Such stock after being on the Common forthat period must make a bona fide trip of at least threedays' absence from Yalgo6 before being entitled to an-other seven days free; should the seven days be ex-ceeded, such stock will be charged at the rate of six-pence per head per day or part of a day, but in no caseshall such stock remain on the Common under this By-law longer than 12 days at any one Hine.

(a) the premises on which the pigs are slaughteredare registered under Division 2 of Part VII.of "The Health Act, 1911";

(b) all relative By-laws under "The Health Act,1911," and its amendments are duly ob-seved and performed by the licensee; and

(c) the prescribed fee is paid by the licensee.2. Every licensee shall pay to the Department of

Public Health, or its collector, as an inspection fee, thesum of sixpence for earls pig killed.

3. The minimum number of carcases presented forinspecton to be twenty, otherwise the licensee to payfees as if twenty pigs had been inspected.

4. Twenty-four hours' clear notice shall be given theDepartment of Public -Health by the licensee that allinspection is desired, or alternatively a licensee may,by arrangement with the .Department of Public Health,fix definite days and hours of inspection.

5. Every license shall be -revocable be the Ministerin his absolute discretion.

6. A. license may be in the form or to the effect ofthe Schedule.

(a.) The top of the main beam of light projectingfrom any lamp or lamps shall have the mainbeam of light projecting therefrom restrictedto a height of three feet above any road ata distance of 75 feet on a level from thefront of any motor -car, motor wagon, motorcarrier, motor cycle, cycle, hand-cart, engine,or trailer in the direction in which the sameis proceeding or intending to proceed.

(b.) Provided that if any lamp or lamps are pro-vided with any lens or other immovabledevice which efficiently prevents the beani oflight dazzling, blinding, or confusing anyother person, at a. greater distance than thatspecified in the foregoing by-law, and if writ-ten approval is obtained of such lens or otherimmovable device from the local authorityby which such motor car, motor wagon, motorcarrier, motor cycle, cycle, hand-cart, engine,or trailer is licensed, such lens or other im-movable device shall be deemed to complywith the provisions of the foregoing By-law.

By-law No. 61.Motor Cars, Motor Wagons, and Motor Carriers.

At least two lamps so constructed and placed as toexhibit a white light in the direction in which such motorcar, motor wagon, or motor carrier is proceeding orintending to proceed, and one lamp- so constructed andplaced as to exhibit a red light from the rear of themotor car, motor wagon, or motor carrier, and a whitelight to so illuminate the rear number plate as to makethe inscription thereon easily distinguishable, and allsuch lamps shall, during the time as aforesaid, and whilstsuch motor car, motor wagon, or motor carrier is in anystreet or way, be kept lighted, and shall show a lightsufficiently clear and strong to afford adequate meansof signalling the approach or position of such motorear, motor wagon, or motor carrier.

CARNARVON WATER BOARDBY-LAWS.Interpretation Clause.

The terms "House" and "Land" shall have themeanings severally attached to them in Section 3 of

The Health Act, 1911."The words "Board." "Fittings," "Land," "Occu-

pier," "Owner," "Person," "Pipe," "Prescribed,""Rateable Land,' "Water Area," "Waterworks,"and "Works" shalt have meanings severally attached tothem in Section 3 of "'rho Water Boards Act, 1904."

"Inspector" and "Local Officer" respectively shallmean a person appointed by the Board for the pus-posesof these By-laws or to administer the said By-laws.

Division 1.By-laws for preventing Pollution of theWaters of the Catchment Area.

I. No person shall bathe, or wash clothes or otherarticles, in any reservoir or other waterworks within thewater area, or wash, throw or cause to enter therein anydog or other animal; or throw or convey, or permit tobe conveyed or thrown therein any rubbish, dirt, filth,dead animal, or other noisome thing, or otherwise causeany pollution within the Water Area.

2. No person shall deposit, or permit to be depositedany refuse, dung,, manure, or other offensive matter inor near any Catchment Area, or in any place where, inthe opinion of the Inspector, storm waters will he liableto wash such matter into any feeder.

3. No person shall place or deposit or spread, or per-mit to be placed, deposited, or spread, in or upon anyland or garden within the Catchment Area, any night-soil or human urine, whether mixed with any other sub-stance or not, or any solution of nightsoil, unless thesame has been thoroughly deodorised and disinfected tothe satisfaction of the Inspector, and unless writtenconsent thereto has been obtained.

4. In the event of the death, or of any accidentnecessitating the slaughter of any horse, cattle, sheep,or other animal, the carcase of such animal shall be re-moved by the owner thereof to a safe distance from anywaterworks, or to such place as the Inspector maydirect, and the owner shall immediately thereafter dis-pose of same, by burning, to the satisfaction of the In-spector.

5. No person shall deposit or permit to be depositedany rubbish, filth, blood, offal, Or manure, or any slops,soaRjsuds, urine, water containing urine or other refuse,noisome thing, or matter in any part of the CatchmentArea or Water Area, whence it may, in the opinion ofthe Inspector, be carried by storm water into anyfeeder.

6. Unless otherwise provided for, the time whichmay elapse between the giving of a notice and the doingof a thing required to he done by any Inspector orother authorised officer shall be determined by theBoard according to the nature or each ease.

Division 2.-By-laws for protecting the -Water,Grounds, Works, etc., from. Trespass and Injury.

7. No unauthorised person shall trespass within thefenced area adjacent to any waterworks, or any reserveor other lands vested in the Board.

8. No person shall, without first obtaining a license,cut or remove timber from any land or from any re-serves or other properties in the possession of theBoard.

9. No person shall, without proper authority, enterany machinery house, valve house, or other portion ofthe works not open to the public, or enter any enclosurewithin the Water Area containing a tank, reservoir,meter, house, office, or other waterworks.

10. No person shall permit live stock to have accessto any portion of the grounds in the vicinity of anywaterworks.

11. No person shall post any bills, advertisements,or other notices on any portion of any waterworks orgrounds in the vicinity without consent of the Board.

Division 3.-By-laws for the Licensing of Plumbers.12. By-laws under this division shall apply to all

plumbers' work done within the boundaries of theWater Area, and in districts not within such boundariesplumbers' work shall be done under such arrangementas may be specified in each case by the Board.

13. No person shall affix, alter, or repair any ser-vice pipe or fitting to be used in connection with anymain or other pipe belonging to the waterworks, or in-terfere in any way therewith, unless licensed as aplumber under these By-laws, or with the consent of theBoard.

14. An application for a plumber's license shall bein writing, signed by the applicant, and addressed tothe Board.

15. Every applicant for a plumber's license shallsatisfy the Board that he is a competent plumber, andmay be required to submit to an examination in thetheory and practice of plumbing work.

16. Every license shall be granted by the Board;and the granting and cancellation of any license shallbe ill the absolute discretion of the Board.

17. Every license shall be annual, expiring on the10th day of January next following the granting there-of, and may be in the Form "A" in the Schedulehereto.

18. A fee of ten shillings shall be payable for everylicense except when a license is granted after the 10thday of July in any year, in which case the fee shall befive shillings.

19. Every applicant for a plumber 's license shall,before receiving a license, deposit with the Board thesum of five pounds, to be held by the Board during thecurrency of the license as security for the proper per-formance of all work undertaken by the licensee.

20. The Board may deduct from such deposit the ex-pense of making good any bad work of the licensedplumber or his workmen, and as often as any expense

is so deducted the licensed plumber shall make good thedeposit to the sum of five pounds, and in default hislicense will be cancelled.

21. Every licensed plumber shall, within forty-eighthours of any change of his address, give notice, inwriting, thereof to the Board.

22. The mains shall be tapped only by the workmenof the Board.

23. No licensed plumber or any other person shallinterfere with any pipe or fitting belonging to thewaterworks, without the permission in writing of a. localofficer 'first obtained.

24. No ground shall be opened, nor shall any workbe undertaken for the purpose of laying and fixing anew service or fittings, or in the extension or alterationof an existing service or fittings until notice shall havebeen given by the responsible licensed plumber to a localofficer. Such notice shall be in writing, in the Form"B" in the Schedule, and shall describe the nature andextent of the proposed work, and shall be given forty-eight hours at least before the work is intended to becommenced, unless the officer expressly accepts shorternotice.

25. On the completion or extension of any service,the responsible plumber or other person shall report thework to a local officer as ready for inspection.

26. In no case shall the ground be filled in or waterbe turned on to any land until the work executed by theresponsible plumber or other person has been examinedand passed by a local officer, and a certificate in writinghas been g,iven by such officer to that effect.

Division 4.-By-laws for General Purposes.27. Within the Carnarvort Water Area the water

rate shall be at a rate not exceeding two shillings in thepound per annum upon the net annual value of all rate-able land, provided that a minimum rate of not exceed-ing one pound per annum shall be payable on eachseparately assessed piece of land.

28. Water rates shall become due and payable half-yearly in advance, on each first day of January andJuly: Provided that in all cases where a water rate ismade after the first day of January in any year thenotice of the order for the making and levying of suchrate, published in the Government Gazette and a news-paper as provided by Section 94 of the said Act, shall

specify the minimum suns payable as rate as aforesaid,and the date or dates when the rate shall be due andpayable, and such rates shall be and become due andpayable in accordance with the terms of such notice.

29. Every ratepayer will be entitled to consume, oneach separately assessed property for which he is rated,that quantity of water which, if calculated at a pricenot exceeding two shillings per thousand gallons, wouldamount to the equivalent of the water rate paid on suchproperty, provided that such water be taken during theperiod for which the rate is struck.

30. Every ratepaying-consumer taking water in ex-cess of the quantity to which he is entitled in respect ofthe rate will be charged for the excess at a price notexceeding five shillings per thousand gallons.

31. It shall be at the discretion of the Board tosupply water to any individual consumer, whether ratedor not, at such price or prices as may be mutuallyagreed upon.

32. Where water is supplied by measure to theowner or occupier of land, whether rated under the Actor otherwise, payment of the same shall be made atsuch times and in such manner as may be agreed uponbetween the Board and the consumer.

33. Any person or persons requiring a water serviceto premises in respect of which for the time being awater rate may not be made may be supplied on pay-ment of an annual minimum charge, which shall befixed by the Board in each case. The minimum chargeshall then take the place of a water rate, and the gen-eral provisions of these By-laws, as applying to rate-paying consumers, shall apply to minimum-charge pay-ing consumers: Provided that the minimum charge toany public building or for any water service for publicpurposes shall he subject to the approval of the Min-ister.

34. Application for services shall be Made on theprinted form procurable at the local Water SupplyOffice, and shall be lodged not less than one week beforethe service is required.

35. Applications will not be entertained unless fullinformation, as indicated on the printed form, is sup-plied, and the full amount of rates due on the premisesto which a service is required is paid.

36. The Board may, by notice to a consumer, fromtime to time restrict the quantity of water that may besupplied to him in any one week.

37. The Board may, from time to time, when neces-sary for the purpose of tapping or repairing the main,or otherwise, cut off. the supply of water from any partor parts of the Water Area. The Board shall havepower to regulate the time for the use of sprinklers.

38. It shall be at the discretion of the local officeras to whether or not a meter shall be affixed to any ser-vice, and such officer will also determine the size andclass of meter in each case.

39. Meters will be supplied by the Board, and may,in the discretion of the Board, be open or encased, andrent for same, if ruling, be payable in advance, on thefollowing scales:

40: The quantity registered by a meter at any timebetween ten days before and ten days after any stateddate may be taken as the reading of the meter at suchstated date, but in addition the Board may determine,on its merits, any dispute arising in regard to the read-ing of any meter.

41.. During the time any meter is undergoing repairs,or should it cease to properly register the consumptionof water, the Board may, at its option, estimate thequantity of water consumed by taking an average of thequantity used during the previous month or quarter, orduring the corresponding period of the previous year,and shall charge for the consumption so ascertained.

42. If the consumer shall at any time be dissatisfiedwith any particular reading of a meter, and shall be de-

sirous of having same tested, he shall give writtennotice thereof to the local officer within seven days ofsuch reading, and thereupon the said meter shall betested by passing through it a predetermined quantityof water, and, if upon such testing, it shall appear tothe satisfaction of the local officer that the said meterregistered above five per cent. more than was actuallypassed through it at such testing, then the said Boardwill hear the expense of and incidental of such testing,and will also adjust the charge to the said consumer;but if the said meter upon such testing shall notregister five per cent. more than the quantity that shallactually have passed through it, then the said consumershall pay to the said Board all the expenses of and in-cidental to such testing; provided that the amount re-presenting the expense of each and every test shall befixed by the Board, and shall in no case exceed the sumof forty shillings: Provided, also, that the said con-sumer shall not be at liberty to avail himself of theright to test the registration of the said meter for anyperiod other than three months next preceding the dateof reading in respect of which he shall have given noticeas aforesaid: Provided further, that for testing metersof sizes in. and under, a uniform fee of 10s. shall becharged.

43. No person shall break or in any way interferewith the seal fixed on a meter through which water issupplied by the Board, or turn or attempt to turn any,screw, bolt, or nut on or attached to such meter, or useany tool or appliance on any such meter, or introduce orattempt to introduce any body or substance into suchmeter, or in any way interfere with any portion of suchmeter or of ally pipes or fittings attached thereto.

44. No licensed plumber, or holder of an operativeplumber's certificate, or other person shall under anycircumstances disconnect the flange from a meter, orshall, after a meter has once been fixed on a service andwater has been turned on, disconnect or interfere withany [Aping within twelve feet of such meter. Suchwork shall be done by the servants of the Board only.

45. Any person supplied with water through a meterbelonging to the Board shall pay the cost of makingBrood all .lamages to such meter whilst on his land andin his charge, and shall deliver such meter up in goodorder on ceasing to hire same. Any repairs requiredshall be done by the officers of the Board, and the ex-rens,e ineurred by the Board in so doing shall, on de-mand, be paid by the owner or occupier of the land,and if not paid on demand, shall be recoverable in thesame manner as water rates.

40. Any person supplied by the Board with waterthrough a meter shall, on finding that meter is damagedor not registering, immediately give notice of the factto the local Water Supply Office.

47. No person knowing that a meter is damaged ordoes not register properly shall draw water throughsuch meter from a service pipe which is supplied withwater by the Board.

48. In every case in which the supply of water shallhave been cut off by reason of non-payment of rates orother charges, or by reason of a defective service, or byrequest of the occupier or owner, or when, in the opin-ion of the 'Hoard or local officer, necessary to preventwaste of water, or for other reason, a fee of five shil-lings shall be charged for re-connection, and shall bepayable by the owner or occupier for the time being ondemand. The service shall not be restored until suchfee shall have been paid.

49. No person to whom water is supplied by theBoard shall, without written permission, sell or supplywater to any person who may not reside on the premisesof which lie is the occupier.

50. The occupier of any premises to which the waterhas been laid on, or in the event of there being no oc-cupier, the owner shall cause proper means to be takenby locks or otherWise, subject to the approval of thelocal officer, to prevent the use of water from the mainby persons not connected with the premises supplied.

51. The owner or occupier of any allotment of landwithin the -Water Area who shall erect or make, or causeto be erected or made, any building or addition to anexisting building on such land shall, within one calendarmouth thereafter, give notice in writing thereof to theBoard.

52. Officers or workmen employed by the Board shallnot solicit or receive fro mthe public any fee, gratuity,or reward.

53. No person shall use or distribute water on gar-dens or premises generally fronr a tap, piping or hosewithout the medium of a sprinkler or hose attachment.

5.Penalties.54. Any person contravening any of these By-laws,

whether by act or omission, shall be liable on summaryconviction to a penalty not exceeding Twenty pounds.

No junior worker shall be employed as sawyer or tailer-out on the breaking-downor planking-out benches.

No junior worker with less than one year 's experience in the industry shall be em-ployed tailing out.

No junior worker who is under the age of seventeen years and who has had lessthan two years' experience in the industry shall be employed as a sawyer, or on thebuzzer or thicknesser.

The number of junior workers employed by any employer shall not exceed one foreach fully paid worker employed by him. Provided that any employer who himselfworks as a journeyman shall be reckoned as a fully paid worker.

For the purpose of determining from time to time whether a junior worker maybe taken on or continued in employment the following provision shall have effect: Thecalendar year shall be divided into quarters and the first days of January, April, July,and October shall be the quarter days. The average number of fully paid workers em-ployed by an employer on all working clays of the six months immediately precedingany quarter day shall, for the purposes of this subclau.se, be taken as and be deemed tobe the number of fully paid workers employed on such quarter day, and the number ofjunior workers who may be taken on or continued in employment by an employer at anytime shall be based upon the number of fully paid workers so deenied to be employedby such employer on the then last preceding quarter day. Fully paid workers shallmean time workers who are receiving not less than the minimum wage, and pieceworkerswho are earning for a full day 's work not less than the minimum wage for the claSs ofwork which they are doing.

4. Hours,The ordinary week's work shall consist of forty-eight hours, whichshall be so arranged as to permit of work ceasing ,at noon on Saturday.

5. Casual Hands. A casual hand shall be paid at least one shilling per day inexcess of the minimum rate fixed for his class of work.

G. Overtime.Time worked beyond the usual hours shall be paid at the rate oftime and a-quarter for the first two hours and time and a-half thereafter. Each- dayshall stand by itself.

7. Holidays. Double rates shall be paid for work performed on Sunday, NewYear 's Day, Good Friday, Easter Monday, Eight Hours' Day, and Christmas Day, andtime and a -half for work performed on Anniversary. Day, Easter Saturday, King'sBirthday; and Boxing Day.

Under-rate Workers.Any worker who by reason of old age or infirmity isunable to earn the minimum wage may be paid such lesser wage as may from time totime be agreed upon in writing between the union and the employer, and in default ofsuch a,reement within twenty-four hours after such worker shall have applied in writing,to the secretary of the union stating his desire that such wage should be agreed upon,such wages as shall be fixed by the most convenient resident or police magistrate uponthe application of such worker after twenty-four hours' notice in writing shall havebeen given by him to the said secretary, who shall, if he so desires, be heard by themagistrate upon such application. After having given notice to the secretary, and afterlodging the application mentioned, and pending the magistrate's decision thereon, theworker shalt be entitled to work for and be employed at the proposed lesser rate. Thedetermination of the magistrate shall have effect for the period of six calendar months .

from the date thereof and after the expiration of the said period until the wage shallhave been again fixed at the instance of the said secretary in the manner prescribed.

The secretary of the union may by writing under his hand appoint an agent or substituteto represent the union at the hearing' of the application before the magistrate.

9. PiecewOrlo. (a) In the case of piecework the rates paid shall be such as toenable the average adffit worker to earn not less than the minimum wage fixed for a timeworker working at similar work under like conditions.

(b) The employer shall supply to each worker employed on piecework before thework is put in hand a docket containing the particulars of and rate to be paid for suchwork.

(c) All piecework shall be done at the employer 's factory and shall be limited tothe hours during which time workers are working in the factory.

.10. Record Book.Each employer shall keep a record of the time worked by andthe wages paid to each worker, including overtime. Such record shall be available atleast once per week, during working hours, to the secretary or other person appointedby the union.

11. Area.This award shall operate over the area comprised within a radius offourteen miles from the General Post Office, Perth.

12. TermThis award shall continue in force for a period of three years fromits date. Provided that at any time after the expiration of twelve months from itsdate the Court may alter or amend the same on the application of any party or personaffected by its provisions.

heels, trotters, and heads."Beef lumper" means a worker who is engaged to lump beef at the slaughter

yards, but who may also be required to do other work.2. flours.The ordinary week's work shall be:For Slaughterman and. Slaughterman's Labourer. Forty -four hours, viz., eight and

a-half hours per day on Monday, Tuesday, Wednesday, and Friday, and ten hours onThursday.

The ordinary starting time shall be eight o 'clock a.m., and one hour shall beallowed for dinner, but the employer may fix any other time not later than 10 a.m., asthe starting time upon any day or days between the first day of November and thethirty-first day of March. Provided that in each such case he shall notify the yardforeman thereof on the preceding day, and, provided also that in no case shall thefinishing time be later than 7 p.m., and if the prescribed hours of work in any day arethereby curtailed the required tally for that day shall be proportionately reduced.

For Tallowmen and Scalders.Forty-four hours, viz., eight hours per day on fiveweek-days and four hours on Saturday. The starting time, not being later than 9 a.m.,shall be, fixed by the employer. One hour shall be allowed for dinner.

For Beef Lumpers.Forty-four hours, viz., eight and a-half hours per day onMonday, Tuesday, Wednesday, and Friday, and ten hours on Thursday. The startingtime shall be fixed by the employer. One hour shall be allowed for dinner.

For General Labourers.Forty-four or forty-five hours, at the employer 's option,spread over the week as follows, viz., eight hours per day on five week-days and fourhours on Saturday, or nine hours per day on each week-day exclusive of Saturday. Thestarting time not being later than 9 a.m., shall be fixed by the employer. One hourshall be allowed for dinner.

Jew Cattle: To count two for one;Hams and Ram-stags: To count two for one.

All sheep penned for slaughter after the thirty-first of May, except those whichhave been shorn after the thirtieth of November next preceding, shall be deemed" woolly '' sheep.

In calculating the required tally for a period of more or less than eight and a-halfhours, any fraction of over one-half shall be counted as one, and any other fractionshall not be counted at all.

5. Variation in Tally.Slaughtermen who by reason of the employer not pro-Viding the necessary stock fail to 'kill the full day 's tally shall, nevertheless, be paidthe full day's wage.

All sheep killed in excess of the day 's tally shall be paid for at the rate of sixpenceeach, to be divided equally aniongSt the slaughtermen by whom the extra sheep are killed.

All bullocks killed in excess of the day's tally shall be paid for at the rate of threeshillings each, to be divided amongst all workers employed in the killing of such extrabullocks in proportion to their ordinary wage.

6. Crippled Stock.All stock required to be killed as part of the ordinary day 'stally shall be delivered to the slaughtermen in the pens. Crippled stock required to hekilled elsewhere, outside the ordinary day 's work, shall be paid for at the rate of twofor one.

7. Compulsory Killing on Saturday.Sleughternien employed on cattle ordered tobe killed by the Inspector on Saturday shall be paid for a full day's work at casualrates, irrespective of the number killed.

8. Casual Hands.Casual hands employed for more than three days in any weekshall be paid at ordinary rates, but not less than one full week's wage.

9. Slaughtermen doing other work.Slaughtermen shall not he required to lumpbeef, or clean up, or wash down. Provided that each employer shall be entitled to em-ploy one man at slaughterthan's wages to kill half-a-day's tally and do other work forthe rest of the day.

10. Overtime.Workers, other than those working on tally, who are called upon towork in excess of the hours specified shall be paid for such extra, work at the rate oftime and a-half.

11. Holidays.Workers shall be entitled to the following days as paid holidays,on which days no work shall be done, viz., Christmas Day, Boxing Day, New Year 'sDay, Good Friday, Easter Monday, Royal Show Day, Eight Hours' Day, and PicnicDay.

12. Time-Book.Each worker shall keep or cause to be kept a time-book con-taining a record of the names of all employees, the class of work performed, the wagespaid to each worker, and the number of hours worked by each worker. Such time -hookshall be kept at the slaughterhouse and shall be open for the inspection of the secretaryof the workers' union on any day during working hours.

13. Apprentices. Apprentices may be taken to the Slaughtering trade in the pro-portion of one apprentice to every four slough termen, or where less than four slaughter-men are employed, one apprentice to every two slaughtermen.

The term of apprenticeship shall be five years, with a probationary period of sixmonths.

2. The like particulars shall be posted in a conspicuous place in the faCtory.3. The rate shall he not less than the recognised piecework rate for similar

work; or4. If there be no recognised piecework rate the rate for the required output shall

be such as would enable the average adult worker to earn not less than theminimum wage fixed for a time worker working at work under likeconditions.

6. Apprentices. (a) An apprentice means a worker registered as an apprenticein manner hereinafter provided.

(b) Apprentices may be employed in any of the following branches of the trades'covered by this award, viz., (1) Cutter, (2) Presser, (3) Coat and Vest hand, and (4)Coat Machinist, in the trade of Men's and Boy's ready-made clothing- (outer gar-ments); (5) coat, bodice, blouse, and mantle hand; and (6) skirt hand, in the orderdressmaking trade, and Stock Cutter in the ready -made dressmaking trade.

(c) The term of apprenticeship shall he five years. A probationary period of threemonths previous to being bound shall be lawful, such probationary period to be countedas portion of the term in the event of the probationer becoming bound.

(d) Any employer hereafter taking an apprentice or probationer shall withinfourteen days thereafter register such apprentice or probationer by giving notice thereofto the clerk of the Court in the prescribed form: Provided that an apprentice or pro-bationer shall be deemed to be duly registered during the said period of fourteen days.

(e) The proportion of apprentices in the various branches of the trade to fully paidworkers employed in such branches, respectively, allowed to be taken by an employershall be as follows:

Stock Cutter (clothing or dressmaking) and presser, one apprentice to every twoor fraction of two (not being less than one) fully paid workers. Coat and vest handand coat machinist, one apprentice to each fully paid worker. Coat, bodice, blouse, andmantle hand, and skirt hand, two apprentices to each fully paid worker. Provided thatany junior workers employed in any of the above-mentioned branches by virtue ofClause S of this award shall for the purpose of applying this subclause be deemed to beapprentices.

(f) For the purpose of determining from time to time whether an apprentice pro-posed to be taken by an employer is within the number of apprentices allowed to suchemployer the following provisions shall have effect:

The calendar year shall be divided into quarters and the first days of January,April, July, and October shall be the quarter days. The average number of fully paidworkers employed by an employer on all working days of the six months immediatelypreceding any quarter day shall, for the purpose of this subclause, be taken as and bedeemed to be the number of fully paid workers who are employed on such quarter day,and the number of apprentices who may be taken on by an employer at any time shallbe based upon the number of fully paid workers so deemed to be employed by suchemployer on the then last preceding quarter day. Fully paid workers shall mean timeworkers who are receiving not less than the minimum wage and pieceworkers who areearning for a full day's work not less than the minimum wage for the class of work forwhich they are doing.

(g) Should any employer from unforeseen circumstances be unable to carry outhis obligations to his apprentice, he shall be allowed to transfer the .apprentice to com-plete his or her term with another employer, but it shall be incumbent upon such formeremployer to notify the clerk of the Court of Arbitration of the date of such transferand when such apprenticeship commenced.

(h) The following provisions shall apply in respect of all apprentices:(1) An employer shall be deemed to undertake the duty which he agrees to perform,

viz., teaching the apprentice the trade, as a duty enforceable under thisaward, and shall, subject to the provisions of Subelause (10), pay the ap-prentice the rate of wages herein provided.

(2) At the end of the period of apprenticeship the employer shall give the ap-prentice a certificate to show that lie or she has served his or her apprentice-ship. Should the employer at any time before the termination of the termof apprenticeship desire to dispense with the services of the apprentice hemay, with the consent of the apprentice, transfer him or her to another em-ployer carrying on business within a reasonable distance of the originalemployer's place of business, willing to continue to teach the apprentice andto pay the rate of wages prescribed by this award, according to the totallength of time served, and generally to perform the obligations of theoriginal employer. Ile shall also give to the apprentice a certificate of thetime served arfa of the rate of wages paid, and shall give notice to the clerkof the Court of Arbitration of such transfer in the form provided. It shallnot be obligatory upon the employer to find the apprentice another employerif he or she shall so misconduct himself or herself as to entitle the employerto discharge him or her, but he shall nevertheless give him or her a certificatefor the time actually served.

(3) An employer shall be deemed to fail in his duty towards his apprentice if hewilfully neglects to keep him or her constantly at work; but slackness ofwork may form a proper ground for transferring him or her to an employerwilling to undertake the responsibility of teaching him or her.

(4) When an apprentice is discharged for cause, the employer shall send notice, inwriting, of the discharge, and the cause thereof, to the said clerk of thecourt.

(5) The minimum wage payable to an apprentice shall be as follows:Male.

a. Board of Examiners hereinafter constituted once in each six months of.his or her service when called upon by the clerk of the Court so to do.

The clerk of the Court shall notify the Board of Examiners of the names andaddresses of all candidates required to submit themselves to examination.The examination will be held at the place where the apprentice is employed,or such other place as the Court may decide, and it shall be the duty of eachemployer to provide such necessary material and machinery as may be re-quired and in all ways facilitate the conduct of the examination.

(8) The examination will be held in the months of April and October in each year.The Board of Examiners mill consist of persons skilled in the particularclass of the trade to which the candidate is apprenticed, to be nominated bythe union and by the employers carrying on business within the area to whichthis award applies; or, failing such nomination, or nominations, such person,or persons, as may be appointed for that purpose by the Court. In the eventof :a disagreement between the examiners, the matter in dispute shall bereferred to a third person agreed to by them or nominated by the Court,or the President, at the request of either member, and the decision of suchthird person shall be final and conclusive. The examiners shall examine' thework of and inquire into the diligence of each apprentice, and as to theopportunities provided by the employer to each apprentice to learn.

(9) The examiners shall report to the Court, in writing, as to the result of theexamination.

(10) The clerk of the Court shall supply to each candidate a certificate shoWing theresult of the examination; and it shall be lawful for any employer to with-hold the increase in wages accruing, in accordance with the scale set forthin Subelause (5) hereof, from any apprentice who fails to satisfy theexaminers.

(11) If the examiners report to the Court that any employer has not providedsufficient opportunity for the apprentice to learn, the employer shall bedeemed prima facie guilty of a breach of thus award under Section :90 of theAct, and may be summoned before the Court. Upon any such proceedingthe report may be received in evidence.

(12) Such fees shall be paid by the clerk to the examiners as the Court shall allow.7. Junior Tokers.(a) "Junior worker" means a worker over the age of four-.

teen years and under the age of twenty-One years.(b) junior workers may be employed in those branches of the trades covered by

this award in which no provision is made for apprentices, but (except as provided byClause 8) not otherwise.

(c) Junior workers may not be employed by any employer in excess of one juniorworker for every fully paid worker employed by such employer in those branches ofthe trade. in which junior workers are allowed. For the purpose of this subelause thenumber of fully paid workers employed by an employer shall be ascertained as providedin Clause 6 (f) of this award.

(d) The minimum rate of wages payable to a junior worker shall be as follows:£ s. d.

If by virtue of this provision any junior workers continue to be employed in anyof those branches of the trade in which provision is Made for apprentices, they shall hepaid not less than the rates of pay fixed for apprentices.

9. Unde -rate Workers.----Any worker who by reason of old age or infirmity isunable to earn the minimum wage may be paid such lesser wage as may from time totime be agreed upon in writing betWeen the union and the employer, and in default ofsuch agreement within twenty-four hours after such worker shall have applied in writingto the secretary of the union stating his or her desire that such wage should be agreedupon, such wages as shall be fixed by the most convenient resident or police magistrateupon the application of such worker after twenty-four hourS' notice in writing shallhave been given by him or her to the 'said secretary, who shall, if he so desires, be heardby the magistrate upon such application. After having given notice to the secretary,and after lodging the application mentioned, and pending the magistrate's decisionthereon, the worker shall be entitled to work for and be employed at the proposed lesserrate. The determination of the magistrate shall have effect for the period of sixcalendar months from the date thereof, and after the expiration of the said period untilthe wage shall have been again fixed at the instance of the said, secretary in the mannerprescribed. The secretary of the union may by writing under his hand appoint anagent or substitute to represent the union at the hearing of the application before themagistrate.

10. Record Boole. A time and wage book shall be kept by each employer, in whichbook shall be entered the name of each worker paid by time the nature of the work heor she is doing, the hours worked each day, and the amount of wage received by himor her each week. The employer shall be responsible for the proper Posting of the bookeach week. The said book shall be open to the inspection of the secretary of the unionduring working hours.

11. Nothing in this award shall in itself operate to reduce the wages of any workerbelow the rate actually received by him at the date hereof.

12. Area.ThiS award shall apply over the area comprised within a radius of 25miles from the General Post Office, 'Perth.

13. Tenn.This award shall be binding upon the above-named applicant andrespondents, and shall continue.in force for a period of three years from its date: Pro-vided that, at any time after the expiration of twelve months from its date the Courtmay alter or amend the same on the application of any party or person affected by itsprovisions. .
