CAPITAL or FIXED ASSET POLICY
SCOPE/PURPOSE: Assets that have a useful life of more than one fiscal year are considered fixed assets. The term fixed assets (also referred to as capital and or plant assets) will be identified through the capital improvements planning process. The objectives of fixed asset planning are to enhance the accuracy and reliability of Burleigh County Water Resource District (BCWRD) financial statements, amortize the cost of long term assets over their useful lives and strategically plan systematic replacement of capital investments. Fixed assets accounting is required under compliance with Government Accounting Standards Board (GASB) Statement No. 34. Application of this fixed asset policy must adhere to GASB, North Dakota Century Code (NDCC) and the ordinances of the BCWRD.
Fixed Asset Process - The capital improvements planning process will provide the necessary information to identify long term fixed assets.
Designation as a Fixed Asset - The acquisition of an independent asset with an estimated useful life of not less than one fiscal year and an estimated capitalized value of $5,000 or greater will be designated through the capital improvements process and capitalized as a fixed asset. Capitalized value will include interest, administrative, professional and or engineering costs, transportations charges and site preparation. Donated items will be valued at their estimated fair market value at the time of acquisition.

Land and land improvements will be recorded at actual or estimated historical cost in the case of purchased land and recorded at fair market value on the date of donation for any land donated to the BCWRD.
Land and land improvements will not be subject to annual depreciation expense. Annual review of additions and disposals may warrant changes in estimated useful lives for subsequent additions. Typically, lives will be relative within a single asset classification, it is important to assign lives not less than the time intended to maintain the asset.
Asset Acquisition - The acquisition of fixed assets will be determined in the capital improvement planning process. Assets and depreciation expenses will be assigned to specific funds. Collective purchases totaling $5,000 or greater will be evaluated and may be transferred from an expense account to fixed assets if their collective useful life is greater than one year. Asset acquisitions will be capitalized at cost and effective on the date that they are put into use. The depreciation method used will be the straight line method and the assets will be depreciated monthly starting in the month after the month of acquisition. Documentation of asset additions is required element of GASB Statement 34 Management Discussion and Analysis (MDA) .
Asset Disposition - The disposition of fixed assets will be determined by the BCWRD Board . Asset dispositions must be reported to the Secretary-Treasurer with the explanation for disposition: obsolescence, trade, sale , destruction , or theft. In the event an asset is disposed of prior to fulfilling the term of its' estimated useful life, a loss on disposal will be calculated and reflected by department. Gain or loss on disposal is calculated as follows :

Acquisition Cost Accumulated Depreciation Net Book Value Reimbursement Received Loss or GAIN on Disposal
Dispositions resulting from insured perils will reflect subsequent reimbursement in the disposal transaction . Asset disposals are effective on the date the asset is removed from service. Assets may be transferred from one BCWRD Board to another without disposition as long as both Boards agree. Documentation of asset disposals is required element of GASB Statement 34 Management Discussion and Analysis (MDA).
Implementation of Fixed Assets Program - Implementation of the fixed assets program in compliance with the North Dakota State Auditor's recommendation and GASB Statement No. 34 will be fully reflected in financial statements for the fiscal year ended December 31 , 2009. Actual acquisition costs will be used when available, assessed or consistently applied values will be used as necessary.
Specific Topics of Fixed Assets Program -Collective Purchases: Purchases of similar items that are less than $5,000 minimum capitalization amount are intended to be pooled and capitalized as a consolidated asset, i.e. computers, books. The transactions would transfer costs incurred from expenses to assets.
Demolition Costs: Demolition costs of an existing asset are NOT incorporated into the capitalized cost of the new asset.

Donated Assets: Donations of tangible assets (land) will be valued at their estimated fair market value at the time of acquisition plus any eligible costs incurred. In-kind donations cannot be capitalized/depreciated.
Improvements and Replacements: Improvement is the substitution of a better asset, having superior performance capabilities. Replacement is substitution of a similar asset. The capitalization of a cost incurred is determined when the improvement or replacement increases the future service level as opposed to merely maintaining the existing level of service (estimated useful life).
Infrastructure: Infrastructure assets will be recorded with the most readily available cost estimates. Assets greater than 20 years old will be reported using the modified approach as described by GASB Statement No. 34 which does not record an annual depreciation expense but must meet the following two requirements:
1. Infrastructure asset management system with the following characteristics: • Up to date inventory of infrastructure assets • Condition assessments of infrastructure assets using a consistent
and measurable scale • Demonstrating consistent annual maintenance and preservation • Estimating annual costs to maintain and preserve
2. Documentation of asset preservation and maintenance, including a complete condition assessment every two years.

Dear Mr. Murphy and Mr. Berger:
In response to your inquiries, the Burleigh County Water Resource District requested us to evaluate your drainage complaints, report our findings to the Board, and subsequently provide this summary to you. After completing an onsite inspection, along with Cary Backstrand, BCWRD Manager and Marcus Hall, County Engineer, it was determined the ponded waters creating your concerns are located entirely within designated stormwater easements. The Storm Water Management Plan (SWMP) for this area, completed in February 1, 1999, includes these designated easements, which are shown on the final plat (see enclosed). These storm water easements were designated to contain runoff from the developed properties by storing and infiltrating into the natural topography. There easements were necessary as there is no defined drainage path to convey these waters to a downstream watercourse. There was no requirement to excavate onsite storage in these locations, and groundwater is not part of the SWMP review process.
Subsequently, it was determined the existing conditions are in compliance with the SWMP, within your lots, and no modifications are required. Unfortunately this does not resolve the concerns related to ponded waters, loss of trees and impacts to your residences. While there are alternatives that might address these concerns, these are not the BCWRD's responsibility to resolve. We understand drainage issues west and north of your properties have also been a concern in the past. The drainage channel with the designated easement north of Prairewood Drive is presently filled with cattails and likely does not function very well. This drainage channel is located on private property and there is no maintenance authority, subsequently it remains the property owner's responsibility. A previous letter on this issue is enclosed for your information.
If you wish to pursue a constructed solution, we suggest you contact an engineering firm willing to assist in evaluating the alternatives. Any solution likely requires modifying the 1999 SWMP, which then requires review and approval by the City of Lincoln and County Engineer. If it is true that a number of neighbors are interested in seeking a long term solution, then there may be support to move a project forward. Again understand that the FAA requirements governing the creation of wildlife hazards within 10,000 feet of the City of Bismarck Airport's air operations area may limit some alternatives.

David Larson and Deborah Larson, by and through their attorney, hereby state their
answers to Plaintiffs Interrogatories and Responses to Request for Production of Documents, Set
No.1, dated February 16, 2017, as follows:
a. Defendants object to all of Plaintiff's Interrogatories to the extent, ifany, they seek
the discovery of information that is privilegcd for the reasons that it (a) is subject to the attorney
client privilege; (b) is covered by the "work product" doctrine; (c) was prepared in anticipation of
litigation or for trial by or for Defendants, or their representatives, or (d) is otherwise beyond the
scope of discovery under Rulc 26 of the North Dakota Rules of Civil Procedure.
b. Defendants object to Plaintiff's Interrogatories to the extent thcy seck identification
of "all facts," "all persons," "all documents," "all provisions," or similar all-inclusive descriptions.
It is impossible to guarantce that all such facts, persons, documcnts, provisions, or the like have
been identified.
c. Defendants oL~ect to Plaintifl's definitions and instructions, if any, to the extent
such definitions and instructions exceed or arc inconsistent with the requirements imposed by the
North Dakota Rules of Civil Proccdure.
d. These gencral conditions and objections to Plaintiffs Interrogatories are made in
response to each of the interrogatories as if the objections were fully set forth herein.

INTERROGATORY NO.1: For Defendants David Larson and Deborah Larson, please

Greg:
You definitely told me that. You even said you (Burleigh Water Resource District) would move them for me. And it isn't up to the County engineer. The County doesn't own the right of way, it is owned by the adjoining land owner to the center of the road subject to the rights of the public and possible utility holders. I can put anything I want in the right of way as long as it doesn't hinder the rights of others or cause a safety issue for use of the road. The County will be legally responsible for all damage caused by the road lift, which includes sprinklers.

Mr. Clausnitzer,
Thank you for contacting me. We have been attempting to contact you at 701-222-2449 and via USPS mail to set up a one-on-one meeting to discuss your property, but have been unable to reach you.
Attached are the plans and profiles that you requested. Please excuse some leaders, as we are at a 90% set and have not fully completed all of the small details.
As you will note, there are two profiles that are shown on the attached PDF. The less steep profiles are designed to meet the existing grade of your current driveways, however, in order for us to be able to construct these, the contractor would need your permission to enter into your private property, therefore needing a temporary construction easement. The more steeper profiles are what would be designed and constructed if we are unable to obtain a temporary construction easement from you, as we would not have permission to enter into your private property and would have to tie in at the right of way line. I would ask that you please consider allowing the contractor a temporary construction easement so that your driveway looks as nice as it currently does, but in the end, it is your decision.
As for a cost estimate, there is zero cost to you and all of the construction is paid for by the project, including the reconstruction of your driveway on your private property, if you so allow that to occur.
I will inform you, as we have been informing everyone. If there are any unauthorized landscaping materials, sprinkler systems, etc within the public right of way (ROW). they will be removed and not replaced. Therefore, if you happen to have any of these items in the ROW, please have them removed prior to construction so that they are not disposed of. This does not include standard mailboxes.
I am sure that there are other items that you may want to discuss, so if you would like for me to meet you at your home, please let me know a date and time that would work for you.

Re: Apple Creek Industrial Park levee Evaluation
Dear Lori:
This letter is sent to you as the contact for your Apple Creek Industrial Park association. The Burleigh County Water Resource District (BCWRD) requested, received and accepted the cost share agreement with the North Dakota State Water Commission (SWC) in June 2014 for the Apple Creek Industrial Park (ACIP) Levee Evaluation. These allocated funds are now nearly three years old and the BCWRD is considering releasing them to the SWC. The BCWRD agreed to proceed with the levee evaluation under the condition that the landowners within the ACIP provided the necessary matching funds. While there have been tacit discussions and contacts since then no action has been taken. Based on the continued inactivity there appears to be little interest in evaluating the levee to pursue options for compliance with FEMA standards and removing the floodplain and floodway limitations from these properties. Subsequently, further development within this industrial subdivision continues to be restricted pursuant to floodplain and related stormwater management ordinances.
The projected cost for this evaluation has increased to $169,426 and the local share, after removing the SWC Grant funds, has increased to $104,426. The BCWRD has an option to request additional SWC cost share funding that could lower this to $84,713, if approved, however this will not occur until the matching funds are secured. If the funding allocation is released, given the nature of available state funding, it is very unlikely this evaluation could see future funding for at least several years.
This letter is notice to the landowners within the ACIP that if the matching funds are not secured on or before June 1, 2017, the BCWRD will contact the SWC and release these funds.

6. Prior to the beneficial use of water an in-line, continuous recording, totalizing flow meter shall be installed to measure the quantity ofwatcr pumped fl'om the water source. The flow meter must meet the following rcquirements:
• The flow meter must be celtified by the manufacturer to record neither less than 98% nor more than 102% of the actual volume of water passing the flow meter when installed according to the manufacturer's speci fications.
• The now meter must have a display that is readable at all times,
• The now meter must have a totalizer that mects the following criteria:
.. Continuously updated to read directly in acre-feet, acre-inches, U.S. gallons, cubic feet, or barrels (42 U,S. gallons).
- Sufficient capacity, without cycling past zero, to record the quantity of water pumped in one calendar year.
- Dial or counter that can be timed with a stopwatch over not more than a lO-minute period to accurately determine the rate of flow.
- Nonvolatile memory if the meter is equipped with an electronic totalizer.
• The flow meter must be installed according to the manufacturer's specifications and properly maintained.
7. Failure to comply with any order of the State Engineer may result in forfeiture of this water permit.

SPECIAL PUBLIC NOTICE NATIONWIDE PERMIT REISSUANCE
On Jan uary 6, 20 17, the U.S. Army Corps of Engineers published its Final Notice of Issuance of Nationwide Permits (NWPs) in the Federal Register (FR) (82 FR 1860). NWPs are general permits issued on a nat ionwide basis, wh ich authorize specific activities under authority of Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act. The FR notice includes reissuance of 50 ex isting NWPs and the issuance of two new NW Ps. The FR notice is avai lab le from our Website at http ://www.usace.army.miIlM issions/Ci vi I Works/Regul atoryProgramandPenn itslN at ionwidePer m i ts.aspx.
After publication of the FR notice, Corps districts fini shed development of regional conditions for the reissued NWPs. Regional conditions provide additional protection by ensuring that NWPs authorize only those acti vities with minimal adverse effects on the aquat ic environment. Regional conditions also help ensure protection of high value waters within specific geographic areas . By this public notice the Northwestern Division Engineer establishes the enclosed regional conditions applicable to the NWP program in North Dakota.
Decision documents, including environmental assessments and Findings of No Sign ificant Impact, have been prepared fo r each NWP indicating that authorized activities comply with the requirements for issuance under general permit authority including comp liance with the Section 404(b)( I) Guidelines as published in 40 CFR Part 230 and the requirements of the National Environmental Policy Act. Furthermore, the decision documents have been supplemented by Division Engineers to address decisions concerning regional conditions. These documents are ava ilabl e at the Corps Omaha Distri ct Office, 16 16 Capitol Avenue, Omaha, Nebraska, 68102-4901.

2017 NATIONWIDE PERMITS REGIONAL CONDITIONS
OMAHA DISTRICT STATE OF NORTH DAKOTA
The following Nationwide Pennit Regional Conditions will be used in the State of North Dakota. Regional conditions are placed on Nationwide Permits to ensure projects result in no more than minimal adverse impacts to the aquatic environment and to address local resource concerns.
I. Wetlands Classified as Peatlands - Revoked for use
All Nationwide Permits, with the exception of 3, 5, 20, 32, 38 and 45, are revoked for use in peatlands. Peatlands are pennanently or seasonally saturated and inundated wetlands where conditions inhibit organic matter decomposition and allow for the accumulation of peat. Under cool, anaerobic, and acidic conditions, the rate of organic matter accumulation exceeds organic decay.
2. Wetlands Classified as Peatlands - Preconstruction Notification Requirement
For Nationwide Pennits 3, 5, 20, 32, 38 and 45 pennittees must notify the Corps in accordance with General Condition 32 (Pre-Construction Notification) prior to initiating any regulated activity impacting peatlands.
3. Waters Adjacent to Natural Springs Preconstruction Notification Requirement
For all Nationwide Permits permittees must notify the Corps in accordance with General Condition No. 32 (Pre-Construction Notification) for regulated activities located within 100 feet of the water source in natural spring areas. For purposes of this condition, a spring source is defined as any location where there is flow emanating from a distinct point at any time during the growing season. Springs do not include seeps and other groundwater discharge areas where there is no distinct point source.
4. Missouri River, including Lake Sakakawea and Lake Oahe - Pre-construction Notification Requirement
For all Nationwide Pennits pennittees must notify the Corps in accordance with General Condition No. 32 (Pre-Construction Notification) prior to initiating any regulated activity occurring in or under the Missouri River, including Lake Sakakawea and Lake Oahe. In addition, any activity occurring in an off channel area (marinas, bays, etc.) of any of these waterbodies, a preconstruct ion notification is required.
5. Spawning Areas
Spawning restrictions and important fish habitat areas, if applicable, can be accessed on the North Dakota Game & Fish Department's website at:

No regulated activity within the Red River of the North shall occur between IS April and I July. Spawning season restrictions do not apply to projects involving dredging or other discharges of less than 25 cubic yards of material in any jurisdictional water.
6. Counter-Sinking Culverts and Associated Riprap - All Nationwide Permits
In streams with intermittent or perennial flow and a stable stream bed, culvert stream crossings shall be installed with the culvert invert set below the natural streambed according to the table below. This regional condition does not apply in instances where the lowering of the culvel1 invert would allow a headcut to migrate upstream of the project into an unaffected stream reach or result in lowering the elevation of the stream reach.
Riprap inlet and outlet protection shall be placed to match the height of the culvert invert.

REGIONAL CONDITIONS APPLICABLE TO SPECIFIC NATIONWIDE PERMITS
Nationwide Permit 7 - Outfall Structures and Associated Intake Structures and Nationwide Permit 12 - Utility Line Activities.
Intake Structures - Intake screens with a maximum mesh opening of ';4-inch must be provided, inspected annually, and maintained. Wire, Johnson-like, screens must have a maximum distance between wires of 1/8-inch. Water velocity at the intake screen shall not exceed Y2-foot per second.
Pumping plant sound levels will not exceed 75 dB at 50 feet.
Intakes located in Lake Sakakawea, above river mile 1519, and on the Yellowstone River, are subject to the following conditions:
• The intakes shall be floating.
• At the beginning of the pumping season, the intake shall be placed over water with a minimum depth of 20 feet.
• If the 20-foot depth is not attainable, then the intake shall be located over the deepest water available.

• If the water depth falls below six feet, the intake shall be moved to deeper water or the maximum intake velocity shall be limited to v" foot per second.
Intakes located in Lake Sakakawea, below river mile 1519, and the Missouri River below Garrison Dam are subject to the following conditions:
• The intakes shall be submerged. • At the beginning of the pumping season, the intake will be placed at least 20 vertical feet
below the existing water level. • The intake shall be elevated 2 to 4 feet off the bottom of the river or reservoir bed. • If the 20-foot depth is not attainable, then the intake velocity shall be limited to v,,-foot
per second with intake placed at the maximum practicable attainable depth. Intakes and associated utility lines that are proposed to cross sandbars in areas designated as· . piping plover critical habitat are prohibited.
Utility Lines
• Any temporary open trench associated with utility lines are to be closed within 30 days of excavation. This time limit may be extended by notifying the North Dakota Regulatory Office and receiving a written response that the extension is acceptable.
Nationwide Permit 11 - Temporary Recreational Structures - Boat Docks
To ensure that the work or stmcture shall not cause unreasonable obstmction to the free navigation of the navigable waters, the following conditions are required:
• No boat dock shall be located on a sandbar or barren sand feature. The farthest point riverward of a dock shall not exceed a total length of 30 feet from the ordinary high watermark. Information Note: Issuance of this permit does not supersede authorization required by the North Dakota State Engineer's Office.
• Any boat dock shall be anchored to the top of the high bank. • Any boat dock located within an excavated bay or marina that is off the main river
channel may be anchored to the bay or marina bottom with spuds.
Section 10 Waters located in the State of North Dakota are: Bois de Sioux River James River Missouri River Red River of the North Upper Des Lacs.Lake Yellowstone River
Nationwide Permit 13 - Bank Stabilization
Permittees must notify the Corps in accordance with General Condition No. 32 (PreConstmction Notification) prior to initiating any regulated activity. The notification must also include photo evidence of erosion in the area. Prohibited materials found at

Nationwide Permit 23 - Approved Catego.-ical Exclusions

In addit ion to information required by General Condition 32 (Pre-Construction Notificat ion), permittees must identify the approved categorical exclusion that app lies and provide documentation that the project fits the categorical exclusion.

Professional engineering services related to the activities associated with the Fox Island Flood Control Project including the completion of a preliminary engineering report related to flood control and protection from the Missouri River, followed by design and construction.
Tasks Completed: • Researching and drafting easement documents, locating lot lines and boundaries • Wetland Delineation Report - Completed • Received direction on the Section 408 determination from USACE
o Reviewed modeling and impacts - Missouri River Impact Assessment drafted • Looking at additional issues for geotechnical evaluation - Whispering Bay Access
o Coordinating data with Braun o Heringer property evaluation
• Working on plan and profile sheets, levee design, driveway design, erosion control design • Contacting landowners to negotiate temporary construction easements and driveway design • Assembling Project Manual and Special Provisions • Evaluating design options for flood wall at Brown property • Coordination with County Hwy for roadway design and paving options • Utility crossing design and meetings with utility owners • Traffic control design and work phasing plan • Locating, staking and potholing sanitary outfall line
Comments and Issues ,.. Considerable time spent addressing landowner concerns for those outside the assessment area. ,.. Driveway geometry and slopes are critical to the residents and these are being thoroughly
evaluated for design. r The issue of easemcnts and ROW are anticipated to be considerable during design and
construction activities. This will likely impact project development costs and budget, as the time related to the public hearing and issues is beyond that anticipated, and not expected to decrease.
,.. Wetland delineation work has started, report completion pending. Neighborhood meetings to be held to discuss the various issues of concern and impacts.
,. USACE Section 408 could result in the need to complete an Environmental Assessment, which could affect the approval timelines and may impact 2017 construction timeline.
,.. Working with Scott Brown to design an acceptable flood wall past his residence, looking at multiple alternativcs in both routing and design. Landowner desire is to minimize tree removal.
r Meeting with Dr. Heringer regarding impacts to his residence and undeveloped lot.
