Health and Safety at Work etc. Act 1974Enabling act that covers all workers except domestic workers.Applies to all employers, self-employed persons & members of the public who may be affected by employers activities.Provides HSE & Local Authorities various enforcement powers.

HASAWA 1974 continuedSection 2-4 and 6-9 are the duties of the employers and others.Section 7 is the duty on the employees.Section 8 is a duty on all people.The Act allows Regulations to be made to stricter standards and add more clarity.

Section 2/3Safe Plant & Machinery.Safe Systems of Work.Safe Handling, Transportation & Storage.Safe Fellow Employees.Safe Access & Egress.Safe Working Environment.If more than 4 employees a written Safety Policy and Risk Assessments.

Section 4Landlords Duties.Provide safe access & egress.Maintenance of plant and facilities.All dependant on the type of contract or agreement.

Section 7Employees duties;Take care of there own health and safety and those around them and how the things they do may affect others.Co-operate with employer to ensure they can meet legal obligations.

Penalties for Breaches Magistrates Court Up to 12 months in prison & a 20,000 fine per offenseCrown Court Up to 2 years, Unlimited fine or Both. Corporate Manslaughter 25 years in prison.

Relevant Regulations Management of Health and Safety at Work Regulations (MHSWR) 1999. Control of Substances Hazardous to Health (COSHH) Regulations 2002. Lifting Operations Lifting Equipment Regulations (LOLER) 1998. Provision and Use of Work Equipment Regulations (PUWER) 1998.

MHSWR 1999 Regulation 3 Suitable & Sufficient Risk Assessments. Regulation 6 Health Surveillance of employees for adverse conditions (e.g. LFT for sprayers). Regulation 14 Employees Duties Required to use plant, machinery, dangerous substances in line with training. Not to interfere with anything put in place to assist or improve health and safety.

COSHH 2002 Regulation 6 COSHH Assessment Reviewed after 5 years unless changes in substance. Regulation 7 Control of Exposure Hierarchy methods Enclose, use of plant (LEV), Prohibit eating drinking & smoking etc. Regulation 9 Maintenance of Controls.

LOLER 1998 Regulation 4 Lifting equipment is of adequate strength and stability. Marked with SWL. Regulation 9 Statutory Examinations; 6 monthly if suspending a person or weight above a person. Regulation 10 Written reports and who should carry them out what information is required. Regulation 11 Keeping of information; for duration of report intervals. 4 years after.

PUWER 1998 Regulation 4 Suitability Fit for purpose? Regulation 6 Risks associated with; Incorrect installation, Deterioration & Exceptional circumstances.Regulation 12 Protection; Guarding of machinery.Regulation 22 Maintenance Employers duty to ensure maintenance can be carried out safely.

Risk Assessments For any task that may involve a risk to employees. If more than 4 employees needs to be written. Does not need to be complicated. Is there to explain a process, not to be used as instruction or guidance.

What could go wrong??

5 steps to a Risk AssessmentIdentify the hazards; e.g. oil spill.Decide who may be harmed & how; Employees may slip and injure themselves on workshop floors.Evaluate the Risk & Decide on Precautions; Employees could slip on oil spilt on floors. Ensure absorbent granules to soak oil are available. Record findings and implement them; Any additional recommendations i.e. provide employees with oil resistant footwear.Review the assessment and update when necessary; Change in process, materials used, environment etc.
