GOVERNMENT OF JAMMU AND KASHMIR,CIVIL SECRETARIAT—REVENUE DEPARTMENT.
Notification No. 146-Rev (LAJ) of 2016
Dated 15-12-2016.
Whereas, the land, specifications whereof are given in“Annexure-A” to this notification is required for public purpose vizconstruction of Ring Road by NHAI at Village Prithipur, Tehsil Bishnah,District Jammu ; and
Whereas, on the basis of an indent prepared by Project Director,NHAI, 315/1, Jammu, a notification under section 4(1) was issued byCollector, Land Acquisition (SDM South), Jammu South vide No. SDM/Jmu-S/830-36 dated 12-08-2016 for land measuring 39 Kanals 06 Marlassituated at Village Prithipur, Tehsil Bishnah, District Jammu ; and
Whereas, the Collector, Land Acquisition (SDM South), Jammuvide No. SDM/Jmu-S/1106-07 dated 17-09-2016 has reported that thenotification issued under section 4(1) of the J&K State Land AcquisitionAct by him, was served upon the interested persons for filing objections,if any, to the proposed acquisition but no objection was received fromthe land owner/interested persons in the prescribed time period asrequired under sections 5 & 5-A of the Land Acquisition Act ; and
Whereas, the report furnished by Collector, Land Acquisition(SDM), South Jammu vide above referred letter duly endorsed byDistrict Colector (DC), Jammu vide No. 502/2703/R-R-NHAI-Prithipur/J/16/919-22 dated 01-10-2016, has been examined and it has been foundthat the land owners did not file any objection to the proposed acquisition; and
Whereas, the Government is satisfied that the land particularswhereof are given above is required for public purpose viz constructionof Ring Road at Village Prithipur, Tehsil Bishnah, District Jammu ; and
Whereas, the Indenting Department/Collector have expressedurgency for taking over the possession of the land.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat, 1990, it is declared that land measuring39 Kanals 06 Marlas situated at Village Prithipur, Tehsil Bishnah,District Jammu, particulars whereof are given above, in “Annexure-A”is required for public purpose viz for construction of Ring Road byNHAI. Further, the Collector, Land Acquisition (SDM South), Jammuis directed under section 7 of the said Act to take orders for acquisitionof the said land after giving prescribed notice to the interested person(s)as required under the Land Acquisition Act/Rules.
Further, in pursuance of section 17 of the Land Acquisition Act,Samvat, 1990, it is also ordered that on expiry of fifteen days from thepublication of the Notification under section 9 (2) of the said Act, theCollector will take possession of the aforementioned land in VillagePrithipur, Tehsil Bishnah, District Jammu, required for public purposes,subject to fulfillment of the conditions prescribed under section 9 (2)and section 17-A of the Land Acquisition Act and Rule 63 of the LandAcquisition Rules.

However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all theinterested persons/rightful claimants in accordance with the relevantlaws/rules in force, while making the award.

It has been brought into the notice of the authorities thatdevelopmental works are being undertaken by various departments attheir own level without consulting the concerned Hon’ble Legislator(s)which amounts to violations of the instructions of the State Governmentissued vide Circular No. 33-GAD of 2009 dated 16-07-2009.
The following instructions are therefore, reiterated/conveyed to allthe concerned for information/necessary action :–
1. The D.O. letters addressed by the Hon’ble Legislators tothe senior officers shall be promptly acknowledged and indue course, the Hon’ble Member(s) be informed of theaction taken or proposed to be taken by the departmenton such matters.
2. The Hon’ble Legislator(s) shall be consulted in matterspertaining to the formulation of the District Plans anddevelopmental schemes pertaining to their constituencies.Further, the Hon’ble Legislator(s) shall also be consultedon matters relating to the formulation and implementationof the Centrally Sponsored Schemes like BADP/TSP/SCPin accordance with the guidelines of the Government ofIndia pertaining to such schemes.
3. The Hon’ble Legislator(s) shall be invited to all the majorofficial functions like laying of foundation stones, inaugurationof major development projects in their respectiveconstituencies. The Hon’ble Legislator(s) shall also be

invited to Major official functions of the State and theyshall be allotted seats strictly as per the protocol.
4. Due protocol and courtesy shall be extended by theofficers to the Hon’ble Legislators during their visit toGovernment officers. Further, whenever any Hon’bleLegislator indicates his desire to meet an officer fordiscussing any public related issue(s), the appointmentshall be fixed on the same day, if the officer is at theheadquarter. However, if it is not possible to do so forunavoidable reasons, a meeting shall be arranged at theearliest as per the mutual convenience. Arrangementsshould be in place with a view to ensuring that no Hon’bleLegislator is put to any inconvenience on this account.
These instructions are brought to the notice of all the AdministrativeSecretaries, Heads of the Departments, Deputy Commissioners and allthe officers of J&K Police for information and strict compliance.

Final Award
On the requistion of Project Director of NHAI PIU, Jammu videNo. PD/JMU/1501-1611/1687 dated 14-06-2005, the proceedings of landacquisition under J & K Land Acquisition Act, 1990 BK were initiated foracquisition of land measuring 296K-04M situated at village Narsoo, Tehsiland District Udhampur for four laning of the national highway.
Accordingly, notification of section 4(1) of Land Acquisition Act, X-Svt. 1990 was issued by this Collectorate vide No. LA/ADC/377-81 dated24-10-2005 and was served upon the owners/interested persons throughTehsildar, Udhampur. The land owners/interested persons did not file anyobjection in response to the notification issued under section 4(1) of landacquisition Act within the stipulated period.
EXTRAORDINARY REGD. NO. JK—33
Thereafter, the Financial Commissioner, Revenue , Jammuand Kashmir Government was requested vide this Collectrate’s letter No.LA/ADC/656-59 dated 15-12-2005 for issuance of declaration under section6, 7 and 17 of Land Acquisition Act. The Financial Commissioner, Revenueissued Notification No.77/FC of 2006 under sections 6, 7 of LandAcquisition Act, vide his office under endorsement No. FC-LS/LA-1950/06 dated 11-08-2006, and Revenue Department J&K Governmentissued Notification No. 146-RD of 2006 U/s 17 of Land Acquisition Actand communicated the same to this Collectorate vide endorsement Rev.(LAJ)153/06 dated 04-09-2006 for the said land acquisition.
Consequent upon this, notification under sections 9 & 9A was issuedand got pasted on conspicuous places for information of land owners/interested persons and also served upon to indenting department vide thisCollectorate No. LA/ADC/327-29 dated 24-08-2006 for the said landacquisition.
Principle of Compensation
The Tehsildar, Udhampur vide his No. 1075/OQ dated 28-09-2005 atthe time of preparation of revenue papers has worked out the three yearsaverage sale deed rates as Rs. 25,882/- per kanal and recommended thepresent market rate as Rs. 2.00 Lakh per kanal irrespective of classificationof kind of soil. The land under acquisition falls along the existing Jammu-Srinagar National Highway and it carries a great commercial/potential value.The market rate recommended by Tehsildar, Udhampur seems to be genuineand the then Collector, Land Acquisition proposed the rate of landcompensation at the rate of Rs.2.00 Lakh per Kanal irrespective ofclassification of kind of soil and requested the District Collector to place thecase in Collectors meeting for the approval of rates of land compensation.The instant case of land compensation was placed in Collectors meetingheld on 14-09-2006. The proposed rates were discussed in the meeting ofCollectors chaired by the District Collector, Udhampur and Landcompensation @ Rs. 1.50 Lakh per Kanal irrespective of classification ofkind of soil has been approved.
Since, some structures, fruit bearing trees and non-fruit bearing trees arecoming within the alignment, the Superintending Engineering, PWD (R&B)Circle, Udhampur assessed the compensation on account of the structurescoming under the proposed acquisition, the assessment reports were furnished

Thereafter, the District Collector, Udhampur vide this Office No. LA/ADC/485 Dated 23-10-2015, has been requested for the accord of approval ofrates and sanction of awarded amount involved in the case of instant caseof land acquisition from the competent authority. District Collector Udhampurvide his office letter No. DCU/SQ/3228-33 Dated 02-12-2015, submittedthe case to the Divisional Commissioner, Jammu. The Revenue Department,Civil Secretariat, J&K Government Jammu vide No.Rev/LAJ/30/2006 Dated30-08-2016, accorded the approval of rates/award in the instant case. Onthe basis of rates approved and the assessments of the structures, fruitbearing and non-fruit bearing made by the PWD, Forest and Horticulturedepartment the total compensation of Land, structures and trees is workedout as under :—
1. Compensation of land measuring 296 kanal 04 Marlas Rs. 44430000/-@ Rs. 1.50 Lakh per Kanal irrespective of classification of kind of soil.
2. Compensation of structure as assessed by the PWD Rs.74,53,700.00/-Compensation of non-fruit bearing trees as assessed by the Forest Deptt.Rs. 13124.00/-
3. Total Rs. 5,22,788.90/-Jabrana @ 15% Rs. 78,41,833/-Administrative charge @ 0.50% Rs. 2,61,394/-
4. G-Total Rs. 6,03,82.117/-

The requisite certificates are recorded as under :—
1. The land is needed for public purposes i. e. for widening of NationalHighway situated in village Narsoo, Tehsil and District Udhampur.
2. That adequate funds are available with this Collectorate.
3. That no compensation has been paid in respect of the land underacquisition earlier.
4. That Shajra Khasra of the land has been authenticated by theindenting department as token of its correctness.
5. That the compensation will be paid in accordance with theprovisions of Agrarian Reforms Act, 1976.
6. That the land under acquisition is free from all the encumbrances.
7. The Aks/Shajra/Dasti Khaka prepared in the instant case is inaccordance with the spot position and field book.
8. That no EP/Aquaf/Dharmarth Forest land is involved in the instantcase.
9. It is also certified that the compensation payable to the owners/interested persons as shown in the appointment statement shall betendered in accordance with the provisions of Agrarian ReformsAct and guidelines given in the circular issued by the RevenueDepartment under No. (LB)-10/80 Dated 23-03-1980.
Therefore, I, Avny Lavasa, Collector, Land Acquisition (AdditionalDeputy Commissioner), Udhampur, in exercise of powers vested in meunder section 11 of J&K Land Acquisition Act (Smvt., 1990) hereby issuethe final award for an amount of Rs. 6,03,82,117/- (Rupees Six Crore ThreeLakh Eighty Two Thousand one Hundred Seventeen Only) for the landmeasuring 296 Kanal 04 Marlas in Village Narsoo, Tehsil and DistrictUdhampur (including structures and trees existed thereupon) for publicpurpose i. e. widening of National Highway upto four lane.

In exercise of power conferred under sections 66-70 of J&KMunicipal Act, 2000, Municipal Committee, Katra intend to revise theTax/Fee Structure of various establishments under the ambit ofMunicipal Committee, Katra. Therefore it is hereby notified that anypersons/Firms/Government Departments having any objection to theproposed fee structure may submit their written representations to theundersigned within 30 days from the date of publication in the leadingnewspaper. Any representation on this account shall be entertained bythe undersigned only on or before the stipulated time frame indicatedabove, failing which it shall be deemed that there is no objection forthe enhancement of fee/rates and further necessary proceedings willbe initiated to adopt revised fee structure.

1. Policy Objectives
The Policy has the following underlined objectives :
i. Simplification of the regulatory structure by rationalizingand reducing the number of taxes, duties and otherlevies ;
ii. Import substitution of liquor and alcoholic beverages inthe State using tariff barriers ;
iii. Export incentivization through progressive tax and dutystructure ;
iv. Maximizing revenue realization ;
v. Bringing about greater social consciousness about theharmful effects of consumption of liquor and alcoholicbeverages.
2. Type and Forms of Licenses
At present there are twenty-five types of licenses. Overtime,the Department intends to move to a regime of having onlysix types of licenses. Towards this end, in this Policy all theexisting types of licenses have been bucketed into five “salelicense” categories and one “manufacture license” categoryas detailed herein below :––
Type A License : For wholesale trade in local liquor. Thisincludes : JKEL-1B, JKEL-1W, JKEL-1 and JKEL-1A.
Type B License : For retail trade in bars with or within anassociated facility which includes hotel, restaurant,

cinema, banquet hall or club. This category includes :,JKEL-3, JKEL-3A, JKEL-4, JKEL-4A, JKEL-4B,JKEL-4C, JKEL-7 and JKEL-7A.
Type C License : For retail trade in shops, vends andstores. This category includes JKEL-2.
Type D License : For vends, bars and clubs with or withinan Army, Defence or Security Establishment. This categoryincludes : JKEL-5, JKEL-5A, JKEL-7A, JKEL-7B andW-2.
Type E License : For spirits and alcohol inputs and rawmaterials. This category includes: JKEL-12, JKEL-13 andJKEL-15.
Type F License : For Bottling Plants, Distilleries andBreweries.
In addition to these, the Department shall continue to issue‘Permits’ to serve liquor on social occasions at private places,banquet halls, party halls and restaurants etc.
3. Issuance of Licenses
3.1 Wholesale trade
The present Policy for grant of licenses in formJKEL-1, JKEL-1A, JKEL-1B and JKEL-1W shallcontinue.
3.2 Retail trade
3.2.1 The grant of licenses for operating liquor vendsshall be strictly in accordance with the provisionsof the ‘J&K Excise Act, Svt. 1958’, ‘J&K Liquor

License and Sales Rules, 1984’ and subject to theconditions laid down in the following judgments :
(i) Judgment of the Hon'ble Supreme Court dated15-12-2016, passed in Civil Appeal No(s)12164-12166 of 2016 (arising out of SLPCo (c) No (s). 14911-14913 of 2013); the Stateof Tamil Nadu represented by Secretary Homeand others Versus K. Balu and others ;
(ii) Judgment of the Hon'ble High Court dated06-02-2017, in the case titled Sandhya DeviV/s State of J&K & others.
3.2.2 The present Policy for the grant of licenses forretail sale of liquor viz; Bar with Hotel (JKEL-3),Bar with Banquet (JKEL-3A), Bar with Restaurantor Cinema Theatre or Dak Bungalow (JKEL-4),(JKEL-4A), (JKEL-4B) & (JKEL-4C), Unit RunCanteen by Army Paramilitary Forces (JKEL-5),Master Canteen (JKEL-5A) and Club (JKEL-7),(JKEL-7A), (JKEL-7B) & (JKEL-7C) etc. shallcontinue, subject to the fulfillment of therequirements of the orders of Hon'ble High Courtand Hon’ble Supreme Court on the subject.
3.2.3 In order to arrest bootlegging, illicit distillation ofliquor and to ensure availability of safe drinks, theExcise Department may grant new licenses in un-served and under-served areas.
3.2.4 For determining un-served and underserved areas,Tehsil will be the basic unit in the rural areas andMunicipal ward will be the basic unit in the urbanareas.

3.2.5 Upon receipt of demand for granting new licensein the un-served and underserved areas asdetermined above, the Excise Department willgrant such license only through e-auction modesubject to other conditions fulfilled by the eligiblehighest bidder.
3.2.6 The detailed conditions and Modus Operandi fore-auction shall be notified separately by the ExciseDepartment.
3.2.7 Grant of any new license will be for a period of5 years and the bid would include the premiumover and above the annual license fee to be paidby such highest bidder, as determined by theExcise Department from time to time.
3.2.8 New Liquor vends shall be at a minimum distanceof 100 meters from the religious places, schools,hospitals, nearest liquor shops and in conformitywith the provisions of the ‘J&K Excise Act andLiquor License and Sales Rules 1984’.
3.2.9 For the purpose of granting new licenses,all the61 locations in the case titled Sandhya Devi andOthers Vs. State of J&K and others, shall betreated as available for granting new licensesexcept those locations falling within 500 meters ofNational and State highway as per the directionsof Hon’ble Supreme Court. The process ofgranting new licenses on these locations, as in thecase of all new licenses, shall be through e-auctionsupplemented by Technical and Financial Bid, inaccordance with J&K Liquor Licenses and SalesRules 1984.

3.2.10 In the process of e-auction, if an eligible bidderhas bid for more than one location, the license willbe given to the highest eligible bidder for only onelocation of his choice. For other locations in thiscase, the next highest bidder will be allowed tomatch the highest bid and license will be givenaccordingly. If this doesn't materialize suchlocations will again be put to auction.
3.2.11 The liquor licenses shall be granted to the statesubjects of Jammu and Kashmir only. Thosealready having any manufacturing, bottling,brewery, wholesale or retail license will not beeligible to apply for any new license.
3.2.12 The Department of Excise shall undertake a freshsurvey of all existing licenses and conduct forensicaudit if required so as to detect any Benamiownership, ownership procured in violation of theprovisions of J&K Excise Act, Liquor License &Sales Rules, 1984 and circular instructions issuedfrom time to time.
3.2.13 The Department will simultaneously institute andimplement PAN and Aadhaar seeding of licensesand ensure compliance and functioning strictly inaccordance with the provisions of J&K ExciseAct, Liquor License & Sales Rules 1984 andcircular instructions issued from time to time.
4. Grant of license to Manufacturing/Bottling plant
The existing Policy for issuance of licenses for Distilleries,Breweries and Bottling Plants in the State as laid down videGovernment Order No. 99-F of 2003 dated 07.04.2003, read

with Government Order No. 156-F of 2003 dated 22.07.2003,shall continue. 1 per cent of the cost of project shall becharged for issuance of Letter of Intent (LoI) for setting upDistilleries, Breweries and Bottling Plants.
5. Inclusion of different sources of import in onelicense : (JKEL-1A)
The licensee holding Type A (JKEL-1A) license shall beallowed to import liquor from any of its own distilleries or thedistilleries with which it has a valid agreement to produce orbottle liquor on its behalf, located outside the State, subjectto the condition that license fee of Rs. 3.00 lac or as revisedfrom time to time is paid in full for each source.
6. Fixation of Maximum Retail Price
(a) The Maximum Retail Price (MRP) of all types of Liquorincluding JK Special Whisky and Beer shall continueto be fixed by the Excise Commissioner for theyear 2017-18.
(b) Freight charges shall be added to MRP at the rate of5 per cent for Kashmir Division, Poonch and KishtwarDistricts of Jammu Division and ten per cent for Lehand Kargil Districts.
7. All liquors to be ENA based
IMFL manufactured locally or imported from outside theState (other than Foreign Liquor Bottled In Origin (BIO),Bottled in India or Malt Whisky) shall be ENA based only.The use of rectified spirit as a base in manufacture/sale ofLiquor for consumption in civil market and CSD/PMF shallremain banned.

8. Restriction on import of economy brands to protectthe local industry
There shall be a ban on import of brands having MRP ofRs. 300/- per bottle or below into the State.
9. Affixation of security hologram on IMFL, JK SpecialWhisky, Beer and Ready to Drink (RTD) Beverages
In order to check Excise duty evasion, the manufacturers ofIMFL, JK Special Whisky, Beer & RTD as well as Importersof IMFL/Wine/Beer etc. shall continue to affix SecurityHologram as approved by the Excise Department. However,in order to ensure foolproof security against Excise dutyevasion, the process shall be revisited and the enforcementwing shall be further strengthened.
10. Revalidation of permits
The permit issuing authority after charging revalidation feeof Rs. 2000/, may revalidate a permit which remainsunexecuted or becomes time barred.
11. Renewal of licenses
The renewal of license will be automatic subject to thefollowing conditions :
i. The licensee not being a defaulter of any taxes, levies orduties to the Commercial Taxes Department or ExciseDepartment ;
ii. For the above purpose, the Excise Department will referto the defaulters list maintained by the Commercial TaxesDepartment on its website as well as its own records ;
iii. Depositing of Annual prescribed fee by the licensee.

12. Approval of Labels
As provided under section 16-A of the J&K Excise Act,Samvat 1958, labels for different brands of liquor for thefinancial year 2017-18 shall be approved within two weeksof receipt of application in the respective categories. Labelfee at the rate of Rs. 25000/- per label in case of civil andRs. 15000/- per label in case of CSD shall be charged.

Assessment fee @ Rs. 3.00 per bottle of 750 ML shallbe charged for all kinds of IMFL, JK SpecialWhisky, Beer and RTD in case of WholesaleTrades i. e. TYPE A license holders.
Assessment fee shall be payable on monthly basis inaccordance with the prescribed procedure.
18. Duty free import of liquor :
Upto two litres of imported duty free liquor accompaniedwith proper invoice shall be allowed to be carried into theState of J&K by any bonafide person.

19. Social Responsibility Corpus Fund
The long term objective of the State is to eliminate or reducethe consumption of liquor primarily through educating themasses regarding the harmful effects of consumption of liquor.
Towards this end, the Department shall spend money oneducating people through activities like awareness campaigns,engagement with local youth and communities and drugde-addiction programmes.
Accordingly, the Department will exhort all its stakeholders,in particular all licensees, to contribute a minimum of 2 percent of their annual profit towards CSR Fund established bythe Department.
The Department itself will contribute a matching amount andthe corpus so created will be used for education of masses,reduction of instances of drunken driving, de-addictionactivities and providing health support by way of providingambulance services on the National Highway.
This notification shall come in force with immediate effect.
