NEW DELHI, FEB 01 AAP leader Arvind Kejriwal has once again apologised for his actions during his 49-day tenure as Chief Minister of Delhi last year and promised not to quit again. "...Many people across Delhi feel that our actions have let them down. In May (last year), we apolo- gised to the people of Delhi for the disappoint- ment caused; and in case you missed it the first time, I do so again - so you hear us loud and clear," he said. "We did not lie, and we did not steal. However, I acknowledge that people were still hurt by our actions, because what AAP represents is bigger than all of us. The four AAP MPs - Bhagwant Mann,Dharam Vira Gandhi, Harinder SinghKhalsa and Sadhu Singh - are especiallyfocussing on four assembly seats that pre-dominantly account for Punjabi and Sikhvoters. The Shiromani Akali Dal (SAD) hasalso fielded its candidates for these seats aspart of its poll alliance with the BJP in Delhi.

"Our Delhi poll agenda is clear; it is for thepeople to decide now. For Punjabis (living inDelhi) it is important to remember that theSAD-BJP regime in Punjab has devastatedthe youth by making a continuous inflow ofdrugs into the state. One of its cabinet min-isters has been found to be involved in it,"AAP MP from Sangrur Bhagwant Mannsaid.

He was referring to Punjab cabinet minis-ter and SAD leader Bikram Singh Majithia'sname recently surfacing in money launder-ing through drug trade. The EnforcementDirectorate has also questioned him in thecase.

Mann said: "We are trying to make them(Punjabi voters) understand that they willface the same problem here if they allow theBJP-SAD alliance to come to power inDelhi. They will also make Delhi likePunjab (in terms of drug trade)."

Delhi goes to the polls Feb 7 and theresults will be declared Feb 10. The fourseats the SAD is contesting are RajouriGarden, Kalkaji, Shahdara and Hari Nagar.In the 2013 polls, the SAD won only fromKalkaji.

"Their performance in Punjab is in front ofthe people of Delhi," AAP MP from PatialaDharmveer Gandhi said.

"Delhi Punjabis are well aware of the factthat the BJP-SAD rule will give them onlydrugs. We are telling the same to the peo-ple," he added.

Kejriwal slammed the BJP for"failing" to prevent crimesagainst women claiming thatDelhi has seen a 30 per cent risein rape incidents in the last ninemonths after President's Rule wasimposed.

"There have been 2,069 rapesover the last nine months after wequit, which amounts to a 30 percent increase in it. Moreover thecity has witnessed 4,179 incidentsof eve-teasing, a 25 per cent risein such cases," he said.

election, the ElectionCommission has beensubmitted a list of "trou-bled polling booths" inDelhi where differently-abled persons could facedifficulties.

Deputy Chief Electoralofficer AK Srivastava hadcalled a meeting onJanuary 27 with all thestakeholders to facilitatethe differently-abled vot-ers to exercise their fran-chise without any hassleduring the upcomingAssembly election.

Satendra Singh, RTIactivist and professor ofphysiology at theUniversity College ofMedical Sciences whowas present at the meet-ing, submitted a list of 11polling booths which had

proved trouble makers forvoters with disability inthe past.

In the presence of allthree commissioners ofcivic bodies, measurestaken during the last year'sLok Sabha election tofacilitate such voters werereviewed and it was decid-ed to repeat the same asthey had proved success-ful.

Singh said he asked thegovernment agencies suchas Ministry of SocialJustice and Empowerment(MSJE), DelhiDevelopment Authority(DDA) and Institute ofPhysically Handicapped(IPH) and Government ofNational Capital Territoryof Delhi to provide wheel-chairs at the pollingbooths.

"I have given a list of

troubled polling boothswhich include 11 namesfrom different parts of thecapital so that steps can betaken to make themassessable for such voterswho often prefer not tostep out if such problemspersist," said Singh.

"This exercise to facili-tate voters with disabilitywill certainly raise theparticipation," Singhadded.

During the Lok Sabhapolls, Singh said almost2,600 wheelchairs wereprovided by MSJE andDDA. This time, IPH isexpected to provide 400wheelchairs.

"I urge all the govern-ment bodies includingMSJE and DDA to ensurethat wheelchairs are ingood numbers at thepolling booths as meas-

ures taken during LokSabha elections wereappreciated by almost allquarters," Singh said,adding that he would pro-vide more names of inac-cessible polling booths toCEO office in comingdays.

The polling booths iden-tified so far include HaveliAzam Khan, ChandniChowk, booth no.56 atJNU, Mahroli Assembly,booth number A-28 inSubhash Nagar,block 26Community Centre atWest Patel Nagar, boothsnumber 11, 12, 13, 14 inRajokri, booth at SC/STtraining centre, DilshadGarden among others.

hiked soon after theAssembly polls as the gov-ernment has initiated aprocess to review the rateswhich were last raised in2009.

The Union UrbanDevelopment Ministry hassent a proposal to theAppointments Committee ofthe Cabinet to set up a fare-fixation panel which willsubmit its report within threemonths of getting approved.

Retired Justice AKSrivastava has been chosenas the Chairman of theCommittee, Delhi Metrosources said.

Delhi Metro RailCorporation (DMRC) ChiefMangu Singh had recentlyindicated that a fare hike hasbecome imperative with asignificant rise in the opera-tional costs.

"Fare hike is long overdue.Now when the committeewill be formed and when itwill give its recommenda-

tions is not in my hand,"Singh had said, clearly indi-cating that a fare hike was onthe cards.

Delhi Metro can revise itsfares only on recommenda-tion of the three-membercommittee constituted by theUnion government from timeto time. Apart from a personwho is or has been a highcourt judge, the committeecomprises of the urbandevelopment secretary andDelhi's finance secretary.

Fares were last revised in

2009 when the minimumfare was raised from Rs 6 toRs 8 while the maximumfare was hiked to Rs 30 fromRs 22.

During DMRC's 12thanniversary celebrations, itsoperations director SharatSharma had stated thatalmost 40 per cent of metro'soverall expenses go towardspaying electricity bills withthe power consumption ris-ing to around 63 crore unitsamounting to almost Rs 450crore in 2014-15.

Sunday questioned the "role" of RSSin the anti-Sikh riots as a govern-ment-appointed panel has recom-mended setting up of a SpecialInvestigation Team (SIT) to probe the1984 riots in Delhi.

"One aspect of the anti-Sikh riotson which the media and others havebeen very silent is the role of the RSSactivists in the Sikh riots," theCongress general secretary saidwhile speaking at a function.

In the backdrop of cases againstsome Congress leaders in the riots,Singh said that the issue has beeninvestigated and people have beenput to trial in courts.

Singh said that he thinks whateverhas to be done or whoever has to bepunished is being done in thatrespect.

The committee, headed by formerSupreme Court Judge Justice (retd) GP Mathur, was set up on December 23last year to look into the possibility ofre-investigation of the 1984 riots.

Minister Rajnath Singh last week,recommending setting up of an SITfor a fresh probe into the riots thatfollowed assassination of the thenPrime Minister Indira Gandhi onOctober 31, 1984, the sources said.

An order to this effect is likely afterthe February 7 Delhi Assembly pollsas the Model Code of Conduct is inplace in the national capital now andno such announcement can be made,the sources added.

Opposition parties have slammedthe move, saying it was an attempt toinfluence voters in Delhi as less thana week is left for polling.

"It is deprecating. Justice cannot bean electoral gain... Is it only an elec-toral ploy or gimmick of PrimeMinister Narendra Modi to woo vot-ers ahead of polls? If it is so, then itis deprecating," said Congressspokesman Randeep SinghSurjewala.

He said that on the demand of SAD, the GP Mathur panel had been constituted inDecember 2014 by the NDA government toexamine the possibility of constitution of anSIT for re-investigating of the 1984 riots.

He urged Prime Minister Modi to giveappropriate instructions to the MHA for initi-ating immediate action to set up SIT withoutany further delay to probe the entire casesthoroughly related to "well-organised car-nage" against Sikhs in the national capitaland other parts of the country.

BJP had earlier demanded re-investigationinto all anti-Sikh riot cases.

The Justice Nanavati Commission had rec-ommended reopening of only four of the 241cases closed by police but BJP wanted the re-investigation of all the other 237 cases.

However, it was not immediately clear asto how many anti-Sikh riot cases have beenrecomended for reopening by the JusticeMathur committee.

Of the 241 related cases, only four werereopened and re-investigated by CBI. In twoof the cases, CBI had filed a charge sheet andin one of the cases five persons, including aformer MLA, were convicted.

On December 10, 2014, the governmenthad approved a proposal to give an addition-al compensation of Rs 5 lakh each to the kinof victims of the 1984 anti-Sikh riots.

The compensation to the families of theriot victims will be in addition to what theyhave already received from the governmentand other agencies.

The fresh compensation will cost theexchequer Rs 166 crore.

The issue also figured during talks betweenPrime Minister Modi and Chinese PresidentXi during his historic visit to India inSeptember last year.

Swaraj said that "a critical nature" of thebilateral ties are the growing economic ties.

"China today is our largest partner in tradeand goods. The two countries are moving toinvest in each other. Serious discussionsenhancing connectivity has been initiated.On that foundation we are now seeking totake our economic cooperation to a qualita-tively new level," she added.

"We will make it easier for Chinese compa-nies to do business in India and expect thatsimilar encouragement would be given to ourcompanies to expand their business inChina," Swaraj said.

She also pointed out that another majorthrust is in establishing industrial parks intwo Indian states that would contribute to the'Make in India' initiative. She said China hasagreed to invest USD 20 billion in the parks.

The response provided by US authoritiesfollowing the request under the MLATshowed that the account was being operatedby "Shahjee" who had provided the namewhile registering with the email account,official sources said.

There have been email communicationswith some email addresses in Pakistan andeven personal account of Siddiqui, thesources said.

The email account is also alleged to havebeen operated under the Internet Protocol(IP) address of the Pakistan HighCommission in Colombo, the sourcesclaimed.

As one of the world’s mostsocially heterogeneous soci-eties, building solidarity

across social groups has been asingular challenge in India. Socialbias in India is pervasive across arange of key cleavages — whethercaste or class, region or religion.

In this piece we discuss a differ-ent social bias, not between differ-ent castes and religions but withinall castes and religions, namelygender. Last week, while launchingthe “beti bachao, beti padhao” initia-tive, Prime Minister Narendra Modicalled female foeticide a “mental ill-ness” ailing the whole country. “Wecannot call ourselves citizens of21st century by practising such acrime,” he said. His commentsdescribe the distressing persistenceof female foeticide in contemporaryIndia and underscore the broaderscourge of gender bias in Indiansociety.

One might have expected that themajor societal changes that haveoccurred over the past threedecades — improvements in litera-cy and levels of education, rapideconomic growth, and urbanisation— would have led to a decline ingender bias. While there is undoubt-edly some improvement in the gen-der gap, the growing sex ratio prob-lem and continued gender-basedviolence reveal just how far Indiastill has to travel to bring dignity tohalf its population.

We focus on two different issuesrelated to gender bias — son prefer-ence and norms on appropriateattire for women, which can be aform of social control. Between2001 and 2011, the infant (0-6years) sex ratio in India droppedfrom 927 females per 1,000 malesto 914. In an attempt to understandthe underlying attitudes which arebehind India’s falling sex ratio, weasked Lok Survey respondentsabout their preference for the gen-der of their child. Respondents wereasked the following question: Foryour family, is having more boysthan girls preferred?

Overall, 34 per cent of respon-dents readily admitted that theirfamily preferred having more boys.Given the sensitive nature of thisquestion, this number is a lowerbound since some people willundoubtedly give socially desirable

responses. In order to estimate thetrue levels of son preference, weran a “list experiment” which pro-tects the anonymity of the surveyresponses. The respondents wererandomly divided into two groups,given a list of statements, and thenasked the number of statementswith which they agreed. Only half ofrespondents were given a state-ment about son preference, andtherefore, we were able to estimatethe share of respondents whoagreed to the sensitive statement bycomparing the means of the tworespondent groups. Using this tech-nique, we found that once grantedthe cloak of anonymity, 48 per centof respondents have a preferencefor sons in their family.

Son preference is widespreadacross Indian society with little vari-ance across income classes, edu-cation levels, and rural/ urbanareas.Inter-State variation

Rather, what matters most isregion. Inter-State variation on thisissue exceeds variation on anyother social cleavage in Indian soci-ety. The North-Western States dopoorly, as expected, with Haryana(78 per cent) and Delhi (65 per cent)topping the list. Haryana and Delhialso had the largest gap betweenhow people responded directly andhow they responded in the experi-mental question, demonstrating thatdespite the high levels of son prefer-ence in those places, there is asocial taboo in openly admitting it.Madhya Pradesh (59 per cent),Uttar Pradesh (58 per cent), andPunjab (55 per cent) also reportedhigh levels of son preference in theexperimental question and Kerala(15 per cent) reported the lowest.There was a strong correlationbetween the State-wise son prefer-ence as revealed in the experimentand the actual sex ratios of theStates, suggesting that these atti-tudes are manifesting in sex-selec-tive behaviours.

While son preference is manifestevidence of gender bias in the earlyyears of childhood, there are manyadditional forms of bias and socialcontrol that women face throughouttheir lives, such as ‘suitable’ occu-pations or ‘suitable’ marriage part-ners. These are life-altering choic-es. But one dimension that is perva-

sive in the daily lives of youngwomen is social control on whatwomen wear. The survey exploredthis aspect by asking: Would youconsider (the following clothingchoices) inappropriate for youngwomen in your neighbourhoodwhen they go out with friends?

The part of the question in brack-ets was replaced by a type of cloth-ing like “pants and shirt” or “shorts.”Although we first considered askingabout young women “in your house-hold” instead of “in your neighbour-hood” in the pilot, we found that thequestion provoked conflicts inrespondent households, which ledus to rephrase the question. Clearlythe question was fraught —because young women are trying tomake their own choices instead ofpliantly accepting what they are toldis “appropriate.”

Seventy seven per cent ofrespondents felt that pants and shirtwere inappropriate for youngwomen and 92 per cent felt thatshorts were inappropriate. However,there was a large differencebetween rural and urban respon-dents on this question, with 85 percent of rural respondents disapprov-ing of pants and shirt compared to60 per cent of urban respondents.We attempted to understand whichhousehold attributes might driverespondents to report less restric-tive attitudes on women’s clothingusing multivariate regression analy-sis. Contrary to our finding on sonpreference, attitudes on women’sdress were driven by income,urbanisation and education.Ascriptive identities like caste andreligion played a less significant rolein how people evaluated the appro-priateness of women’s clothing. Inurban areas the income level of thehousehold was the single mostimportant factor impacting howrespondents evaluated the appro-priateness of clothing. For citydwellers, 65 per cent of the poorestfamilies did not think that pantswere appropriate for young womencompared to 50 per cent of thosewith the highest incomes in oursample.

Progress was made on several frontsduring President Barack Obama’svisit to India, but one area that was-

n’t highlighted as much as many hadexpected was terror. While the Indo-U.S.joint statement listed several groups thatthey would work to “disrupt,” includingthe Lashkar-e-Taiba (LeT), Jaish-e-Mohammad, and the Haqqani network,and called for Pakistan to bring the “per-petrators of the Mumbai attack to jus-tice,” it didn’t contain any new languagefrom the statement issued in 2014. It alsomade no mention of the group that mostopenly threatens both India and the U.S.,despite a number of events that haveoccurred since then.

In the past few weeks, Pakistan’s newsmedia have carried “reports” that the gov-ernment was planning a “ban” on theJamaat-ud-Dawa (JuD) and its leaderHafiz Saeed. This began with a story inThe Express Tribune, which was then fol-lowed by Dawn — both respected news-papers of Pakistan. But nobody ques-tioned how the JuD and Saeed could bebanned again, given that they had alreadybeen banned in 2008 after the Mumbai26/11 attacks. Indian newspapers werealso quick to pick up the reports, linkingthe decision to pressure from U.S.Secretary of State John Kerry, who hadvisited India just before going toPakistan. Even the U.S. Department ofState believed the reports; it issued astatement “welcoming” the ban on JuDand other organisations. However, afterdays of waffling, the Pakistani ForeignMinistry clarified in an interview to TheHindu on January 23 that there was nonew ban and that all the “action” takenagainst the JuD dated back to 2008.

It now appears that the reports and theofficial “leaks” were prompted less byU.S. pressure or Indian complaints andmore by the impending visit of the UnitedNations Al-Qaeda and Taliban SanctionsCommittee in Islamabad this week. Thecommittee is looking specifically at thedirectives of the UN Security Council onresolution 1267 that obligate UN mem-bers to ensure that all funds of designatedterrorists are frozen, that they don’tacquire arms, or travel “through their ter-ritory.” It is going to be hard to see howPakistan’s actions against Saeed and hisorganisations can qualify under any of the

three, given his prolific public appear-ances all across Pakistan, his well-guard-ed compounds in Muridke and Lahoreand his massive social media presence.

The U.S. stand

In international relations, comparisonsare never possible. Yet, it should be pos-sible to imagine this scenario: imagine if,post 2001, instead of living secretly in asmall compound in the military town ofAbbottabad, Osama bin Laden lived in aheavily guarded fortress outside Lahore.Imagine that every Friday he led prayersat a centrally located mosque, where headvocated war against the U.S. And onceevery few months, he held massive publicrallies, under the al-Qaeda banner, tomake fiery speeches against the U.S.What would the U.S. do?

This is exactly the situation that theU.S. is facing today in the case of Saeedand JuD. In 2001, the U.S. designated theLeT, also founded by Saeed, as a ForeignTerrorist Organisation; in December 2008the definition of Foreign TerroristOrganisation was amended to include theoutfit’s offshoot, the JuD, in June 2014.Saeed himself was designated a ForeignTerrorist with a $10million bounty on hishead for information leading up to his“arrest or conviction” under the U.S.Rewards for Justice programme in 2012.Apart from the U.S., the UN has named

Saeed, Zaki-ur-Rehman Lakhvi, the LeTand the JuD in the al-Qaeda/Taliban sanc-tions list. It seems inconceivable that theU.S. administration watches blankly as aman designated just as much as Osama

bin Laden once was, flaunts his immuni-ty with impunity.

India’s ineffectiveness

If the American stand on Saeed shows acertain double standard, it also points toIndia’s own ineffectiveness in having itsevidence on the issue counted. The UNmonitoring committee led by formerBritish Diplomat Alexander Evans (since2013), that has produced 16 reports so far,hasn’t said anything on Saeed and Lakhviyet. Even after the Mumbai attacks, it hasfocussed on the LeT’s links with the al-Qaeda, the Tehreek-e-Taliban and thePakistan Taliban, but has not said muchon where the JuD and Saeed obtain theirfunds and operate freely across Pakistan.

In its defence, the Pakistan governmenthas said its courts have not found Saeedguilty of masterminding the 26/11 attacksand has expressed discomfort with usingthe evidence that Indian investigatorshave pieced together against him. But theevidence against Saeed’s involvement inone of the world’s most horrific terrorattacks is far from meagre. To begin with,he is the founder of the LeT, the groupthat took responsibility for the attacks,

even as they were under way. Second,Indian police were able to catch one ofthe attackers, Ajmal Kasab, who becamethe most powerful witness in the case.Kasab’s testimony, which identifiedSaeed as an instigator — as someone whovisited the 26/11 attacker team to lecturethem on the mission and even pickedKasab for the team — is strong enough.Third, there is corroborative evidencefrom David Headley, who has been con-victed and sentenced in a U.S. court forhis role in the Mumbai attacks. Headleydetailed how he conducted the reconnais-sance missions for the Mumbai attacks,picking target locations and filming theroute for the LeT’s team, all underinstructions from Saeed and others in theLeT. If the U.S. sent warnings to Indiaahead of November 2008, it was on thebasis — at least partially — of whatHeadley, who served as a double agent,had told them.

In addition, there are the voice record-ings of the Karachi control room includ-ing clear cold-blooded instructions to the26/11 attackers to kill, which, if Pakistanicourts had allowed, could have beenmatched against the men currently stand-ing trial in Rawalpindi’s Adiala jail, if notSaeed himself. At the worst, if the voicesamples match with none of them, itwould prove that Pakistan needs to broad-en its hunt for the masterminds. Finally,there are the testimonies of the PakistaniFederal Investigation Agency in theAdiala court, which in 2012 testified thatthe 26/11 terrorists were trained at LeTcamps in “Mirpur Sakro of Thatta district,Yousaf Goth and Landhi areas ofKarachi, all in Sindh province” and otherareas in Pakistan, which corroborate thestatements of Kasab and Headley in manyways.

That Pakistan’s government has chosento look away from the mountain of evi-dence that points towards the existence ofthe LeT/JuD, and the need to prosecuteSaeed for the 26/11 attacks, is indeedshocking. But it is as much an evidence ofthe UN and the U.S.’s lack of follow-through on the mass murder of 166 peo-ple in Mumbai, as it is of India’s helpless-ness in the face of both. The speculationover a fresh ban, should, if nothing else,serve as a reminder of the facts in a casethat still sears India’s soul and subcon-scious.

The government’s decision not to appeal against theadverse verdict of the Bombay High Court in itsRs.3,200-crore tax case against Vodafone is the

first concrete demonstration of its resolve to do awaywith what Prime Minister Narendra Modi and FinanceMinister Arun Jaitley termed “adversarial” taxation poli-cies of the erstwhile UPA government. Though the BJPhad during its election campaign, referred to “tax terror-ism” in its election campaign there was little that hap-pened in the first eight months of the new government toshow that such policies would be reversed. The latestCabinet decision sends out a strong signal to foreigninvestors that this government will be fair in its tax poli-cies and avoid needless litigation. The decision not toappeal has implications for other such similar casesinvolving multinationals and is, in that sense, a signifi-cant one. It is also an acknowledgment that the IncomeTax Department’s assessment of the case was erroneous.The Vodafone case was about wrong classification of acapital receipt as taxable income at the hands of the com-pany. Applying transfer-pricing guidelines, the I.T.Department held that Vodafone had underpriced its sharesissued to the parent. So it revalued the shares and deemedthe difference to be a loan given to the parent. This wasclearly high-handed and a wrong application of transfer-pricing regulations. The government’s decision to acceptthe High Court verdict is also a signal to assessing offi-cers that they should refrain from making unreasonabletax demands, relying on aggressive and faulty interpreta-tions of rules and sections. Yet, it is also true that the gov-ernment turns the heat on these officers when it decidesthat tax collections need to be augmented. If the tax offi-cial is confused he cannot be blamed. What is needed is astable policy that sends out the signal to both assessingofficers and taxpayers that the government will crackdown on evasion but within the framework of the law;there will be no extraordinary interpretations of rules andsections even in times of revenue distress. The focus willnow shift to whether the government moves to neutralisethe mischief caused by the retrospective tax amendment;this is a major demand of foreign investors who were dis-appointed that it was not addressed in the first budget ofthis government in July last year. The General AntiAvoidance Rules, or GAAR, are a cause for worry fortaxpayers and foreign investors as they confer wide dis-cretionary powers on the I.T. Department. It will be inter-esting to see if Mr. Jaitley makes a Budget announcementto postpone its implementation once again as per the rec-ommendations of the Parthasarathi Shome Committee.

At their recent meeting, PrimeMinister Narendra Modi andPresident Barack Obama dis-

cussed methods of circumventing theIndian nuclear liability law to protectAmerican reactor suppliers from the con-sequences of accidents caused by designdefects. Although public details arescarce, if they have indeed reached anunderstanding on the issue, then this isnot a cause for celebration; it should be amatter of deep concern.

The importance of supplier liability isillustrated by the Fukushima nuclear dis-aster in 2011. When the reactors were hitby the tsunami that year, the weakness ofthe General Electric (GE) Mark I designwas cruelly exposed. The reactors’ inade-quate containment was unable to preventthe spread of radioactivity when the cool-ing systems failed and pressure built upinside the reactors. Although this designdefect was first noted about 40 years ago,just as the Fukushima reactors were com-missioned, the industry resisted regulato-ry changes that could have amelioratedthe disaster.Framework of impunity

Japan Center for Economic Researchestimated that the cost of cleanup atFukushima may reach $200 billion. A2013 expert study “Accounting for long-term doses in worldwide health effects ofthe Fukushima Daiichi nuclear accident”published in the journal Energy andEnvironmental Science estimated that thedisaster may lead to about a thousandexcess deaths due to cancer. However, itis unlikely that GE will ever be heldaccountable for its poor design choice.Under Japanese law, the supplier isindemnified from liability for an acci-dent. This is the framework of impunityunder which nuclear suppliers like tooperate.

Legal indemnity for suppliers creates a“moral hazard”— encouraging suppliersto take excessive risks since they don’thave to pay for the consequences. Thecase of GE not strengthening the Mark Icontainment is not an exception. ThePresidential commission appointed tostudy the 1979 Three Mile Island disas-ter, which saw a partial nuclear melt-down, pointed out that the supplier,Babcock and Wilcox, was already awareof design defects that contributed to theaccident, but never bothered to resolvethem.

ly defended their privilege of being freeof liability, and they exerted tremendouspressure on the Indian government whenthe Civil Liability for Nuclear DamageAct was framed in 2010. Contrary to theindustry’s propaganda, this is not a“tough” law. Indeed, several clauses inthe law were directly lifted from anannex to the “Convention onSupplementary Compensation,” createdby the U.S. government to benefit itsnuclear industry.

The law channels primary liability foran accident to the operator — the publicsector Nuclear Power Corporation ofIndia — and caps it at Rs. 1,500 crore.This overrides the absolute liability judg-ment of the Supreme Court, passed afterthe Bhopal gas leak disaster, which hadno such limit. The cap is about a thou-sand times smaller than estimates of thedamage that a serious nuclear accidentcould cause. Therefore, the law isdesigned to protect the financial interestsof the operators and the supplier; victimsor the taxpayers will simply have to bearcosts beyond this cap.

Multinational suppliers are unhappybecause a relatively minor clause allowsthe operator to recoup this compensation.By the scales of nuclear commerce, theamount of money involved is minuscule.A single reactor may cost up to an esti-mated Rs. 60,000 crore — 40 times themaximum amount the supplier could beliable for. The figures of each unit havebeen arrived at from studying plantsunder construction in Finland andFrance. If imposing liability on suppliersleads to cost increases, it can only meanthat they are using the law as an excuseto escalate prices.

A close reading of the statements madeby advocates of their interests revealswhat suppliers are really concernedabout: the Indian law could set a prece-dent that could undermine the iniquitousinternational system of impunity thatthey enjoy. “If litigants were able to filesuit against suppliers, essentially it coulddestroy the whole industry,” declaredAshley Tellis, an American negotiator forthe nuclear deal.

The United Progressive Alliance gov-ernment repeatedly tried to subvert thelaw, earning a sharp rebuke from ArunJaitley who wrote in 2013 that “a leopardnever changes its spots. The govern-ment’s intention to dilute the right ofrecourse … [has] continued.” He shouldexplain why his own government is pur-suing a similar policy. The current pro-

posal of using a “legal memorandum” toreinterpret the law is similar to the UPA’sattempt to sign away its “right ofrecourse” on various pretexts.No tangible benefits

The most baffling feature of the currentagreement is that it holds no tangiblebenefits for India. The United States hasoffered to sell two reactor designs —both of which are expensive and untest-ed. The Westinghouse AP1000, whichhas been chosen for Mithi Virdi (Gujarat)is not in commercial operation anywhereand has encountered difficulties wherev-er it is being built. At Plant Vogtle, in theU.S. state of Georgia, Westinghouse andits partner Georgia Power have sued eachother for a billion dollars over costincreases and delays. Even in China, theAP1000 has been delayed by about twoyears because of problems with reactorcoolant pumps.

Even less can be said for GE’sEconomic Simplified Boiling WaterReactor (ESBWR), selected for Kovvada(Andhra Pradesh). After years of ques-tions about ESBWR’s steam dryer, thedesign obtained regulatory approval fromthe U.S. Nuclear RegulatoryCommission — the first step before con-struction can commence — only inSeptember 2014. There are no firmorders for the ESBWR.

The Vogtle plants were initially esti-mated to cost about $7 billion apiece.Even accounting for lower constructioncosts in India we showed — in a detailedstudy “Cost of Electricity from theJaitapur Nuclear Power Plant” publishedin the Economic and Political Weekly —could translate into electricity tariffs thatare as high as Rs. 15 per unit. If the gov-ernment is looking for cheap electricityto promote development, importingAmerican reactors hardly seems like asmart choice.

Last week, the residents of Mithi Virdiwrote an open letter to Mr. Obama andMr. Modi reminding them that the “grampanchayats of four most-affected villages… [have] passed a resolution declaringthe entire … region as [a] nuclear freezone.” The leaders of the “world’s largestdemocracies” face a clear choice. Theycan channel billions of dollars intonuclear corporations by sacrificing safetyand economic prudence. Or they canheed the democratic voices from MithiVirdi and cancel these unnecessary deals.

been arrested for allegedlypushing a woman from WestBengal into flesh trade here,police said on Sunday.

The 24-year-old womanhailing from West Bengal wasallegedly brought here about amonth back on the promise ofbeing given a job of Rs 20,000per month. The woman's hus-band is physically challenged,said S R Patil assistant policeinspector, Bhiwandi policestation.

However, after beingbrought here, the woman wassold to a brothel in HanumanTekdi of Bhiwandi town forRs 50,000, he said.

She was then forced to pro-vide sexual favours to severalmale customers in a day fol-lowing which she became sickand was admitted to hospital,Patil said.

The woman's bid to runaway from the brothel wasalso foiled, he said.

However, some social work-ers rescued her yesterday andtook her to the police stationwhere she lodged a complaint.

A woman, identified asNeela who ran the brothel,was yesterday arrested in con-nection with the offence, hesaid.

The Communist Party of India-Marxist (CPI-M) Sunday condemned the Himachal Pradeshgovernment`s decision to conduct a separateentrance test for admission to the private engi-neering colleges.

Himachal Pradesh Technical University inHamirpur will hold this entrance test whichwill be separated from the all-India test con-ducted under the JEE, it said.

"It`s shocking to note that the governmenthas acted under pressure from the private engi-neering colleges which want an easy access onto the market of students, who do not getthrough the all-India test," CPI-M state secre-tariat member Tikender Panwar said in a state-ment.

Himachal Pradesh has over 34 engineeringcolleges. Of these, 17 are run by private uni-versities.

"In 2014-15, these universities could enrollonly 3,055 candidates against the sanctionedcapacity of 6,100 seats," the statement said.

The CPI-M also said in case the governmentwas serious about Himachal Pradesh TechnicalUniversity, it should be converted into a full-fledged university.

"Currently, the technical university wasnothing but a facilitator for engineering cours-es with small paraphernalia," it said.

cive' policing in the city, thefirst Guwahati PoliceCommissioner JyotirmoyChakravarty has said improvingpolice-public relations would behis priority.

The success of policing is cen-tred around police-public rela-tion and is the 'basic necessity'for better results, Chakravartysaid.

"Guwahati Police's philoso-phy will be non-coercive polic-ing. We have to ensure lawenforcement by consent, not byforce. This is going to be a long-term goal," he said.

Accepting that the image ofpolice is not 'very good' inAssam, Chakravarty said notonly the attitude of police has tochange but the behaviour ofpeople towards policemen alsoneeds to improve.

"While we will internally

work with our men in this direc-tion, we will engage NGOs tomake the public understandabout self-policing for personalbenefit. We will tie up with thegroups to tell people that thepolice force is a friend of peo-ple," he said.

Chakravarty said the policecommissionerate system intro-duced in the city a month agoneeded to work on a lot on manyareas, including integration ofdifferent technologies for betterinvestigation purposes.

"We have lots of challenges,the major being the lack ofinfrastructure. It (commission-erate) is a new system and weneed to work out the procedure.We will also need orientationfor our men as it is not going tobe traditional policing as mostof our senior officials have mag-isterial power now. It will takearound six months to fully settledown," he added.

against journalistscovering a stand-offbetween authoritiesand self-styled 'god-man' Rampal inHaryana last year was"unprovoked" and"pre-meditated", amedia panel has said,recommending a judi-cial probe into theincident.

The panel, set up bythe Broadcast Editors'Association (BEA) tolook into the incident,has recommendedprobe by a SupremeCourt judge into thealleged assault bypolice on the journal-ists in Hissar districtin November last.

In its report, the

three-member com-mittee has concludedthat the police actionagainst media per-sons was "unpro-voked" and "pre-meditated". It said thepolice had actedagainst media per-sons as it did notwant the use of forceagainst women andkids to be recordedby the media forshowing it on chan-nels. The panelemphasised thatpolitical executiveshould be sensitive tosuch incidents.

The BEA, a bodywith editors of lead-ing news channels asits members, had con-stituted the panelshortly after the inci-

dent that occurred inNovember last year.

In its report, thethree member com-mittee said that it hadmet Haryana ChiefMinister ManoharLal, police officers,and also talked to thelocal villagers.

It added that itfound that not onlythe victim journalistsbut also police offi-cers were categoricalin their assertions thatthere was no provo-cation from or caus-ing of functionalimpediment from theside of media personswith regard to policeoperation.

the event but hardlyhad the operationbegun by the police-men assisted by thepara-military forces,when media personswere subjected tolathi-charge.

for alleged divergent figures abouthis age and assets in affidavits sub-mitted on different occasions, BiharChief Minister Jitan Ram Manjhi onSunday stood by details submittedduring last year's general elections.

"I stand by my age (70 years) andassets (immovable) that I had fur-nished in affidavit submitted duringfiling of nominations during generalelections last year," he told reportersin reply to a question.

Manjhi had contested from Gaya(SC) Lok Sabha seat last year andstood third. "There is nothing wrongabout details related to my age andassets," the chief minister said inreply to a volley of questions by themediapersons at a function in thestate capital before hastily gettinginto car. Manjhi had got embroiledin a controversy yesterday with asection of media projecting lacunaeabout his age and immovable assetsin at least three affidavits submittedby him in the past one year.

The chief minister had mentionedhis age at about 68 years at oneplace, while the same stood at 71years and 70 years in two other affi-

davits and failed to declare hisimmovable asset in one of affi-davits, while declared the same asfive acre land in another document,the media reports said.

The BJP and a section of the rul-ing JD(U) mounted attack onManjhi following the report andasked him to come forward to tellthe truth.

"The chief minister has causedembarrassment to himself and hisgovernment by declaring differentage and assets," former DeputyChief minister Sushil Kumar Modisaid and called upon the former toexplain the truth. Bihar unit JD(U)spokesperson Neeraj Kumar, whohad attacked Manjhi on numerousoccasions last month exposing turfwar between the incumbent chiefminister and his predecessor NitishKumar said Manjhi showed callous-ness by failing to report his correctage and assets in official documents.

"It reflects character of a person,"Kumar told reporters.

The head of China's commerce regula-tor met with Alibaba Group HoldingLtd chairman Jack Ma to discuss com-

bating fake products, the official Xinhuanews agency reported, with the two adoptinga conciliatory tone after a row over illegalbusiness on the Internet company's plat-forms.

The meeting took place the same day theregulator, the State Administration forIndustry and Commerce (SAIC), back-tracked on an earlier report that had excoriat-ed the Chinese online commerce company

for not doing enough to suppress counterfeit-ing on its websites. SAIC issued what itcalled a "white paper" on Wednesday sayingmany products sold on Alibaba's websitesinfringed on trademarks, or were banned,substandard or fake. White papers often con-vey official policy positions. But in a follow-up statement posted on its website on Friday,a spokesman for the regulator said the reportwas in fact not a white paper and carried nolegal force.

"The most recent SAIC posting speaks foritself. We feel vindicated," Alibaba said in a

statement in response. It's unclear what prompted the regulator's

seeming about-face in a highly unusualepisode, one that saw a major Chinese corpo-ration clash publicly with an influential gov-ernment organization.

While it remains unclear whether the SAICintended any specific action against Alibabaor counterfeiting in general, analysts said theincident reminded investors of the politicalrisk inherent in Chinese companies, that thecountry's regulators may clamp down onbusiness activities with little warning. In the

German luxury carmaker BMW has fixed a securi-ty flaw that could have allowed hackers to unlockthe doors of up to 2.2 million Rolls-Royce, Mini

and BMW vehicles, it said on Friday.BMW said officials at German motorist association

ADAC had identified the problem, which affected carsequipped with the company's ConnectedDrive softwareusing on-board SIM cards -- the chips used to identifyauthorised users of mobiledevices.

BMW drivers can usethe software and SIMcards to activate doorlocking mechanisms,as well as a range ofother services includ-ing real-time trafficinformation, onlineentertainment and air con-ditioning.

The security risk occurredwhen data was transmitted, BMW said, adding it did notimpede the car's critical functions of driving, steering orbraking. BMW said it was not aware of any exampleswhere the data had been used to compromise the securityof a vehicle. In recent years, cyber-security experts havecriticised the automotive industry for failing to do moreto secure internal communications of vehicles with net-work-connected features. The danger, they say, is thatonce external security is breached, hackers can have freerein to access onboard vehicle computer systems whichmanage everything from engines and brakes to air condi-tioning. They fear it is only a matter of time before hack-ers might break into wireless networks on cars to exploitsoftware glitches and other vulnerabilities to try to harmdrivers.

LONDON, FEB 01Red Bull may win races this season but they cannot real-

istically expect to mount a Formula One title challenge,according to their championship-winning designer AdrianNewey.

"I think we should be realistic about our expectations forthis year," the Briton, who has stepped back fromhis full time role as technicalsupremo at the former champions,said in an interview published byRed Bull.

"This year will really beabout continuing to try tomove forward and reduce the(power) deficit that we suf-fered at times last year.

"If we can manage the odd win, as we did last year, thenthat would be fantastic. But we can`t count on it. I thinkit`s really a season that will be very much about trying toextract the most we can and build on it for the future."

Red Bull won three races last year, to 16 for Mercedes,and relinquished both drivers` and constructors` titles they

had held for four years in a row.The 2014 season featured the introduction of a new V6

turbo hybrid power unit, with Mercedes emerging as thepick of the field while Red Bull`s partners Renault strug-gled with reliability and performance.

Renault are hopeful of narrowing a gap that Newey esti-mated at 60 horsepower at the end of last season, but

Mercedes have also been working hard ontheir engine.

"The pace of development, just becauseof the technology, is slower than we`re

able to work at on the chassis side,"said Newey.

"They (Renault) have a challengeahead, which I`m confident they willmeet, but they need time to achieve

that."Red Bull finished second overall last season with

Australian Daniel Ricciardo and four times championSebastian Vettel, who has now joined Ferrari. RussianDaniil Kvyat has joined as the German`s replacement.

The season starts in Australia on March 15.

Three teams unveiled their cars for the 2015 sea-son race on Sunday. Williams and Mercedesunveiled their cars alongside their drivers in front ofthe press in Jerez. While, Red Bull gave the first lookof their car and posted photos of a test drive byDaniel Ricciardo.

Williams' new car named FW37 has come out intheir classic white. The team that finished third in theteam standings last season, presented the car withdrivers Felipe Massa, Valtteri Bottas, Susie Wolffand Alex Lynn.

Meanwhile 2014 champions Mercedes alsounveiled their new car on Sunday with LewisHamilton and Nico Rosberg taking out the wraps offthe F1 W06 Hybrid in the Jerez pit lane.

According to reports, Mercedes' car is expected todeliver mechanical, structural, aerodynamic andweight saving developments and is strengthened inthese sections over its predecessor. Germany'sRosberg will have the honour of driving the F1 W06on Sunday at the start of the four-day Jerez session.

The car is known as the Sechsy Beast.Last season's runner-up team Red Bull also gave

the first look of their car. Named as the RB11, RedBull tested the car with Ricciardo.

They did away with their previous colour altogeth-er after introducing a striking camouflaged liveryahead of the first Jerez test on Sunday morning.

The new livery has been designed especially forpre-season testing. Its white witch black imprintsgiving the car an altogether new look.

With the RB11, the team is carrying the hopes ofDaniel Ricciardo and new arrival Daniil Kvyat thisseason. Kvyat comes from Torro Rosso.
