(he 2tates 3arties to this $onvention4

esiring to codify the rules of international la relating to the high seas4

,ecogni6ing that the United ations $onference on the &a of the 2ea4 held at eneva from 7 "eruary to 7 %pril 19584 adopted

the folloing provisions as generally declaratory of estalished principles of international la4

0ave agreed as follos:

ATIC!E 1(he term ;high seas; means all parts of the sea that are not included in the territorial sea or in the internal aters of a 2tate.

ATIC!E 2(he high seas eing open to all nations4 no 2tate may validly purport to su<ect any part of them to its sovereignty. "reedom of the

high seas is exercised under the conditions laid don y these articles and y the other rules of international la. #t comprises4 inter 

alia4 oth for coastal and non=coastal 2tates:

>1? "reedom of navigation@

>7? "reedom of fishing@

>A? "reedom to lay sumarine cales and pipelines@

>? "reedom to fly over the high seas.

(hese freedoms4 and others hich are recogni6ed y the general principles of international la4 shall e exercised y all 2tates ith

reasonale regard to the interests of other 2tates in their exercise of the freedom of the high seas.

ATIC!E #1. #n order to en<oy the freedom of the seas on eBual terms ith coastal 2tates4 2tates having no sea=coast should have free access

to the sea. (o this end 2tates situated eteen the sea and a 2tate having no sea=coast shall y common agreement ith the latter4

and in conformity ith existing international conventions4 accord:

>a? (o the 2tate having no sea=coast4 on a asis of reciprocity4 free transit through their territory@ and>? (o ships flying the flag of that 2tate treatment eBual to that accorded to their on ships4 or to the ships of any other 2tates4

as regards access to seaports and the use of such ports.

7. 2tates situated eteen the sea and a 2tate having no sea=coast shall settle4 y mutual agreement ith the latter4 and taCing into

account the rights of the coastal 2tate or 2tate of transit and the special conditions of the 2tate having no sea=coast4 all matters

relating to freedom of transit and eBual treatment in ports4 in case such 2tates are not already parties to existing international

conventions.

ATIC!E $)very 2tate4 hether coastal or not4 has the right to sail ships under its flag on the high seas.

ATIC!E 51. )ach 2tate shall fix the conditions for the grant of its nationality to ships4 for the registration of ships in its territory4 and for the right

to fly its flag. 2hips have the nationality of the 2tate hose flag they are entitled to fly. (here must exist a genuine linC eteen the

2tate and the ship@ in particular4 the 2tate must effectively exercise its <urisdiction and control in administrative4 technical and social

matters over ships flying its flag.

7. )ach 2tate shall issue to ships to hich it has granted the right to fly its flag documents to that effect.

ATIC!E %1. 2hips shall sail under the flag of one 2tate only and4 save in exceptional cases expressly provided for in international treaties or in

these articles4 shall e su<ect to its exclusive <urisdiction on the high seas. % ship may not change its flag during a voyage or hile

in a port of call4 save in the case of a real transfer of onership or change of registry.

7. % ship hich sails under the flags of to or more 2tates4 using them according to convenience4 may not claim any of the

nationalities in Buestion ith respect to any other 2tate4 and may e assimilated to a ship ithout nationality.

ATIC!E &(he provisions of the preceding articles do not pre<udice the Buestion of ships employed on the official service of an inter=

governmental organi6ation flying the flag of the organi6ation.

ATIC!E 81. -arships on the high seas have complete immunity from the <urisdiction of any 2tate other than the flag 2tate.

7. "or the purposes of these articles4 the term ;arship; means a ship elonging to the naval forces of a 2tate and earing the

external marCs distinguishing arships of its nationality4 under the command of an officer duly commissioned y the government and

hose name appears in the avy &ist4 and manned y a cre ho are under regular naval discipline.

ATIC!E 92hips oned or operated y a 2tate and used only on government noncommercial service shall4 on the high seas4 have complete

immunity from the <urisdiction of any 2tate other than the flag 2tate.

ATIC!E 1'1. )very 2tate shall taCe such measures for ships under its flag as are necessary to ensure safety at sea ith regard inter alia to:

>a? (he use of signals4 the maintenance of communications and the prevention of collisions@

>? (he manning of ships and laour conditions for cres taCing into account the applicale international laour instruments@

>c? (he construction4 eBuipment and seaorthiness of ships.

ATIC!E 111. #n the event of a collision or of any other incident of navigation concerning a ship on the high seas4 involving the penal or 

disciplinary responsiility of the master or of any other person in the service of the ship4 no penal or disciplinary proceedings may e

instituted against such persons except efore the <udicial or administrative authorities either of the flag 2tate or of the 2tate of hich

such person is a national.

7. #n disciplinary matters4 the 2tate hich has issued a masterDs certificate or a certificate of competence or licence shall alone ecompetent4 after due legal process4 to pronounce the ithdraal of such certificates4 even if the holder is not a national of the 2tate

hich issued them.

A. o arrest or detention of the ship4 even as a measure of investigation4 shall e ordered y any authorities other than those of the

flag 2tate.

ATIC!E 121. )very 2tate shall reBuire the master of a ship sailing under its flag4 in so far as he can do so ithout serious danger to the ship4

the cre or the passengers4

>a? (o render assistance to any person found at sea in danger of eing lost@

>? (o proceed ith all possile speed to the rescue of persons in distress if informed of their need of assistance4 in so far as

such action may reasonaly e expected of him@

>c? %fter a collision4 to render assistance to the other ship4 her cre and her passengers and4 here possile4 to inform the

other ship of the name of his on ship4 her port of registry and the nearest port at hich she ill call.

7. )very coastal 2tate shall promote the estalishment and maintenance of an adeBuate and effective search and rescue service

regarding safety on and over the sea and==here circumstances so reBuire==y ay of mutual regional arrangements co=operateith neighouring 2tates for this purpose.

ATIC!E 1#)very 2tate shall adopt effective measures to prevent and punish the transport of slaves in ships authori6ed to fly its flag4 and to

prevent the unlaful use of its flag for that purpose. %ny slave taCing refuge on oard any ship4 hatever its flag4 shall ipso facto e

free.

ATIC!E 1$ %ll 2tates shall co=operate to the fullest possile extent in the repression of piracy on the high seas or in any other place outside the

 <urisdiction of any 2tate.

ATIC!E 153iracy consists of any of the folloing acts:

>1? %ny illegal acts of violence4 detention or any act of depredation4 committed for private ends y the cre or the passengers of a

private ship or a private aircraft4 and directed:

>a? !n the high seas4 against another ship or aircraft4 or against persons or property on oard such ship or aircraft@

>? %gainst a ship4 aircraft4 persons or property in a place outside the <urisdiction of any 2tate@>7? %ny act of voluntary participation in the operation of a ship or of an aircraft ith Cnoledge of facts maCing it a pirate ship or 

aircraft@

>A? %ny act of inciting or of intentionally facilitating an act descried in su=paragraph 1 or su=paragraph 7 of this article.

ATIC!E 1%(he acts of piracy4 as defined in article 154 committed y a arship4 government ship or government aircraft hose cre has

mutinied and taCen control of the ship or aircraft are assimilated to acts committed y a private ship.

ATIC!E 1& % ship or aircraft is considered a pirate ship or aircraft if it is intended y the persons in dominant control to e used for the purpose

of committing one of the acts referred to in article 15. (he same applies if the ship or aircraft has een used to commit any such act4

so long as it remains under the control of the persons guilty of that act.

ATIC!E 18 % ship or aircraft may retain its nationality although it has ecome a pirate ship or aircraft. (he retention or loss of nationality is

determined y the la of the 2tate from hich such nationality as derived.

ATIC!E 19!n the high seas4 or in any other place outside the <urisdiction of any 2tate4 every 2tate may sei6e a pirate ship or aircraft4 or a ship

taCen y piracy and under the control of pirates4 and arrest the persons and sei6e the property on oard. (he courts of the 2tate

hich carried out the sei6ure may decide upon the penalties to e imposed4 and may also determine the action to e taCen ith

regard to the ships4 aircraft or property4 su<ect to the rights of third parties acting in good faith.

ATIC!E 2'-here the sei6ure of a ship or aircraft on suspicion of piracy has een effected ithout adeBuate grounds4 the 2tate maCing the

sei6ure shall e liale to the 2tate the nationality of hich is possessed y the ship or aircraft4 for any loss or damage caused y the

sei6ure.

ATIC!E 21 % sei6ure on account of piracy may only e carried out y arships or military aircraft4 or other ships or aircraft on government

service authori6ed to that effect.

ATIC!E 221. )xcept here acts of interference derive from poers conferred y treaty4 a arship hich encounters a foreign merchant ship on

the high seas is not <ustified in oarding her unless there is reasonale ground for suspecting:

>a? (hat the ship is engaged in piracy@ or 

>? (hat the ship is engaged in the slave trade@ or 

>c? (hat though flying a foreign flag or refusing to sho its flag4 the ship is4 in reality4 of the same nationality as the arship.

7. #n the cases provided for in su=paragraphs >a?4 >? and >c? aove4 the arship may proceed to verify the shipDs right to fly its flag.

(o this end4 it may send a oat under the command of an officer to the suspected ship. #f suspicion remains after the documents

have een checCed4 it may proceed to a further examination on oard the ship4 hich must e carried out ith all possile

consideration.

A. #f the suspicions prove to e unfounded4 and provided that the ship oarded has not committed any act <ustifying them4 it shall e

compensated for any loss or damage that may have een sustained.

ATIC!E 2#1. (he hot pursuit of a foreign ship may e undertaCen hen the competent authorities of the coastal 2tate have good reason to

elieve that the ship has violated the las and regulations of that 2tate. 2uch pursuit must e commenced hen the foreign ship or 

one of its oats is ithin the internal aters or the territorial sea or the contiguous 6one of the pursuing 2tate4 and may only e

continued outside the territorial sea or the contiguous 6one if the pursuit has not een interrupted. #t is not necessary that4 at the

time hen the foreign ship ithin the territorial sea or the contiguous 6one receives the order to stop4 the ship giving the order 

should liCeise e ithin the territorial sea or the contiguous 6one. #f the foreign ship is ithin a contiguous 6one4 as defined inarticle 7 of the $onvention on the (erritorial 2ea and the $ontiguous Eone4 the pursuit may only e undertaCen if there has een a

violation of the rights for the protection of hich the 6one as estalished.

7. (he right of hot pursuit ceases as soon as the ship pursued enters the territorial sea of its on country or of a third 2tate.

A. 0ot pursuit is not deemed to have egun unless the pursuing ship has satisfied itself y such practicale means as may e

availale that the ship pursued or one of its oats or other craft orCing as a team and using the ship pursued as a mother ship are

ithin the limits of the territorial sea4 or as the case may e ithin the contiguous 6one. (he pursuit may only e commenced after a

visual or auditory signal to stop has een given at a distance hich enales it to e seen or heard y the foreign ship.

. (he right of hot pursuit may e exercised only y arships or military aircraft4 or other ships or aircraft on government service

specially authori6ed to that effect.

5. -here hot pursuit is effected y an aircraft:

>a? (he provisions of paragraph 1 to A of this article shall apply mutatis mutandis@

>? (he aircraft giving the order to stop must itself actively pursue the ship until a ship or aircraft of the coastal 2tate4

summoned y the aircraft4 arrives to taCe over the pursuit4 unless the aircraft is itself ale to arrest the ship. #t does not suffice

to <ustify an arrest on the high seas that the ship as merely sighted y the aircraft as an offender or suspected offender4 if it

as not oth ordered to stop and pursued y the aircraft itself or other aircraft or ships hich continue the pursuit ithout

interruption.

F. (he release of a ship arrested ithin the <urisdiction of a 2tate and escorted to a port of that 2tate for the purposes of an enBuiry

efore the competent authorities may not e claimed solely on the ground that the ship4 in the course of its voyage4 as escorted

across a portion of the high seas4 if the circumstances rendered this necessary.

. -here a ship has een stopped or arrested on the high seas in circumstances hich do not <ustify the exercise of the right of hot

pursuit4 it shall e compensated for any loss or damage that may have een therey sustained.

ATIC!E 2$)very 2tate shall dra up regulations to prevent pollution of the seas y the discharge of oil from ships or pipelines or resulting from

the exploitation and exploration of the seaed and its susoil4 taCing account of existing treaty provisions on the su<ect.

ATIC!E 251. )very 2tate shall taCe measures to prevent pollution of the seas from the dumping of radio=active aste4 taCing into account any

standards and regulations hich may e formulated y the competent international organi6ations.

7. %ll 2tates shall co=operate ith the competent international organi6ations in taCing measures for the prevention of pollution of theseas or air space aove4 resulting from any activities ith radio=active materials or other harmful agents.

ATIC!E 2%1. %ll 2tates shall e entitled to lay sumarine cales and pipelines on the ed of the high seas.

7. 2u<ect to its right to taCe reasonale measures for the exploration of the continental shelf and the exploitation of its natural

resources4 the coastal 2tate may not impede the laying or maintenance of such cales or pipelines.

A. -hen laying such cales or pipelines the 2tate in Buestion shall pay due regard to cales or pipelines already in position on the

seaed. #n particular4 possiilities of repairing existing cales or pipelines shall not e pre<udiced.

ATIC!E 2&)very 2tate shall taCe the necessary legislative measures to provide that the reaCing or in<ury y a ship flying its flag or y a person

su<ect to its <urisdiction of a sumarine cale eneath the high seas done illfully or through culpale negligence4 in such a manner 

as to e liale to interrupt or ostruct telegraphic or telephonic communications4 and similarly the reaCing or in<ury of a sumarine

pipeline or high=voltage poer cale shall e a punishale offence. (his provision shall not apply to any reaC or in<ury caused y

persons ho acted merely ith the legitimate o<ect of saving their lives or their ships4 after having taCen all necessary precautions

to avoid such reaC or in<ury.

ATIC!E 28)very 2tate shall taCe the necessary legislative measures to provide that4 if persons su<ect to its <urisdiction ho are the oners of 

a cale or pipeline eneath the high seas4 in laying or repairing that cale or pipeline4 cause a reaC in or in<ury to another cale or 

pipeline4 they shall ear the cost of the repairs.

ATIC!E 29)very 2tate shall taCe the necessary legislative measures to ensure that the oners of ships ho can prove that they have

sacrificed an anchor4 a net or any other fishing gear4 in order to avoid in<uring a sumarine cale or pipeline4 shall e indemnified y

the oner of the cale or pipeline4 provided that the oner of the ship has taCen all reasonale precautionary measures eforehand.

ATIC!E #'(he provisions of this $onvention shall not affect conventions or other international agreements already in force4 as eteen 2tates

3arties to them.

ATIC!E #1(his $onvention shall4 until A1 !ctoer 19584 e open for signature y all 2tates Gemers of the United ations or of any of the

speciali6ed agencies4 and y any other 2tate invited y the eneral %ssemly of the United ations to ecome a 3arty to the

$onvention.

ATIC!E #2(his $onvention is su<ect to ratification. (he instruments of ratification shall e deposited ith the 2ecretary=eneral of the United

ations.

ATIC!E ##(his $onvention shall e open for accession y any 2tates elonging to any of the categories mentioned in article A1. (he

instruments of accession shall e deposited ith the 2ecretary=eneral of the United ations.

ATIC!E #$1. (his $onvention shall come into force on the thirtieth day folloing the date of deposit of the tenty=second instrument of 

ratification or accession ith the 2ecretary=eneral of the United ations.

7. "or each 2tate ratifying or acceding to the $onvention after the deposit of the tenty=second instrument of ratification or 

accession4 the $onvention shall enter into force on the thirtieth day after deposit y such 2tate of its instrument of ratification or 

accession.

ATIC!E #51. %fter the expiration of a period of five years from the date on hich this $onvention shall enter into force4 a reBuest for the

revision of this $onvention may e made at any time y any $ontracting 3arty y means of a notification in riting addressed to the

2ecretary=eneral of the United ations.

7. (he eneral %ssemly of the United ations shall decide upon the steps4 if any4 to e taCen in respect of such reBuest.

ATIC!E #%(he 2ecretary=eneral of the United ations shall inform all 2tates Gemers of the United ations and the other 2tates referred to

in article A1:

>a? !f signatures to this $onvention and of the deposit of instruments of ratification or accession4 in accordance ith articles A14 A7

and AA@

>? !f the date on hich this $onvention ill come into force4 in accordance ith article A@
