Itesl 116: Telephone The court discussed a request from the District Judge for an addi tional telephone line for hls off ice and a possible decision on the telephone systea for the courthouse. Judge Jones stated there are no additional extensions available on the current phone system. Judge Jones reqested the court to investigate any extensions that are unused or under-utiIlzed in order for his office to utfiize a line.

Kevin Sgith, County Auditor, stated the county received a quote for an upgrade to the phone system and for voice mail. Mr. S8ith stated he will review any possible under-utilized Iines or unused Iines and report back to the court,

INTERLOCAL INDEMNITY AGREEMENT

State of Texas County of Burnet City of Highland Hvvan -

This Agreement is entered into by and between the City of Highland Haven, Burnet county, Texas, acting by and through its governiirg body, and hereinafter called City, and the County of Burnet, State of Texas, acting by and through its governing body, hereinafter called County, upon the following terms and conditions.

The County hds agreed to help the City with repair of street surfaces damage; a list of specific streets to be repaired is attached. The agreed assistance to the City by the County will be limited to the use of County equipment and employees, within the limitations prescribed by law, on condition that the City hold the County harmless from loss, damage, or liability that the County may suffer from claims made against it because of the use, furnishing, or operation of County's equipment or actions by County's employees in the use, operation or maintenance of such equipment, on behalf of the City.

1. The City undertakes to indemnify and save the County harmless from and liability of M

damages County may suffer from claims, demands, suits, or judgments against County F arising out of the use, maintenance or operation of County's equipment or machinery, or the acts, or omissions of County's employees in the operation, use of maintenance of said equipment or machinery, for the City, except those acts or omissions that may reasonably be determined to be gross neglect of the County or of its employees. -

2. The indemnity herein provided for will extend from the 1 7 ~ day of October 2000, until the above described project has been completed, or October 1, 2001, whichever comes first.

3. The County will furnish written notice to the City of any claim made against the County on the indemnified obligations. The County will comply with all Ordinances and provisions regarding claims against the City.

This agreement may be canceled by mutual consent of both parties, however, any such cancellation will not relieve City from any obligations hereunder for any liability or damages County may suffer becaus of claims, demands, suits, costs, or judgments against County arising before the date of cancellaJon of this agreement.

SEPTIC & DEVELOPMENT PERlWT APPLICATION PROCEEDURE

Applicant should obtain a copy of the blank septic or development application along with a checkfist in room 107 of the courthouse. The applicant should provide all documentation required on the checklist and complete the application form and return it to room 107 for review by the environsnentd services director or floodplain administrator or their designee. A trackmg number will be assigned and the applicable fees coifected upon receipt of the completed application and required checkfist materials by Burnet County. No applications will be accepted without the required planning material. The review is to be conducted by the mvironmentd services director / floodplain administrator or their designee. Review persomei will have 10 working days to cumplete the review or make a formal request in writing fiom the applicant for fbther information if needed. All reviews must be done in a timely manner. Any review not completed within 10 working days will be deemed acceptable unless firrther material has been formally requested in d i n g (ie. certified mad) fiom the applicant.

The review will verify ownership, location and compliance with Burnet County on-site sewage and subdivision regulations and the Flood Damage Prevention Order.

Upon successfid review, the applicant will be notified by phone or mail. Construction may begin st this time. Copies of the authorization to construct an on-site sewage fwility or authorized development permits may be picked up st the courthouse or mailed to the applicant.

Upon satidkctory inspection of on-site sewage Wties, a permit to operate will be issued by Bumet County. A certificate of compliance will be issued for approved development within the 100 year floodplain. Permanent records will be maintained by Burnet County for as long as is practically possible.

upon the recommendation of the Commissioners Court of the County of Burnet, Texas and,

WHEREAS, the intended lessor, Associates Commercial Corp., in proposal offers the lease/purchase of a New 2000 Etnyre FWD 11/22 VW Chip Spreader at the following terms:

CONTRACT BETWEEN BURNET COUNTY AND

THE BURNET COUNTY FAlR AND RODEO ASSOCIATION

WHEREBY BURNET COUNTY FAlR AND RODEO ASSOCIATION agrees to provide the promotion of youth oriented programs to the County of Burnet. BURNET COUNTY FAlR AND RODEO ASSOCIATION agrees to perform the services that are customarily p e r f o r m by such associations and which have been provided to Burnet County in the past and paid for by Burnet County. The BURNET COUNTY FAlR AND RODEO ASSOCIATION agrees to provide these services for an amount not to exceed $2,400.00 for its services under this Agreement. The compensation is payable as determined by the Commissioners Court and provided for in the FY 2001 budget. Any discrepancies in payment shall be determined by the Commissioners Court Minutes and the Budget, which are on record in the County Clerk's Office in Burnet County. Any change in the Budget or monies requested will require a written revision and approval by the Commissioners Court. This Agreement is for a period of 12 months to begin October 1, 2000 and expire September 30, 2001. w

COOPERATIVE AGREEMENT

THE STATE OF TEXAS

COUNTY OF BURNET

This Agreement is entered into this 1st day of October, 2000 and shall end September 30,2001, by and between the d!lTY OF COTTONWOOD and COMMISSIONERS' COURT and SHERIFF of Bwrnet County, Texas as follows:

WHEREAS, the ClTY OF COTTONWOOD operates a municipal marshall department and the BURNET COUNTY Sheriff's Department operates a radio law enforcement dispatch system, and;

WHEREAS, the jurisdiction of the ClTY and the COUNTY law enforcement units overlap and;

WHEREAS, the mutual interest of both law enforcement units could best be served by the cooperative use of one r'adio law enforcement dispatch unit and;

WHEREAS, the ClTY COUNCIL of the ClTY OF COTTONWOOD and the COMMISSIONERS' COURT of BURNET CUUNTY have ratified this Agreement and approved its provisions;

It is therefore agreed that the ClTY OF COTTONWOOD, in order to partially defray the expense of the operation of a dhdio law enforcement dispatch unit, shall pay to BURNET COUNTY the cahh sum of $3014.00 (THREE THOUSAND FOURTEEN AND NO1100 DO(LLARS) annually. Payments will be due on the first day of each month, be inning with October 1, 2000, as follows: eleven monthly installments of $251. it (Two Hundred Fifty- one and no1100 dollars) and the final monthly installrfhent of $253.00 (Two Hundred Fifty-three and no1100 dollars) due September 1,2001.

In consideration of the said payment to BURNET COUNTY, the ClTY OF COTTONWOOD and the COTTONWOOD MARSHALL DEPARTMENT shall receive the benefit of full time (24 hours per day) radio law enforcement dispatching services operated by and under the control of the SHERIFF OF BURNET COUNTY.

1. CALL TO ORDER AND ROLL CALL: Mayor Pickens called this Regular Meeting to Order at 7:03 p.m., with both Commissioner Phipps and Commissioner Pfeifer in attendance, a Quorum was present.

He stated this was the same standard agreement that the City approved last year. He added there had not been any increase in the cost for this much needed service. Commissioner Pfeifer made a motion to approve the agreement between the City of Cottonwood Shores and the Commissioners' Court and the Sheriff of Burnet County for dispatching , services from Odober 1, 2000 through September 30, 2001. CONSIDER AND POSSIBLY TAKE ACTION ON THE APPROVAL OF THE PROPOSED REPLAT OF * LEGACY 9 AND LEGACY 11, AS SHOWN ON THE PLAT OF "THE PENINSULA" (NORMAN HURD HOME TRACT IN BURNET COUNTY) TO BE KNOWN AS "A PLAT TO FORM LEGACY 9-A, THE PENINSULA" WITHIN THE ClTY OF COTTONWOOD SHORES EXTRA TERRITORIAL JURISDICTION: Mayor Pickens introduced Mr. Don Sherrnan with W~llis Environmental Engineering to explain the replat of Legacy 9 and Legacy 11. Mr. Sherman stated The Peninsula" had been plated into 11 lots. One buyer had purchased two of the lots and was requesting the replat, which would be known as 'A Plat to Form Legacy 9- A, The Peninsula'. This would do away with the present utility easement between Lot 9 and Lot 11, and allow him to build a larger home doser to the lake. Commissioner Pfeifer stated he did not see a problem with allowing the replat. Mr. James Gillis asked where this land was located. Mr. Sherman explained the location on Ranch Road 2147 just before Horseshoe Bay. Mr. Gillis asked how many lots were in the subdivision. Mr. Sherman stated there was originally eleven, if this replat is approved then there will be ten. Mr. Gillis asked if the area was in the City Limits of Cottonwood Shores. Mr. Shennan explained it was not in the City's Corporate Limits, however, it is in the City's E.T.J. Mayor Pickens stated Mr. Sherman had brought the original plat to the Council at the last regular meeting. Now he was requesting a replat and needed Council approval before he could proceed to the county level. Then Commissioner Pfeifer made a motion to approve the proposed replat of Legacy 9 and Legacy 11 of The Peninsula into Legacy 9-A, The Peninsula. Commissioner Phipps seconded his motion, which carded.

6. CONSlDER AND POSSIBLY TAKE ACTION ON A REQUEST BY MR. BRADLEY TRAVIS FOR A VARIANCE TO ORDINANCE NO. 060799, AN ORDINANCE OF M E ClTY OF COTTOMMOOD SHORES, EXAS, REGULATING THE LICENSING AND PERMlmNG OF SIGNS, EXTENDING THE MAXIMUM TIME PERIOD FOR TEMPORARY SPECIAL EVENT SIGNS: Mayor Pickens stated the City hada sign ordinance which put a limit on the time a special event sign could be displayed [forty-five (45) days]. Mr. Travis wanted an exlension to display his from May to September. Mayor Pickens stated he had observed the sign was continuously blowing down. He was concerned it could be a hazanl if it blew in the road. Commissioner ffeifer stated last time the wind picked up the canopy fell down. Mr. Keith Patschke stated the canopy remains on his property now. Mayor Pickens stated he would like for Mr. Travis to come address the Council. He wanted him to do a better job of displaying his sign and assure the Council of its safety.

Commissioner Pfeifer made a motion to disapprove Mr. Travis' request until such time he could assure Council sign would be secured. Commissioner Phipps seconded his motion, which carried.

CONSIDER AND POSSIBLY TAKE ACTION ON A REQUEST BY MR. KEITH PATSCHKE TO ABANDON AND CLOSE THE ROAD (RIDGEVIEW DRIVE) ALONG LOT 74, BLUFFVIEW SECTION, WITHIN THE CITY OF COTTONWOOD SHORES: Mr. Patschke stated he would like to develop area for commercial activity such as a restaurant. He added he would pay for all cost involved with the procedure. Commissioner Pfeifer asked if it was just the road in front of Lot 74 or whole road. Mr. Patschke stated the highlighted area on the map showed what he intended for the Council to close. He was asking for the road beginning from the southwest corner of Lot 70 up to the northeast comer of Lot 74. He wanted to then have the area zoned for commercial activity in order to generate some sales tax revenue. Commissioner Pfeifer expressed concern for giving up the road, which he felt belonged to the Mizens of Cottonwood Shores. Mayor Pickens asked Mr. Patschke if he owned Lot 70. Mr. Patschke stated he had consent from the property owner. Commissioner Pf- he had heard of closing alleyways, but felt citizens should have a say about closing a through rocP1.=#3%&&ed Council should hold a public hearing to let them speak. He suggested checking to see what 5IiepmWSs was.%iayor Pickens stated the area was zoned Single Family Residential now. He was not sure citizens would want commercial activrty. He agreed it would be a good idea to see what the procedure was before proceeding any further. Commissioner Phipps stated she felt she didn't have enough information at this time to make a decision. Commissioner Pfeifer made a motion to disapprove Mr. Patschke request at this time until procedure was determined. Commissioner Phipps seconded his motion, which carried.

CONSIDER AND POSSIBLY TAKE ACTION ON ORDINANCE NO. 092100, AN ORDINANCE OF THE CITY OF COTTONWOOD SHORES, TEXAS, ADOPTING THE BUDGET FOR THE CITY OF COTTONWOOD SHORES, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2000 AND ENDING ON SEPTEMBER 30, 2001: Commissioner Phipps made a motion to approve Ordinance No. 092100, an Ordinance of the City of Cottonwood Shores adopting the budget for the City for the fiscal year beginning October 1,2000 and ending on September 30,2001. Commissioner ffeifer seconded her motion, ,C which carried.

CONSIDER AND POSSIBLY TAKE ACTION ON ORDINANCE NO. 092100-A, AN ORDINANCE OF THE CITY OF COTTONWOOD SHORES, TEXAS, LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT FOR M E FISCAL YEAR 2000 - 2001: Mayor Pickens stated this ordinance would set a Tax Rate of $0.3782 for each one-hundred dollar valuation of property, of which $0.2647 was for General Government and $0.1135 was for Water Interest and Sinking. Commissioner Pfeifer made a motion to approve Ordinance No. 092100-A levying taxes for the use and support of the Municipal Government for the fiscal year 2000 - 2001. Commissioner Phipps seconded his motion, which canied.

9. MONTHLY ACTIVITY REPORTS: A. POLICE DEPARTMENT:

(1) ACTIVITY LOG: Chief Reeh read the report for the Police Department. He noted there had been no traffic accidents. Mayor Pickens stated he knew why there had not been a lot of activity this month. He had the occasion to be out late several evenings going up to the water plant. He noticed Chief Reeh out on RR 2147 running radar and was sure the word was getting around. (2) ARREST

B. PUBUC WORKS: (1) WATER 8 SEWER SYSTEM PERFORMANCE 8 USAGE: Mayor Pickens stated Robert Pope was

not in attendance since he had been working hard to keep water in service. Mr. James Gillis stated the water pressure had been better in Castle Terrace lately. Mayor Pickens stated that even with the mandatory water conservation in effect, people are still using more water. He noted the water crew had been up there day and night trying to keep the plant up and running. Mrs. Rains asked about the new water tank. Mayor Pickens stated the contractor had 120 days to'complete the installation, and the dock was running. Mr. Gillis asked if it was a local contractor or someone from out of town. Mayor Pickens stated L.S.E. was the contractwfor the job. He noted they were new to the area. He added there had been some delay in revising the plans for the foundation because of the height and wind upon the hill. Mrs. Rains asked if the City was still getting water from Horseshoe Bay. Mayor Pickens stated no. He noted that had ended two days ago, the City used that just

0 during outages to keep water flowing. He added the connection was still there just in case. Mr. Mike Butler asked if the City had plans to increase the raw water pump. Mayor Pickens stated they had upgraded the pump already. He noted the size of the line needed to be increased as well as a new road bore sometime in the future. Mr. Butler asked if the standpipe at the Civic Center was cut-off. He added the Fire Department

had not used any water since August. Mayor Pickens stated that since it had been leaking it was cut-off at the

0 valve. Mr. Butler stated he didn't have a wrench for the valve. Mayor Pickens suggested he use one of the other two if the Fire Department needed water. He added it would be fasterthan turning on and off the valve.

(2) ANIMAL CONTROL: Mr. Gillis asked about the outcome of the parrot in Castle Terrace. Connie Capone explained she had talked to Ms. Brenda Slaton about the situation. Ms. Slaton agreed to keep the bird inside during the weekends, and not as early on the weekdays. She also stated Ms. Slaton was trying to find a new home for her bird. Connie also stated the kennel was full. She had two little dogs if any one knows of a good home for them. She noted that her truck was broke down which made it difficult to patrol. She added she had been busy with the water so no report to give to Council tonight. Mayor Pickens stated he knew she had delivered a few animals to their home and was doing the best she could. C. CIVIC PRIDE:

(1) UPCOMING MEETING DATES: Marjorie Phipps stated Claudie Short was out of town but she wanted to remind everyone of the spaghetti supper Friday, September 22"d at the Civic Center from 5:30 to 7:00 for $5.00 a plate. Mayor Pickens encouraged everyone to attend.

12) FUTURE PRO-rS - - 10. MAYOR'S REPORT:

A. UPDATE ON WATER SYSTEM IMPROVEMENTS GRANT: Mayor Pickens stated any day now we should see some action on the hill. He noted the City plans to extend the 8 inch main into the City for hydrants. The presentation for the grant to extend the water lines within the City should be sometime in October. He noted it was not a fast process, but it was underway.

B. UPDATE OF SEWER PROJECT IN CASTLE TERRACE: Mayor Pickens stated the crew was working on the road bore tonight to make the connection. Once all is done they will repave the roads in Castle Terrace. Mr. Gillis asked if the roads would be widened. Mayor Pickens stated there was a fifty-foot (50') right-of-way for the roads. They will not be widened any further than that. commissioner Pfeifer stated the property pins are fifty-foot (50') apart the actual paving will be twenty-one-foot (21 ') wide.

In response to the information your office forwarded me on appraisal service of the above referenced R.O.W. parcels. I have reviewed the package you sent but have not reviewed all of the tracts. I am familiar with the area, but do not know if the tracts will include the valuation of any residences or other improvements. It is my understanding that the appraisals will consist of the value of the parcels to be taken and not the value of the owner's entire parcels before and after

Based upon your information sent to me for a request for proposal on appraisal service, my fee for the appraisal of (15) parcels would be $1,000 per parcel or $15,000. The completed reports would be delivered approximately 45 to 60 days from date of acceptance. Due to time obligations, my office can only supply appraisal reports and not court testimony due to time deliberations of court proceedings.

This letter is to propose our employment =to appraise the Fee Simple interest of a total of fifteen R.O.W. parcels of land located along Hoover Valley Road-C.R. 116 to become State Road 3509, Burnet County, TX. As all are narrative in format, we will be trying to determine the following Market Values: 1) of the "Whole Property", 2) "Part to be Acquired", 3) "Value of the Remainder Immediately before the Taking" and 4) "Net Daqages or Enhancements, if Any'' to determine the total compensation. The market value as defined by the Office of the Comptroller of the * Currency will be used. The appraisals will be reported in compliance with the Standards of Professional Appraisal Practice of the Appraisal Institute.

Please provide us with complete legal descriptions, owner's names, surveys if available and any other information that you may have pertinent to this assignment. If any environmental studies have been done on the subject property, please provide these documents, also. The value estimate must reflect the impact, if any, of the above listed items.

The appraisals will include a detailed highest and best use analysis.

The appraisals will include one original and two signed copies with photographs and maps of the subject property. The reports will be addressed to you at the above address unless otherwise noted.

We would like to bid an appraisal fee of FIFTY-THOUSAND AND N0/100 DOLLARS ($50,000.00). It is our office policy to request %? payment at the beginning of the assignment and the remaining % - to be paid upon delivery of the completed reports.

Both Steve Maercklein and I will be responsible for completion of the appraisals. We both have Texas General Appraisal Certifications with the State of Texas. Copies of our Resumes and S W Licenses are attached. Since that tine, we have added an Appzaiser Trainee and have secretarial help committed that would allow us to do the assignment in a timely fashion.
