AUTHORITY-OWNED LAND 14 Pickering/Scarborough Townline – City of Toronto, Rouge River Watershed CFN 33517 ____________________________________________________________________________ KEY ISSUE Receipt of a request from Melissa Preston and Laura Alderson, Co-Executors of Joyce Scott’s Estate, (former tenant of TRCA) to consider the sale of a portion of Toronto and Region Conservation Authority-owned property located at 14 Pickering/Scarborough Townline, City of Toronto, Rouge River watershed. RECOMMENDATION THAT the potential disposal of a portion of Toronto and Region Conservation Authority (TRCA) owned property located at 14 Pickering/Scarborough Townline, City of Toronto, be referred to TRCA staff for review and discussion in accordance with established TRCA policies; AND FURTHER THAT a report be brought forward to the Executive Committee at a future date recommending further action. BACKGROUND This request is being brought to the attention of the Executive Committee in accordance with resolution #26, adopted by TRCA at Authority Meeting #1/91, held on February 22, 1991. Correspondence has been received from Melissa Preston and Laura Alderson requesting to purchase a fragment of TRCA-owned property located at 14 Pickering/Scarborough Townline, in the City of Toronto. A copy of the letter is included as Attachment 1. The subject TRCA-owned lands were transferred to TRCA by the Ontario Realty Corporation (ORC) in 2004 as part of the land holdings transferred for Rouge Park purposes. At the time of transfer the Province of Ontario retained an Option to Purchase/First Right of Refusal over all the lands transferred including the subject property. All leases that were in place at the time of the transfer were assumed by TRCA. The lease with the late Joyce Scott for 14 Pickering/Scarborough Townline was one of these leases. The subject TRCA-owned land is improved with a single family dwelling. It was reportedly built in 1835 with an addition constructed in 1958. The subject property is being well maintained and is in average to good condition. The interior finishes are dated and require upgrading. There are some exterior repairs required to the windows and stone work.

Item 8.1

On May 25, 2012, the federal government announced the proposed Rouge National Urban Park. The subject TRCA-owned property falls within the boundaries of the Park, and is included in the Memorandum of Agreement Respecting the Assembly of Lands for the Proposed Rouge National Urban Park. It is anticipated the transfer will occur later this year or early next year. In accordance with TRCA policy, this request for disposal will be circulate to TRCA technical staff as well as municipal staff for review and comment. Since the property is included in the Option to Purchase/First Right of Refusal with the Province and Memorandum of Agreement with Parks Canada, the Province and Parks Canada will also be circulated for review and comment. Staff will report to the Executive Committee on the comments received and make a recommendation to either retain the property or declare it surplus. The proponent will be advised of the results of the staff review at the time a report is prepared for the Executive Committee. The proponent will have the opportunity to make a delegation at the Executive Committee meeting when the matter is considered. A sketch illustrating the subject lands is attached as Attachment 2. July 4, 2017 Ms. Maria Augimeri, Chair Toronto and Region Conservation Authority 5 Shoreham Drive Downsview, ON M3N 1S4 Dear Ms. Augimeri; RE: Request to Repurchase 14 Pickering Townline in the Rouge Park, Scarborough, Ontario As the Co-Executors of our dear late mother’s estate (Joyce Anna Scott), we are writing to you as the Chair of the Toronto and Region Conservation Authority (TRCA) on behalf of our immediate family. In an attempt to restore equity, fairness and finally make right the past, we would like to have our family home at 14 Pickering Town Line returned to us, as is consistent with the provincial government’s promise to our parents. Our late father ( John Scott) purchased the land in April of 1958 (instrument no. 217540). In addition to a matrimonial interest, our mother was a mortgagee.15 years later, In February of 1973, our 10 acre family farm was expropriated by the Ministry of Housing to make way for the Pickering Airport and the North Pickering Community development project that would surround it, an ill-advised project that would never happen. In a pamphlet from the Ontario Government dropped in our mailbox were the terms under which the acquisition of our home by the provincial government would take place. It contained the following question/answer posed by the government on the last panel. “What if the government finds it doesn’t need my house after all? If such a decision is made – and this will occur, unquestionably in some instances, you will be offered the chance to recover ownership at the same price you were paid initially. In other words, you will have had the use of house and property rent-free through the time the government owned it.” (attach. “A”)

In that same month, the Honourable Claude F. Bennett wrote to our parents concerning our impending expropriation and although they were shaken, our parents were again somewhat reassured by what the Minister had to say in writing. “…wherever present residential uses are compatible with the plan for redevelopment which is scheduled for completion by the end of 1974, the owners will have an opportunity to repurchase them at the price originally paid for them by the province.” (attach. “B”)

More than a year later, in September of 1974, they received correspondence from G.M. Kaye, Acquisition Agent for the Ministry of Housing. The letter quotes a statement by the Honourable Sidney Handleman, then Minister of Housing, to the effect that occupancy of the expropriated lands until June 1975, would be possible by entering into a licensing agreement with the province. According to the letter, the licensing agreement would assure rent-free possession of properties until that date and would guarantee the right to buy back the residential portion of the properties at prices based upon that paid by the province, if they are compatible with the plan for North Pickering. (attach. “C”)

Without notification to the previous owners, our parents, and contrary to Section 42 of the Expropriations Act, the Ministry of Housing transferred the land to the Ontario Land Corporation in October of 1979 without giving us the opportunity to repurchase the land. More than a decade later on March 22nd, 1989 and long after plans for the Pickering Airport had been scrapped, our parents wrote to the Ministry of Government Services and expressed their sincere interest in buying back our heritage home since 1958, where they had raised their family. Incredulously, and fully sixteen years after their expropriation for a project that never happened, a reply was sent on April 6th, 1989 from the Ministry advising that while our parents had expressed interest in purchasing the property, they had not yet declared it surplus! “In the event that the expropriated lands are declared surplus, you will be notified.” (attach. “D”)

In spite of the contents of that letter, our parents were reassured by what we had been told in writing by the Ontario government and accepted in good faith that should our family farm not be used for the sole purpose of the expropriation , we would have the opportunity to repurchase our family farm that had been our home since 1958. Subsequently, without offering us the first right of refusal to repurchase our family farm, the Ontario Land Corporation sold our land to the Toronto and Region Conservation Authority in 2004, thereby breaking the government’s promise to advise us when the lands would be declared surplus. Although the TRCA has declared our property to be park land (part of the Rouge Park) and therefore part of the Greenbelt, the official park plan does indeed contemplate continuing residential use, therefore the TRCA cannot dispute that the re-conveyance of our family home IS consistent with that plan. Furthermore, as the TRCA is no doubt aware, environmental stewardship of the lands is enhanced rather than destroyed by private ownership, resulting in the reinvestment of both the lands and heritage buildings on the property. Although our mother was a model tenant and never complained, it has been the family’s experience that repairs to the property were promised but not completed in a timely manner. Therefore, we cannot help but wonder whether the TRCA, has perhaps been remiss in their duties as the steward of this heritage property, by allowing the remaining properties within the park, some of them designated heritage such as ours, fall into such disrepair as to permit “demolition through neglect.” Surely

this is not consistent with the Ontario Heritage Act? Given the many promises made to our family by the Ontario Government in writing, how is it possible that in June of 2017, fully forty-four years after we entered into what we thought were honest, fair and equitable dealings with the provincial government, we are still waiting to be advised whether our land will be used for the purpose of the original expropriation and failing that, returned to us? While not acquired through deception but with the best intentions of the government at that time, the property is nonetheless being held “in trust?” by a seemingly less than fair current policy. How can it be considered equitable to expropriate private land for a public project that never happens and then charge current market value rents effectively clawing back whatever payment or benefit may have resulted from the forced sale of the property? In our parent’s case, they have paid considerably more in rent over the years than they were originally paid for the property! Regardless of the governing party of this or any other day, how can this in any way be considered fair and equitable treatment of Ontarians that include vulnerable senior citizens? In view of the simple, but nonetheless important, fact that our parents have paid more in rent than they were compensated for during the initial expropriation proceedings, we are asking that the TRCA return our family farm to us at a fair price. Should the family wish to dispose of our rightful legacy at some future date, the stipulation for such a transfer could be that it is offered up for sale as a single family dwelling and that all 10 acres be considered as one parcel of land to protect the integrity of the home my parents lovingly referred to as “The Seasons”. In the spirit of fairness and to restore some semblance of integrity, transparency and accountability to the provincial government and now its agency, the TRCA, a family representative would very much like the opportunity to make a deputation at your next Executive Committee Meeting on Friday, July 14th. We look forward to hearing from you at your earliest convenience in order to satisfactorily resolve what has been for us a long outstanding and personally very difficult issue. MUNICIPAL CLASS ENVIRONMENTAL ASSESSMENT Award of Contract RFP#10001976

____________________________________________________________________________ KEY ISSUE Award of contract RFP#10001976 for professional hydraulic modelling and flood protection design consulting services, as part of the Eastern and Broadview Flood Protection Due Diligence and Municipal Class Environmental Assessment (EA). RECOMMENDATION THAT contract RFP#10001976 for professional hydraulic modelling and flood protection design services, as part of the Eastern and Broadview Flood Protection Due Diligence and Municipal Class EA, be awarded to AECOM at a total cost not to exceed $88,404.42 plus 50% contingency to address uncertainties associated with the number of parallel projects currently underway, plus HST, it being the highest ranked proposal for value meeting TRCA’s specifications; AND FURTHER THAT staff be authorized and directed to take all necessary actions to implement the foregoing, including the signing of documents. BACKGROUND At Toronto City Council Meeting #27, held on March 28, 2017, the Planning and Growth Management Committee Report PG18.6 was adopted, within which the Deputy City Manager, Cluster B, was directed to commence, together with the Toronto and Region Conservation Authority and TWRC, the Eastern and Broadview Flood Protection Municipal Class Environmental Assessment (Recommendation 4). At Authority Meeting #5/17, held on June 23, 2017, Resolution #A104/17 was approved, in part, as follows:

WHEREAS the City of Toronto and TWRC have requested that TRCA lead a Due Diligence and Class Environmental Assessment (EA) Study, which will be undertaken to identify a flood protection solution to remove the remaining flood risk to these 8 ha of urban land north of the elevated Metrolinx railway embankment; THEREFORE LET IT BE RESOLVED THAT TRCA enter into a Delivery Agreement with TWRC to undertake the Due Diligence and Class EA studies;

A Delivery Agreement between TRCA and the TWRC is currently under review between the two co-proponents, with an approved overall budget of $1.8 million. This includes hydraulic modelling and flood protection design consulting services in support of identifying a potential flood protection solution for the Eastern and Broadview Class EA. In support of the Class EA, TRCA requires a qualified hydraulic modelling and flood protection design consultant team to review and make refinements to the TRCA’s MIKE FLOOD hydraulic model; develop a HEC-RAS model to conduct an initial screening of alternative solutions including sensitivity analysis runs over a range of hydrological conditions; utilize the MIKE FLOOD model to complete detailed hydraulic analysis of the refined short-list of Alternatives; and provide design expertise related to alternative flood protection solutions under consideration. The scope of this work will start with an initial Due Diligence phase (Stage 1) which may dovetail into an expedited Class EA process (Stage 2) if the Port Lands Executive Steering Committee deems that viable solutions are identified during Stage 1 (from an impact and cost perspective). TRCA will lead a Project Management Team consisting of staff from TRCA, the City and Waterfront Toronto and the studies will be coordinated closely with the large number of initiatives that are currently underway in the Project Area. These include, but are not limited to, the Gardiner EA, Port Lands and South of Eastern Class EA, Metrolinx TPAPs, TTC Subway Relief Line planning, the Detailed Design of the Don River and Central Waterfront Project, and TRCA’s Don River Watershed Hydrological Modeling review. RATIONALE RFP#10001976 was released via Biddingo to all potential bidders on June 19th 2017, with a total of seven firms submitting proposals in advance of the 12:00 p.m. submission deadline on Friday July 14th 2017 (Table 1). All three members on the evaluation committee, consisting of staff from TRCA and Waterfront Toronto, received copies of the submitted proposals on July 14th, 2017. At the proposal evaluation meeting held on July 27th, 2017, consensus was reached between all members of the committee that the proposal submitted by AECOM offered the best service for the best value. The criteria used to evaluate the submissions and to select the successful consultant included the following:

Overall conformance of proposal submission package with terms of RFP;

Understanding of project scope of work;

Experience of firm working on projects of similar scope and budget;

Expertise of staff and appropriate allocation of resources;

Approach and methodology of work plan, including innovative ideas, identification of project limitations, and proposed solutions;

Clear and well thought out schedule and timelines to achieve project objectives; and

Detailed cost breakdown, including an itemized cost of additional works anticipated beyond the approved budget.

FINANCIAL DETAILS The creation of a sub-project within the Waterfront Revitalization Initiatives 2017-2026 Capital Budget and Plan has been recommended in order to cover the full cost of the Eastern and Broadview Flood Protection Municipal Class EA. Funding will be tracked through a series of 191-70 accounts. Given the large number of planning initiatives underway in the immediate area, and given the Don River Watershed Hydrology model review currently underway by TRCA, there is the potential for a significant number of additional model runs that may be required than was originally identified in the RFP. To address the uncertainty associated issues arising from the parallel planning initiatives, staff are recommending a 50% contingency be added to the contract. DETAILS OF WORK TO BE DONE TRCA, TWRC and the City of Toronto will work as co-proponents to identify a viable flood protection solution for the area north of the railway embankment. The project will consist of a Two Stage process:

a) Stage 1: Due Diligence stage that will follow Phases 1 and 2 of the Municipal Class EA process, minus the public engagement elements of the study to confirm that a viable alternative can be established; and

b) Stage 2: Undertaking the formal Municipal Class EA process if directed to proceed by the Executive Steering Committee (ESC) – it will be reconfirmed whether a Schedule B or C Class EA is required at this time.

For the above-mentioned works, TRCA requires the support of several consultant teams in order to fulfill the requirements of the EA planning and design process. Three consultant teams will lead the implementation and management of the required services and will coordinate with each other in order to 1) characterize the environmental, geotechnical and hydrogeological subsurface conditions of the project area; 2) carry-out hydraulic modeling and design services of the various flood protection solutions under consideration; and 3) provide planning and engineering support in the development of the Due Diligence and Class EA. AECOM has been selected as the consultant lead the Task 2 services outlined in RFP#10001976, which includes but is not limited to the review of existing model frameworks, the development of new model simulations based on a variety of flood protection alternatives, and assisting with refinement and integration of alternatives with existing and future land use considerations. RECOMMENDATION THAT Contract #10005326 for Smart Energy Networks, Engineering Consulting be awarded on a preferred source basis to Hero Engineering at a total cost not to exceed $58,800, plus 15% contingency, plus HST; AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents. BACKGROUND Toronto and Region Conservation Authority (TRCA) has been participating in leading edge research towards Smart Energy Networks (SEN), Smart Grid and Net-Zero Energy Buildings with the common goal of reducing greenhouse gases (GHGs), introducing low carbon technologies and distributed energy sources, and decreasing our energy dependency. This type of work is heavily emphasized in TRCA’s 10-year strategic plan “Building The Living City” which identifies action related to the development of “…sustainable strategies for large scale community development and redevelopment initiatives by integrating traditional watershed planning and municipal environmental planning concepts with other sustainability elements, such as energy efficiency… …green infrastructure” (Section 4, Action 1). Engineering consulting is needed in a variety of streams to help support the work of TRCA’s Sustainable Technologies Evaluation Program (STEP), including the development of a feasibility study on Smart Energy Networks, which will directly influence TRCA's energy conservation and management practices, future development of the new head office and organization-wide GHG reductions, along with providing a model for low carbon district energy systems for municipalities. Additionally, the consultant will be aiding STEP in developing proposals with the Independent Electricity System Operator (IESO) and Natural Resources Canada (NRCan) for future funding utilizing TRCA infrastructure and the consultant’s connections within academic and utility industries. Furthermore, the consultant will be aiding in developing software and infrastructure to continue TRCA’s distributed data acquisition and monitoring for external labs and projects. This will aid STEP to provide relevant and up-to-date research projects with a variety of partners and stakeholders that provide the necessary funding. Hero Engineering has been involved with and led the development of a number of SEN initiatives at The Living City Campus including the photovoltaic sensor array, data warehouse, and networking infrastructure. As such, Hero Engineering has intimate knowledge of the existing systems that will be used as part of planned SEN research and development going forward.

RATIONALE Smart Energy Networks and net zero buildings are a critical part of how communities will function in the near future. The SEN approach is a critical piece of how municipalities will adapt their energy systems to become more resilient to climate change. Working with our municipal partners to catalyze advances in SEN’s is supported by TRCA’s Building the Living City Strategic Plan. The Selection Committee of TRCA staff (Leigh St. Hilaire, Amanda Yip) reviewed the proposal. The criteria used to evaluate and select the recommended vendor were based on qualifications and experience, quality of the proposal, approach/methodology and reasonability of cost. The selection committee found that the consultant is competitively priced, and reflects the cost savings realized by utilizing a consultant who is already familiar with the study area, requiring less hours to complete the assignment. Staff recommends that Contract #10002159 be awarded to Hero Engineering on a preferred source basis for a total cost not to exceed $58,800.00, plus a 15% contingency, plus HST. The vendor has specialized knowledge on these subjects and projects as well as detailed knowledge and expertise of TRCA's energy generation infrastructure, hardware and programming needs. The vendor was also a co-applicant on the LDC Tomorrow Fund project that is covered under this contract. Furthermore, the vendor has a detailed understanding and communication with key proponents and stakeholders of the project: York University, Ryerson University, and Sumaran Inc and is uniquely qualified to deliver the services requested to TRCA. Approval to hire Hero Engineering on a preferred source basis is in compliance with TRCA’s Purchasing Policy requirements under Section 9.3(3) which states:

The required goods and services are to be supplied by a vendor or supplier having specialized knowledge, skills, expertise or experience that cannot be reasonably provided by any other supplier.

RECOMMENDATION WHEREAS the Province of Ontario has posted the proposed amendments to the Planning Act and Ontario Municipal Board Act as part of Bill 139, the Building Better Communities and Conserving Watersheds Act for public comment on the Environmental Bill of Rights (EBR);

AND WHEREAS Toronto and Region Conservation Authority (TRCA) has roles and responsibilities affecting planning matters that come before the Ontario Municipal Board (OMB), through which TRCA staff regularly participate;

THEREFORE LET IT BE RESOLVED THAT the staff report on TRCA’s draft comments to the Province through EBR posting #013-0590 be endorsed;

AND FURTHER THAT this report be circulated to TRCA’s municipal partners, neighbouring conservation authorities and Conservation Ontario for their information. BACKGROUND Since 2004, the Ontario government has implemented a series of land use planning reforms aimed at making the provincial planning system more inclusive and transparent, including the Strong Communities (Planning Amendment) Act, 2004, the Planning and Conservation Land Statute Law Amendment Act, 2006, and the Smart Growth for Our Communities Act, 2015 (EBR# 012-3651). These efforts altered the procedures and operations of the OMB by placing limits on the number of matters that can be appealed and giving municipalities a stronger, more independent voice in local land use decisions. Despite these changes, the Province continued to hear concerns from municipalities, stakeholders and the public about the role of the OMB in the land use planning system.

In June 2016, the Ontario government commenced its review of the scope and effectiveness of the OMB. In October 2016, the Province released a Consultation Document to provide the public with an opportunity to comment on changes being considered to improve Ontario’s land use planning appeal system in response to the changing needs of its communities (EBR #012-7196). A series of questions centering on the following five themes were proposed:

1) OMB jurisdiction and powers; 2) Citizen participation and local perspective; 3) Clear and predictable decision-making; 4) Modern procedures and faster decisions; and, 5) Alternative dispute resolution and fewer hearings.

On December 19, 2016, TRCA staff provided comments in response to these questions and offered a number of recommendations staff deemed to be of particular importance from TRCA’s jurisdictional perspective and experiences at the OMB, as approved by Resolution #A231/16 at Authority Meeting # 11/16. These key recommendations included:

Appeals based on non-decisions are often tied to applications that are deemed “complete” yet lack the supporting information required for agencies like TRCA to make an adequate assessment of the application;

Appeal rights should be restricted for land use matters that protect provincial interests and prohibit development related to natural heritage, source water and natural hazards in the Provincial Policy Statement (PPS);

Given the unique provincial ministerial approval process, appeal rights should be restricted for official plan (OP) or OP amendments (OPAs) associated with Special Policy Areas (SPAs) under Section 3.1.4 (a) of the PPS;

The technical criteria developed to provide guidance on provincial interests at OMB hearings, specifically those related to the natural heritage and natural hazard policies of the PPS, should be given more weight and status;

Updated provincial planning rules should apply at the time of decision for applications submitted before 2007;

Clarification is needed as to what constitutes information as “significant” when new “significant information” is introduced at an OMB hearing and sent back to council for reconsideration;

The number of appeals should be limited, appeal timelines should be shortened, and broad appeals should be substantiated by a sound planning rationale prior to proceeding;

When new technical work in support of an application is introduced during a hearing, the hearing should be adjourned and the application should continue to be processed to a decision in the municipal planning realm;

Multi-member panels are needed to increase the consistency of decision-making and provide a more holistic and balanced perspective of the various public interests relevant during appeals, particularly for complex cases;

Where applicable, OMB members may benefit from professional development/training on emerging or complex issues such as environmental management and/or issues related to the Conservation Authorities Act.

On May 30, 2017, the Province introduced Bill 139, the Building Better Communities and Conserving Watersheds Act, 2017. Bill 139 is an “omnibus bill” that proposes a series of transformative legislative changes that, if passed, would overhaul Ontario’s land use planning system by changing the manner in which local planning decisions are made. The changes proposed through Bill 139 are included in the following five Schedules:

Schedule 1: Enacting the Local Planning Appeal Tribunal Act, 2017 Schedule 2: Enacting the Local Planning Appeal Support Centre Act, 2017 Schedule 3: Amendments to the Planning Act, the City of Toronto Act, and the Ontario Planning and Development Act Schedule 4: Amendments to the Conservation Authorities Act Schedule 5: Amendments to various Acts consequential to their enactment

Bill 139 will have to pass through two more readings in the legislature before being enacted. This could occur during the next season of legislature (commencing September 11, 2017). During this time, it will be debated and could be referred to a Standing Committee for a “clause by clause” review. Many of the proposed amendments are enabling only, meaning that they would not come into force until a later date through regulations made by the Lieutenant Governor in Council (LGIC) or the Minister. Bill 139 also proposes significant changes to the Conservation Authorities Act (Schedule 4), however, TRCA staff have, and will continue to report on these changes independently from those specific to the OMB reform (Schedules 1, 2, 3, and 5).

KEY LEGISLATIVE CHANGES PROPOSED THROUGH BILL 139 (Related to the OMB only) The following synopsis outlines significant changes that would result from Bill 139, as they relate to TRCA’s interests, roles and responsibilities. Additional recommendations to further these proposed changes are outlined in the “Analysis and Key Recommendations” section of this staff report.

Replacing the OMB with a Local Planning Appeal Tribunal (“LPAT”) The OMB would be replaced with the LPAT, a tribunal mandated to give greater weight to the decisions of local communities, while ensuring that development and growth occur in a way that is good for Ontario and its future.

Establishing the Local Planning Appeals Support Centre (“LPASC”) Planning appeals would be more publically accessible through the creation of the LPASC, an agency modeled after the Human Rights Legal Support Centre. The LPASC would address TRCA’s call for enhanced support for the general public in the appeals process as it would provide free, general legal and planning advice and representation to eligible citizens who may want to participate in local planning appeals. The LPASC would be independent from, but still accountable to, the Ontario government. Eligibility criteria for the LPASC would be prescribed through a future regulation.

New Appeals Process / Elimination of de novo Hearings An appeal of a municipally-adopted/approved OP or Zoning By-law (ZBL) amendment would now have to describe, in writing, why a decision by Council (or failure to make a decision) fails one of the following “conformity/consistency tests”:

(i) it is inconsistent with a provincial policy statement; (ii) it fails to conform with or conflicts with a provincial plan; and, (iii) in the case of a lower-tier OP, it fails to conform with the OP of the applicable

upper-tier municipality.

An appeal for a refusal of a privately-initiated OP/ZBL amendment would need to explain why existing policies/regulations of an OP/ZBL fail one of the above conformity/consistency tests, while also demonstrating how the proposed OP or ZBL amendment would satisfy the test in its entirety.

If the LPAT deems that an appeal does not adequately meet the requirements of the conformity/consistency tests, or if a submission is missing any other essential information, the LPAT must dismiss the appeal without a hearing.

The OMB operates with a considerable level of discretion regarding its ability to hear evidence and overturn a municipal decision if, in the Board’s opinion, Council did not make an “optimal” planning decision based on the principles of “good planning”. The Board also has the authority to conduct hearings on a “de novo” basis, meaning that OMB decisions must have regard for decisions by Council (and any information Council considered) but the Board can make a decision independent from and without reference to them. Through Bill 139, this “standard of review” would be reformed such that the LPAT could only overturn Council’s decision if the LPAT deemed it to have failed any one of the above noted conformity/consistency tests, and after Council has been given the opportunity to make a new decision.

If the LPAT was convinced that Council’s decision failed any of the conformity/consistency tests, all or part of the decision would be returned to the municipality with justification as to why a new decision is required. The municipality would then have 90 days to reconsider the application and make a new decision that rectifies the deficiencies identified by the LPAT. If the LPAT receives a second appeal and the LPAT still finds that the new municipal decision failed to meet the conformity/consistency test, then the LPAT would have the powers to substitute its own decision. A diagram from Province’s website depicting the proposed LPAT hearing process can be found in “Attachment 1” to this report.

As further outlined below, to a certain extent, the LPAT would address many of TRCA’s previous comments concerning limiting the authority of the OMB, restricting appeal rights, reducing the number of appeals and their timelines, and requiring stronger criteria for appeals based on sound planning rationale. Despite these improvements, however, TRCA staff note that, appeals based on a non-decision by Council would not be subject to the new conformity/consistency tests. In these circumstances, the LPAT would retain the traditional approval powers of the OMB (i.e. to approve, modify, or refuse an application). Moreover, outside of OPs, ZBLs and plans of subdivisions (non-decisions), the modified appeals process would not apply to other Planning Act applications (e.g. Site Plan, Consent, etc.). For appeals of subdivision applications, however, the LPAT would now be required to refer any information and material introduced at a hearing back to the municipality for reconsideration, where at present the OMB has discretionary powers to determine whether new information should be sent back.

The Minister of Municipal Affairs would be afforded the authority to make appeals to the LPAT and could advise if an OP or ZBL appeal would or could adversely affect provincial interest. If the Minister provided this notice, the LPAT would retain the authority to make a decision but the new powers of appeal afforded to the LPAT under the new model would not apply, and any decision made would not be final until confirmed by the LGIC.

Expanded Control of Hearing Procedures Mandatory Case Management: An important procedural change proposed is the requirement for mandatory case conferences prior to a hearing (for appeals of OPs, ZBLs, and subdivisions). While this would be congruent with current OMB practice regarding pre-hearing conferences and encouraging mediation, mandatory case conferences would enable opportunities for settlement and mediation early on in the LPAT process. This could necessitate increased staff time and resources during the onset of a hearing, but may limit the overall cost and length associated with TRCA’s involvement by first identifying and narrowing the scope of issues, an important concern TRCA staff raised previously.

Oral Hearings: OMB appeals are currently conducted “orally”, whereby parties may call witnesses to provide evidence orally (unless otherwise requested by the parties). This evidence can then be tested through cross-examination, argument, and the submission of additional materials. Through Bill 139, however, oral hearings would no longer be “as of right”. In the event that an oral hearing is permitted by the Tribunal, no party or person could adduce evidence or call or examine witnesses. Only a party or person identified at the request of the LPAT could make an oral submission to be examined by the Tribunal (which may be time limited by a regulation not yet released). At any stage in a proceeding, the LPAT would be empowered to “examine”– i.e. examine a party to the proceeding; examine a person other than a party who makes a submission; require a party/person to the proceeding to produce evidence for examination; or, require a party to produce a witness for examination.

Rules and Procedures: The LPAT would be afforded the same general rule-making abilities regarding hearing practice and procedure as is currently provided under the OMB. However, the LPAT would have the ability to adopt alternative approaches to traditional adjudicative procedures and the authority to appoint a person from among the parties to be a class representative where parties have a common interest. That being said, Bill 139 proposes to provide the Minister with the authority to make regulations, which could change the manner in which appeals are conducted, including:

a) Setting out procedures governing appeal proceedings, rules regarding the conduct and format of hearings, and practices regarding the admission of evidence and the format of decisions;

b) Providing for and governing the composition of multi-member panels to hear proceedings before the LPAT; and,

c) Prescribing timelines to proceedings on Planning Act appeals.

Extended Timelines for Decision Making Bill 139 would extend the time municipalities have to make decisions (on OPs and ZBLs) by 30 days (210 days and 150 days, respectively). For decisions involving both OPAs and ZBLs, the timeline would extend to 210 days. The amount of time a municipality would be provided to make a decision on all other Planning Act applications would remain unchanged.

Limiting the Scope of Appeals / Removing Appeal Rights for Certain Planning Act Applications Bill 139 would limit or remove appeal rights for a range of planning decisions previously appealable to the OMB, including: new interim control by-laws, OP policies and by-laws pertaining to Major Transit Station Areas (which municipalities would be allowed to designate in OPs) and two years for new Secondary Plans. In addition to limiting the grounds on which appeals can be made (for OPs and ZBLs, inconsistency or non-conformity with a provincial policy or plan or upper-tier OP), Bill 139 would also prohibit appeals of decisions relating to OPs where the Minister is the approval authority. This would appear to address TRCA staff’s previous comment that the Planning Act be amended such that appeals to SPAs are added to the list of specified provincial matters on which appeals are to be disallowed, where a comprehensive review of an SPA has been undertaken and received ministerial approval. In addition, it is our understanding that appeals of decisions relating to OP amendments to conform with the source protection requirements of the Clean Water Act and its regulations would also be prohibited. TRCA staff will be requesting confirmation of both interpretations.

Transition Bill 139 charges the Minister with preparing regulations at a future date to address how matters will be resolved that were commenced before the date the new legislation takes effect. TRCA staff will monitor the release of any such regulation and report back, as needed.

Other Planning Act Changes Bill 139 proposes to expand the list of “provincial plans” and “policy statements” currently defined and described in the Planning Act. Policy statements would now also include those issued under the Metrolinx Act, Resource Recovery and Circular Economy Act, and others which may require Ministerial approval. Provincial plans would now also include policies referred to in the Lake Simcoe Protection Act, Great Lakes Protection Act and Clean Water Act.

The scope of Local Appeal Bodies (LABs) would be expanded to include site plan control, in addition to minor variances and consents. It remains to be seen whether appeals of complex site plans (not associated with OP, ZBL, and subdivision applications) would still be heard at the LPAT. The Province has only indicated, in the OMB Consultation Document, that this would allow LABs to hear disputes on individual properties relating to, for example, landscaping, driveways or lighting. Currently, Toronto is the only municipality within TRCA’s jurisdiction to have a LAB.

Building on the climate change policies introduced in the recently amended Growth Plan for the Greater Golden Horseshoe, proposed changes to the Planning Act through Bill 139 would require OPs to contain policies that identify goals, objectives and actions for climate change adaptation and the mitigation of greenhouse gas emissions. This appears to align with changes to the Conservation Authorities Act proposed through Bill 139 that enable the creation of regulations relating to the role of CAs in climate change mitigation and adaptation, including a regulation pertaining to the review of planning documents for consistency with climate change-related policies in the PPS. TRCA has long played a critical role in addressing climate change risks and impacts of growth and urbanization in the Toronto region. As TRCA continues to advance expertise in this area, staff are strategically positioned to aid municipalities in the development of OP climate change policies.

Analysis and Key Recommendations TRCA staff generally support the legislative changes proposed through Bill 139 and note that many of TRCA’s previous comments were addressed to varying degrees, including: creating the LPASC to provide resources to community members to better navigate the appeals process; requiring detailed planning justification to prevent unsubstantiated appeals and help agencies like TRCA scope their involvement; extending timelines for municipalities to make decisions on complex planning applications to reduce the number of appeals for non-decisions; retaining mediation as an option while requiring case management to facilitate settlement and reduce the length and cost of hearings; placing limits on appeals on matters of provincial interest; and expanding the scope for dismissal of an appeal without a hearing if an application differs substantially from the one on which council based its decision.

Many of TRCA’s previous comments may eventually be addressed through future Ministerial regulations enabled by Bill 139. For instance, provisions for transitional matters (i.e. to apply current provincial planning rules to land use applications submitted prior to 2007), clarifying LPAT roles and procedures, and prescribing rules for multi-member panels and their composition (i.e. to increase the breadth of experience and consistency of decision making).

Although Bill 139 would address many of TRCA’s former comments, staff provide the following key recommendations that, if incorporated into Bill 139, would further strengthen the Province’s municipal planning and appeals process:

1. Enhancing the Role of Third Party Comments & Technical Review for LPAT Appeals

TRCA staff recommend that the Planning Act be amended to require that municipalities consult CAs during the municipal pre-consultation process prior to an application being deemed “complete” and an appeal to the LPAT can ultimately be made. While language exists in municipal OPs/ZBLs suggesting that other agencies may be consulted, TRCA staff are not always advised of municipal pre-consultation meetings and do not have the ability to provide input into a municipality’s determination that an application is “complete”. As a result, technical work that would be required to make an informed decision is often absent or incomplete when an application is accepted, resulting in additional time spent requesting this work during the statutory plan review period. In TRCA staff’s experience, this delay often results in the expiration of the statutory timeframe and an appeal being filed based on the municipality’s failure to make a decision, forcing TRCA staff into potentially avoidable appeal hearings without sufficient opportunity to review technical information. Requiring the consultation of CAs in the determination of “complete” applications would streamline the plan review process and limit the number of appeals for non-decision in such cases.

2. Requiring Circulation to Conservation Authorities on Notices of Appeal

TRCA staff recommend that the Planning Act and the LPAT Act be amended to require that CAs be circulated on notices of appeal to the LPAT where their areas of interest are affected. In current practice, TRCA is often left out of circulations of notices of appeal by municipalities, including background materials submitted with appeal packages. In these cases, TRCA is pulled into a hearing process with little time to adequately prepare. Therefore, the Planning Act and the LPAT Act should be further amended to ensure that all prescribed agencies (including CAs) are copied on all notices of appeal that affect their areas of interest and to ensure they can attend mandatory case management conferences.

3. Conservation Authorities as Prescribed Agencies

The status of a CA as a commenting agency is acknowledged in the supporting regulations of the Planning Act. CAs have been delegated the responsibility to represent the provincial interest on natural hazards encompassed by Section 3.1 of the PPS as outlined in the Conservation Ontario/Ministry of Natural Resources and Forestry/Ministry of Municipal Affairs Memorandum of Understanding (MOU) on CA delegated responsibilities. In 2010, the Province approved the ‘Policies and Procedures for Conservation Authority Plan Review and Permitting Activities’ which provides clarity about the roles and responsibilities of CAs in the planning and permitting process. In keeping with the Provincial MOU and policies and procedures, TRCA provides planning and environmental advisory services to municipalities, implemented through MOUs and service agreements. In this respect, TRCA is essentially acting as a technical advisor to municipalities. These agreements cover TRCA’s areas of technical expertise such as water management, natural hazards and natural heritage. CAs also regulate development under their permitting responsibilities under Section 28 of the Conservation Authorities Act.

The recent release of ‘Conserving our Future: A Modernized Conservation Authorities Act’, in support of the proposed changes to the Conservation Authorities Act, as part of Schedule 4 of Bill 139, outlines the Province’s intent to recognize in regulations, the current and future roles of CAs in the planning process to assist the Province in achieving consistency with the PPS, “including policies related to natural hazard policies and land use and development patterns that promote climate change adaptation and mitigation.” Therefore, TRCA staff recommend that CAs be acknowledged as prescribed commenting agencies under the Local Planning Appeal Tribunal Act.

4. Tightening the Basis for Appeal of Non-Decisions

TRCA staff welcome the extended time afforded to municipalities to make a decision on OPs and ZBLs. Staff also generally support the proposed conformity/consistency tests outlining the basis for appeal where Council has made a decision. However, as noted above, for appeals based on failure to make a decision (a “non-decision”), the conformity/consistency test would not be required and the Tribunal would be afforded the same powers provided currently to the OMB. Where an initial appeal of a non-decision of an OP or ZBL is made, TRCA staff recommend the Province consider directing the Tribunal to determine whether Council had just cause in not making a decision within the statutory timeframe. Where appropriate, the LPAT should return the matter to Council with recommendations and prescribe a reasonable timeframe and/or information requirements necessary for a decision. If a decision could be made within the extended timeframe, and an appeal was subsequently made in response to this decision, the matter would be returned to council for review based on the conformity/consistency test. If Council could not make a decision within the extended time period, the matter would be returned to the Tribunal, where the existing powers and “standard of review” would apply (i.e. to approve, modify, or refuse an application based on the principle of “optimal” planning).

5. Clarifying Appeals Involving Multiple Planning Act Applications

Appeals under the Planning Act often include a combination of associated applications to facilitate their implementation. For instance, OPs and ZBLs are typically reviewed concurrently with related subdivision and/or site plan applications. However, Bill 139 does not specify whether subdivisions, site plans and Committee of Adjustment applications would be subject to the same conformity/consistency appeal test as OPs/ZBLs, even if they collectively form part of the same development proposal. TRCA staff suggest that Bill 139 be revised to clarify that the newly proposed conformity/consistency tests (both as the basis for an appeal and for the LPAT’s final decision) will apply not only to OPs and ZBLs, but also to other associated Planning Act applications.

6. Coordination with Provincial Policy & Legislation

It is unclear whether the Tribunal will seek consistency with all of the provincial plans/policies defined and described in the Planning Act as the basis of the conformity/consistency test for an appeal (or a final decision), or whether some will be prioritized over others. In TRCA’s experience, appeals can be heard based on compliance with a single section of the PPS or Provincial Plan (e.g. intensification) without regard for other sections (e.g. section 3.1 of the PPS, regarding flood hazards). LPAT appeals (and Tribunal decisions) should be based on a consistent and defensible planning justification considered from a balanced and comprehensive assessment of the entire current provincial policy and legislative framework, as well as implementing municipal documents. TRCA staff recommend that the Province establish guidance materials outlining how the conformity/consistency tests are to be operationalized, both as the basis of an appeal, and for a Tribunal’s decision. In doing so, the Province should clarify their involvement and potential attendance in a hearing to represent the provincial interest. Additionally, it should be explained that the Planning Act must be read in conjunction with all other applicable land use policies, plans, regulations and/or standards (as amended from time to time) and specify where more specific plans or regulations take precedence, as per the Implementation section of the PPS (4.10, 4.11).

7. Qualifications and Training of Tribunal Members

Without adequate professional development on emerging or complex issues such as environmental management, Tribunal members may not have the appropriate knowledge and expertise to effectively manage hearings and issue decisions for the broad range of matters brought before the LPAT. This issue is of particular importance given that the majority of evidence used to inform Tribunal decisions would be in written format, fewer opportunities may exist, if at all, for experts to explain or critique technical studies produced in support of written submissions. TRCA staff request that the Province create a minimum standard of qualifications and training for new Tribunal members.

8. Role of Technical Guidance on Provincial Interests

While Bill 139 has introduced new tests for appeals of OPs and ZBLs based on provincial policies and plans, it remains silent on the role of technical criteria developed to provide guidance on provincial interests. In TRCA staff’s experience, opinions based on technical documents related to the natural heritage and hazard policies of the PPS (e.g. Natural Heritage Reference Manual and the Technical Guide for River and Stream Systems) are not given adequate weight during appeal hearings. TRCA staff are concerned that this trend could continue under the new LPAT model. Additionally, it may become increasingly difficult to reference, explain and expand upon technical documents, given that written evidence would predominantly be used to inform Tribunal decisions and cross-examination would no longer occur. Bill 139 states that the Province could clarify whether a matter under appeal would adversely affect provincial interest, but the extent of provincial involvement in doing so is yet to be determined and could rely on as-of-yet unpublished regulations.

TRCA’s concerns regarding the lack of weight given to technical criteria at hearings are compounded given that recent amendments to the four provincial land use plans have introduced progressive policies requiring environmental and planning criteria that will rely heavily on such materials. For example, municipalities, partnering with CAs, are now required to undertake watershed planning to ensure that growth occurs in an environmentally sustainable manner. The Province has indicated that guidance materials and supplementary information will be produced in support of these policies. In fact, TRCA is currently involved in the Province’s “Watershed Engagement Group” to help inform the development of a Watershed Planning Guidance document in support of carrying out these very policies. TRCA staff would like to reiterate a previous recommendation to clarify and strengthen the role of technical guidance on provincial interests in LPAT decision-making, specifically those related to the natural heritage and hazard policies of the PPS.

9. Applying Current Provincial Policies at the Time of Decision for Applications

Since 2007, the Planning Act has required that Planning Act decisions must be consistent with provincial policies and conform to provincial plans that are in place at the time of a decision, rather than when an application is made. The October, 2016, Provincial Consultation Document on changes being considered to the OMB sought feedback on whether this requirement should be amended. However, Bill 139 does not appear to have been changed to reflect this consideration. In TRCA’s experience, examples continue to arise of unbuilt subdivisions originally approved in the 1970s, ‘80s and ‘90s, proposing to be developed at the present time in a manner which does not meet the objectives of current provincial policies (e.g. natural hazards or significant environmental features such as wetlands). If development proposals have not been built since 2007 (at the latest), there is no need to perpetuate planning decisions based on outdated policies that have since been replaced following years, or even decades, of progressive advancements to Ontario’s land use planning and legislative framework. TRCA staff recommend that the Minister utilize the powers bestowed through Bill 139 to remove “grandfathering” of all

Planning Act applications submitted before 2007 (or earlier) and that they be subject to updated provincial policies and plans, which apply at the time of a decision or approval.

10. Future Ministerial Regulations

As noted above, Bill 139 enables the Minister to make regulations regarding: transitional matters that commenced before the new legislation comes into effect; rules for the composition and governance of multi-member LPAT panels; and, Tribunal practices and procedures - admission of evidence, and the conduct and format of hearings, and structure of decisions. To this effect, a number of the aforementioned recommendations could be addressed through the creation of future regulations and, as such, TRCA staff would like to express our interest and desire to participate in their initial formulation. We recommend that the Province undertake public consultation on any and all regulations proposed pursuant to Bill 139 to provide agencies like TRCA with the opportunity to contribute on the basis of our experience. RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is to undertake works within the Rouge River Watershed to recognize the construction of a deck (approximately 436.8 square feet in size) and to remediate a disturbed area as a result of unauthorized site alteration adjacent to/within the valley corridor in advance of a TRCA permit. The works also includes the demolition of an existing metal shed situated adjacent to the valley corridor. The proposed works will resolve the outstanding TRCA Violation (No. V2893) on the subject property. The rear of the subject property contains a portion of the Berczy Creek valley corridor associated with the Rouge River. A geotechnical report identifying the long-term stable top of bank (LTSTOB) associated with the valley corridor has been prepared by a qualified geotechnical engineering consultant (GeoPro Consulting Ltd.) in support of this application. The report also provides a slope stability assessment, of which, TRCA geotechnical engineering staff agree with the findings of the consultant, noting that the location of the newly constructed deck is appropriately setback from the LTSTOB. The existing metal shed situated adjacent to the valley corridor will be demolished and the area of disturbance caused by its construction will be restored as outlined within the restoration/planting plan submitted by the applicant. A restoration/planting plan consisting of native, non-invasive species of trees and shrubs with deep root systems planted along the valley wall at the rear of the property are to be implemented to address the violation (i.e. site alteration & unauthorized construction of auxiliary structures) on the site, to provide a net ecological gain to the valley system and improve slope stability. In addition, there are no flood related concerns anticipated as part of this application. Additional Fee: The applicant initiated works in advance of a permit pursuant to Ontario Regulation 166/06 being issued. The applicant has paid the application fee plus 100%, as required in association with the violation of the regulation. Control of Flooding: The proposed development is located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of floodwaters are anticipated. Pollution: Appropriate erosion and sediment controls (i.e. silt fencing) will be installed and maintained throughout the duration of the project. Dynamic Beaches: Not applicable Erosion: The subject site is traversed by a valley corridor associated with the Berczy Creek, a tributary of the Rouge River Watershed. A geotechnical report was undertaken and submitted to the TRCA for review. The report identified the long-term stable top of bank associated with the valley feature. TRCA geotechnical staff are satisfied that the consultant retained by the applicant has sufficiently addressed TRCA's concerns with respect to the potential erosion and slope failure and concur with the findings of the report.

Conservation of Land: The location of the proposed works are void of any significant, however, as the works initiated without a permit caused a minor disturbance to the natural system, staff required a planting plan to aid in stabilizing the slope of the valley wall and to remediate the area of disturbance. The restoration/planting plan consists of native, non-invasive species of trees and shrubs with deep root systems and will enhance the overall ecological condition of the valley corridor and improve the slope stability of the valley wall. Plantings

All plantings proposed are deep rooting, native, non-invasive species in accordance with TRCA's guidelines.

temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 21, 22, 23, 24 Lot , Concession 3, (Taunton Road and Sideline 22), in the City of Pickering, Duffins Creek Watershed as located on the property owned by 1133373 Ontario Inc.. The purpose is to construct a major a stormwater channel, stormwater management plan, two stormwater outfalls and access road, and restore with native planting.

The permit will be issued for the period of August 11, 2017 to August 10, 2019 in accordance with the following documents and plans which form part of this permit:

Letter of Undertaking, committing to providing the appropriate engineering and landscape drawings which address comments to be provided by TRCA, and committing to address natural heritage system compensation and make satisfactory payment arrangements for the compensation, prepared by 1133373 Ontario Inc., dated July 14, 2017

Application-Specific Permit Conditions 14. The Owner shall coordinate a pre-construction meeting with the agent, contractor,

engineer, inspector, TRCA, municipality and any other regulatory agencies prior to the commencement of the approved works to the satisfaction of TRCA.

15. The Owner shall ensure all works within and adjacent to the watercourse are directly supervised by a qualified ecologist and/or fluvial geomorphologist (or an equivalent as approved by TRCA) to the satisfaction of TRCA.

16. The Owner shall ensure all erosion and sediment controls are monitored by an environmental monitoring professional certified by CISEC; and the environmental monitoring professional shall utilize an on-line erosion and sediment control document monitoring software and as may be updated from time to time in carrying out their duties; and the appropriate access permissions to the software shall be granted to TRCA staff.

17. No work as authorized by the issuance of this permit may be commenced by the permit holder unless and until all conditions precedent as set out in the License of Land for Temporary Use and Access dated <to be determined> between Her Majesty The Queen In Right Of Ontario, as represented by The Minister of Economic Development, Employment and Infrastructure ("I/O") and 1133373 Ontario Inc. have been either fulfilled by 1133373 Ontario Inc. or waived by I/O. For greater certainty, the purpose of the foregoing is to ensure that 1133373 Ontario Inc. does not rely on this permit to commence work, or even enter onto the subject lands, unless and until all requisite permissions to enter as granted by I/O are in full force and effect and without outstanding conditions precedent.

18. The Owner shall obtain clearance from TRCA Planning & Development staff prior to requesting the full or partial release of any Letters of Credit or other securities from the City of Pickering for the approved works and associated compensation plantings.

RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The proposal is to construct a major stormwater management pond, a stormwater channel, two stormwater outfalls and an access road, for the facility referred to as the Seaton SWMF#2 within the TRCA regulated area on lands located south of Taunton Road, west of Brock Road in the City of Pickering. This one of many TRCA permits required to construct the Seaton Community, the planning approvals of which were the result of a lengthy Ontario Municipal Board mediation process in 2012. The channel, pond, outfalls and the access road are required to support the development of draft approved Plans of Subdivision SP-2008-07 and SP-2009-14 owned by subsidiaries of Lebovic Enterprises. The channel, pond, outfalls and access road is all located within the Seaton Natural Heritage System in a generally open area of fields, young forest and valley slopes. The access driveway is required in order to provide for a suitably graded surface to meet the intent of the City of Pickering's maintenance access requirements. The works will take place on lands within the Natural Heritage System owned by the Ontario Infrastructure and Lands Corporation and leased to the subsidiaries of DG Group. The lease will be triggered upon all approvals being obtained from the TRCA and City of Pickering. Control of Flooding: The bottom of the outfall is located in the regional storm floodplain but is designed to have no impact on the control of flooding. The remainder of the project is not located within the Regional Storm Floodplain. Pollution: Temporary sediment controls have been provided per the Greater Golden Horseshoe Area Conservation Authorities, Erosion and Sediment Control Guideline for Urban Construction. The controls include the use of rip-rap swales to direct water, double row silt fence with straw bales, flow spreaders, rip rap check dams, silt soxx, and ensuring timely and staged stabilization of the site through seeding or erosion control blankets. The proponent has agreed to employ a multi-layer inspection process using CISEC certified inspectors. A number of the application-specific conditions are designed to ensure that proper controls are in place to ensure the contractor does not discharge sediment from the construction site. The outfalls will be constructed during the MNRF mandated timing window for Red Side Dace. Dynamic Beaches: Not applicable.

Erosion: The proposal was designed in consultation with a professional geotechnical engineer, and was reviewed by TRCA's geotechnical engineer. The engineers are satisfied that the proposal will not have any impact on slope stability. Temporary erosion controls have been provided per the Greater Golden Horseshoe Area Conservation Authorities, Erosion and Sediment Control Guideline for Urban Construction. Conservation of Land: The City of Pickering Official Plan Amendment 22 for the Seaton Neighbouhood allows for stormwater management infrastructure to be located within the Natural Heritage System subject to certain setback requirements from natural features. This project by its nature is located within the Natural Heritage System with the outfalls on the valley slope and will involve the removal of 0.838 ha of young forest primarily along the route of the channel, the outfalls on the valley slope and some trees along the edge of the proposed SWM pond. The proponent has agreed to compensate for the lost vegetation by restoring a significant area of disturbed portions of the Natural Heritage System located outside of the infrastructure, as well as plant 2.154 ha of public lands with native trees, whips and shrubs. Vegetation was removed in the February-March period in order to avoid migratory birds. Plantings

2.154 ha of caliper trees, whips and shrubs will be planted in former agricultural fields within the Natural Heritage System to restore and compensate for 0.838 ha of lost natural features as part of the compensation program for the two Lebovic Subdivisions, and will be secured through the Subdivision approval process or direct payment to TRCA prior to the release of this permit.

with a wetland at 15877 Mount Wolfe Road, in the Town of Caledon, Humber River Watershed as located on the property owned by Riteland Development Corporation. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate grading and servicing works associated with an approved residential draft plan of subdivision.

The permit will be issued for the period of August 11, 2017 to August 10, 2019. The documents and plans which form part of this permit will be listed in a separate report RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of the application is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate grading operations and final servicing in support of a draft approved plan of subdivision (Town File #21T-98001C) and zoning by-law amendment (Town File #RZ 98-07) to develop 28 estate residential lots on the 56.12 ha (138.68 acres) site at 15877 Mount Wolfe Road, in the Town of Caledon. There are three (3) wetlands on the site that are part of the Provincially Significant Halls Lake-Kennifick Wetland Complex (PSW), as well as several other natural features including a woodland feature. As such, a significant portion of the property is located within the TRCA Regulated Area of the Humber River Watershed. The subject property is located on the Oak Ridges Moraine (ORM), within the Natural Linkage Area land use designation of the Oak Ridges Moraine Conservation Plan (ORMCP). This subdivision application predates the enactment of the Oak Ridges Moraine Act as the applications were submitted to the Town of Caledon in 1998. However, no decisions under the Planning Act were made on these planning applications. Therefore, this development only needs to conform to the transitional policies of the ORMCP. TRCA staff have been involved in the review of the planning applications associated with this development, and the associated Ontario Municipal Board (OMB) hearing (Case #PL140631). Through the OMB hearing, TRCA staff were successful in achieving the integration of TRCA's requirements into the proposed plan. The OMB hearing was resolved through a mutually agreeable settlement, which reduced the number of lots proposed, integrated all of TRCA's regulatory and policy requirements and objectives, including requisite buffers from the PSWs and natural features, enhancement of natural features through active restoration, as well as the gratuitous dedication of the environmentally significant lands. Also, as part of the negotiated settlement, funding is being provided for TRCA's Restoration Services to complete significant reforestation within certain areas to be protected. Control of Flooding: The proposed development is located outside of the Regulatory Floodplain. As such, there will be no impact on the storage and/or conveyance of flood waters. Pollution: Appropriate erosion and sediment control measures will be installed and maintained throughout all phases of construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability issues associated with the proposed development. In addition, the implementation of the aforementioned erosion and sediment control measures will minimize erosion on the site.

Conservation of Land: No significant vegetation will be removed as a result of construction. However, an extensive enhancement planting plan will be submitted for this development application prior to registration of the subdivision to enhance the ecological condition of the area. Plantings

temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, at Chorley Park (245 Douglas Drive, north of Roxborough Drive), in the City of Toronto (Toronto and East York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto. The purpose is to construct a switchback trail connection. Works will involve construction of a new switchback trail connection and restoration of the existing trails to a natural state. No in-water works are within the scope of this project.

The permit will be issued for the period of August 11, 2017 to August 10, 2019 in accordance with the following documents and plans which form part of this permit:

Letter of undertaking from the City of Toronto to TRCA to provide revisions to the engineering and landscape drawings to the satisfaction of TRCA; dated August 4, 2017; received by TRCA on August 4, 2017.

RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The City of Toronto is proposing to construct a switchback trail in Chorley Park, located on the east side of Douglas Drive, between Glen Road and Roxborough Drive. This work was identified by the City of Toronto in 2011 due to the eroded and steep state of the existing trails, as well as the deteriorating timber staircase on the site. This project was previously approved by the Executive Committee on March 7, 2014 (CFN 50410, permit C-140124), but has since been delayed due to a redesign of the original proposal. Works under the new contract will involve construction of a new trail surface in a repeating ‘Z’ pattern, connecting the existing Beltline Trail

to Douglas Drive. The new trail connection is to be flanked with armour stone. New drainage pipes and rip rap swale treatments will be located at various switchback points. The existing timber staircase, part of the existing trail system, will be removed and replaced with a new shorter staircase between the southernmost switchback points. Access to the site is to be obtained from Douglas Drive, while a staging area is to be established adjacent to the site entrance. Silt fencing will be established to isolate the work areas, access route and staging area, while sediment socks will be employed in the swales on the site to contain sediment laden runoff. Mud mats will also be employed at the site entrance. Tree protection hoarding will be constructed in accordance with City of Toronto Urban Forestry standards. In 2014, there were 138 tree removals associated with this project, mostly consisting of non-native, invasive species. The revised design will necessitate the removal of an additional 31 trees with 37 injuries, also mostly consisting of non-native, invasive species. All removals will be compensated through an extensive landscape planting plan of roughly 1,500 native trees and shrubs, which will be executed by City of Toronto Urban Forestry Renewal staff to ensure an ecological net gain on the site. The existing system of asphalt trails, which connects the Beltline Trail to Roxborough Drive and Douglas Drive, will be removed and restored to a natural state using topsoil and a seed mix. Construction is now anticipated to begin in late summer 2017. Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. All grades will be maintained or matched. Pollution: Erosion and sediment control measures (silt fence, silt socks, mud mats) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into Mud Creek, a tributary of the Lower Don River. Erosion and sediment control measures have been provided in accordance with the Greater Golden Horseshoe Area Conservation Authorities’ Erosion and Sediment Control Guideline for Urban Construction (2006). Dynamic Beaches: The proposal will not have any implications to dynamic beaches. Erosion: There are no impacts identified to slope stability or erosion as a result of these works. Conservation of Land: No in-water works are within the scope of this project. Plantings

Upon the final review and approval of the Environmental Management Plan, TRCA staff will have no concerns related to flooding, ecology or geotechnical issues associated with the proposed works. Control of Flooding: The proposed works are located on tableland. As such, there are no impacts anticipated related to flood control or flood conveyance as a result of the proposed works.

Pollution: Appropriate sediment and erosion control measures are to be installed prior to, and maintained during all phases of construction. In addition, a comprehensive monitoring plan has been included in the Environmental Management Plan to undertake ongoing monitoring of the sensitive wetlands and watercourses. Dynamic Beaches: Not applicable Erosion: There are no slope stability and/or erosion related concerns associated with this phase of the preliminary site alteration and grading works as the proposed works will incorporate slope stabilization measures to the satisfaction of TRCA staff. Conservation of Land: The site has historically and is currently used as active farmland. As such, there is no significant vegetation to be removed as a result of this phase of the proposed works. Furthermore, there are no in-water works proposed within this permit. As such, there are not fisheries related impacts anticipated with this proposal. Plantings

The preliminary site alteration and grading works subject to this permit does not include the planting and restoration of the environmental buffers at this time. All planting and restoration works will be included in subsequent stage of the overall construction works for the plan of subdivision and/or at the time of constructing the permanent stormwater management facilities
