STIPULATEDPROCEDURALORDER
On September17, 2003,HawaiianElectric Company,Inc. (“HECO”) filed an
applicationfor approvalto commitfundsin excessof $500,000for ItemY00021, the
New KuahuaSubstationproject. HECOservedcopiesofthe applicationon theDivision
ofConsumerAdvocacyofthe DepartmentofCommerceandConsumerAffairs (the
“ConsumerAdvocate”or “CA”).
By OrderNo. 20597,filed October28, 2003, theCommissiondirectedHECOand
theConsumerAdvocateto meetinformally to formulateastipulatedschedulingorder for
submissionto the Commissionfor approvalby November17, 2003(twentydaysfrom the
dateofOrderNo. 20597).
By OrderNo. 20657,filed November20, 2003,theCommissionapprovedHECO
andtheConsumerAdvocate’srequestfor anextensionoftime until December3, 2003to
submita stipulatedschedulingorderto theCommission.
HECO andthe ConsumerAdvocatehavereachedagreementon proceduralmatters
andsubmitthis StipulatedProceduralOrderto theCommission,which is acceptableto
theparties.
ACCORDINGLY, IT IS ORDEREDthatthefollowing StatementofIssues,
ScheduleofProceedings,andproceduresshallbeutilized in thisdocket.
I.
STATEMENT OFTHE ISSUES
The issuesin this docketare:
1. WhetherHECO‘s proposedexpendituresfor ItemY00021, theNew
KuahuaSubstation,will providefacilitieswhicharereasonablyrequiredto
meetHECO’sprobablefuture requirementsfor utility purposes?

If therearesubstantialdisagreementsfollowing thefiling ofthe SOPs,andthe
partiescannotresolvethe differencesby stipulationandthe partiesdo not waive theright
to ahearing,thepartiesshallproposeahearingschedule(includingthefiling of
simultaneouspost-hearingbriefs) for Commissionapproval.
If HECOdeterminesthataReply SOPis unnecessary,HECOandtheCA will
notify theCommissionthattheproceedingis readyfor decisionmaking.
ThepartiesacknowledgethatunderSection2.3.g.2oftheCommission’sGeneral
OrderNo. 7, theCommission’s90-dayperiodto act upontheApplication andrendera
DecisionandOrderexpireson December16, 2003. Giventhe scheduleagreedto by the
parties,HECOrequestsandtheCommissionapprovesan extensionofthe 90-dayperiod
for theCommissionto act upontheApplicationuntil 20 daysafterHECOprovidesnotice
thattheproceedingis readyfor decisionmaking (andHECOdoesnot file aReply SOP)
or 20 daysafterHECOfiles its Reply SOP.
If thepartiesproposeahearingschedule(becausetherearesubstantial
disagreementsfollowing the filing ofthe SOPs,andthepartiescannotresolvethe
differencesby stipulationandthepartiesdo not waive theright to ahearing),HECO
requestsandtheCommissionapprovesan extensionofthe 90 dayperiodfor the
Commissionto act upontheApplicationuntil 45 daysafterthesubmittal ofpost-hearing

briefs.
III.
MISCELLANEOUSMATTERS TO FACILITATEAND EXPEDITE THE ORDERLY CONDUCTOF
THESEPROCEEDINGS
A. Requestsfor Information
To theextentpractical,HECO andtheConsumerAdvocatewill cooperate(1) by
exchanginginformationrequestsandresponsesastheybecomeavailable,and(2) by
resolvingquestionsregardinginformation requestsandresponsesinformally to attemptto
work out problemswith respectto understandingthe scopeormeaningof information
requests,or with respectto the availability of information. If apartyis unableto provide
theinformationrequestedwithin theprescribedtime period, it shouldso indicateto the
inquiring partyassoonaspossible.The partiesshall thenendeavorto agreeupon alater
datefor submissionoftherequestedinformation.
In lieu ofresponsesto informationrequeststhatwould requirethereproductionof
voluminousdocumentsor materials,the documentsor materialsmaybemadeavailable
for reasonableinspectionandcopyingat amutuallyagreeabledesignatedlocationand
time. In theeventsuchinformation is availableon computerdisketteor otherreadily
usableelectronicmedium,thepartyrespondingto the informationrequestmaymakethe
disketteor suchelectronicmediumavailableto the otherparty andtheCommission.
A partyshallnot berequired,in a responseto an informationrequest,to provide
datathatarealreadyon file with theCommissionor otherwisepartofthepublic record,

orthat maybe stipulatedto pursuantto PartB, infra. Therespondingpartyshall, in lieu
ofproductionofa documentin thepublic record,includein its responseto the
informationrequestan identificationofthedocumentwith reasonablespecificity
sufficient to enabletherequestingparty to locateandcopy the document. In addition,a
party shallnot be required,in aresponseto an informationrequest,to make
computations,computeratios,reclassify,trend,calculate,or otherwisereworkdata
containedin its files or records.
A partymayobjectto respondingto an informationrequestthat it deemsto be
irrelevant,immaterial,unduly burdensome,onerousor repetitious,or wheretheresponse
containsinformationclaimedto beprivilegedor subjectto protection(confidential
information). If aparty claimsthat informationrequestedis confidential,andwithholds
productionof all or aportionof suchconfidentialinformation,theparty shall: (1) provide
informationreasonablysufficient to identify theconfidential informationwithheldfrom
theresponse,without disclosingprivilegedor protectedinformation; (2) statethebasisfor
withholdingtheconfidential information (including,but not limited to, thespecific
privilege applicableor protectionclaimedfor theconfidential informationandthe
specificharmthatwould befallthepartyif theinformationweredisclosed);and(3) state
whetherthepartyis willing to providetheconfidential informationpursuantto a
protectiveordergoverningthis docket.
A partyseekingproductionof documentsnotwithstandingaparty’sclaimof
confidentiality,may file amotionto compelproductionwith the Commission.

B. Mattersof PublicRecord
In orderto provideameansto reduceunnecessaryreproductionofdocumentsand
to facilitatetheseproceedings,identified mattersofpublic record,suchasreportsthat
HECOhasfiled with theCommission,publisheddecisionsof this or otherCommissions,
publishedscientificor economicstatisticaldata,materialandtextbooks,technicalor
industryjournalsrelatingto electricutility matters,andspecifiedpartsoftherecordin
previousCommissiondocketsshallbeadmissiblein thisproceedingwithoutthenecessity
ofreproducingeachdocument;providedthat thedocumentto beadmittedis clearly
identifiedby referenceto theplaceof publication,file or docketnumber,andthe
identified documentis availablefor inspectionby the Commissionandtheparties;and
furtherprovidedthatanypartyhasthe right to explain,qualify or conductexamination
with respectto theidentifieddocument.TheCommissioncanrule on whetherthe
identified documentcanbeadmittedinto evidencewhena partyprofferssuchdocument
for admissionasevidencein this case.
From time to time, thepartiesmayenterinto stipulationsthatsuchdocuments,or
anyportionof suchdocuments,maybeintroducedinto evidencein this case.
C. Copiesof Filings and InformationRequests.

Commission’sRulesofPracticeandProcedure.
4. Copiesof all filings, informationrequestsandinformationrequest
responsesshouldbe sentto theotherpartiesby handdelivery orvia facsimile. In
addition, if available,all partiesshallprovidecopiesof theirfilings, informationrequests
andinformationrequestresponsesto theotherpartiesvia disketteor e-mail in a standard
electronicformatthat is readilyavailableby theparties. Thepartiesagreeto useWord 97
orWord 2000 asthestandardprogrammingformatfor filings in thiscase. However,if
workpapers,documentation,or exhibitsattachedto anyfiling arenot readily availablein
anelectronicformat,a partyshallnot berequiredto convertsuchworkpapers,
documentation,or exhibits into an electronicformat. Also, existingdocumentsproduced
in responseto requestsneednotbeconvertedto Word 97/Word2000aslongasthe
applicableformatis identified. In theeventa copyof a filing, informationrequestor
informationrequestresponseis deliveredto a partyvia disketteore-mail, unless
otherwiseagreedto by suchparty,the samenumberof copiesof suchfiling, information
requestor informationrequestresponsemust still bedeliveredto suchpartyby hand

deliveryor via facsimileasprovidedin PartsC.1 and C.2 above.
D. Communications
Chapter61, subchapter3, section6-61-29of the Commission’sRulesofPractice
andProcedureconcerningex partecommunicationsis applicableto anycommunications
betweena partyandtheCommission.However,thepartiesmaycommunicatewith
Commissioncounselon mattersof practiceandprocedurethroughtheirown counselor
designatedofficial.
Communicationsbetweenthepartiesshouldeitherbe throughcounselor through
designatedrepresentatives.All pleadings,papers,andotherdocumentsfiled in this
proceedingshallbeservedon theopposingparty. All motions,supportingmemoranda,
andthelike shall alsobe servedon opposingcounsel.
E. General
Theseproceduresareconsistentwith the orderlyconductofthis docket.
Pursuantto Chapter61, subchapter3, section6-61-37of theCommission’sRules
of PracticeandProcedure,this StipulatedProceduralOrdershallcontrolthe subsequent
coursesof theproceedings,unlessmodifiedat orprior to thehearingsto preventmanifest
injustice.
