute 53% of the population and females 47%. Chirkunda has an average literacy rate of 64%, higher than the national average of 59.5%; with male literacy of 71% and female literacy of 56%. 14% of the population is under 6 years of age.

• The total no. of household in the sampling villages are 2088 with total population of 10100 • Population at the age of 0-6 years is about 1187 • Scheduled caste population is about 1874 and scheduled tribe population is 1989 • Out of the total population 6662 population are literates i.e 65.96%

OCCUPATIONAL STRUCTURE OF THE SAMPLING VILLAGES OF THE STUDY AREA Chirkunda is situated amidst rich coal mines of Jharia and Raniganj. Major industries in and around this area includes refractory making, coal making, iron and steel plants, food processing, retailing, and service industry. The presence of DVC's Maithon Dam and Panchet Dam, power stations is another major factor for the development of industries in and around this area. Maithon Power Limited, a Joint venture of Tata Power and DVC Maithon holds brighter prospects for the future and prevalent industries. Villages Total

It can be concluded from the above data that the total main workers in the surveyed villages are 2681 and the about 79.07% people in the sampling villages are engaged in other activity i.e labour, service and business class. 17.19% population is engaged as agriculture laborers. While it can be seen that non worker population in the villages is about 6632 of the total population.

Infrastructure Facilities Available in the Sampling Villages The details of the infrastructure facilities available in the villages are given below:

Hadla- There are 2 primary schools, 1 middle school, 1 secondary school and 1 high school in the village. No medical facility is available in Hadla village and the drinking water is available through Tap and Uncovered well while closed drainage sanitation is available but people are unsatisfied with the facility. Dendua- The only education facility available is Primary school while for further education children go to Salanpur village. The village lack in medical facility and the sources of drinking water is tap water, uncovered well, hand pump and tube well. No sewage and drainage facility is available in village Kulti- The education facility is available in the form of primary and middle school while no government medical facility is available in village. The primary source of drinking water is untreated tap water and Hand Pump. The sanitation facility is very poor in the village and people are unsatisfied with the condition. Milikhola- Primary school is only available in the village while for middle and secondary school people go to Belrui village about 7 kms by road. No medical and sanitation facility is available in the village and the main source of drinking water is tap and hand pump facility. Salanpur- There are 3 primary schools, 1 middle school, 1 secondary school and 1 senior secondary school in the village. There is Primary health sub-centre working in the village with 3 medical staff. Tap water, Hand pump and covered well are the sources of drinking water. Open drainage system is available and there are community toilet build in the village. Nakarjuria- Only primary and middle school is available in the village. No government medical facility is available in village. Tap water, uncovered well and hand pump is available for drinking water and the village is lack of toilet and sanitation facility. Mahespur- The village has only primary school facility. The source of drinking water is uncovered well and tube well. No drainage system is in the village. Villagers are not satisfied with the facilities available.

FOLLOWING ACITVITIES CAN BE PROPOSED IN THE STUDY AREA As per the socio economic survey in the study area, following activities can be proposed in the surrounding areas of the plant in consent of the Gram Panchayat and by identifying the priorities needs of the villagers. The CSR budget for the welfare activities shall be Rs 20 Lakhs per annum.
