Justice though may havegot delayed but finally pre-vailed. Today after 24 yearsof filing of the charge-sheetby the crime branch jammuin then popularly called Ex-cise scam 1995- 96 , foundthe accused primafacieguilty of the commission ofoffences of cheating andforgery which then causedloss of around three crore tothe govt. The order was an-nounced today by Addl.Sessions Judge jammu MrTahir Khurshid Raina onvirtual mode. However,charge will now be framedagainst the accused on nextdate, provided the physicalhearing in the courts willstart .

A scam in the Excise de-partment jammu surfacedin the year 1995 -96 thenpopularly called Excisescam which causedaround three crores loss tothe government exchequer. The scam related to pay-ment of contract bid ofcountry liquor vends whichwas then alloted by the gov-ernment to Messers kuldipsingh and Co, for supply ofcountry liquor vends to sixdifferent groups in jammuprovince. The contract bidamount fixed to be given bythe said firm to the Excisedepartment was13,23,00,000(thirteen crore, twenty three lakh) whichwas to be paid by the firmin 24 fortnight instalmentsin a year started from firstApril 1995 to 31st March1996 . The bid money was tobe deposited in banks andtreasuries and thereaftertheir receipts and voucherswere to be presented beforeExcise office jammu to getpermit of equal quantity ofliquor to be purchased fromware House on still headprice . And a bulk of morethan 17,000 ltr liquor wasalloted to the firm againstthe above quoted bidmoney.

However, at the end of fi-nancial year , the DC Excisejammu made a verificationof the bid amount paid bythe firm. During verifica-

tion he found some receiptsand vouchers doubtful. Hesent them to concernedtreasury and banks. And onverification it was foundthat there is a huge varia-tion in the amount paid bythe firm there and that ofshown in those vouchersand receipts presented toExcise office with a requisi-tion memo for grant of per-mit for purchasing liquor .For instance they depositedone lakh in the bank, but onthe voucher got from thebank added on more zero tomade it ten lakh. This ille-gal practice continuedthrough out the year andthis is how they causedaround three crore loss tothe Excise departmentjammu.

On surfacing of this fraudcommitted by the accusedfirm , a complaint got filedby the then deputy commis-sioner Excise jammu J.S.Modi to the crime branchjammu . On receiving of thecomplaint F.I.R number 8/1996 got lodged againstthe firm for commission ofvarious offences u/sec's-409, 420, 467, 468, 471,477-A , 120-B RPC .

Finally on the basis of in-vestigation done by thecrime branch jammucharge sheet filed against 16accused persons for com-mission of said offences .The accused includes -Hansraj Mangotra rtd IASofficer , Manoj mangotras/o Hansraj mangotra ,Amardeep sharma s/oManmohan sharma, Kuldipsingh s/o Sarak dev singhjamwal , Rashpal singh s/oGian singh (Dead)Rameshwar singh s/o Giansingh , Ripu Daman sharmas/o Manmohansharma ,Ashok Agarwal s/o Shadi lal(Dead) , Sudershan singhjamwal s/o Narinder singh ,Thakur shiv Ram s/oRangu Ram(Dead), Mool-raj s/o Amar nath (Dead) ,Sunil Masih Matto s/oSafiq Masih Matto,Surinder singh S/o Balwantsingh ( Dead) , Narindersharma s/o Isher dass ,Sardari lal s/o Isher days(Dead) , Randhir singh s/o

investigation that accusedpartners in connivance witheachother and some offi-cials of Excise departmenthas committed the crime offorgery and cheatingwhereby they have causedloss to the department.Even when the investiga-tion was in progress, the ac-cused deposited backaround 90 lakh of the totalloss, but that didn't con-done the offence commit-ted, rather established theculpability of the accused.

During the pendency ofthis charge sheet in the ses-sions court jammu, Ac-cused Kuldip singh filed bailapplication in the highcourt jammu in the year1996 . Same was rejected.However, high court di-rected vigilance organisa-tion to look into the role ofcomplainant J S Modi whowas then DC Excise jammu,and other officials of the Ex-cise department to ascer-tain whether they were part

of the crime or it got com-mitted on account of theirnegligence. After sometime Accused kuldeep singhagain filed bail application.HC called the report fromVO. Same was filed. On thebasis of said report HC di-rected VO to register thecase and make fresh investi-gation . On account of thisdirection to VO , the HCstayed the proceedings infirst chargesheet pending inthe court of sessions Judgejammu. Now second F .I . R- 34/ 1997 got registered byVO and investigation en-sued afresh in the case . Fi-nally chargeshheet was sub-mitted in the court ofspecial judge anticorrup-tion jammu in 1998 againstJ S Modi then D C excisejammu and other officials ofthe Excise departmentjammu along with all otheraccused who were earlierchargesheeted by crimebranch jammu for offencesunder prevention of corrup-tion Act and other offencesunder penal code .

Speaking on the occa-sion, the DGP appreciatedthe SSP Bandipora and histeam partners and mem-bers of the technical teamsfor conduct of the megaevent and managing itsmoothly and profession-ally for a month. He saidthat this event was one of itskind in which not only 228teams from Bandipora Dis-trict but also from other dis-tricts of Kashmir valley par-ticipated in different sportscompetitions. He said thatwitnessing the finals was atreat to eyes as the perfor-mances were of nationalstandards.

The DGP said that wit-nessing today’s Kabaddi fi-nals brought back the mem-

ories of times when he usedto take part and witnesssuch sports activities inschool and in his collegedays. He congratulated thewinner and runner upteams for putting up a greatshow and wished themgood luck for the future. Heappreciated all 228 teamswhich took part in Football,Volleyball, Cricket andKabaddi events and addedthat such events would con-stantly encourage the youthto take part in such positiveactivities.

The DGP said that whenteams are playing againsteach other, it not onlybrings team spirit and fair-play but also spreads posi-tivity all around. He saidthat positive energy creates

positive attraction andadded that we need to takethis energy to the next levelby engaging more youth insuch positive activities. Hesaid that Jammu and Kash-mir Police is always ready toguide and assist youth toexcel in different sports.

The DGP said thatJammu and Kashmir dur-ing the past over threedecades witnessed enoughof violence and destructionwith huge loss of life andproperty and added thatthis is the time when we allneed to make a collective ef-fort to ensure peace andhappiness here. He saidthat Jammu and Kashmir isknown for its scenic beautyand rich culture across theglobe and added that youth

Justice Rajnesh Oswal hasquashed the Public SafetyAct order passed by Dy,Commissioner Samba or-dering detention of S Har-bans Singh Asla.

The Court passed the or-der after hearing Mr. A.K.Sawhney Advocate for thepetitioner and Mr Aijaz LoneDy Advocate General for therespondents.

Mr Sawhney submittedbefore the Court that the peti-tioner has challenged thepublic safety order on vari-ous grounds and urged be-fore the court that nogrounds were furnished tothe detain the petitioner, nodocuments were suppliedwhich was the basis of de-tention.

Advocate Mr. A.K. Sawh-ney submitted that the im-pugned detained order thatthe impugned detention or-der was arbitrary , illegal anddoes not comply with the re-quirements of Public SafetyAct. Advocate Mr. A.K.Sawhney argued that NoPublic order was involved itwas misuse of the power bythe authorities.

Justice Rajnesh Oswal inhis significant judgment ob-served that a perusal of de-tention order reveals that

there is non-application ofmind on the part of the de-taining authority. In the or-der of detention there is nowhisper as to on which basisthe Respondent No. 2 hasderived his satisfaction thatit has become necessary todetain the petitioner. Even ifthe order of detention is readin conjunction with groundsof detention, it is evident thatthe grounds of detention arethe verbatim reproduction ofdossier prepared by Respon-dent No. 3. The detaining au-thority was required to applyits mind independently withregard to the material placedbefore it so as to derive satis-faction that it has becomenecessary to detain the peti-tioner. But the same hasbeen done in the instantcase. This too renders the de-tention order illegal.

The Court held “since theorder of detention is re-quired to be quashed onthese twin grounds only, sothere is no need to considerthe other grounds of chal-lenge. In view of the above,this petition is allowed. De-tention order No. 02/PSA of2020 dated 17.07.2020 isquashed. Petitioner be setfree from the preventive cus-tody provided he is not re-quired in any other case.”.JNF

SRINAGAR, OCTO-BER 28: Director SchoolEducation Kashmir Mo-hammad Younis Malik to-day resolved the long pend-ing issue between a privateschool Devki Arya Putri Pat-shala (DAPP) and parents ofchildren studying in the saidprivate school.

The Director said that theschool shall continue tofunction as it was function-ing in the past years and ifneed arises, the presentmanagement can be substi-tuted with a new manage-ment committee in order tostreamline the educationalscenario of the school.

Following pouring ofcomplaints regarding the is-

sue, Director School Educa-tion had called the schoolmanagement, staff of theschool and parents of chil-dren studying in the schoolto his office where he lis-tened to the grievances ofboth sides.

The Director said that theissue was resolved afterthreadbare discussion withthe management and theparents and it was furtherdecided that the depart-ment shall consider theopinion of the managementaccordingly.

He said it was also de-cided that the managementshall continue to operateboth academically as well asadministratively.
