2017 EDITION

Publication of Oregon RevisedStatutes. The Legislative CounselCommittee, pursuant to ORS 171.275,publishes Oregon Revised Statutes anddistributes the up-to-date statute text, index,comparative section tables and annotations.

The statute text of the first officialedition of Oregon Revised Statutes, publishedin 1953, was bound in loose-part form, witheach chapter constituting a part that couldbe removed from the binder.

Until 1989, replacement parts wereidentified by the words REPLACEMENTPART, preceded by the year of publicationon the first page of each part. Those chaptersthat were reprinted, but were notreplacement parts because they contained nonew material, were identified by thedesignation “(19 reprint),” indicatingthe year in which they were reprinted.

The first softcover edition of OregonRevised Statutes was published in 1989. The2017 edition of Oregon Revised Statutesconsists of 21 softbound volumes.

A Table of Titles and a Table of Titlesand Chapters, covering all 17 volumes of thestatute text, follow this Preface. Eachvolume begins with a Table of Titles andChapters of the statutes contained in thatvolume. A chapter outline precedes eachchapter and lists the ORS sections andcertain temporary provisions compiled inthat chapter.

Chapters that have been entirelyrepealed or renumbered are no longer listedin the Tables of Titles and Chapters, but apage identifying each of those chapters andindicating the disposition of the formercontent of the chapter is in the appropriateplace in the statute text.

In addition to the statutes, OregonRevised Statutes contains the Oregon Rulesof Civil Procedure, printed pursuant to ORS1.750. The rules appear in Volume 1immediately preceding ORS chapter 12.

Compilation of 2016 regular sessionand 2017 regular session Acts. The 17volumes of statute text contain, with someexceptions, the statute laws of Oregon of ageneral, public and permanent nature ineffect on January 1, 2018 (the normaleffective date of the Acts passed by the 2017regular session of the Seventy-ninthLegislative Assembly). Exceptions arise

because not all laws take effect on the usualeffective date.

The text of every statute sectioncompiled in Oregon Revised Statutes isreproduced verbatim from an enrolled Act,with the exception of the changes in formpermitted by ORS 173.160 and other changesspecifically authorized by law.

The Legislative Counsel has no generalauthority to revise; therefore, aside from theauthorized changes, the text appearing forthe first time in the statute text is notrevised in the sense that statutes enacted asa part of House Bill No. 2 of the 1953 session(the so-called “revision bill” by which OregonRevised Statutes was enacted) were revised.See the Preface to the 1953 edition. Theprovisions of ORS 174.510 to 174.550, relatingto the enactment and construction of therevised statutes enacted by House Bill No.2, are not applicable to every statute sectionnow compiled in Oregon Revised Statutes.

The Legislative Counsel has set forth asnotes certain temporary material and newmaterial or has retained repealed statuteswith notes explaining delayed effective dates.The notes are included to assist the user inplacing the permanent law in a clearercontext. In some instances, the notes havebeen given leadlines, which also appear inthe chapter outline. Additional notes indicatespecial effective dates, special temporaryprovisions or temporary versions ofpermanent law. Notes are deleted insubsequent editions when they are no longeruseful.

Changes in text of Acts. A number ofthe types of changes made in the text ofenrolled Acts for publication in OregonRevised Statutes are explained and illustratedbelow.

(1) Changes made pursuant to generalauthority granted by ORS 173.160:

(a) ORS numbers are assigned to codifiedsession law sections. For example, section 2,chapter 253, Oregon Laws 2009, is compiledas ORS 267.387.

(b) Long sections of session laws may bedivided into several shorter ORS sections.For example, section 240, chapter 16, OregonLaws 1985, is compiled as the series ORS816.040 to 816.290.

(c) Several sections of session laws maybe combined in one ORS section. For

example, sections 1, 2, and 3, chapter 896,Oregon Laws 2009, are compiled as ORS276.055.

(d) Existing ORS sections are assignednew ORS numbers if reorganization of thematerial is warranted. For example, ORS418.035 was renumbered to ORS 412.001 in2007.

(e) Actual effective dates are inserted inplace of “the effective date of this Act.” Forexample, “the effective date of this 2003Act” was replaced by “August 29, 2003” insection 4, chapter 733, Oregon Laws 2003,compiled as ORS 238A.070.

(f) References in session laws to “this(year) Act” or to a section of the sessionlaws are replaced by specific ORS references.For example, in section 23, chapter 179,Oregon Laws 2009, amending ORS 125.015,the words “sections 1 to 22 of this 2009Act” are replaced by “ORS 125.800 to125.852” and the words “section 2 of this2009 Act” are replaced by “ORS 125.802.”

(g) Alterations are made in unamendedORS sections containing references to aspecific series of ORS sections when newsession law sections were “added to andmade a part of” that ORS series. Forexample, “ORS 475.846 to 475.894” (emphasisadded) cited in ORS 133.619 (6) in the 2009edition was expanded to “ORS 475.806 to475.894” (emphasis added) in the 2011 editionto accommodate sections 6 to 20, chapter 524,Oregon Laws 2011, which were added to andmade a part of ORS 475.846 to 475.894 bysection 5, chapter 524, Oregon Laws 2011,but which could not be accommodatednumerically within the existing series. Thenew sections became ORS 475.806 to 475.834and expanded the series to become ORS475.806 to 475.894.

(h) Alterations are made in unamendedORS sections when new session law sectionsare enacted “in lieu of” repealed ORSsections or when ORS sections wererenumbered, and such unamended ORSsections contain references to the repealedor renumbered ORS sections. For example,“307.248” was substituted for “310.692” inORS 307.244 when ORS 310.692 wasrenumbered ORS 307.248 in 2015.

(2) Changes made pursuant to specificstatutes. Alterations are made inunamended ORS sections pursuant to specificstatutes directing the substitution of newwords or phrases for existing words orphrases. For example, section 2, chapter 762,Oregon Laws 2009, authorized thesubstitution of “Oregon University System”for “Department of Higher Education” inOregon Revised Statutes. A complete listingof sections authorizing substitutions of this

nature appears as a note at the end of thisPreface.

“Not added to and made a part of.”Notes may indicate that a particular ORSsection was not added to and made a part ofthe ORS chapter or series in which thesection appears. These notes mean that theplacement of the section was editorial andnot by legislative action. Notes also are usedwhen the series references are either toonumerous or too complex to bear furtheradjustment. However, the note does notmean that the section not added to a seriesor a chapter is any less the law. The note isintended only to remind the user thatdefinitions, penalties and other references tothe series should be examined carefully todetermine whether they apply to the notedsection.

For example, Oregon Revised Statutescontains chapter 137 relating to judgment,execution, parole and probation. A lawrelating to any of those subjects may beenacted but not legislatively added to ORSchapter 137, even though the section clearlybelongs with the related materials found inthat chapter. The Legislative Counselcompiles the section where it logicallybelongs and provides the “not added to” note.

Classification and arrangement. Oneof the fundamental tasks in code compilationis the maintenance of a sound classificationsystem. Proper classification, by which thelaws or parts of laws are brought together inlogical consecutive units, is vital for anumber of reasons. Classification makes thelaw more accessible and understandable.Only through classification can all conflicts,implied repeals and duplications bediscovered and the proper “revision”legislation enacted. Classification makespossible improvements in the numberingsystem, the index and the annotations.

In the process of the initial classificationfor Oregon Revised Statutes, the statuteswere divided into four main codes; the codes,in turn, were divided into titles and the titlesinto chapters. In each of the codes, anattempt has been made to arrange the titles,and the chapters within titles, in the mostlogical sequence. The four main codes are asfollows:

(1) Volume 1 contains the remedial code,dealing with court structure andorganization and remedies (ORS chapters 1to 55) and the Oregon Rules of CivilProcedure.

(2) Volumes 2 and 3 contain thecommercial and civil codes, dealing withcorporations and other private legal entities,commercial transactions and relationships

between individuals (ORS chapters 56 to130).

(3) Volume 4 contains the penal code,dealing with criminal procedure, crimesgenerally and punishment (ORS chapters 131to 170).

(4) Volumes 5 through 17 contain thepolitical code, dealing with the structure andorganization of state and local governmentand with the services rendered and theregulation exercised by government (ORSchapters 171 to 838).

The basic unit of classification is thechapter. Each chapter is intended to includeall the statutes relating to each subject thatlogically can be treated as a unit. Thearrangement of chapters within a title isintended to lead from the general to thespecific or to deal with equally important butdistinct legislation.

The arrangement of sections within eachchapter is intended to follow a logicalpattern. If there are definitions applicable toa whole chapter, they are contained in thefirst section (or sections) of the chapter.Next comes a section (or sections) statingthe leading principle of the chapter.Following this, the details dealing withcarrying out or enforcing the principle areset forth. If it is contemplated that certainsteps shall be taken in a chronological order,the steps are arranged in that order. If achapter consists of several independent orseparable laws, the sections dealing witheach law are arranged according to thepattern just described. In most chapters,except those in the penal code (Volume 4),criminal penalties, and often civil penalties,for violating provisions of a chapter arecontained in the last section or sections ofthe chapter.

Appointment and designation lists.Lists of appointments required to be made orrecommended by legislative leadership andappointments confirmed by the Senate followthe chapter 171 outline. A list of officialdesignations, such as the beaver as theofficial animal of the State of Oregon, followthe chapter 186 outline.

Numbering system. Under the decimalsystem adopted for Oregon Revised Statutes,the number to the left of the decimal pointindicates the number of the chapter in whichthe section is located, while the number tothe right indicates the relative position ofthe section within the chapter. The chaptersare numbered progressively with Arabicnumerals, but some chapters also contain analphabetic reference, e.g., ORS chapter 72A.A progressive rather than a consecutivesystem has been used in order that additionalchapters may be inserted in future editions

without renumbering existing chapters. Thesections are also numbered with the sameprogressive system.

Legislative history: source notes. Thelegislative history of each section subsequentto its enactment as a part of the 1953revision bill, as well as the legislative historyof every new section, is noted in brackets atthe end of the section. The pre-1953 historyis contained in a softcover pamphlet that ispart of the complete edition of OregonRevised Statutes. Source notes for sectionsthat are repealed, amended or renumberedand new sections that are enacted areindicated as follows:

(1) Repealed sections. The number“657.222” followed by “[1983 c.528 §8;repealed by 2009 c.11 §83]” means that ORS657.222 was enacted by Oregon Laws 1983,chapter 528, section 8, and was repealed byOregon Laws 2009, chapter 11, section 83.Repealed numbers are never used in anysubsequent edition.

(2) Amended sections. (a) The sourcenote “[Amended by 2010 c.98 §1]” followingthe text of ORS 171.010 means that ORS171.010 was enacted prior to the 1953revision and was amended by Oregon Laws2010, chapter 98, section 1.

(b) The source note “[1979 c.806 §1; 1981s.s. c.3 §124; repealed by 1985 c.502 §28]”following the number “135.053” means thatORS 135.053 was enacted by Oregon Laws1979, chapter 806, section 1; amended byOregon Laws 1981 (special session), chapter3, section 124; and then repealed by OregonLaws 1985, chapter 502, section 28.

(3) Renumbered sections. Thelegislative history of a renumbered ORSsection for the period before therenumbering of the section is found underthe original ORS section number. Thelegislative history of the section for theperiod after the renumbering is foundfollowing the text of the renumbered section.For example, the number “184.202” followedby “[1989 c.533 §1; renumbered 285.095 in1991]” means that ORS 184.202 was enactedby Oregon Laws 1989, chapter 533, section1, and was subsequently renumbered as ORS285.095 in 1991. (Beginning with the 1989edition, source notes for renumbered sectionsindicate the year of the renumbering.) Thesource note “[Formerly 91.766; 1997 c.249§31]” following the text of ORS 90.310 meansthat ORS 90.310 is a renumbered section thatwas formerly numbered ORS 91.766 and afterrenumbering, ORS 90.310 was amended byOregon Laws 1997, chapter 249, section 31.For legislative history before therenumbering, consult the original or earliernumbers.

(4) New sections. The source note“[1991 c.630 §1; 2009 c.595 §94]” following thetext of ORS 137.227 means that ORS 137.227was enacted by Oregon Laws 1991, chapter630, section 1, and amended by Oregon Laws2009, chapter 595, section 94.

Most new ORS sections are not expresslyenacted “in lieu of” statutes superseded bythem, so the source notes following the textof such new sections reveal only the formallegislative history. The user may refer to theAct that created the section, or to theComparative Section Tables in Volume 20,and determine whether that Act alsorepealed other ORS sections. These repealedORS sections may have related to the samesubject as the newer section and may leadthe user to useful annotations.

(5) Repeals with enactments in lieu. Incases where an ORS section has beenenacted “in lieu of” a repealed ORS section,the source note following the text of theexisting section will so indicate. Forexample, the source note following the textof ORS 9.260 reads “[Amended by 1953 c.604§1; 1979 c.252 §21; repealed by 1989 c.1052 §7(9.261 enacted in lieu of 9.260)].” Referenceto former ORS 9.260 in the 1987 ReplacementPart shows that it related to the samesubject as ORS 9.261, and further referenceto the appropriate volume of annotationsdiscloses numerous notes of cases pertainingto former ORS 9.260 that are still relevant toORS 9.261.

(6) Referred measures. In someinstances, the amendment or repeal of asection does not become operative becausethe amendatory or repealing Act wasreferred to and rejected by the people.Consequently, the amendment does notbecome operative and is not compiled as partof the text. This fact will be indicated in theComparative Section Tables (Volume 20) asa note. For example, “Note: Chapter 906,Oregon Laws 1989, was referred by theelectors and not approved.”

Finding former law. The user who isinterested in the text of an ORS section priorto its amendment or repeal should consultthe chapter as it appeared in the precedingedition of Oregon Revised Statutes or theappropriate volume of Oregon Laws (sessionlaws) for the year in which the change wasmade. For example, the source note to ORS58.410, “[1987 c.94 §6; 1989 c.383 §2; 1991c.132 §2; 1999 c.362 §§2,2a]” shows that ORS58.410 was amended in 1989, 1991 and 1999.The text of ORS 58.410 as it read prior to the1999 amendment can be found in ORS

chapter 58 (1997 Edition). The 1997 text, asaffected by the 1999 amendments, can befound in Oregon Laws 1999, chapter 362,sections 2 and 2a, where the new material isshown in boldfaced type and the deletedmaterial is shown in bracketed italic type.

Citation of Oregon Revised Statutes.This publication should be cited as “OregonRevised Statutes” (or “ORS”). Individualsections may be cited by using thedesignation “ORS” followed by the sectionnumber. No other citation is necessary.Numbered paragraphs within a section arereferred to within the section as subsections,lettered paragraphs as paragraphs. In otherORS sections, subsections and paragraphsare cited as ORS 619.026 (2)(b).

As defined in ORS 174.100, the word“to” means “to and including” when used inreferences to a series of statute sections,subsections or paragraphs. A reference to theseries ORS 758.505 to 758.555 includes bothORS 758.505 and 758.555.

Method and form of publication. Thecomplete set (21 volumes) of 2017 OregonRevised Statutes consists of 17 volumescontaining statute text, two volumescontaining the General Index, one volumecontaining the Comparative Section Tablesand one volume containing the Annotationsannual cumulative supplement. In addition,the set includes one hardcover volumecontaining the Annotations 1971 PermanentEdition and one volume containing thesoftcover 1953 Edition Prior LegislativeHistory.

Statute text in Oregon Revised Statutesis not interrupted by the insertion ofannotations or cross-references betweenstatute sections. An additional reason forseparating the text and the annotations is toavoid the expense of reprinting the completeannotation material each time the statutetext is brought up to date.
