5.1/ While examining the case files in terms of provisions contained in the

Jammu and Kashmir Daily Rated Workers/Work Charged Employees

6. Review cases. 6.1/ Cases of 46 left out DRWs which were deferred in previous meetings of the

Empowered Committee due to some deficiencies and re-submitted by the department were placed before the Empowered Committee. While examining the case files of these incumbents in terms of provisions contained in the Jammu and Kashmir Daily Rated Workers/Work Charged Employees (Regularization) Rules, 1994 notified vide SRO 64/ 1994 read witl1 Government

order No. 26-F of 1994 dated 31.01.1994, the Cr/Wmittee observed that in most .. · of the cases total breaks involved from date of engagement ranges more

than one year even up to five/ ten years or more either in one spell or

different spells and the department has attributed the same to paucity of

funds. The period of breaks shall not count for 7 years continuous

service. As regards break(s) prior to 01/94, seven continuous 3

service, wherever required, shall be computed from culmination of last

break. It has also been observed that a number of DRWs have neither

rendered service on cut off date i.e 01/94 nor the wages for the said month have been paid. The break which starts from a date earlier to 01/94 lasts ahead of 01/94 and breaks also occur even beyond the culmination of said break. In such cases, the Committtee observed and decided that seven years of service shall be reckoned by way of computing eighty four months as period of mandatory service required for regularization in terms of SRO 64 of 1994 subject to the condition

that payment of wages for this period is established with reference to records. Same principle has been decided to be applied in respect of such cases as well, wherein, even wages have been paid for 01/94 but the breaks exist even beyond the period of 01/94 on varying dates.

6.2/ The Committee cleared and approved creation of 39 posts of "Helper" in the pay scale of 2550-3200 (Pre-revised) for regularization of as much number of DRWs from the dates shown against each detailed in the below matrix.

6.3/ The above recommendations are further subject to following conditions:-

(i) The Department shall verify MRs of 9-10 months of the incumbents to establish genuineness of their claims.

(ii) Genuineness of engagement order/MRs is certified by the concerned HoD.

(iii) Continuous working from the date of initial engagement and payment of wages whether in cash or in kind quantity at notified rates shall be established/certified by the concerned HoD.

(iv) The department shall get breaks, if any, other than paucity of funds, condoned from the Competent Authority and the breaks subsequent to the date of regularization shall be seen and verified by the department and no arrears of salary shall be drawn for the period wages have not been paid.

(v) The incumbents are eligible for regularizaf and fulfill all conditions as laid down in SRO 64/1994.

(vi) The Department shall verify their date of birth and Permanent Residence Certificate, prior to issuance of regularization orders.

(vii) Relaxation of age/qualification, wherever required, shall be

considered by the Department with prior approval of the Competent Authority.

(viii) Regularization orders shall be issued by the concerned HOD after formal orders for creation of posts are issued by the Administrative

Department. (ix) The post shall cease to exist on death/ retirement/resignation/

termination of the incumbent or his/her adjustment against any hierarichical post.

(x) Arrears from date of regularization to the date of issue of regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the Department.

7.2/ The above recommendations are further subject to following conditions:-i. The Department shall verify MRs of 9-10 months of the

vii. Relaxation of age/ qualification, wherever required, shall be considered by the Department with prior approval of the Competent Authority.

viii. Regularization orders shall be issued by the concerned HOD after formal orders for creation of posts are issued by the Administrative Department.

ix. The post shall cease to exist on date/ retirement/resignation/ termination of the incumbent or his/her adjustment against any hierarichical post.

x. Arrears from date of regularization to the date of issue of

regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the

''In view of the submissions made by the learned counsel for the petitioner and nature of controversy involve~ the present writ petition as prayed for, is treated as representation on behalf of petitioner and is disposed of along with connected !As with a direction to the respondents to accord consideration to the claim of the petitioner as reflected in the writ petition within a period of six weeks from the date copy of this order is served to them. Needful to be done strictly in accordance with the law and rules governing the field. It is made clear that it should not be construed to mean that by passing this order, the court has expressed any opinion in the matter. "

9.2/ The Committee was informed that the incumbent was initially engaged as daily wager in Block Pulwama for a period of 89 days by the then BOO Pulwama, vide order dated 27.09.1991. Subsequently he was allowed to continue till further orders, vide order dated 26.12.1991. The department has certified that the petitioner has been engaged before ban and continuously performing his duties as DRW from the date of his initial engagement. The petitioner has not been paid wages for the period

12/91, 06/95, 07/95, 03/03 to 09/03, 07/04 to 03/06, 11/07 to 11/08, 01/09, 02/09, 10/09 to 02/10, 11/10 to 03/11, 12/11 to 02/12, 10/12 to 01/13 & 12/13 to 02/14.

9.3/ The Committee Considered the mandatory period of seven years from 01/92 and approved creation of one post of Helper in the pay scale of 2550-3200 (pre-revised) from 01.04.1999 for regularization of the petitioner subject to following conditions:-

i. The Department shall verify MRs of 9-10 months of the incumbent to establish genuineness of the claim.

ii. Genuineness of engagement order/MRS is certified by the concerned HoD.

iii. Continuous working from the date of initial engagement and payment of wages whether in cash or kind quantity at notified rates shall be established/certified by the concerned HoD.

iv. The department shall get breaks, if any, other than paucity of funds condoned from the Competent Authority and the breaks subsequent to the dateof regularization shall be seen and verified by the department and no arrears of salary shall be drawn for the

period wages have not been paid. v. The incumbent is eligible for regularization and fulfills all

conditions as laid down in SRO 64/1994. vi. The Department shall verify date of birth and Permanent

Residence Certificate, prior to issuance of regularization ders.

• vii. Relaxation of age/qualification, if required, shall be considered by

the Department with prior approval of the Competent Authority .

viii. Regularization order shall be issued by the concerned HOD after formal order for creation of post is issued by the Administrative Department.

ix. The post shall cease to exist on date/ retirement/resignation/ termination of the incumbent or his/her adjustment against any hierarichical post.

x. Arrears from date of regularization to the date of issue of regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the Department.

9.4/ SWP No. 3534/ 2010 titled Shamim Akhter Vs State & others:

Sh. Shamim Akhter has invoked judicial intervention, praying for regularization of his services in terms of SRO 64/1994. The writ petition has been disposed of by the Hon'ble High Court on 17.07.2017. The operative part of the judgement reads as under:-

" ........... Statement of learned Dy. AG is taken on record. In view of the statement of learned Dy. A~ the writ petition is disposed of by directing respondent No. 2 to consider the claim of the petitioner for regularization in the light of the position as noted above as well as rules and regulations applicable. In case, the petitioner is found fulfilling the requirement of rules and regulations for regularization, then in that eventuality, appropriate orders shall be passed regularizing the services of the petitioner w.e.f the date of his entitlement. Needful be done within a period of three months from the date of receipt of certified copy of this order. Writ petition disposed of with the aforementioned directions. 11

9.5/ The incumbent was initially engaged as casual labour in Block Kotranka Budhal from 01.09.1993. Subsequently he was engaged as DRW from 01.12.1993. The petitioner has been paid wages continuously except for the period 01/02 to 03/02, 04/09 to 12/09, 02/16 to 06/16.

9.6/ The Committee Considered the proposal and approved creation of one post of Helper in the pay scale of 2550-3200 (pre-revised) from 01.04.2001 for regularization of the petitioner subject to following conditions:-

i. The Department shall verify MRs of 9-10 months of the

v. The incumbent is eligible for regularization and fulfills all conditions as laid down in SRO 64/ 1994.

vi. Recovery of excess wages for the period 04/02 to 03/13, if any and the department shall furnish TV. No. & date of drawals made from 10/ 13 to 01/ 16 whereunder wages have been paid to the petitioner.

vii. The Department shall verify date of birth and Permanent Residence Certificate, prior to issuance of regularization orders.

viii. Relaxation of age/qualification, if required, shall be considered by the Department with prior approval of the Competent Authority.

ix. Regularization order shall be issued by the concerned HOD after formal order for creation of post is issued by the Administrative Department.

x. The post shall cease to exist on date/ retirement/ resignation/ termination of the incumbent or his/her adjustment against any hierarichical post.

xi. Arrears from date of regularization to the date of issue of regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the Department.

9.7/ SWP No. 1081/2002 titled Radhya Sham Vs State & others: Sh. Radhya Sham was engaged by BOO Udhampur vide order bearing No. 4266 dated 07.03.1994 and continued in the department up to 31.01.2001. On his disengagement, he filed SWP No. 698/2001 seeking regularization of his services. The Hon'ble High Court on 24.07.2001 disposed of the writ petition with direction to the respondents to consider the case of the petitioner for regularization of his service under the provisions of SRO 64 of 1994, provided that the petitioner has completed seven years of service as DRW un-interruptedly and continuously and further provided that the evidence annexed with the petition with regard to his engagement as DRW and his un-interrupted continuati by the record of the respondents.

• 9.8/ The department considered the case and rejected claim of the petitioner

for his regularization on the grounds of being engaged as casual labour vide order No. 414-DRD of 2001 dated 07.12.2001. The petitioner filed another writ petition and the Hon'ble High Court on 16.03.2016 has passed the following order in SWP No. 1081/2002:-

''a) That the petitioner has completed the requisite seven years of continuous service in-effect as a Daily Wager being entitled to regularization therefore, his case for regularization be finalized within four weeks.

b) Position of the petitioner, as to whether, he has been actually performing duties from the date of his disengagement i.e 31.03.2001 shall be worked out. In case, he has been working then whatever, wages due to him shall be paid to him and in case it is found that he was not discharging the duty effectively in view of the disengagement order, then for that period, 25% of wages shall be considered to be paid to him.

c) Rule is required to be framed against then Director, Rural Development, Jammu for having violated the judgement dated 24.07.2001, but taking a lenient view, same is deferred but in case of any fUtther default, framing of Rule will be indispensible.

Petition succeeds shall stand disposed of on afore said terms. "

9.9/ It has been stated that the petitioner has worked continuously from the date of his disengagement and wages whatever due stands paid to him from time to time.

9.10/ After thread-bare discussion the Committee was of the opinion that the petitioner has been engaged on 07.03.1994 and paid wages from 08.03.1994 i.e after ban imposed vide Government Order No. 26-F of 1994 dated 31.01.1994. The mandate of the Empowered Committee is to screen left out cases of DRWs engaged upto 31.01.1994 only. In view of the orders of the Hon'ble High Court, the department shall take further appropriate action in the matter at its level for implementation of orders of the Hon'ble Court.

10. Waive-off condition of condonation of breaks:

10.1/ Among others, Empowered Committee in its meeting held on 26.09.2016 approved creation of posts of Helper for regularization of below mentioned Daily Rated Workers subject to condition that the department shall obtain condonation of breaks for the periods shown therein against each from the Competent Authority. The department has recommended to waive-off the condition of condonation of breaks in favour of these DRWs s hey have been paid wages for the said period annexing wages statement:

10.2/ The Committee decided to agree the departmental proposal, provided the

other conditions as laid down in the minutes of meeting held on 26.09.2016 are fulfi lled. In respect of S. No. 10, date of regularization shall be considered 01.04.2001 subject to condition that department shall categorically certify that the incumbent has been paid wages continuously from 01/ 94 at the rates notified by the Government from

time to time.
