RECOMMENDATIONS Toronto Building Division recommends that: 1. The applications to demolish the buildings at 1677 and 1681 Weston Road be approved pursuant to By-law 3102-95 of the former City of York without the owner entering into a beautification agreement with the City or, 2. SUMMARY

On September 17, 2012, Toronto Building received two demolition permit applications to demolish an existing one and a half storey vacant residential dwelling at 1677 Weston Road, and two existing vacant structures at 1681 Weston Road. Toronto Building has not received any building permit applications to replace the buildings to be demolished as of this date.

RECOMMENDATIONS

Toronto Building Division recommends that:

3. City Planning Division Staff be authorized to prepare the agreement in consultation with the Ward Councillor and the owner and,

4. The appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Financial Impact The recommendations in this report have no financial impact.

DECISION HISTORY

Under the City of York Act 1994 (Bill PR147), By-law No. 3102-95 was passed designating the entire area of the former City of York as an area of demolition control. The City of York Act, 1994, provides the authority for Council in the former City of York area to enact special demolition control legislation for the purpose of securing beautification measures on the lands and abutting municipal boulevards, where appropriate, as a condition of the issuance of demolition permits. The legislation and By-law are still in force and effect.

ISSUE BACKGROUND

Proposal Two demolition permit applications have been received to demolish 3 vacant buildings on lands owned by Sedona Development Group Inc., municipally know as 1677 and 1681 Weston Road. The sites have a combined area of 0.42 acres (1,700 sq. m)

Phase I and Phase II Environmental Site Evaluation for these properties prepared by Bruce A. Brown Associates Limited was reviewed by Healthy Environments, Toronto Public Health. Toronto Public Health staff advised Toronto Building that it has no objection to the issuance of the two demolition permits. Public Health issued a letter to the owners outlining the recommendations to be followed before and during the demolition work.

Site and Surrounding Area The subject properties are located on the southeast corner of Weston Road and Victoria Avenue East south of Lawrence Avenue West. The site is within a residential area. 1677 Weston Rd is a vacant detached residential one and a half-storey dwelling constructed in the 1920s.

The 1681 Weston Rd property was developed with two structures. A two-storey commercial building that was formerly operated as a butcher shop, and a metal clad work shop to the rear of the property. Most recently the shop was used for automotive repairs and painting.

The surrounding properties are primarily residential. The CNR/CPR rail right-of-way is located less than 100 m to the east and the Humber River is located about 350 m to the west.

Official Plan The lands are designated Apartment Neighbourhood by Toronto Official Plan, Map 14.

Zoning The entire site is zoned RM2 - Residential Multiple Zone.

Site Plan Control The applicant has indicated that demolition is required in preparation for a proposed redevelopment on site. Sedona Development Group Inc., the owners of the above properties made an application for a site plan. The proposal is to construct 11 townhouse units. The application is still under review.

COMMENTS Planning further advises that the applicant needs to apply to Committee of Adjustments for variances as well the land need to be severed to allow for the 11 freehold townhouses.

Approval of the demolition permit applications is recommended with either of the 2 options below:

1. The applications to demolish the buildings at 1677 and 1681 Weston Road be approved pursuant to By-law 3102-95 of the former City of York without the owner entering into a beautification agreement with the City or,

2. The applications to demolish the buildings at 1677 and 1681 Weston Road be approved pursuant to By-law 3102-95 of the former City of York subject to the owner entering into a beautification agreement with the City containing a beautification plan to the satisfaction of the City Solicitor and the agreement be registered on title to the lands.
