Whereas, the land, specifications whereof are given at“Annexure-A” to this notification is required for public purpose viz“Widening of Jammu-Poonch Double Lane road by GREF ; and
Whereas, on the basis of an indent placed by Officer Commanding79 RCC (GREF) vide dated 20-11-2000, accordingly, a notification undersection 4(1) was issued by Collector, Land Acquisition (Defence), HQ,Rajouri/Poonch, Rajouri for land measuring 90 Kanals-13 Marlas situatedin Village “Seri Chawana”, Tehsil Haveli, District Poonch vide No. Coll/Def/419-23 dated 21-09-2000 ; and
Whereas, subsequently a corrigendum to notification under section4(1) of the Land Acquisition Act was issued vide No. Coll/Def/419-23dated 21-09-2000 for net area measuring 88 Kanals-10 Marlas instead of90 Kanals-13 Marlas notified earlier ; and
Whereas, the Deputy Commissioner, Poonch vide letter No. Coll/Def/239 dated 14-06-2016 has reported that the notification issuedunder section 4(1) of the J&K State Land Acquisition Act, by theCollector, Land Acquisition (Defence), HQ Rajouri/Poonch, Rajouri wasserved upon the interested persons for filing objections, if any, to theproposed acquisition but no objection was received from the land owner/interested persons in the prescribed time period as required undersections 5 & 5-A of Land Acquisition Act ; and
Whereas, the report furnished by Deputy Commissioner, Poonchvide letter referred to above, has been examined and it has beenfound that the land owners did not file any objection to the proposedacquisition ; and
Whereas, the Government is satisfied that the land particularswhereof are mentioned are given at “Annexure-A” to this notification,is required for public purpose viz “widening of Jammu-Poonch DoubleLane road by GREF”.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat, 1990, it is declared that land measuring88 Kanals-10 Marlas situated in Village “Seri Chawana”, Tehsil HaveliDistrict Poonch, particulars whereof are given at “Annexure-A” to thisnotification is required for public purpose viz. “widening of Jammu-Poonch Double Lane road by GREF”. Further, the Collector LandAcquisition (Defence), HQ, Rajouri/Poonch, Rajouri is directed undersection 7 of the said Act to take order for acquisition of the said landafter giving prescribed notice to the interested person(s) as requiredunder the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all the

interested persons/rightful claimants in accordance with the relevantlaws/rules in force, while making the award.

Whereas, the report furnished by District Collector (DC), Srinagarvide letter referred to above has been examined and it has beenfound that the objections filed by the interested person(s)/land owner(s)are sub-servient to the larger public interest involved in the matter andthat there is no alternative but to acquire the said land ; and

In accordance with the directions issued vide Circular No. FC-LS/Mics-3591/08 dated 30-07-2008, Financial Commissioner, Srinagar, the entireextent of forest lands falling under the alignment of Block Boundary, Ghordito Katwalt PMGSY Road in Village Ressain, Tehsil Ramnagar earliernotified vide No. SDMR/LA/2016-17/25-32 dated 12-04-2016 are herebyde-notified. The Intending Department shall initiate a separate case fortransfer of these lands in terms of the J&K Forest (Conservation) Act,1997 and the rules thereof with the previous approval of the State ForestAdvisory Committee headed by the Chief Secretary.

Annexure- “A”
1. The rates quoted for printing of Newsletter should be for OneThousand Two Hundred (1200) copies of Newsletter and perfour pages inclusive of all charges i. e. composing, scanning/planning, designing, plate making, cost of paper and all kind oftaxes etc. The rates quoted shall also apply to the printing ofspecial issues/annual issue of the Newsletter for four pages(Multiples of four pages) the same specifications on need basis.
2. Each tender should be accompanied be earnest money ofRs. 5000/- in the shape of CDR of any Scheduled Bank, pledgedto S. O. to ADGP, Armed, J&K. A photocopy of dealership/registration certificate of the printing firm, as an SSI Unit withState Industries Department or under the Companies Act, mustalso accompany the tender without which the tenders will not beentertained.

3. Successful tenderers shall have to complete the printing workconforming to the quality and specifications and deliver printedmaterial at APHQ, Srinagar (from May, 2017 to October, 2017)and at APHQ, Jammu (from November, 2017 to April, 2017) withinseven days of the receipt of supply order.
4. The CDRs of the unsuccessful tenderers will be returned afterfinalizing the process for award of contract whereas the CDR ofthe successful tenderer would be released/returned after successfulcompletion of annual contract for the year 2017-18. Tender shouldbe free from cuttings and overwriting. Mutilated tenders shall notbe accepted.
5. The payment of the bill will be made as and when the funds underthe particular Head are available in APHQ.
6. The contract/supply order can be repudiated at any time, if thesupplies are not made according to the entire satisfaction of thedepartment. It shall be at the absolute discretion of the departmentto ask for replacement in lieu of the rejected supply.
7. VAT/Income Tax clearance up to December, 2016 should beenclosed with the tender.
8. The tenderer should sign the form at each page at the end in tokenof acceptance of all the terms/conditions of the tender and theagreement.
9. The tenders should be free from overwriting and alternations.
10. No conditional tender shall be accepted.
11. All legal proceedings arising out of any dispute between partiesshall have to be instituted in courts situated in Jammu/Srinagaronly.
12. The successful tenderer shall have to execute an agreement withthe department in the prescribed form for successful completionof the contract immediately after its finalization within one week.
13. The terms and conditions of the tenderer will form a part ofagreement.
14. If after the placement of orders, the successful tenderer backs out,the security deposit will be forfeited, besides other remedial penalmeasures shall be taken against him.

15. The decision of the accepting authority shall be final as to thequality of the material.
16. The successful supply order, failing which penalty at Re. 1% perday over the esteemed cost of indented supplies or 25% of thetotal cost whichever be the lesser shall be imposed for the belatedperiod.

EXTRAORDINARY REGD. NO. JK–33
Whereas, the Election Commission of India, having regard to theright of franchise of such migrant electors, directed that these migrantsshall continue to be treated as ordinary residents of their respective places,for inclusion/retention of their names in the electoral roll of the constituencyconcerned, despite their temporary migration and as such their names wereallowed to be included in the electoral rolls of the said constituenciessummarily revised with reference to 01-01-2017 as the qualifying date.
Now, therefore, the Election Commission of India, in exercise ofpowers conferred by section 25 of the Representation of the PeopleAct, 1951, for the purposes of giving votes at the poll in the bye-election tothe House of the People, to be held in the year 2017, in pursuance of thenotifications to be issued by the President under section 14 of theR e p r e s e n t a t i o n o f t h e P e o p l e A c t , 1 9 5 1 , h e r e b y specifies the aforesaidmigrant electors enrolled in any of the Parliamentary Constituencies of2-Srinagar and 3-Anantnag, who are residing outside their place of residence,but other than those who have been notified under clause (c) of section 60of the Representation of the People Act, 1951 to vote by postal ballot, asthe specified class of persons for whom special polling stations shall beprovided outside the territorial limits of the Parliamentary Constituenciesmentioned above.

Whereas, Section 4 of the J&K RTI Act, 2009, lays down the variousobligations of the Public Authority for suo moto disclosure of informationpertaining to it ;
EXTRAORDINARY REGD. NO. JK—33
Whereas, the said section also lays down the steps to be taken by thePublic Authority in making such suo moto disclosure of information in variousforms and manner ;
Whereas, it has come to the notice of the State InformationCommission that a large number of Public Authorities in the State have notmade suo moto disclosure of information in terms of Section 4 and havealso not taken various steps mentioned therein for the same purpose.
Now, therefore, in exercise of the powers conferred underSection 22 (5) of the J&K RTI Act, 2009, the J&K State InformationCommission makes the recommendation to all such Public Authorities inthe State to take necessary steps so as to conform to all the provisions ofSection 4.
The State Information Commission also recommends that action/actions in this regard be taken and completed by or before 30th of June,2017 to achieve such conformity.

THE SPECIFIED BANK NOTES (CESSATION OF LIABILITIES)ORDINANCE, 2016
(No. 10 of 2016)
Promulgated by the President in the Sixty-seventh Year of the Republicof India.
An Ordinance to provide for cessation of liabilities on the specifiedbank notes and for matters connected therewith or incidental thereto.
Whereas, the Central Government, on the recommendations of theCentral Board of the Reserve Bank, vide Notification No. S. O. 3407(E)dated the 8th November, 2016, declared the then existing series of the banknotes of the denominational value of five hundred rupees and one thousandrupees to cease to be legal tender with effect from the 9th November, 2016to the extent specified therein ;
And Whereas, a part of the series of bank notes in circulation whichhave ceased to be legal tender on account of the said notification has comeback to the Reserve Bank of India ;
And Whereas, such bank notes which have ceased to be legal tenderare a liability in the books of accounts of the Reserve Bank of India underSection 34 of the Reserve Bank of India Act, 1934 ;
And Whereas, it is necessary to have clarity and finality to the liabilitiesof the Reserve Bank of India and the Central Government arising fromsuch bank notes which have ceased to be legal tender on the basis of thesaid notification ;
And Whereas, Parliament is not in session and the President is satisfiedthat circumstances exist which render it necessary for him to take immediateaction.
Now, therefore, in exercise of the powers conferred by Article 123of the Constitution, the President is pleased to promulgate the followingOrdinance :––
1 . Short title and commencement.––(1) This Ordinance may becalled the Specified Bank Notes (Cessation of Liabilities) Ordinance, 2016.
(2) It shall come into force on the 31st day of December, 2016.
2. Definitions.––(1) In this Ordinance, unless the context otherwiserequires,––
(a) “appointed day” means the 31st day of December, 2016 ;

(b) “grace period” means the period to be specified by the CentralGovernment, by notification, during which the specified banknotes can be deposited in accordance with this Ordinance ;
(c) “notification” means a notification published in the OfficialGazette ;
(d) “Reserve Bank” means the Reserve Bank of India constitutedby the Central Government under Section 3 of the ReserveBank of India Act, 1934 (2 of 1934) ;
(e) “specified bank note” means a bank note of the denominationalvalue of five hundred rupees or one thousand rupees of theseries existing on or before the 8th day of November, 2016.
(2) The words and expressions used and not defined in this Ordinancebut defined in the Reserve Bank of India Act, 1934 (2 of 1934) or theBanking Regulation Act, 1949 (10 of 1949), shall have the meaningsrespectively assigned to them in those Acts.
3. Specified bank notes to cease to be liability of ReserveBank or Central Government.–––On and from the appointed day,notwithstanding anything contained in the Reserve Bank of India Act, 1934(2 of 1934), or any other law for the time being in force, the specified banknotes which have ceased to be legal tender, in view of the notification ofthe Government of India in the Ministry of Finance, Number S. O. 3407(E)dated the 8th November, 2016, issued under sub-section (2) of Section 26of the Reserve Bank of India Act, 1934 shall cease to be liabilities of theReserve Bank under Section 34 and shall cease to have the guarantee ofthe Central Government under sub-section (1) of Section 26 of thesaid Act.
4. Exchange of specified bank notes.––Notwithstanding anythingcontained in Section 3, following persons holding specified bank notes on orbefore the 8th day of November, 2016 shall be entitled to tender within the

grace period with such declarations or statements, at such offices of theReserve Bank or in such other manner as may be specified by it,namely :––
(i) a citizen of India who makes a declaration that he was outsideIndia between the 9th November, 2016 to 30th December,2016 subject to such conditions as may be specified, bynotification, by the Central Government ; or
(ii) such class of persons and for such reasons as may be specified,by notification, by the Central Government.
(2) The Reserve Bank may, if satisfied, after making such verificationsas it may consider necessary that the reasons for failure to deposit thenotes within the period specified in the notification referred to in Section 3,are genuine, credit the value of the notes in his Know Your Customercompliant bank account in such manner as may be specified by it.
(3) Any person, aggrieved by the refusal of the Reserve Bank tocredit the value of the notes under sub-section (2), may make arepresentation to the Central Board of the Reserve Bank within fourteendays of the communication of such refusal to him.
Explanation :– For the purposes of this section, the expression “KnowYour Customer compliant bank account” means theaccount which complies with the conditions specified inthe regulations made by the Reserve Bank under theBanking Regulations Act, 1949 (10 of 1949).
5. Prohibition on holding, transferring or receiving specifiedbank notes.–– On and from the appointed day, no person shall, knowinglyor voluntarily, hold, transfer or receive any specified bank note :
Provided that nothing contained in this section shall prohibit the holdingof specified bank notes––
(a) by any person––
(i) up to the expiry of the grace period ; or

(ii) after the expiry of the grace period,––
(A) not more than ten notes in total, irrespective of thedenomination ; or
(B) not more than twenty-five notes for the purposes ofstudy, research or numismatics.
(b) by the Reserve Bank or its agencies, or any other personauthorised by the Reserve Bank ;
(c) by any person on the direction of a court in relation to anycase pending in that court.
6. Penalty for contravention of Section 4.––Whoever knowinglyand wilfully makes any declaration or statement specified under sub-section(1) of Section 4, which is false in material particulars, or omits to make amaterial statement, or makes a statement which he does not believe to betrue, shall be punishable with fine which may extend to fifty thousand rupeesor five times the amount of the face value of the specified bank notestendered, whichever is higher.
7. Penalty for contravention of Section 5.––Whoever contravenesthe provisions of Section 5, shall be punishable with fine which may extendto ten thousand rupees or five times the amount of the face value of thespecified bank notes involved in the contravention, whichever is higher.
8. Offences by companies.––(1) Where a person committing acontravention or default referred to in Section 6 or Section 7 is a company,every person who, at the time the contravention or default was committed,was incharge of, and was responsible to, the company for the conduct ofthe business of the company, as well as the company, shall be deemed to beguilty of the contravention or default and shall be liable to be proceededagainst and punished accordingly :
Provided that nothing contained in this sub-section shall render anysuch person liable to punishment if he proves that the contravention or

default was committed without his knowledge or that he had exercised alldue diligence to prevent the contravention or default.
(2) Notwithstanding anything contained in sub-section (1), where anoffence under this Ordinance has been committed by a company and it isproved that the same was committed with the consent or connivance of, oris attributable to any neglect on the part of, any director, manager, secretary,or other officer or employee of the company, such director, manager,secretary, other officer or employee shall also be deemed to be guilty of theoffence and shall be liable to be proceeded against and punished accordingly.
Explanation :––For the purpose of this section,––
(a) “a company” means any body corporate and includes afirm, trust, a co-operative society and other association ofindividuals ;
(b) “director”, in relation to a firm or trust, means a partner in thefirm or a beneficiary in the trust.
9. Special provisions relating to offences.––Notwithstandinganything contained in Section 29 of the Code of Criminal Procedure, 1973(2 of 1974), the court of a Magistrate of the First Class or the court of aMetropolitan Magistrate may impose a fine for contravention of theprovisions of this Ordinance.
10. Protection of action taken in good faith.––No suit, prosecutionor other legal proceeding shall lie against the Government, the ReserveBank or any of their officers for anything done or intended to be done ingood faith under this Ordinance.
11. Power to make rules.––(1) The Central Government may, bynotification, make rules for carrying out the provisions of this Act.
(2) Every rule made under this Ordinance shall be laid, as soon asmay be after it is made, before each House of Parliament while it is in

session for a total period of thirty days which may be comprised in onesession or in two or more successive sessions, and if, before the expiry ofthe session immediately following the session or the successive sessionsaforesaid, both Houses agree in making any modification in the rule or bothHouses agree that the rule should not be made, the rule shall thereafterhave effect only in such modified form or be of no effect, as the case maybe ; so however, that any such modification or annulment shall be withoutprejudice to the validity of anything previously done under that rule.
12. Power to remove difficulties.––(1) If any difficulty arises ingiving effect to the provisions of this Ordinance, the Central Governmentmay, by order published in the Official Gazette, make such provisions notinconsistent with the provisions of this Ordinance, as may appear to it to benecessary or expedient for removing the difficulty.
(2) Every order made under this section shall, as soon as may beafter it is made, be laid before each House of Parliament.

(SPECIAL PROVISIONS) REGULATIONS, 2014
Regulations to provide for regularization of Municipal Corporatione m p l o y e e s a p p o i n t e d o n ad hoc, contractual or consolidated basis.
In exercise of the powers conferred by section 67 read withsection 394 of the Jammu and Kashmir Municipal Corporation Act, 2000,the Corporation with the prior approval of the Government hereby makesthe following regulations to provide for regularization of the employeesappointed on ad hoc, contractual or consolidated basis.
1. Short title and commencement.––(1) These regulations may becalled the Jammu Municipal Corporation Class-IV Services (SpecialProvisions) Regulations, 2014.
(2) These shall come into force from the date of their publication inthe Government Gazette.
2. Definitions.––In these regulations unless there is anythingrepugnant in the subject or the context,––
(a) “Act” means the Jammu and Kashmir Municipal CorporationAct, 2000 ;
(b) “Appointed day” means 1st of January, 2014 ;
(c) Competent Authority” means the authority competent to makeappointments under section 67 of the Act ;
(d) “Consolidated appointee”, means a person who has beenappointed against any post under the Corporation onconsolidated monthly salary/wages ;
(e) “Contractual appointee” means a person who has beenappointed on contract basis against any post under theCorporation ;

(f) “Ad hoc appointee” means a person appointed on ad hocbasis against any post on need basis ;
(g) “Government” means the Government of Jammu andKashmir ;
(h) “Post” means a post borne on the establishment of theCorporation in the cadre of Class-IV categories like peons,orderlies, farash, safaiwallas, mushkies, summon server,sampler, workshop helper, chowkidar, garderner, boatmen,slaughter house worker, cattle catcher, cleaner and similar postscreated by the Competent Authority from time to time on needbasis ;
(i) “Empowered Committee” means the Empowered Committeeconstituted under sub-section (1) of regulation 10 ;
(j) “Regularized Employee” means a person whose services areregularized under regulation 10 (5) ;
(k) “Corporation” means Jammu Municipal Corporation ;
(l) “Recruiting Agency”, means the authority competent to makeselection for appointment to any substantive post or serviceunder the Corporation.
3. Applicatilon of the Regulations.—These Regulations shallapply to safaiwallas and Class-IV posts under the Corporation as are heldby any person having been appointed on ad hoc, contractual basis includingthose appointed on consolidated salary/wages, provided that suchappointments have been made by the competent authority on need basisbut shall not apply to,—
(a) Persons appointed on tenure posts co-terminus with the life ofthe project or scheme of the State or Central Government, asthe case may be.

(b) Part time or seasonal employees.
Explanation to Rule (3) :
Provided that only safaiwalla and Class-IV posts shall be utilizedfor purpose of adjustment/regularization of the consolidatedworkers engaged from time to time and having completed sevenyears of continuous service.
4. Exclusion from the purview of recruitingagencies.—Notwithstanding anything to the contrary contained in any otherrule/regulation for the time being in force, the posts referred to undersection 3 shall be and shall always be, deemed to have been excluded fromthe purview of the recruiting agencies.
5. Regularization of contractual, consolidated and ad hocappointee.—Notwithstanding anything to the contrary contained in anyrule/regulation for the time being in force, the ad hoc, contractual orconsolidated appointees shall be regularized on the fulfillment of the followingconditions :—
(i) That he has been appointed/engaged as consolidated/ad hoc/contractual worker by the Competent Authority onneed basis ;
(ii) That he continues as such on the appointed day ;
(iii) That he possessed the requisite qualifications and eligibilityfor the post on the day of his initial appointment on contractual,or consolidated basis as prescribed under the recruitment rulesgoverning the service or post ;
(iv) That no disciplinary or criminal proceedings are pending againsthim on the appointed day ;
(v) That he has completed seven years of continuous service assuch on the appointed day ;
(vi) Regularization shall be done against clear vacant post :
Provided that the regularization of the eligible ad hoc,contractual or consolidated employees under these regulations

shall have effect only from the date of such regularizationirrespective of the fact that such appointees have completedmore than seven years of service on the appointed day orthereafter but before such regularization :
Provided further that any contractual or consolidated appointeewho is in service but who has not completed seven years ofservice on the appointed day shall continue as such tillcompletion of seven years and shall thereafter be entitled toregularization under these regulations.
6. Relaxation in upper age limit.—(1) The upper age limit asprescribed under rules for entry into Corporation service shall be relaxedby the Minister Incharge Housing and Urban Development Department, incase the ad hoc, consolidated or contractual appointee is otherwise eligiblefor regularization under these regulations provided such appointee hascrossed the age limit at the time of his regularization but was within theprescribed age for appointment/engagement at the time of his initialappointment as such or his age was relaxed by the competent authority atthe time of his initial appointment/engagement.
(2) The ad hoc, contractual or consolidated appointee shall be treatedas an in service candidate so far as the upper age limit is concerned fordirect recruitment to Corporation service :
Provided his ad hoc, contractual or consolidated service is subsistingon the day of issue of the advertisement notification or at the time ofconsideration of their regularization by the competent authority under theseregulations.
7. Fixation of pay.—Every regularized employee shall from the dateof his regularization be entitled to fixation of pay in the time scale of payapplicable to the Safaiwalla/Class-IV post against which he is regularized.
8. Test or Training.—Wherever any test or training is prescribed asa qualification for declaration of completion of probation in a service theregularized employee shall pass such test or undergo such training withinone year from the appointed day, failing which his annual increments shall

be stopped and if he fails to pass such test or undergo such trainings evenby the end of the fourth year from the date of his regularization, his servicesshall be terminated.
9. Seniority.—The seniority of the regularized employees shall bedetermined with reference to the date of his regularization :
Provided that the inter-se-seniority of the regularized employeeshall be determined with reference to the date of their initial appointmentson ad hoc or contractual or consolidated basis, as the case may be, subjectto the merit/select list, if any :
Provided further that if the date of initial appointment on ad hoc orcontractual or consolidated basis of two or more employees is same, thenan employee older in age shall rank senior to an employee younger in agesubject to merit/select list, if any.
10. Empowered Committee.—(1) There shall be an EmpoweredCommittee consisting of,—
(i) Commissioner, JMC Chairman
(ii) Joint Commissioner (Adm.) Member
(iii) Representative of the Administrative MemberDepartment (not below therank of Dy. Secretary)
(iv) Financial Advisor (CAO), JMC Member
(v) Joint Commissioner (Works) Member(in respect of Works Div.)
(vi) Secretary, JMC Member-Secretary
(2) The Divisions, Branches, Sections of the Corporation shall within60 days from the commencement of these Regulations, refer all the casesof eligible ad hoc, contractual or consolidated appointees for regularizationunder these regulations to the Member-Secretary for being placed beforethe Empowered Committee for scrutiny and verification with regard totheir entitlement to regularization under these regulations.

(3) The Empowered Committee shall examine such cases and notifythe names of such ad hoc, contractual or consolidated employees whohave been found eligible for regularization under these regulations in respectof each wing of JMC within 15 days period for filing of objections beforethe committee.
(4) The Empowered Committee shall thereafter examine thecomplaints, if any, received and make appropriate recommendations to theCompetent Authority with regard to administrative approval for regularizationin respect of each case on fulfillment of the conditions specified underthese regulations or rejection of the case.
(5) The Competent Authority on the recommendations of EmpoweredCommittee shall consider and accord approval for regularization.
11. Appeal.—(1) Any person aggrieved of the recommendationsmade by the Empowered Committee on account of being left-out mayprefer an appeal within 30 days from the date of recommendations by theEmpowered Committee before the Administrative Secretary, Housing andUrban Development Department.
(2) The Appellate Authority may, after hearing the appellant and afterseeking comments from the Empowered Committee pass appropriate ordersin this behalf which shall be final and conclusive.
12. Penalty.—(1) In case it is found that the regularized employeehas secured appointment or regularization on the basis of a forged, fake orfabricated document/certificate, his regularization or appointment shall becancelled by the Competent Authority.
(2) In case any officer or official fabricates or forges any documentto give undue advantage to any person in the matter of regularization oraids or abets any person to secure any fabricated or forget document toclaim regularization under these regulations he shall be liable for disciplinaryproceedings and the salary drawn by such regularized employee shall berecoverable from such defaulting officer or official as arrears of landrevenue.
13. Restriction on further ad hoc, contractual, consolidatedappointments.—With effect from the commencement of these regulationsno appointment shall be made by the Corporation on ad hoc, contractual,

consolidated or temporary basis and all the vacant posts shall be filled upstrictly in accordance with the rules governing the recruitment to therespective services or post. However, in case of further expansion ofmunicipal limits from time to time as per functions of the Corporation and incase of special circumstances, the Corporation with prior approval of theGovernment can engage such persons on need basis if they possess theprescribed eligibility criteria.
14. Interpretation.—If any question arises relating to theinterpretation of these rules, the matter shall be referred to the Governmentwhose decision thereon shall be final.
